AN ORDINANCE REPEALING ORDINANCE NO. G-349 ENTITLED "AN ORDINANCE
AMENDING ARTICLE II OF CHAPTER 3 OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATING TO LICENSES
FOR THE SALE OF ALCOHOLIC BEVERAGES"
WHEREAS, on October 23, 1984, the corporate authorities of the Village
of Oak Brook passed Ordinance No. G-349 entitled "AN ORDINANCE AMENDING ARTICLE
II OF CHAPTER 3 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS
RELATING TO LICENSES FOR THE SALE OF ALCOHOLIC BEVERAGES", a copy of which is
attached hereto and made a part hereof, and
WHEREAS, the corporate authorities deem it advisable and in the best
interest and in furtherance of the general welfare of the citizens of the Village
that Ordinance No. G-349 be repealed;
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That Ordinance No. G-349 entitled "AN ORDINANCE AMENDING
ARTICLE II OF CHAPTER 3 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK,
ILLINOIS RELATING TO LICENSES FOR THE SALE OF ALCOHOLIC BEVERAGES", a copy of
which is incorporated herein by reference, be and is hereby repealed.
Section 2: That all sections of the Code of Ordinances of the Village
of Oak Brook are hereby restated and readopted as said sections were passed and
approved prior to the passage of Ordinance No. G-349, it be the intent of this
body to return to the status immediately prior to the adoption of Ordinance No.
G-349.
Section 3: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
Section 4: That the Village Clerk is hereby authorized and directed to
publish this Ordinance in pamphlet form as required by law.

AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 3 OF THE CODE OF
ORDINANCES OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATING TO
LICENSES FOR THE SALE OF ALCOHOLIC 'BEVERAGES
WHEREAS, Article II of Section 3 of the Code of Ordinances of the
Village of Oak Brook, Illinois concern classes of retail liquor licenses, fees
and limitations on the number of liquor licenses, and
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook deem it advisable and in the best interest and in furtherance of the
general welfare of the citizens of the Village that the Code of Ordinances of the
Village of Oak Brook be amended by adding a new'sub-class of retail liquor
license in the event that hotels or motels holding a Class A-2 liquor license
hold a special event which goes not more than 2 hours past the prescribed closing
hours; ,
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF ,OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That subsection (2) of Section 3-17 of,the Code of
Ordinances of the Village of Oak Brook, Illinois be and the same is hereby
amended as follows:
Section 3-17. Classes. .
Class A-2: Retail sale 'of alcoholic liquors
in hotels and motels. Class A-2 licensees
may apply for a Class A-2(S) license in the
event that alcoholic liquors are sold at a
special event on the premises between the
hours of 1 A.M. and 3 A.M. on weekdays.
Class A-2(S) licenses shall be issued for
not more than one day annually per
applicant.
Section 2: That subsection (a) of Section 3-21 of the Code of
Ordinances of the Village of Oak Brook, Illinois be and the same is hereby
amended to read as follows:
Section 3-21. Fees; term.
(a) The applicable fee for licenses under
this article shall be:
Class of License Initial Fee Renewal Fee
A-1 $4,000.00 $2,000.00
A-2 6,000.00 4,000.00
A-2(S) 150.00 per day
A-3 4,000.00 2,000.00
A-4 4,000.00 2,000.00
B 4,000.00 2,000.00
C 2,000.00 1,500.00
D 100.00 per day
($4,000.00 maximum per license)
E 3,000.00 1,500.00
Pursuant to Section 3-28 of this Code, consumption of
alcoholic beverages is not permitted during the hours
within which the sale of alcoholic liquors is prohibited.
Section 3: That subsection (c) of Section 3-21 of the Code of
Ordinances of the Village of Oak Brook, Illinois be and the same is hereby
amended to read as follows:

(c) Each license issued under this article
in classes A (except Class A-2(S)
licenses) , B, C and E shall terminate
on the thirtieth (30th) day of June
next following its issuance. The fee
to be paid for such license shall be
reduced in proportion to the full
calendar months which have expired in
the license year. But no part of such
annual fee which exceeds the respective
renewal fees designated in (a) shall be
subject to any proration hereunder.
Section 4: That Section 3-23 of the Code of Ordinances of the Village
of Oak Brook, Illinois be and the same is hereby amended to read as follows:
(1) Class A-1, thirteen (13) licenses;
(2) Class A-2, four (4) licenses; the number of
Class A-2(S) licenses shall not be limited;
(3) Class A-3, two (2) licenses;
(4) Class A-4, one (1) license;
(5) Class B, two (2) licenses; ,
(6) Class C, three (3) licenses;
(7) The number of Class D licenses shall not be
limited;
(8) Class E, one (1) license.
Section 5: That Section 3-28 of the Code of Ordinances of the Village
of Oak Brook, Illinois be and the same is hereby amended as follows:
Sec. 3-28. Closing; hours of business.
It shall be unlawful to sell, offer for sale,
cause to be sold or to give away in or upon any
licensed premises, any alcoholic liquor between
the hours of 1:00 A.M. and 6:00 A.M. (3:00 A.M.
and 6:00 A.M. for holders of Class A-2(S) liquor
licenses) on weekdays arid- between the hours of
2:00 A.M. and 12:00 noon on Sundays provided that
on January 1st of each year the hours during
which no alcoholic liquor shall be sold at retail
and during which the public shall not be admitted
to any premises in or on which alcoholic liquor
is sold at retail shall be between 4:00 A.M. and
6:00 A.M. unless such January 1st shall fall on a
Sunday in which event such hours shall be from
4:00 A.M. to 12:00 noon.
It shall be unlawful to keep open for business or
to admit the public to or to permit the public to
remain within, or to permit the consumption of
alcoholic liquor in or upon any licensed premises
during the hours within which the sale of such
liquor is prohibited; provided, however, that in
the case of restaurants and hotels, such
establishments may be kept open for business
during such hours, but no alcoholic liquor may be
sold or consumed by the public on or about such
licensed premises.

In addition to any other penalties provided by
law, any person who violates any of the provisions
of this section shall be subject to a fine of not
more than five hundred dollars ($500.00) for each
such violation. (Ord. No. S-265, Sec. 1,

Section 6: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
Section 7: That all ordinances or parts thereof in conflict with the
provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 8: That the Village Clerk is hereby authorized and directed to
publish this Ordinance in pamphlet form as required.-by J aw.
