G- 314 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 14 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK RELATIVE TO THE VILLAGE RECREATIONAI, FACILITIES WHEREAS, the President and Board of Trustees of the Village of Oak Brook, Illinois have previously established rules and regulations governing the use and operation of the Sports Core Facilities of said Village through the passage of Ordinances S-465 , S-472 and G-279 ; and WHEREAS, said Ordinances established specific policies for the use and operation of the Sports Core and of the Municipal Golf Course known as the Oak Brook Golf Club in the best interest and in furtherance of the general welfare of the citizens of the Village ; and WHEREAS, the President and Board of Trustees deem the amendment and the integration of said rules adopted pursuant to said ordinances and codification thereof in the code of ordinances to be in the best interest and in furtherance of the general welfare of the citizens of the Village of Oak Brook; NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows : Section 1 : That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2 : That article II of Chapter 14 of the Code of Ordinances of the Village of Oak Brook entitled "Sports Core", be and is hereby amended to read as follows : �i Section 14-11 SPORTS CORE OPEN FIELDS-UTILIZATION (a) Scheduling : Requests to utilize the Open Field or Show Field areas for re- creational sporting events shall be made at least thirty (30) days in advance and shall be reviewed and scheduled by the Sports Core Manager . Any proposed event involving concessions will not be scheduled until approval of any licenses required from the Village . Use of the Sports Core for recreational sporting events which involves spectator admission fees or concessions shall be limited to nonprofit amateur organizations . Any nonsport Open Field or Show Field use shall be scheduled only after issuance of a permit by the Village . (b) Fees : For Open Fields there shall be a daily user fee of $100 . 00 per field (approximately 12 acres) for up to four hours of use plus an additional $20 . 00 per field for each hour (or part thereof) of use over four hours . Rental of the Show Ordinance No . G- 314 Page two Recreational Facilities Field for horse shows shall be $11000 . 00 plus $500 . 00 for each day. The Show Field rental-for nonhorse show events . shall be $250 . 00 per day. When an event involves spectator admission fees or concessions there shall be an additional fee equal to ten percent gross gate receipts and ten percent gross concession receipts . All above fees and the additional requirements in Subparagraph (c) hereof shall not be applicable when Open Field events or activities. are arranged through separate written contract approved by the Village Board. Fees for the use of . the Open Field or Show Field include only the availability of the basic facility as it normally exists . Additional facilities or services may be required for a particular event ; the cost of such facilities or services shall be the obligation of the user. (c) Additional Requirements : Whenever an event involves an admission fee or concessions ; ( i) security services acceptable to the Village may be required; ( :ii)' a clean-up bond equal to 110 percent of the es- timated clean-up cost and in a form acceptable to the Village Attorney will be provided ; (iii) portable restroom facilities shall be arranged through the Village ; and (iv)' field set-up shall be arranged exclusively through the Village . Billing for all services detailed in subparagraphs (i), (iii) -and (iv) shall be through the Village , who in turn shall invoice the user who shall be responsible for all such expenses . (d) Permitted and Prohibited Activities : There shall be no camping or picnicing on the Sports Core . No events shall be authorized or scheduled which require the in- stallation of permanent facilities or the alteration or ob- struction of Open Field areas . Open Field events shall be scheduled and held only during the daylight hours . Cross-country skiing shall be permitted on any area of the Sports Core except on the golf course greens . Snowmobiles , motorbikes , motorcycles , and other off-the-road vehicles shall not be operated on the Sports Core . Motor- cycles may be operated only on paved roadways . No admission fees shall be imposed upon any resident of the Village of Oak Brook in conjunction with any Open Field or Show Field event except as arranged through separate written contract approved by the Village Board for polo games . (e) Rental Insurance : Any person renting Sports Core facilities shall be required to provide proof of insurance for the proposed event , indicating coverage of any risk not adequately covered by the current Sports Core insurance coverage . The Sports Core Manager shall have the right to require any such additional insurance for non- covered risks in the amounts consistent with the character and extent of the rental purpose . Ordinance No . G- 314 Page three Recreational Facilities (f) Bridle Paths : Sports Core Bridle Paths shall be open to the general public . All operations of commercial stables shall pay a •$500 . 