AN ORDINANCE AMENDING THE TRAFFIC ORDINANCE OF THE
L' VILLAGE OF OAK BROOK TO REGULATE PARKING ALONG
ILLINOIS RTE. 56(BUTTERFIELD ROAD)
WHEREAS, the Village of Oak Brook is desirous of improving the traffic signals
at the intersection of ILL. Rte. 56(Butterfield Road)/Meyers Road; and
WHEREAS, the Illinois Department of Transportation proposed to made said
improvements pursuant to a contract with the Village of Oak Brook; and
WHEREAS, said contract identified as Traffic Signal Modernization, ILL. Rte. 56
(Butterfield Road) & Meyers Rd. , F.A.U. Rte. 3545, State Section (55 & 56)TS-85,
Village Section 85-00015-00-TL, requires that certain parking regulations be
undertaken by the Village of Oak Brook; and
WHEREAS, the corporate authorities deem the following regulation in the best
interest of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: All parking shall be prohibited along ILL. Rte. 56(Butterfield Road)
from the western Village limits to the eastern Village limits.
Section 2: That the Superintendent of Public Works is authorized to post signs
stating the parking prohibition set forth in Section 1.
Section 3: Any person, firm, or corporation violating the provision of this
Ordinance shall be fined not less than FIVE DOLLARS ($5.00) nor more than FIVE
HUNDRED DOLLARS ($500.00) for each offense.
Section 4: This Ordinance shall be in full force and effect ten (10) days from
and after its passage, approval, and publication, as provided by law.

Renovation of museum, per Ordinance No. 5-516, was to be completed by

To grant an extension of time to January 1, 1987 for the museum
renovation and that the Village Attorney prepare the necessary
documents to effectuate same.

Traffic Signal Modernization - Illinois Route 56 (Butterfield Road)
and Meyers Road - Oak Brook/Illinois Department of Transportation
(IDOT) Agreement:
Traffic signal modernization includes the installation of fire pre-
emption equipment, "Opticom", new control equipment and other work
necessary to the improvement. Agreement identifies the proportional
participation costs of engineering and installation.
1. Resolution No. R-405 A Resolution Authorizins Execution of an
Agreement between the Village of Oak Brook and the Illinois Department
of Transportation for Im rovements to Illinois Rte. 56/Meyers Road:

A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN
THE VILLAGE OF OAK BROOK AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION
FOR IMPROVEMENTS TO ILLINOIS RTE. 56/MEYERS ROAD
WHEREAS, the Village of Oak Brook is desirous of improving the traffic signals at
the intersection of ILL. Rte. 56/Meyers Road; and
WHEREAS, the Illinois Department of Transportation proposes to make said
improvements, identified as Traffic Signal Modernization, ILL. Rte. 56 (Butterfield
Road) & Meyers Road. , F.A.U. RTE.3545, State Section (55 & 56)TS-85, Village Section
85-00015-00-TL, pursuant to the Agreement with the Village of Oak Brook, a copy of
which is attached hereto as Exhibit l ; and
WHEREAS, the corporate authorities deem execution of the attached Agreement in the
best interest of the Village of Oak Brook;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section l: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That the Village President and`Village Clerk are hereby authorized
and directed to execute the Agreement with the Illinois Department of Transportation
for improvements to the intersection of ILL. Rte. 56/Meyers Road. Said Agreement
shall conform substantially to the form of Agreement attached hereto as Exhibit I.
Section 3: This Resolution shall be in full force and effect from and after
its passage and approval as provided by law.

AGREEMENT
This agreement entered into thisZ� day of A.D.
19_2a/_, by and between the STATE OF ILLINOIS, acting by ancr through
its Department of Transportation, hereinafter called the STATE , and
the VILLAGE OF OAK BROOK, a Municipal Corporation, in Du Page and
Cook Counties , of the State of Illinois , hereinafter called the
VILLAGE.
WITHESSETH:
WHEREAS, the STATE , in order to facilitate the free flow of
traffic and insure safety to the motoring public, is desirous of
improving the intersection of IL 56 at Meyers Road by modernizing
the existing traffic control signals , (to be known as STATE Section
(55 & 56)TS-85 and as VILLAGE Section 85-00015-00-TL) , by installing
fire pre-emption equipment, by installing new control equipment, and
by performing all other work necessary to complete the improvement
in accordance with the plans and specifications; and,
WHEREAS , the VILLAGE is desirous of said improvement in that
same will be of immediate benefit to the residents of the VILLAGE,
and permanent in nature; and,
WHEREAS , the intersection of IL 56 @ Meyers Road lies within
the corporate limits of the VILLAGE.
NOW 'THEREFORE, in consideration of the mutual covenants
L- contained herein, the parties hereto agree as follows :
1 . The STATE agrees to prepare plans and specifications , receive
bids , award the contract, furnish engineering inspection
during construction, and cause the improvement to be built in
accordance with the plans , specifications , and contract . The
STATE also agrees to pay all nor.-federal construction and
engineering costs subject to reimbursement by the VILLAGE as
hereinafter stipulated .
2. The VILLAGE agrees to approve the plans and specifications by
letter or resolution prior to the STATE advertising for the
work to be performed hereunder.
3 . It is mutually agreed that the proportional participation for
the construction costs and engineering costs of this
improvement shall be as follows:

