AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION XI(E)(7)(ii) OF THE ZONING ORDINANCE OF
THE VILLAGE OF OAK BROOK AS AMENDED RELATIVE TO
REQUIRED SIDE YARDS
(1314 Kensington Road - United States Post Office)
WHEREAS, the owner of the below described property has petitioned the
President and Board of Trustees of the Village of Oak Brook, DuPage and Cook
Counties for a certain side yard variation for said property; and
WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has
held a public hearing on February 4, 1986, pursuant to statutory notice, on the
proposed variation and has submitted its recommendations to the President and
Board of Trustees; and
WHEREAS, the Zoning Board of Appeals recommended that the applicant's
proposed variation be granted; and
WHEREAS, the President and Board of Trustees deem the passage of this
Ordinance to be in the best interest and in furtherance of the general welfare of
the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That a variation from Section XI(E)(7)(ii) of Appendix I of
the Zoning Ordinance of the Village of Oak Brook is hereby granted to the United
States Post Office so as to permit the construction of approximately 16
additional parking spaces to the existing parking lot which is located along the
side of the United States Post Office building which adjoins a street (Kensington
Court) , subject to the conditions enumerated in Sections 3 and 4.
Section 3: That the variation herein granted is specifically subject
to the following conditions:
A. That the proposed parking lot addition is constructed in
substantial conformity with the Site Plan dated March 30,
1985 by Donohue Engineers and Architects.
B. That this Variation shall cease at such time as the United
Stated Post Office or other United States agency ceases to
use and occupy the below described property.
Section 4: The property to which the above Variation is granted is
legally described as follows:
Lot 1 in Corporate Plaza Lot 8 Resubdivision being a
resubdivision of Lot 8 in Corporate Plaze Subdivision Unit
Two, of parts of Lots 1 and 2 in Oak Brook Investment Company
Assessment Plat No. 3, of part of Section 26, Township 39
North, Range 11, East of the Third Principal Meridian, in
DuPage County, Illinois,
Permanent Parcel No. 06-26-101-014,
and is commonly known as 1314 Kensington Road, Oak Brook, Illinois, located at
the northeast quadrant of the intersection of Kensington Road and Kensington
Court, Oak Brook, Illinois.
Section 5: This Ordinance shall be in full force and effect from and
after its passage and approval as by Statute in such case made and provided.
This Ordinance shall be published in pamphlet form.

Section 6: All ordinances, rules, and regulations of the Village of
Oak Brook which are in conflict with the provisions of this Ordinance are hereby
repealed to the extent of the conflict and only as they apply to the territory

this Ordinance is for any reason held to be invalid, such determination shall not
affect the validity of any remaining portion of this Ordinance.

On January 20, 1986, the Plan Commission recommended that the setback from
Adams Road be amended to 50 feet from 100 feet in keeping with the front

SUBJECT: Request for waiver of fees - United States Post Office -

Work began without benefit of a permit on 1/10/86 as the Post Office
authorities advised us that they are exempt from applying for a permit,
but would apply for one. It was noted that part of the additional parking
was proposed to be constructed in the 100' side yard abutting Kensington
Road and they did agree that complaince with the ordinance was in order,
and a variation would have to be applied for.
1) Request for waiver of fees related to Variation to the required
number of parking spaces allowed in the 100' Side Yard abutting
Kensington Court.
2) Request for waiver of fees related to the building permit for
construction of parking area.

Dear President and Board of Trustees:

The Zoning Board of Appeals, at its February 4, 1986 regular meeting, considered
the application of the U. S. Post Office for a variation which would permit
construction of an additional 16 parking spaces between the building and the
Kensington Court right of way.
The Zoning Board of Appeals recommends to the President and Board of Trustees
approval of this Variation based on the following findings of fact:
1) The property is unique due to the small size of the lot as well as its
double frontage.
2) Approval of the variation would not be detrimental to surrounding properties,
since the Post Office is located within a business area and the proposed
parking area directly abuts the parking lot directly North.
This recommendation is further made based on the understanding that adequate land-
scaping surrounding the parking area will be included as a part of the development.
This recommendation was made on a motion by Member Martinello, seconded by Member
Weber and approved on a Roll Call Vote of five (5) ayes: Members Bartecki, Crouch,
Martinello, Weber, Chairman Savino; zero (0) nays ; one (1) absent: Member O'Brien.

I refer you to my memo of January 30, 1986 to the Zoning Board of Appeals which
is page 7 in the folder which contains the details of this application.
The Zoning Board of Appeals, at its February 4, 1986 meeting, recommended approval
of the variation request based on the findings of fact as contained in Chairman
Savino's letter.
In the event that the Village Board chooses to approve the requested variation,
it would be appropriate to direct the Village Attorney to prepare the necessary
ordinance approving same.