00 annual fee for utilization of the Sports Core Bridle Path system. Section 14-12 OAK BROOK GOLF CLUB: (a) Definitions : (1) Unlimited Season Membership : permits holder to play without payment of additional greens fees at any time course is open. Reserved starting times are required on weekends before noon. (2) Limited Season Member : permits holder to play without payment of additional greens Yees at any time course is open on weekdays and after 12 noon on weekends and holidays . Member may play before noon on weekends and holidays by paying the prevailing greens fee . C (3) Resident : any person permanently residing within the corporate limits of the Village of Oak Brook and all full-time permanent employees of the Village of Oak Brook as defined in Article I of the Personnel Rules and Regulations of the Village of Oak Brook. (4) Non-resident : any person residing outside the corporate limits of t e Village of Oak Brook. (5) Corporate Resident Employee : any person employed on a full time basis whose primary place of employment is within the corporate limits of the Village of Oak Brook. (6) Junior : a minor child eleven (11) to seventeen (17) years of agc . Junior members may play without payment of additional greens fees any time except : 1) Wednesdays ; 2) weekends and holidays before noon ; 3) if 13 years of age or under after 3 : 45 PM on weekdays unless accompanied by an adult . Members may play during the excepted times in 1 , 2 and 3 above by paying the prevailing greens fees . (7) Senior : any person 60 years of age or older. Senior members may play without payment of additional greens fees any time except weekends and holidays before noon. Members may play during these excepted times by paying the prevailing greens fee. . (8) Resident Identification Card : permits holder to play for prevailing Resident greens fee rate . There is no charge for this card. (9) Junior and Senior Resident Indentification Card: permits holder to qualify for the ten 10) percent discount rate when applicable . There is no charge for this card . Holder must be a Village Resident . (10) Season Member : persons paying season pass fees . (b) Policies : (1) Oak Brook Businesses : Employees of businesses within the corporate limits of the Village of Oak Brook shall be entitled to purchase Resident Season Memberships to the Oak Brook Golf Club. Anyone purchasing a season membership under this policy shall be required to present a current certification of employment from his employer. Employees not holding a season member- ship will pay the Non-resident greens fee rates . Ordinance No . G- 314 Page Four Recreational Facilities (2) Golf Club Season Membership : r a) Golf Club Season Memberships, except Junior Member- ships , shall include a Social Season Membership to the Bath and Tennis Club entitling members to utilize the Club house dining facilities throughout the season and to invite unlimited dining guests . b) Season Members will be issued a plastic card in- dicating the type of season membership and the member ' s name. Such cards will be used for identification and for charging at the Oak Brook Golf Club and the Oak Brook Bath & Tennis Club . Junior Memberships shall include charging privileges only upon the written consent of the parent or legal guardian. c) All accounts .will be payable upon receipt of state- ments . Any balance not paid within 30 days of the billing day shall be charged an interest fee of 1 . 5% (18o annual rate) . Charging privileges on any accounts with unpaid balances over 60 days old will be canceled. d) Golf Club Season Memberships shall entitle members. to the associated playing privileges only during those times when the course is declared open for play by the Golf Pro/Manager and only during the year indicated on such membership . (3) Indenti.f.ication Cards : A resident of Oak Brook who does not hold a current Golf . Club Season Membership Card or a current Bath & Tennis Club Membership Card must obtain an annual Resident Identification Card to qualify for resident greens fee rates . Junior or Senior residents must obtain an annual Junior or Senior Identification Card to qualify for discount rates as applicable . Such cards shall be issued through the Village Hall without charge upon application and verification of residency or age . (4) Bath $ Tennis Club : l Season Memberships at the Bath $ Tennis Club shall not include Season Membership privileges at the Oak Brook Golf Club . However , Bath & Tennis Club Season Membership cards can be used at the Oak Brook Golf Club to qualify for appropriate greens fee rates and may also be used for charging privileges at the Oak Brook Golf Club . (5) Golf Leagues : Golf League tee times will be scheduled only between the following times : Monday 4 :00 PM 6 : 00 PM Tuesday 4 :00 PM - 6 : 00 PM Wednesday -- --- - NONE - - - -- - - Thursday 9 : 00AM 11 :00 AM Friday 9 : OO AM - 11 :00 AM 4 : 00 PM - 6 : 00 PM (6) Golf Outings : ' A golf outing may be arranged through the Golf Pro/Manager if, in the Pro/Manager ' s judgment , such a function will not significantly affect daily fee play. Ordinance G- 314 Page Five Recreational Facilities .