ORDINANCE NO. G- 365
AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE
VILLAGE OF OAK BROOK ILLINOIS AND ADJUSTING WATER CHARGES
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook, Illinois have heretofore, by ordinance established rates, fees, and
service charges for water usage; and
WHEREAS, the Water Commission Act of 1985 sets forth certain
regulations and financing procedures for the proposed Lake Michigan water
distribution system within. DuPage County; and
WHEREAS, until such time as Lake Michigan water is available, the
Village will serve its water customers in accordance with the Water Commission.
Act; and
WHEREAS, the President and Board of Trustees deem a revision of the
water rates, fees, and charges, and the passage of this Ordinance to be in the
best interest and in pursuance of the general welfare of the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the above preamble are hereby
adopted as though fully set forth herein..
Section. 2: That Section. 12-87(C)(9) of the Code of Ordinances of the
Village of Oak Brook, Illinois be and is hereby amended to read as follows:

When billing occurs other than on a monthly basis, the
minimum rate shall be prorated proportionately to the
period billed and the gallonage charges shall be based
on actual usage proportionately increased for the
period billed.
Section. 3: That Section. 12-87(C)(12) of the Code of Ordinances of the
Village of Oak Brook, Illinois be and is hereby amended to read as
follows:
(12) Construction. Water. Unmetered water during
construction as provided in Section 12-70(D) hereof:
(a) 1" service or smaller. .. .. . ....... . ...$ 61.15
(b) 1-1/2" to 3" service inclusive. .. . ... .$122.33
(c) 411 or larger. ...... . ..... .... ..... . . . .$244.65
Water used in excess of sixty (60) days and water used on a
temporary basis, whether metered or not, will be billed at
the rate of $2.42 per 1,000 gallons.
Section. 4: That Section. 12-87(C)(13) of the Code of Ordinances of the
Village of Oak Brook, Illinois be and is hereby amended to read as follows:
(13) Water rate and connection. fee. Water used from the
Village system and all line connections at premises
not located within, the Village or not located within
the accredited area of the Oak Brook Utility Company
shall be paid for as required hereunder at a rate or
fee equal to the then applicable rate or fee relative
to usage or connection within the Village or within
the accredited area of the Oak Brook Utility Company,
except in those instances wherein a separate agreement
has been approved by the Village or the same is
otherwise provided for.
Section 5: All ordinances, rules and regulations of the Village of Oak
Brook which are in conflict with the provisions of this Ordinance are hereby
repealed to the extend of such conflict.
Section 6: If any section., sub-section., sentence, clause or phrase of
this Ordinance is for any reason held to be invalid, such determination, shall not
affect the validity of any remaining portion of this Ordinance.
Section 7: This Ordinance shall be in full force and effect from and
after its passage, approval and publication in pamphlet form as provided,
however, that the water consumption charges as set forth in Section. 1 hereof
amending Section, 12-87(C)(9) (i) and (ii) shall only be effective as to water
consumed subsequent to October 1, 1985 anal:
(1) billed to commercial customers after November 24, 1985.
(2) billed to residential customers after November 26, 1985.
Any water consumption billings prior to said respective dates shall be at the
rates heretofore established pursuant to ordinance.
All other rates, fees and charges established or amended herein shall be in full
force and effect upon the passage, approval and publication, in pamphlet form of
this Ordinance.
Section 8: The Village Clerk is hereby authorized and directed to
publish this Ordinance in pamphlet form as required by law.

ON WHETHER TO ISSUE $150,000,000 GENERAL OBLIGATION WATER BONDS OF THE
DU PAGE WATER COMMISSION AND OF SUCH COMMISSION IMPOSING 1/4x SALES
TAXES:
Y. Proposed resolution refers to forthcoming referendum to be voted upon
�- on November 5, 1985 at the Nonpartisan Election in Du Page County,
Illinois.

$546,910.89 and authorize the Village President to affix his signature
thereon.
President Cerne abstained from voting on the bill from Pepsi Cola due
to corporate ownership by his employer of Pepsi Cola General Bottlers,
Inc.
