RE50LUTION- AUG ( WHEREAS, than Village of Oakbrook, locat.3d in the Cvtn ; State of Illinois, wishes to install, operate and maintain a manually actuated traffic control~;ignal on 31st. Streat at an equestrian crossing approved by the County. All charges for the installation, operation and subsequent main- tenance will be assumed by the Petitioner. . 'WHEREAS, a permit from said Department of Highways of DuPage N County is required before said work can be legally undertaken by said Village of Oakbrook; NOW THEREFORE, Be It Resolved by the,;Village Board of Oakbrook, � County of DuPage. Stata of Illinois: \ First: That we do hereby request from the Department of Highways, County of DuPage, State of Illinois. a permit authorizing the Village of Oak- brook to proceed with the work herein described. Second: That we hereby pledge the good faith of the Village of Oak- brook and guarantee thai all work shall be performed in accordance with the conditions of the permit to be granted by the Department of Highways, County of DuPage, State of Illinois, and to hold the County of DuPage harmless an account of any damages that may occur to persons or property during the prosecution of such work, and assume all liability for damages to persons or property due to accidents or other wise by reason of tho work which is to be performed under the provisions of said permit. Third; That we hereby state that the proposed work is/i*-mt. to be performed by a competent contractor. Fourth: That the proper officers of the Village of Oakbrook are hereby instructed and authorized to sign said permit in behalf of the Village of Oak- brook. (sEAl.,) � , � �_ ��,�r� DU PAGE COUNTY AUG 19 1959 HIGHWAY PERMIT WHEREAS, the Village of Oakbrook, DuPage County, Illinois, hereinafter termed the Petitioner, requests permission and authority to do cer- tain work herein deecribe>d, in, upon or along County Highway known as County Highway No. 34, DuPage County, subject to the fallowing conditions and restrictions: To in€tall, operate and maintain a manually operated stop sign at the equestrian crossing on said road. The installation shall be in accordance with the plans submitted to and approved by the County. The lights shall be ,set to signal the "GO" (green) position until manually operated by call button for cross traffic. All charges for the installation, operation and subsequent .maintenance of this installation will be assumed by the Petitioner. First: The said petitioner shall furnish material, do all work, Pay all costs and shall in a reasonable length of time restore said highway to a condition similar or equal to that existing before the commencement of the described work. It is also understood that the work shall be completed within 120 days after the date this permit is approved, otherwise the permit becomss null and void. Second.: That the proposed work shall be located and constructed to the satisfaction of the Superintendent of Highways or his duly authorized representative and the material Used shall conform to the standard spec- ifications of the State of Illinois, #department of Public Works and Buildings, Division of Highways. Third: In performing this work the petitioner shall not Interfere with or obstruct traffic on said highway. Fourth: That the said peritioner, his successor or assigns, shall assume all risk and liabili6f! for accidents and damages that may accrue to parsons or property on account of this work. Fifth: That should the C.ountyes construction can and operation of said highway require any alteration or change of location of the work called for in this permit, such alteration or change of location shall be made by the Petitioner upon written request by the Superintendent of Highways with- out expenee to the County, and ,should the petitioner fail to make satisfac- tory arrangements to comply with this request within 60 days, the County reserves the right to make such alterations or change of location or remove the work and the Petitioner agrees to pay for the cost incurred. Brechin, Village Manager FROM: Dale L. Durfey, Jr. , P.E. SUBJECT: Butler Traffic Signal on 31st Street Attached please find a copy of Tony Rynearson's letter to me of August 3, 1984 and a copy of a resolution and DuPage County Highway Permit concerning the above stated subject. It is quite clear from the resolution and permit that the Village of Oak Brook requested that the signal be installed. It also is apparent from the resolution and permit that the Village of Oak Brook had the signal constructed and paid for its construction, unless the Village had another arrangement with a private party, possibly Paul Butler, for reimbursement of those costs. I point out condition four within the Highway Permit which states that the Village shall assume all risk and liability for accidents and damages that may occur to persons or property on account of this work. From this language, it appears that the Village is on the hook should damages result due to the signal operation or lack of operation. I forward these materials to you for your information. After your review of same, it might be appropriate to contact the Butler Company, receive their input regarding this issue, and investigate the possibility of removing these signals.