(7) Golf- Lessons : Lessons will be available for a fee through the Oak Brook Golf Club Building. (8) Golf Season : The Oak Brook Golf Club and Driving Range will be open be- .tween April lst and November 1st weather permitting, provided that the course and driving range shall not be open during the one week annual period of the Western Open Golf Tournament . (9) Attire : Appropriate attire , including shirts , shall be worn at all times by persons utilizing the Golf Club. (d) Season Membership Fee Schedule : Resident Non-Resident Unlimited $ 250 $ 600 Limited $ 200 $ 400 Junior $ 150 Not available Senior $ 150 Not available Family and Individual Season Members of the Oak Brook Bath $ Tennis Club shall be entitled to a twenty (20) percent discount from the Season Membership fees listed above . (e) Permanent Reserved Weekend Starting Times : (1) Tee times will be available for 18 holes from 5 : 30 AM to 12 :00 PM on Saturdays and Sundays for the period annually from approximately the last Saturday in April to the date one week immediately prior to the Monday celebrated as Labor Day. Times will be scheduled 10 minutes apart teeing off approximately 6 foursomes per hour . Foursomes only will be scheduled for these times . Ordinance G- 314 Page Six Recreational Facilities (2) The permanent reserved weekend starting time draw will be held annually in the Spring after the brochure is mailed. The order of drawing will be as follows : (i) Unlimited Resident Season Members (ii) Unlimited Corporate Resident Employee Season Members (iii) Unlimited Non-resident Season Members (iv) . Limited Resident Season Members (v) Limited Corporate Resident Employee Season Members (vi) . Limited Non-resident Season Members (vii) Residents (viii) Non-residents (3) The drawing is proposed to be held under the following conditions : (i): ' One person of a foursome can qualify for a drawing category. (lii)- One person of a foursome must be present at the drawing. - (iii) Only foursomes may apply for the drawing. (iv)' A person may apply as a member of only one foursome . (v) . If all tee times are filled the drawing would continue to establish a stand-by list of golfers . These stand-by foursomes could fill in any times that are cancelled before the golf course opens or could fill in those times that are cancelled during the playing season. (4) Tee Time Forfeiture : If a tee time is nbt cancelled at least 7 days prior to play and the foursome does not show for play , or if less than a foursome shows for play, the tee time shall be forfeited unless the foursome fills these spots with other golfers or pays for the spots . Forfeited tee times shall become available to foursomes on the waiting list for permanent assignment . (5) Non-Permanent Tee Times : Weekends and Ilolidays - forfeited, cancelled and un drawn permanent times , and all other Weekend and Holiday times will be available for reservation not more than 7 days in advance . Weekdays - Weekday times will be available for reservation not more than 7 days in advance for Residents and Season Members . Other times will be available on a first-come , . first-serve basis . (f) Golf Leagues : A Golf League is any group of golfers of significant size for which a standard block of starting times is reserved on a con- sistent basis , normally weekly. There would be two golf league categories , twilight golf leagues and morning golf leagues . Twilight golf leagues would be scheduled on Mondays , Tuesdays , and Fridays between the .hours of 4 : 00 PM and 6 : 00 PM. These times would be assigned to Oak Brook businesses or Oak Brook { organizations on a first-come , first -serve basis . If these times are not filled by Oak Brook businesses or organiz- ations by May 1st in any year, these league times would then become available to any group on a first-come , first-serve basis . I i Ordinance G' 314 Page Seven Recreational Facilities Morning leagues will be scheduled on Thursdays and Fridays from '9 :00 AM through 11':00 AM. These league times will be assigned annually first to those leagues who had times the previous year and then to all other groups on a first-come , first-serve basis . The Golf league schedule times listed above may be extended for an Oak Brook organization or business golf league , provided the golf manager, with the concurrence of the Sports Core Manager , determines that such an extension is into a time period with a low level of play where daily fee use would not be significantly affected. Golf league participants shall pay the applicable resident greens fee rate. (g) Golf Cart Rental Fees : 18 Holes 9 Holes Power Carts $ 13.00 $ 7 .00 1 Hand Carts $ 1. 00 $ . 