VI U. S. POST OFFICE - PARKING VARIATION (1314 Kensington Road)
Dick Beebe, Traffic Consultant, was present representing this application. He
noted that the Post Office property has experienced severe overcrowding related to
office and other growth within the Oak Brook area. He noted that the Post Office
has prepared plans to expand employee and customer parking providing an additional
45 spaces at the North of the property. He noted that the Site Plan meets all
Hinsdale Sanitary District requirements for storm water detention, that there will
be no change in access points to the property, and that the new parking area will
be limited to use by employees.
In response to Member Martinello, Mr. Beebe stated that the new parking area will
replace a grassed swale area which is located directly across from a parking lot to
the North. He also noted other interior traffic problems relative to semi-trailers
having a difficult time using the existing loading dock and that the proposed plans
will help alleviate that problem.
Member Crouch noted that the five proposed spaces at the northwest of the property
appear to be too close to the Kensington Court right of way. Following discussion
it was determined that the spaces scale to the old office standard and that
utilizing the recently approved standard, these spaces could pull back from the
right of way to some extent.
In response to the Chairman, Mr. Beebe indicated that the Post Office has future
development plans which, within 10 years, might call for construction of a new Post
Office elsewhere in the Village totally replacing the current site.
In response to Member Martinello, Mr. Beebe stated that although landscaping will
be provided around the parking area, such has yet to be designed.
The Chairman noted that there were no members of the audience expressing support
for or opposition to the proposed Variation.
A motion was made by Member Martinello, seconded by Member Weber to recommend to
the President and Board of Trustees approval of the requested Variation which would
permit construction of approximately 16 additional parking spaces between the
building and the Kensington Court right of way based on the following findings of
fact:
1) The Post Office site is unique due to its small size and double frontage.
2) Approval of the Variation would not be detrimental to the area, since the Post
Office is surrounded by other businesses, including a parking area directly
North of the proposed construction.
This Variation is further recommended based on the indication that adequate
landscaping will be provided in conjunction with the construction.

COMMISSION HEARING ON THE THIRD MONDAY OF THE FOLLOWING
MONTH, WITH ZONING BOARD PUBLIC HEARING TO FOLLOW.
A Variation is a zoning adjustment which permits minor changes of district require-
ments where individual properties are both harshly and uniquely burdened by the
strict application of the law. The power to vary is restricted and the degree of
Variation is limited to the minimum change necessary to overcome the inequality
inherent in the property.
1. A Variation recognizes that the same district requirements do not affect all
properties equally; it was invented to permit minor changes to allow hardship prop-
erties to enjoy equal opportunities with properties similarly zoned. You must
prove that your land is affected by special circumstances or unusual conditions.
These must result in uncommon hardship and unequal treatment under the strict ap-
plication of the Zoning Ordinance. Where hardship conditions extend to other prop-
erties a Variation cannot be granted. The remedy for general hardship is a change
of the map or the text of the Zoning Ordinance.
2. You must prove that the combination of the Zoning Ordinance and the uncommon
conditions of your property prevents you from making any reasonable use of your
land as permitted by your present zoning district. Since zoning regulates land and
not people, the following conditions cannot be considered pertinent to the applica-
tion for a Variation: (1) Proof that a Variation would increase the financial re-
turn from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last
case, the recognition of conditions created after the enactment of the Zoning Ordi-
nance would encourage and condone violation of the law.
3. No Variation may be granted which would adversely affect surrounding property
or the general neighborhood. All Variations must be in harmony with the intent and
purposes of the Zoning Ordinance.

Work began without benefit of a permit on 1/10/86 as the Post Office
authorities advised us that they are exempt from applying for a permit,
but would app y 'for one. It was noted that part of the additional parking
was proposed to be constructed in the 100' side yard abutting Kensington
Road and they did agree that complaince with the ordinance was in order,
and a variation would have to be applied fora
1) Request for waiver of fees related to Variation to the required
number of parking spaces allowed in the 100' Side Yard abutting
Kensington Court.
2) Request for waiver of fees related to the building permit for
construction of parking area.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT AND CERTAIN VARIATIONS TO
THE PROPERTY COMMONLY KNOWN AS THE NORTHEAST QUADRANT TO TIIE
INTERSECTION OF KENSINGTON ROAD AND KENSINGTON COURT, OAK BROOK,
ILLINOIS
WHEREAS, the owner of the below described property has petitioned the Presi-
dent and Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties for
a use subject to a Special Use Permit and certain variations for said property; and
WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a
public hearing, pursuant to statutory notice, on the proposed use and variations and
has submitted its recommendations to the President and Board of Trustees; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its
report on the subject petition to the President and Board of Trustees; and
WHEREAS, the President and Board of Trustees deem the passage of this Ordi-
nance to be in the best interest and in furtherance of the general welfare of the Village
of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Oak Brook, Du Page and Cook Counties, Illinois, that:
SECTION 1: The provisions of the preamble hereinabove set forth are hereby restated
herein as though herein fully set forth.
SECTION 2: A Special Use Permit for a post office operated by the United States govern-
ment, pursuant to Section X, B. 2. b. of Ordinance No. G-60, as amended, the Zoning
Ordinance of the Village of Oak Brook, is hereby granted for the property described in
Section 4 hereof.
SECTION 3: Variations from Sections V, G. 3. b, and XI, E. 7. of Ordinance No. G-60
as amended, the Zoning Ordinance of the Village of Oak Brook, are hereby granted to
permit the construction of twenty-five (25) parking spaces on the property described in
Section 4 hereof, in accordance with the U.S. Postal Service Central Region Site Plan
dated January 21, 1977, and identified as Drawing CA-6795-A, solely as it relates to
said parking area.
SECTION 4: The property to which the above Special Use Permit and Variations are
granted is legally described as follows:

published in pamphlet form.
SECTION G: All ordinances, rules, and regulations of the Village of Oak Brook which
are in conflict with the provisions of this Ordinance are hereby repealed to the extent
of the conflict and only as they apply to the territory hereinbefore described.
SECTION 7: If any section, subsection, sentence, clause, or phrase of this Ordinance
is for any reason held to be invalid, such determination shall not affect the validity of
any remaining portion of this Ordinance.
