AN ORDINANCE ESTABLISHING CONSERVATION/RECREATION ZONING
DISTRICT IN THE VILLAGE OF OAK BROOK ZONING ORDINANCE
WHEREAS, on September 14, 1982, the Village of Oak Brook, a municipal
corporation, filed an application with the Village Clerk of the Village of Oak
Brook requesting that a new zoning classification called the Conservation/
Recreation (CR) Zoning District be created; and
WHEREAS, on September 28, 1982 the corporate authorities referred the
application to the Plan Commission and the Zoning Board of Appeals for public
hearings; and
WHEREAS, the legal notice for the hearing before the Zoning Board published
on October 7, 1982, states in part as follows:
The purpose of the district is to
encourage the development of land
for open space recreational
activities and/or preserve natural
resources. This district is
characterized by open uses of land.
The only structures and improve-
ments permitted are those which
supplement and are incidental to
the principal open use. This
district is not intended to
encourage commercial or residential
operations; and
WHEREAS, at their meeting on December 20, 1982, the Plan Commission
recommended to the Village Board that the proposed CR Zoning District be created
subject to a revision in the proposed text precluding the rezoning of any
privately owned property; and
WHEREAS, on April 5, 1983 a majority of the Zoning Board of Appeals
recommended to the Village Board that the CR Zoning District be created, subject
to certain revisions in the proposed text including reduction of the floor area
ratio (FAR) , revision of the structure height and inclusion of a total ground
coverage requirement; and
WHEREAS, the Comprehensive Community Development Plan as set forth in Chapter
5 of the Comprehensive Plan for the Village of Oak Brook as amended May, 1978
states in part on page 93 as follows:
Open space continues to be one of the principal
attractions in the Village of Oak Brook. All
possible efforts should be made to preserve
existing open space for aesthetic, recreational
and environmental purposes. . .
Butler National Golf Club provides 180 acres of
open space in the eastern portion of the Village,
and, when coupled with the Sports Core properties
to the east and the forest preserve property to
the south, creates an area approximately two
miles long and one-half mile wide of primal
forest and recreational open space. This
objective, preservation of open space, can only
be accomplished by close coordination and
cooperation on the part of all governmental
agencies --- local, county, state, and federal;
and
WHEREAS, it is in the best interest: of the-Village-of Oak Brook-that the
Conservation/Recreation Zoning District be created.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:

Section 1 : That the "Zoning Ordinance" of the Village of Oak Brook,
Ill inoi s~ ordinance G-60, as amended, be and the same is hereby amended by
adding thereto a new Section VIA as follows:
SECTION VIA. CONSERVATION/RECREATION DISTRICT
The Conservation/Recreation District is designed to encourage the development
of land for open space recreational activities and/or preserve natural resources.
This district is characterized by open uses of Tana, for example, golf courses
and agricultural uses. The only structures and improvements permitted are those
which supplement and are incidental to the principal open use. This district is
not intended to encourage commercial or residential operations.
(1) Permitted Uses:
(a) Agricultural, including incidential agricultural
structures
(b) Forest preserves, wildlife reservations, ecological
sanctuaries and arboretums.
(c) Parks and playgrounds.
(d) Golf courses, and similar open field recreational
activities.
(e) Accessory uses and structures, incidental to and
on the sane zoning lot as a principal use.
(2) Spec;al Uses:
(a) Botanical gardens.
(b) Zoological gardens.
(c) Educational facilities.
(d) Governmental service facilities, including municipal
civic centers, police and fire stations and similar uses.
(e) Tennis and swimming clubs.
(f) Cultural facilities, including libraries, museums, and
similar cultural institutions.
(g) Accessory uses and buildings incidental to and on the
same lot as the principal use.
(3) Lot Area:
Not less than five (5) acres.
(4) Lot Width:
Not less than 220 feet within the buildable area.
(5) Floor Area Ratio:
Not to -exceed . 15.
(6) Structure Height:
Not more than thirty (30) feet. Special uses may not exceed
forty (40) feet.
(7) Yards:
Yards shall be provided as follows:
(a) All yards shall be established according to the
following requirements: No structure shall be

erected or maintained: 1) within 100 feet from
the center thread of any waterway or watercourse.
2) within 100 feet from the right of way lane of
any street or, 3) within 100 feet from any
adjacent residence district.
(b) Notwithstanding the above, public utilities such
as wires, cables, conduits, vaults, laterals,
pipes, mains and valves and other similar
transmission distributing equipment, bridges,
fountains, sidewalks, gateways, flagpoles,
roadways, and other similar structures intended
to be accessory and incidental to the primary
use of a principal building on the lot shall
be permitted without regard to the setbacks
established herein.

($) Off-street, loading and off-street parking shall be as set forth in
Section XI of this Ordinance.
(9) Any use established in a Conservation/Recreation District shall
be operated in compliance with the Performance Standards set•, forth.
in Section X(A) (4) of this Ordinance.
(10) Awnings, Marquees and Signs may be erected in conformance with the
provisions of Section X(B) (6) of this Ordinance.
Section 2: That the "Zoning Ordinance" of the Village of Oak Brook, Illinois
Ordinance G-60, as amended, be and the same is hereby amended by adding thereto a
new subsection Q to Section V "General Provisions" as follows
SECTION V. GENERAL PROVISIONS
(Q) All provisions in this Zoning Ordinance, Ordinance G-60, as amended ,
which pertain to property abutting or adjoining, a Residence District shall be
equally applicable to property abutting or adjoining any property zoned
Conservation/Recreation District.
Section 3: That this Ordinance shall be in full force and effect from and
after its passage and approval as provided by law.
Section 4: That all ordinances or parts therof in conflict with the
provisions of this Ordinance are hereby repealed to the extent of such conflict.