75 When the Golf Club leases additional carts on a short term basis , the per diem cost in excess of the above rate shall be charged to the person or persons for whom such carts were leased. Section 14-13 OAK BROOK BATH & TENNIS CLUB: (a) -The Bath & Tennis Club consists of : 1 . A clubhouse , including : kitchen facilities dining room facilities locker and show facilities bar facilities 2 . Outdoor swimming pools , including : a wading pool an Olympic-size swimming pool a diving pool 3. A lake with canoes 4 . A barbecue snack pavilion with picnic tables 5 . Ordinance G- 314 Page Eight Recreational Facilities (c) Season Membership Definitions : Persons paying the Family , Individual or Social fee shall be known as Season Members . (1) Family Season Member: Will include husband and/or wife an d all persons permanently residing in the household of the principal member or members . Membership will entitle the participant to utilize all -the facilities at no additional charge : except for food, beverage , and special charges for private services throughout the season. (2) Individual Season Member: Will be an individual at least 21 years of age . em ership will entitle the .participant to utilize all the facilities at no additional charge : except for food, beverage, and special charges for private service throughout the season (3) Social Season Member : Membership will entitle the participants to utilize the Clubhouse dining facilities through- out the season and to invite unlimited dining guests . ( i) Business Social Member : shall be issued in the name of an individual and in the name of his/her business . Such membership shall include the person in whose name the card is issued and any employee of the business in which the card is issued who possesses the membership card with the authority of the person in whose name it is issued. (ii) Personal Social Member : will include individuals an all persons permanently residing in the household of the principal member. (4) Bath Tennis ' Guests :' Will be individuals registered by a Family or Individual Season Member to utilize the tennis courts and swimming pools and shall be limited to ten visits per season. Guests may not charge vouchers and must be accompanied by the member at all times . (d) Membership Identification and Charging : (1) Season Members will be issued plastic cards indicating the type of membership and the holder ' s name . Such cards will be used for charging at the Bath & Tennis Club . (2) All accounts will be payable upon receipt of statements . Any balance not paid within 30 days shall be charged an interest fee of l . Sa (18o annual rate) . Charging privileges on any accounts with unpaid balances over 60 days will be cancelled. (3) Payment for season goods and services at the Bath & Tennis Club , with the exception of the barbecue , shall be by way of charging, utilizing Season Membership cards . Food and beverage at the barbecue house shall be paid for by utilizing prepaid coupons , or adults may charge utilizing Season Membership cards . Prepaid coupons , in $10 books , can be charged at the Clubhouse by utilizing a Season Membership card. (4) All charges for lessons shall be charged through the Bath $ Tennis Club . Fee Schedules for lessons shall be posted at the Clubhouse . j • Ordinance G- 314 Page Nine Recreational Facilities � (5) Seasonal locker rentals shall be on a first-come , first- serve basis . Not more than 600 of the lockers shall be rented. Locks will be provided by indivdual renting the locker. (e) Operations - Clubhouse : (1) The Clubhouse will be open to members beginning the Saturday, immediately before the Federally observed Memorial Day , and continuing through the Monday , observed as Labor Day. Operating hours will be : Clubhouse - Tues . , Wed. , Thurs . , Sat. , Sun. - 10 :00 AM to 5 :00 PM - Fri. - 10 :00 AM to 8 :00 PM - Mon. - CLOSED (except Holidays) Luncheon j Service - Tues . thru Sun. - 11 : 30 AM to 2 : 30 PM Dinner Service - Friday - 5 :00 PM to 8 : 00 PM Cocktail Lounge - Tues . , Wed. , Thurs . , Sat. - 11 :30 AM to 5 : O0 PM Bar service to courts , pool and barbecue - until 5 :00 PM - Friday 11 :30 AM to 8 : 00 PAi - Sunday - 12 :00 Noon to 5 : 00 PM Barbecue (weather House - Daily permitting) - 11 : 30 AM to 5 :30 PM Locker (weather Rooms Daily permitting) - •10 :00 AM to Dusk Bar and luncheon service will be available on Holidays . (2) A 15% service charge for tips and gratuities will be added to all luncheon, dinner, and bar charges . (3) Prices on items for resale , including food, beverages , tennis accessories , and similar items shall be as approved by Village Manager or his authorized agent . (4) Prices for catered food services shall be in accordance with contracts between the Village and the food service contractors . (f) Operations - Swimming Pools : (weather permitting) (1) The pools may be utilized by Family or Individual Season Members . (2) The pools will be open beginning on the Saturday immediately before the Federally observed Memorial Day and closing the day after Labor Day. Pool hours during Swim Team Season will be : Mon. - Fri . - 10 AM 1 PM Lessons & Swim Team* 1 PM - 8 PM Open Swim After Swim Tean Season : Mon. - Fri . - 10 AM - 8 PM Open Swim Sat . la Sun. - 10 AM - 8 PM Open Swim Ordinance Gr 314 Page Ten Recreational Facilities *One lane will be open for adult swim during lesson and swim team periods . (3) Group and individual swimming and diving lessons will be available through the Club Instructors . (4) Swim Team Fee Schedule : 1st child in family $ 35 . 00 . 2nd child in family $ 30 . 00 3rd child in family $ 25 . 