G-370 - 11/26/1985 - ZONING - Ordinances ORDINANCE NO. G— 370 AN ORDINANCE AMENDING SECTION XI OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ORDINANCE NO. G-60, AS_ AMENDED WHEREAS, the President and Board of Trustees of the Village of Oak Brook hired Richard S. Beebe and Associates to conduct appropriate field studies and prepare a report concerning small car parking in the Village for use in analyzing small car parking space requirements; and WHEREAS, the President and Board of Trustees requested the Plan Commission to review the Beebe report and other available evidence and to report back with suggested revisions to the small car and loading berth requirements set forth in the Zoning Ordinance; and WHEREAS, by letter dated July 17, 1985, the Plan Commission reported back its proposed revisions to the Zoning Ordinance; and WHEREAS, on September 24, 1985 the Village of Oak Brook, a municipal corporation, filed an application with the Village Clerk of the Village of 0ak Brook requesting that the text of the Zoning Ordinance be amended as it pertains to certain requirements pertaining to off—street parking spaces and loading berths; and WHEREAS, at its meeting on October 21, 1985, the Plan _Commission recommended that, in general, the proposed text amendments be approved, with --certain modifications pertaining to exterior building surfaces of parking .structures, and the computation of loading berths; and WHEREAS, the Zoning Board of Appeals, pursuant to due and appropriate legal notice, conducted a public hearing thereon on November 5, 1985, and recommended that the proposed text amendments be approved, with certain modifications pertaining to exterior building surfaces of parking structures; and WHEREAS, it is in the best interests- of the Village of Oak Brook that the amendments set forth below be made; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section XI(D)(7) of the Zoning Ordinance of the Village of Oak Brook, Illinois, Ordinance G-60, as amended, be and the same is hereby amended as follows: (7) Required Berths. (a) The minimum number of off—street loading berths accessory to office uses hereafter erected, structurally altered or enlarged in all Business and Office- Research—Assembly Districts shall be in accordance with the following schedule: Floor Area of Establishments Required (square feet) Number 0 to 200,000 2 a' For each additional 200,000 square feet of floor area, or fraction thereof, over 200,000 square feet of floor area: One additional loading berth. rf (b) The minimum number of off—street loading berths accessory to non—office uses hereafter erected, structurally altered, or enlarged in all Business and Office—Research—Assembly Districts shall be in accordance with the following schedule: Ordinance No. G- 370 Amending Section XI of the Zoning Ordinance Page two Floor Area of Establishments Required (square feet) Number 5,000 to 25,000 1 25,001 to 40,000 2 40,001 to 100,000 3 For each additional 100,000 square feet of floor area, or fraction thereof, over 100,000 square feet of floor area: One additional loading berth. Section 3: That Section XI(E)(3) of the Zoning Ordinance of the Village of Oak Brook, Illinois, Ordinance G-60, as amended, be and the same is hereby amended to read as follows: (3) Size and Aisles: A required off-street parking space shall have a width and length, exclusive of access drives or aisles, ramps, columns, or office and work areas in accordance with standards set forth below. Enclosed parking spaces shall have a vertical clearance of at least seven feet. Ordinance No. G- 370 Amending Section XI Of the Zoning Ordinance Page three Section 4: That Section XI(E)(4) of the Zoning Ordinance of the Village of Oak Brook, Illinois, Ordinance G-60, as amended, be and the same is hereby amended to read as follows: (4) Access: All off-street parking facilities shall be provided with appropriate means of vehicular access to a street or alley with location and design of intersection of parking area access driveway and the street or alley in accordance with regulations set forth below: ACCESS DRIVEWAYS FROM STREETS TO OFF-STREET PARKING AND LOADING SPACES a. Width of driveways. (measured at the lot line adjoining a street) (1) Residential Uses: Not less than 9 feet wide or more than 20 feet wide. (2) Nonresidential Uses: (i) Not less than 12 feet wide or more than 22 feet wide for a one-way driveway. (ii) Not less than 22 feet wide or more than 25 feet wide for a two-way driveway serving 20 or fewer parking spaces or one loading berth. (iii) Not less than 24 feet wide or more than 30 feet wide for a two-way driveway serving more than 20 parking spaces or two or more loading berths. b. Radius connecting street pavement edge and driveway edge. (1) In residential and Institutional Districts: Not less than five feet, except driveways more than 20 feet in width, not less than 8 feet. (2) In Business and ORA Districts: (i) Not less than 15 feet at the intersection of a driveway and street pavement in a street having a right-of-way more than 66 feet in width. (ii) Not less than 8 feet at the intersection of a driveway and a street pavement in a street having a right-of-way of 66 feet or less in width. c. Angle at intersection of a driveway and street. The acute angle formed at the intersection of driveway and street pavement edges shall be not less than 60 degrees. The required turning angle for a vehicle entering or leaving a driveway shall not exceed 90 degrees. d. Spacing between separate driveway entrances on a lot (measured center to center at the lot line adjoining a street) No less than 40 percent of the length of the lot line adjoining the street, or 400 feet, whichever is less. e. On corner lots -- spacing between driveway entrance and right-of-way line of an adjacent intersecting street (measured from the nearest edge of the driveway pavement at its intersection with the street pavement to the nearest right-of-way line, extended, of an adjacent intersecting street) ' Ordinance No. G-370 Amending Section XI of the Zoning Ordinance Page four No less than 20 percent of the length of the lot line adjoining the street being entered. (Ord. No. G-141, 1-25-72) Section 5: That Section XI(E)(12)(d) (8) of the Zoning Ordinance of the Village of Oak Brook, Illinois, Ordinance G-60, as amended, be and is amended to read as follows: (8) Offices: Business, professional, administrative, and public (other than medic91 and dental clinics, and offices of physicians and dentists)--One parking space for each 300 square feet of floor area. (Ord. No. G-142, 1-25-72) Section 6: That Appendices I and II to Appendix A, the Zoning Ordinance of the Village of Oak Brook, Ordinance No. G-60, as amended, are hereby deleted, because they have been incorporated, as amended, into Sections XI(E)(3) and (4) above. Section 7: That Section XI(E) of the Zoning Ordinance of the Village of Oak Brook, Ordinance G-60, as amended, be and the same is hereby amended by adding subsection 13 as follows: (13) Parking Structures: All parking structures shall be landscaped and/or bermed to screen substantially the first level from adjacent streets. All exterior walls of such structures, which are visible from adjacent roadways, shall be finished with a material so as to maintain a common architectural character, as defined in Section VIII-A of this Ordinance, with the principal building. Section 8: That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. Section 9: That all ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. PASSED THIS 26th day of November . , 1985.