4 . It is mutually agreed that the estimated construction costs
and engineering costs of this improvement are divided as

5 . It is mutually agreed that the VILLAGE will reimburse the
STATE in an amount equal to the VILLAGE 'S share of the actual
cost as determined in accordance with Item 13 above. It is
mutually agreed that upon award of the contract for this
improvement , and upon receipt of a request for payment from
the STATE , the VILLAGE will pay to the Department of
Transportation of the State of Illinois , in a lump sum from
any funds allotted to the VILLAGE, an amount equal to 95% of
its obligation incurred under this Agreement and will pay to
said department the remainder of its obligation in a lump sum
upon completion of the project, based upon final costs .
6 . The VILLAGE has passed a resolution appropriating sufficient
funds to pay its share of the cost of this improvement, a co-py
of which is attached hereto as Exhibit "A" and made a part
hereof.
s . Upon acceptance by the STATE of the traffic signal work
included herein, the financial responsibility for
maintenance and electrical energy shall be as follows :

It is further agreed that the signals shall be maintained
to at least Level of Maintenance II .

8 . Payment by the STATE of any or all of its share of
maintenance and energy costs is contingent upon the STATE
receiving adequate funds in its annual appropriation.
9 . The parties hereto agree that the traffic signal
maintenance and energy provisions of this Agreement shall
remain in effect for a period of twenty (20) years from
the date of its execution or so long as the traffic
signals covered by the terms of this Agreement or any
Amendment hereto remain in place either in their current
or some modified configuration, whichever is the shorter
period of time . Such an effective term shall apply unless
otherwise agreed in writing by the parties hereto.
10 . The STATE retains the right to control the sequence of
timing of the traffic signals .
11. It is mutually agreed that the financial responsibility
for the maintenance of the "Opticom" equipment shall be
borne entirely by the VILLAGE.
12. The STATE ' S Electrical Maintenance Contractor shall
maintain the "Opticom' equipment located at the traffic
signal installation to be maintained by the STATE. The
STATE ' S Electrical Maintenance Contractor shall invoice
tb:e VILLAGE for the maintenance costs related to the
maintenances of the "Opticom" equipment . The VILLAGE shall
r:a.intain. tine emitters and associated appurtenances at its
-own expense . The emitters shall be maintained and tested
by the VILLAGE in accordance with the recommendations of
the manufacturer .
13 . It is mutually agreed that the STATE ' S Electrical
Maintenance Contractor will send to the VILLAGE an
itemized invoice covering the actual cost for the
maintenance of the "Opticom" equipment . Upon receipt of
said invoice , the VILLAGE agrees to pay to the STATE ' S
Electrical Maintenance Contractor the amount of the
invoice.
14 . The VILLAGE has adopted and will put into effect , prior to
constructing the work to be performed hereunder , an
ordinance requiring that parking be prohibited on IL 56
adjacent to this improvement on the approaches lying
within the corporate limits of the VILLAGE, a copy of
which is attached hereto as Exhibit "B" or immediately
adjacent to this improvement as may be determined to be
necessary by the STATE from traffic capacity studies . The
VILLAGE presently prohibits parking on Meyers Road as
stated within the VILLAGE ' S code of ordinances page
1250 .2 , a copy of which is attached hereto as Exhibit .

15 . The STATE agrees to comply with all applicable Executive
`- Orders and Federal Highway Acts pursuant to the Equal
Employment Opportunity and Nondiscrimination Regulations
required by the U. S. Department of Transportation.
16 . This agreement and the covenants contained herein shall
become null and void in the event the contract covering
the construction work contemplated herein is not awarded
by Septen-iber 30, 1988.
17 . This agreement shall be binding upon and inure to the
benefit of the parties hereto, their successors and
assigns .

WHEREAS, the VILLAGE has entered into an Agreement with the State of Illinois for

Meyers Road, known as STATE Section (55 & 56)TS-85 and as VILLAGE Section 85-00015-00-T_L
and,
WHEREAS, in compliance with the aforementioned Agreement, it is necessary for
the VILLAGE to appropriate sufficient Motor Fuel Tax Funds to pay its share of the cost
of said traffic signal modernization.
NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of
$2,300.00 (TWO THOUSAND-THREE HUNDRED AND NO/100 DOLLARS) or so much thereof as may be
necessary, from any money now or hereinafter allotted to the VILLAGE under provisions
of the Motor Fuel Tax Law, to pay for its share of the cost of this improvement as
provided in this Agreement; and,
BE IT FURTHER RESOLVED, that upon award of the contract for this improvement and
upon receipt of a request for payment from the State of Illinois, the VILLAGE will pay to
the Department of Transportation of the State of Illinois, in a lump sum from any funds
allotted to the VILLAGE, under the Motor Fuel Tax Law, an amount equal to 957 of its
obligation incurred under this Agreement,- and will pay to the said Department the
remainder of its obligation (including any non-participating costs for FA projects) in
a lump sum, upon completion of the project based upon final costs; and,
BE IT FURTHER RESOLVED, that the VILLAGE agrees to pass a supplemental resolution to
provide necessary funds for its share of the cost of this improvement is the amount
)oropriated herein proves to be insufficient to cover said cost.
