ORDINANCE. No. G- 277
AN ORDINANCE: AMENDING ARTICLE 11 OI' CHAPTER 10 OF
THE CODE OI' ORDINANCES OF THE- VILLAGE OF OAK BROOK
AND AMENDING THE FLOOD PLAIN AND IVETLAND REGULATIONS
PROVIDED FOR THEREIN
WHEREAS, the Village President and Board of Trustees have
heretofore passed and approved Ordinance G-217 on September 27 ,
1977 , which Ordinance has been codified as Sections 1.0- 16 through
10- 52 , inclusive, of the .Code of -Ordinances of the Village of Oak
Brook ; and
WHEREAS, amendment and revision of said provision is
necessary to assure the Village' s eligibility for participation in
the National Flood Insurance Program; .and
WHEREAS, pursuant to law ., 44 C.F.R. 59 , et sequitur , said
revisions and amendments must be legally enforceable no later than
February 18 , 1981 to guarantee the Village' s eligibility for parti-
cipation in the said National Flood Insurance Program;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUv'TIES,
ILLINOIS as follows :
Section 1 : That the provisions of the preamble hereinabove
set forth are hereby adopted as though fully set forth herein.
Section 2 : That Section 10- 19(a) (5) of the Code of Ordin-
ances of the Village of Oak Brook are hereby amended to read as
follows :
"Federal Insurance Administration, Flood Insurance Rate
Map (FIRM) and Flood Boundary and Floods+gay Map (FLOOD-
WAY) , said maps effective February 18, 1981 . "
Section 3 : That Section 10-19 (b) (5) of the Code of Ordin-
ances of the Village of Oak Brook be and is hereby amended to read
as follows :
"Federal Insurance Administration, Flood Insurance
Study for the Village of Oak Brook dated August
18 , 1980 . "
Section 4 : That Section 10-20 (a) of the Code of Ordinances
of the Village of Oak Brook be and is hereby amended to read as
follows
"Floodways : On lots containing floodways , which have been
identified in Section 10- 19 of this Article , fill , en-
croachments and new construction and substantial im-
provements of existing structures shall be prohibited
except such as are specifically permitted in floodways
by the ordinances , rules and regulations of the Village .
Mobile homes shall be prohibited within the areas desig-
nated as floodways . "
Section 5 : That Section 10- 20 (b) of the Code of Ordinances
of the Village of Oak Brook be and is hereby amended to read as
follows :
"Floodway Fringes : On lots- containing floodway fringes , which
have been identified in Section 10-19 of this Article.', con-
struction, filling or use of those low - lying lands shall
be prohibited except such as are specifically permitted
in floodway fringes by the ordinances , rules and regulations
of the Village . Mobile homes shall be prohibited within
the areas designated as floodway fringes . "

Ordinance Amending Aritcle II of
Chapter 10 of the Code of Ordinances
and amending the (,'l.00d Plain and
Wetland Regulations
Section 6 : That Section 10- 20 of the' Code of Ordinances
of the Village of.Oak Brook be and is hereby amended to adding there-
to sub-section (j ) which sub- section shall read as follows :
" (j ) Other Governmental Agencies : On lots containing
floodways and/or floodway fringes on which appli-
cation for development is being made, the Village
shall review such proposed development to assure
that all necessary permits have been received
from those governmental agencies from which approval
is required by federal or state ,law including Section
404 of the Federal Water Pollution Control Act
Amendments of 1972 , 33 U. S .C. 1.33411 ,
Section 7: That Section 10-35 of the Code of Ordinances
of the Village of Oak Brook be and is hereby amended by adding
thereto sub-section (g) which sub-section shall read as follows :
" (g) The Village shall inform applicants for variations
that should a variation be granted to build a
structure with it-s lowest floor below the base
flood elevation, it could result in flood insurance
premiums as high as $25. 00 per $100. 00 of insurance
coverage. "
Section 8 : That Section 10- 50 (a) of the Code of Ordinances
of the Village of Oak Brook be and is hereby amended to read as
follows :
(a) Structures :
1 . Residential : The lowest floor, including the
basement , must be at an elevation of not less than
that of the base flood elevation pluse three (3)
feet .
2 . Non-Residential : The lowest floor, including the
basement, must be at an elevation of not less .than
that of the base flood elevation plus three (3)
feet, unless adequately flood-proofed. "
Section 9 : That pursuant to Section 1- 2-4 of Chapter 24 of-
the Illinois Revised Statutes this Ordinance shall be in full force
and effect from and after its passage and approval pursuant to law
in light of the urgency inherent in providing that this Ordinance
shall be legally enforceable in all respects prior to February 18 ,
1981.
