G 351 AN ORDINANCE AMENDING ORDINANCE NO.-G-177,-THE TRAFFIC CODE OF THE VILLAGE OF OAK BROOK ILLINOIS AS AMENDED AND PROVIDING FOR THE PROHIBITION OF RIGHT TURNS ON RED FOR EAST BOUND TRAFFIC ON 22ND STREET AT SPRING ROAD WHEREAS, the President and Board of Trustees of the Village of Oak Brook have heretofore enacted Ordinance G-177 being an Ordinance regulating traffic within the Village of Oak Brook, which Ordinance has from time to time been amended; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem it advisable and in the best interests and in furtherance of the general welfare and safety of the citizens of the Village that said Ordinance G- 177 be further amended to prohibit right turns for east bound vehicular traffic facing a steady red signal at the intersection of 22nd Street and Spring Road; and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem it advisable and in the best interest and in furtherance of the general welfare and safety of the citizens of the Village that Ordinance G-177 be further amended by incorporating Section 11-1425 of the Illinois Vehicle Code into Division XIV ("Miscellaneous Laws") of Ordinance G-177; and WHEREAS, the proposed amendments are made pursuant to authority set forth in the Illinois Vehicle Code, Chapter 95 1/2 of the Illinois Revised Statutes as adopted by the Village of Oak Brook in Ordinance G-177. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby incorporated herein as though fully set forth herein. Section 2: That Section 1-306(c)(2) of Ordinance G-177 be and is hereby amended to read as follows: 1. Vehicular traffic facing a steady red signal at an intersection may turn right after stopping as required by paragraph (c) 1 of this Section, but shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection. However, local authorities may by ordinance and state authorities may by rule or regulation prohibit any such right turn against a steady red signal at any intersection under their respective jurisdiction. Such ordinance or rule or regulation shall be effective when a sign is erected at such intersection giving notice of the ordinance or rule or regulation prohibiting the right turn. a. Vehicular traffic proceeding eastbound on 22nd Street at the intersection with Spring Road shall not turn right when facing a steady red signal. Section 3: That Division XIV of Ordinance G-177 be and is hereby amended by adding Section 1-1425 as follows: 1-1425 Stop when traffic obstructed Section 11-1425. Stop when traffic obstructed. No driver shall enter an intersection or a marked crosswalk or drive onto any railroad grade crossing unless there is sufficient Ordinance No. G 351 Amend Traffic Code Prohibiting Right Turn on Red for East Bound Traffic on 22nd Street at Spring Road Page two space on the other side of the intersection, crosswalk or railroad grade crossing to accomodate the vehicle he is operating without obstructing the passage of other vehicles, pedestrians or railroad trains notwithstanding any traffic-control signal indication to proceed. Section 4: That the appropriate officers and employees of the Village of Oak Brook are hereby authorized and directed to post such signs in conformance with the provisions of Sections 2 and 3 of this Ordinance to implement the provisions of this Ordinance. Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval, publication in pamphlet form and the posting of appropriate signs as directed in Section 4 hereof. Section 6: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form as required by law.
