ORDINANCE NO. G- 372
AN ORDINANCE REGULATING NOISE IN THE VILLAGE OF OAK BROOK
AND AMENDING SECTION 9-1 OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook deem it advisable and in the best interests and in furtherance of the
general welfare and safety of the citizens of the Village that loud, unnecessary,
prolonged or unusual noise which disturbs the peace of others be declared
unlawful in the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
`- are hereby incorporated herein as though fully set forth herein.
Section 2: That Section 9-1 of Chapter 9 of the Code of Ordinances of
the Village of Oak Brook as amended, which chapter is entitled "Offenses and
Miscellaneous Provisions" be amended to read as follows:
9-1 . Noise.
a) It shall be unlawful for any person to make, continue to
cause to be made or continued any loud, unnecessary,
prolonged or unusual noise which disturbs the peace of
others.
b) Any person who shall, without prior authorization by the
President and Board of Trustees, operate or cause, permit
or allow to be operated upon any public street in the
Village any mechanically operated piano, phonograph or
other musical instrument, radio or similar mechanical or
electrical device or wind instrument or noise-making
devise of any character whatsoever, for the purpose of
advertising any goods, wares, merchandise or other
`_ articles for sale, barter or exchange, or for the purpose
of attracting attention, or of inviting the patronage of
any person to any business whatsoever, shall be deemed
guilty of an offense against the Village.
Section 3: That this Ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form.
Section 4: That the Village Clerk is hereby authorized and directed to
publish this-Ordinance in pamphlet form as required by law.

MEMO TO: Village President and Board of Trustees
FROM: Richard A. Martens, Village Attorney
SUBJECT: Noise Complaints
Each summer the Police Department and I receive complaints from residents about
noise which distrubs them. Typically this noise is an outside audible alarm which
a neighbor fails to turn off.
We presently do not regulate offensive noise. Some time ago I drafted a noise
ordinance at the suggestion of Trustee Watson. The Board discussed the matter at a
Committee-of-the-Whole meeting but found that draft ordinance needlessly wordy.
At Trustee Rush's suggestion, I have drafted a simpler version. Section (a) of the
revised draft is new language; Section (b) of the revised draft incorporates our
existing regulations in Section 9-1 of the Village Code which prohibits audible
advertising by vendors on public streets in the Village.
I look forward to discussing this matter with you at the January 13, 1986
Committee-of-the-Whole meeting.

IV.SPORTS CORE ORDINANCE AMENDMENTS:
-Page 835 - Saturday service provisions of 11:30 to 5:00 should be added to
the operating hours for beverage service;
-Page 840 - There should be no proposed change on the January 1 through
March 31st Friday, Saturday, and Sunday 10:00 A.M. to 4:00 P.M. no minimum
provision until such time as Staff has analyzed entire sections on clubhouse
rental;
-Page 841 - Section 14-14 should be repealed.
The Village Board further reached a consensus to draft an appropriate ordinance
for final Village Board consideration incorporating these ordinance changes.
V.LANDSCAPE MAINTENANCE:
Trustee Maher noted the concern that the successful bidder on the polo portion
of the landscape maintenance had regarding execution of a contract. He further
noted that negotiations with the Polo Club to assume the maintenance responsibility
had not been successful. In light of that situation, he advised that the open
fields maintenance contract would be executed forthwith with the lowest responsible
bidder selected by the Village, Oak Brook Landscape Company.
VI.GARBAGE RATES:
The Village Board considered Bruce Kapff's January 9, 1986 memo and the
rate increase request of Rots Disposal Service contained in their November 8,
1985 letter and the request of Oak Brook Disposal as contained in their October 28,
1985 letter. After considerable discussion, the Village Board reached a consensus
that the Village Attorney prepare the necessary contract amendments to the
three existing solid waste contracts to amend residential service rates as follows:
Once a week curb pick-up from $6.40 to $7.10 per month;
Twice a week curb pick-up from $8.50 per month to $9.40 per month;
Once a week rear pick-up from $10.00 to $11.00;
Twice a week rear pick-up from $15.00 to $16.00.
The Board further requested that the matters be placed on the agenda of the
meeting of January 14, 1986.
VII. FIRE STATIONS:
The Village Board deferred discussion on the subject concerning consolidation
of Fire Stations.
VIII OISE ORDINANCE:
The Village Board reviewed the proposed ordinance attached to the January 9,
1986 memorandum of Richard Martens and requested that it be placed on the
agenda of the Village Board meeting of January 14, 1986.
IX.ADJOURNMENT:
Trustee Philips moved, seconded by Trustee Bushy to adjourn this meeting.

C. RESOLUTION NO. R-404 A RESOLUTION APPROVING 1986 AMENDMENT TO
EMPLOYEE PAY PLAN FOR 1986:
Discussed at the Special Meeting of December 14, 1985.
Trustee Winters moved, seconded by Trustee Rush. . .
To pass and approve Resolution No. R-404 as presented and amended to
add Bath and Tennis Director under Sports Core in Grade Seven and
waive the full reading thereof and that the Village Attorney prepare
the necessary document to add Paramedic with a $1,200.00 pay
differential to the Fire Department.

January 13, 1986 for Staff to prepare draft ordinance to declare
prolonged or unusual noise as being unlawful.
Trustee Rush moved, seconded by Trustee Maher. ..
To pass and approve Ordinance No. G-372 as presented and waive reading
of same.

To authorize payment of Payout #1 to Virgil Cook & Sons, Inc. for
installation of traffic signals at the subject location in the amount
of $77,099.73, subject to receipt of waivers.

B. Approval of Bills:
Warrant Register by fund dated January 8, 1986 to reflect payment from

To approve payment of Warrant Register by Fund in the total amount of
$508,106.60 and authorize the Village President to affix his signature
thereon.
Trustee Winters abstained from voting on the bills from Illinois Bell
due to employment by same.
