AN ORDINANCE OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS,
PROVIDING THAT THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS,
BE AMENDED BY REVISING IN PART SECTION 12-87 OF SAID CODE.
WHEREAS, the Village of Oak Brook provides water to certain areas
within and without its municipal boundaries; and
WHEREAS, the Village maintains, installs, and operates certain
waterworks in order to provide the said water service; and
WHEREAS, the costs of providing said water service have increased
substantially since the establishment of the water rates, fees, and charges
now in effect; and
WHEREAS, the President and Board of Trustees deem a revision of
such rates, fees, and charges, and the passage of this Ordinance to be in
the best interest and in pursuance of the general welfare of the Village; and
WHEREAS, pursuant to the provisions of Section 11 Division 150-1
of the Illinois Municipal Code and all laws amendatory thereof and supplementary
thereto, the Village of Oak Brook is authorized to assess a charge against
new or additional users of its water system to provide funds for the construction,
expansion, and extension of said system,
Now, THEREFORE, BE IT ORDA= by the President and Board of Trustees
of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows:
SECTION l: The provisions of the preamble hereinbefore set forth are restated
herein as though herein fully set forth.
SECTION 2: Section 12-87 (C) (8) is hereby amended to read in full as follows:
"8. Turning on water following interruption in service,
twenty-five dollars (.$25.00) ."
SECTION 3: The third paragraph of Section 12-87 (C) (9) is hereby amended to
read in full as follows:
"An additional charge of ten (10) percent is hereby added to
bills not paid within twenty-one (21) days of billing date.
SECTION 4: There shall be added a new paragraph to Section 12-87 (C) (9) to
read in full as follows:
- "There shall be charged a fee of ten dollars ($10.00) for all
payments returned by the maker's bank for non-sufficient funds,
regardless of date payment was attempted."
SECTION 5: All ordinances, rules, and regulations of the Village of Oak Brook
which are in conflict with the provisions of this Ordinance are hereby repealed
to the extent of the conflict.
SECTION 6: If any section, sub-section, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.
SECTION 7: This Ordinance shall be in full force and effect from and after
its passage, approval, and publication in pamphlet form.
