A RESOLUTION APPROVING THE FINAL PLAT FOR THE
CLEARWATER RESUBDIVISION
IN THE VILLAGE OF OAK BROOK, ILLINOIS
2100 and 2122 York Road
PINS: 06-24-308-007, 06-24-308-009, 06-24-308-010, 06-24-308-011, 06-24-308-012 and 06-24-308-013
WHEREAS, at its meeting on February 11, 2016, the Plan Commission completed its review and
deliberations on an application by York Road Associates, LLC ("Owners' , the owners of the 15.6 acres
located at 2100 and 2122 York Road ("Subject Property'l, seeking approval of a six-lot final plat of
subdivision; and
WHEREAS, the Subject Property is legally described as follows:
LOT 2 IN CLEARWATER OAKBROOK ASSESSMENT PLAT, RECORDED AUGUST 28, 2008 AS
DOCUMENT R2008-133469, BEING A PART OF THE SOUTHWEST QUARTER OF SECTION 24,

WHEREAS, the Subject Property is currently improved with commercial buildings and vacant
land; and
WHEREAS, by a vote of 4 to 0, the Plan Commission recommended approval of the request for
a final plat of subdivision for the Subject Property; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and deem the final plat of subdivision for the Subject Property, as set forth below, to
be in the best interests of the Village;

NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1. Recitals. The foregoing recitals are incorporated herein by reference as though
fully set forth herein.
Section 2. Approval of Final Plat of Subdivision.
A. Approval of Final Plat. Subject to and contingent upon the conditions set forth in Section 3 of
this Resolution, the final plat prepared by Mackie Consultants, LLC, dated March 8, 2016,
and attached to this Resolution as Exhibit A("Final Plat"), is hereby approved.
B. Authorization and Execution. The Village President, Clerk, and other appropriate Village
officials are hereby authorized and directed to execute and seal, on behalf of the Village, the
Final Plat and the customary certifications indicating such approval.
C. Recordation. Upon the execution of the Final Plat by all required parties, the Village Clerk is
hereby directed to record the Final Plat with the Recorder of Deeds of DuPage County,
Illinois, and the Village Clerk will then be authorized and directed to assess against and
collect from the Owner any costs in connection with those actions and this Resolution.
Section 3. Conditions. The approvals granted in Section 2 of this Resolution are hereby
expressly subject to and contingent upon each of the following conditions:
A. That each of the subdivided lots on the Subject Property shall be subject to the terms,
provisions and conditions of Ordinance 2007-ZO-SU-S-1183, granting a special use for a
mixed use development in the 04 District for the Subject Property;
B. That the "parking cross-access agreement' provided by the Second Amended and Restated
Reciprocal Easement, Maintenance and Use Declaration, as amended or may be amended
in the future ("Agreement'), which governs the entire Clearwater development, shall remain
in place and will allow all existing and future buildings to use parking spaces in the
Clearwater development and allow full access to all existing and future buildings.
C. That all previously approved special uses and variations granted to this property will remain
in full force and effect;
D. The signature of the Village Engineer on the Final Plat; and
E. The Owner and all subsequent owners of the Subject Property shall comply with all
requirements of law, including without limitation, federal, state, and local laws, ordinances,
resolutions, and regulations, relating to the Subject Property.
Section 4. Severability. If any section, paragraph, clause or provision of this Resolution
shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution.
Section 5. Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