00 All additional children $ - No . Charge - (g) Operations - Tennis Courts : (weather permitting) (1) The tennis courts may be utilized by Family or Individual Season Members . (2) The tennis courts will be supervised by Club staff from the Saturday before the Federally observed Memorial Davy through Labor Day. The nets will be up and the courts open on a first-come , first-serve basis from about May 10th to the first supervised day and from the day after Labor Day . to October 15th. The courts will be open seven days a week from 7 AM until dusk. (3) Tennis lessons will be available through the Club instructor. (h) Clubhouse Rental (1) The Clubhouse will be available for private parties or events any day prior to Friday, - May 22 , 1981 or after Monday, September 7 , 1981 , and between those dates on Tuesday, Wednesday , Thursday, and Saturday, and Sun- day evenings after 6 : 00 PM. (2) The Clubhouse will be available at the following rates . Friday (off season) $ Saturday $ Sunday Evenings : Resident $ 250 .00 r Non-resident * $ 350 . 00 Saturday $ Sunday daytime (off season) (10 : 00 to 4 :00) Resident $ 200 . 00 Non-resident $ 300 . 00 Monday thru Thursday _Evenings : Resident * $ 160 . 00 Non-resident * $ 260 . 00 Daytime (10 : 00 to 5 :00) (off-season) : Resident $ 100 . 00 Non-resident $ 200 . 00 *An additional $10 .00 per hour for any event over five (5) hours . (3) The term resident shall include Oak Brook residentsand Oak .Brook businesses . All civic and nonprofit organi- zations shall receive a 20o discount from resident rates . (4) Maximum seating with existing equipment is 125 . In the event any additional equipment is required an additional charge will be made . ORDINANCE G- 314 Page Eleven Recreational Facilities (5) All arrangements for rental and private events shall be made through the Club Director. All food services shall be provided only by licensed food service companies pursuant to Division 2 of Article II of Chapter 14 of this Code. (6) Notwithstanding the above fee schedule and minimums , regularly organized Oak Brook Community groups may rent the facility for day or evening use on any Sunday through 'Thursday during the off-season for $35 . 00 for a S hour limit . (i) Bath and Tennis Club Grounds Rental Any use of the grounds of the _Bath and Tennis Club in the off-season (after Labor Day and prior to the Federally- observed Memorial Day) may be authorized by the Sports Core Manager subject to : (1) a rental fee of $50 . 00 for up to four hours of use and an additional $20 . 00 for each additional hour; (2) a rental fee of $50 . 00 for any use of Clubhouse :Facilities ; and (3) proof of insurance as referred to in Section 14-11 (e) ` of this Code. Section 3 : Section 14-22 (b) (5) be and is hereby amended to read as follows : Licensee ' s' personnel . Licensee shall provide all personnel" necessary for the orderly, efficient and expeditious conduct of each special event . Licensee shall provide at least one waiter/waitress for each thirty (30) estimated patrons at a special event who shall remain on duty at a minimum until the conclusion of the special event involved. The Club Director may require licensee to provide additional personnel for any special event where circumstances warrant such need. Section 4 : Section 14-22 (c) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows : Scheduling of special events . Special events shall be booked only by the Club Director and shall not he booked by the licensee in- dependently. Special events may be booked for any time prior to the season open party or following Labor Day in accordance with the booking policies of the Village. Between the opening party and Labor Day non- membership special events may be scheduled only for evenings after 5 : 00 PM except Fridays . The Village agrees to give licensee at least ten (10) days prior notice of all scheduled special events . Licensee shall provide catering services for all special events as directed by the Club Director who shall have the exclusive right to direct licensee to provide such services . "Special events" for purposes of this division means all special events at the Oak Brook- Bath and Tennis Club including club memberships special events , holiday dinner and Friday dinner special events . Section 5 : That Section 14-22 (f) (2) (a) (3) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows : ' Credits due the Village shall be 150 of the gross food g g charges , exclusive of any service charges , or $2 . 00 per person served , whichever is greater. • r Ordinance G- 314 Page Twelve Recreational Facilities (/ J 1 Section 6: That all Ordinances or parts that are in conflict with the provisions of this Ordinance be in the same are hereby repealed to the extent of such conflict . Section 7: That the provisions of this Ordinance are deemed severable and th e validity or in validity of any part thereof shall not affect the validity of the remaining portions thereof. Section 8: That the Village Clerk is hereby authorized and directed to publi—s-h this Ordinance in pamphlet form in the manner provided by law. Section 9: That this Ordinance shall be in full force and effect from and after its passage , approval 'and publication in pamphlet form, as required by law.
