AN ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINNOMPT,
PROVIDING THAT THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS BE
AMENDED BY REVISING IN PART SECTION 12-87 OF SAID CODE.
WHEREAS, the Village of Oak Brook provides water to certain
areas within and without its municipal boundaries; and
WHEREAS, the Village maintains_,_ installs, and operates cer-
tain waterworks in order to provide the said water service; and
WHEREAS, the costs of providing said water service have in-
creased substantially since the establishment of the water rates, fees, and
charges now in effect; and
WHEREAS, the President and Board of Trustees deem a revision
of such rates, fees, and charges and the passage of this Ordiance to be in
the best interest and in pursuance of the general welfare of the Village; and
WHEREAS, pursuant to the provisions of Section 11 - Division
150-1 of the Illinois Municipal Code and all laws amendatory thereof and sup-
plementary thereto, the Village of Oak Brook is authorized to assess a charge
against new or additional users of its water system to provide funds for the
construction, expansion, and extension of said system,
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Oak Brook, DuPage and Cook Counties,. Illinois, as
follows:
SECTION 1: The provisions of the preamble hereinbefore set forth are re-
stated in as though herein fully set forth.
SECTION 2: Section 12-87(C) (13) of Division 6 of Article III of Chapter 12
of the Co e of Ordinances of the Village of Oak Brook, Illinois, shall and the
same is hereby amended to read in full as follows:
"Water rate and connection fee premium. Water
used from the village system and all line connect-
ions at premises not located within the Village or
not located within the accredited area of the Oak
Brook Utility Company shall be paid for as required
hereunder at a rate or fee equal to two hundred per-
cent (200%) of the rate or fee then applicable rel-
ative to usage or connection within the village or
within the accredited area of the Oak Brook Utility
Company, except in those instances wherein a separate
agreement has been approved by the village or the
same is otherwise provided for."
SECTION 3: All ordinances, rules, and regulations of the Village of Oak Brook
which are in conflict with the provisions of this Ordinance are hereby repealed
to the extent of the conflict.
SECTION 4: If any section, sub-section, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.
SECTIOIN S: This Ordiance shall be in full force and effect from and
after its passage, approval, and publication in pamphlet forma
