G- 376 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF SECTION XI(E)(7)(ii) OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK AS AMENDED RELATIVE TO REQUIRED SIDE YARDS (1314 Kensington Road - United States Post Office) WHEREAS, the owner of the below described property has petitioned the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties for a certain side yard variation for said property; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a public hearing on February 4, 1986, pursuant to statutory notice, on the proposed variation and has submitted its recommendations to the President and Board of Trustees; and WHEREAS, the Zoning Board of Appeals recommended that the applicant's proposed variation be granted; and WHEREAS, the President and Board of Trustees deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation from Section XI(E)(7)(ii) of Appendix I of the Zoning Ordinance of the Village of Oak Brook is hereby granted to the United States Post Office so as to permit the construction of approximately 16 additional parking spaces to the existing parking lot which is located along the side of the United States Post Office building which adjoins a street (Kensington Court) , subject to the conditions enumerated in Sections 3 and 4. Section 3: That the variation herein granted is specifically subject to the following conditions: A. That the proposed parking lot addition is constructed in substantial conformity with the Site Plan dated March 30, 1985 by Donohue Engineers and Architects. B. That this Variation shall cease at such time as the United Stated Post Office or other United States agency ceases to use and occupy the below described property. Section 4: The property to which the above Variation is granted is legally described as follows: Lot 1 in Corporate Plaza Lot 8 Resubdivision being a resubdivision of Lot 8 in Corporate Plaze Subdivision Unit Two, of parts of Lots 1 and 2 in Oak Brook Investment Company Assessment Plat No. 3, of part of Section 26, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, Illinois, Permanent Parcel No. 06-26-101-014, and is commonly known as 1314 Kensington Road, Oak Brook, Illinois, located at the northeast quadrant of the intersection of Kensington Road and Kensington Court, Oak Brook, Illinois. Section 5: This Ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. This Ordinance shall be published in pamphlet form. The Zoning Board of Appeals recommends to the President and Board of Trustees approval of this Variation based on the following findings of fact: 1) The property is unique due to the small size of the lot as well as its double frontage. 2) Approval of the variation would not be detrimental to surrounding properties, since the Post Office is located within a business area and the proposed parking area directly abuts the parking lot directly North. This recommendation is further made based on the understanding that adequate land- scaping surrounding the parking area will be included as a part of the development. Post Office - Parking Variation (1314 Kensington Road) I refer you to my memo of January 30, 1986 to the Zoning Board of Appeals which is page 7 in the folder which contains the details of this application. The Zoning Board of Appeals, at its February 4, 1986 meeting, recommended approval of the variation request based on the findings of fact as contained in Chairman Savino's letter. In the event that the Village Board chooses to approve the requested variation, it would be appropriate to direct the Village Attorney to prepare the necessary ordinance approving same. POST OFFICE - PARKING VARIATION (1314 Kensington Road) Dick Beebe, Traffic Consultant, was present representing this application. He noted that the Post Office property has experienced severe overcrowding related to office and other growth within the Oak Brook area. He noted that the Post Office has prepared plans to expand employee and customer parking providing an additional 45 spaces at the North of the property. He noted that the Site Plan meets all Hinsdale Sanitary District requirements for storm water detention, that there will be no change in access points to the property, and that the new parking area will be limited to use by employees. In response to Member Martinello, Mr. Beebe stated that the new parking area will replace a grassed swale area which is located directly across from a parking lot to the North. He also noted other interior traffic problems relative to semi-trailers having a difficult time using the existing loading dock and that the proposed plans will help alleviate that problem. Member Crouch noted that the five proposed spaces at the northwest of the property appear to be too close to the Kensington Court right of way. Following discussion it was determined that the spaces scale to the old office standard and that utilizing the recently approved standard, these spaces could pull back from the right of way to some extent. In response to the Chairman, Mr. Beebe indicated that the Post Office has future development plans which, within 10 years, might call for construction of a new Post Office elsewhere in the Village totally replacing the current site. In response to Member Martinello, Mr. Beebe stated that although landscaping will be provided around the parking area, such has yet to be designed. The Chairman noted that there were no members of the audience expressing support for or opposition to the proposed Variation. A motion was made by Member Martinello, seconded by Member Weber to recommend to the President and Board of Trustees approval of the requested Variation which would permit construction of approximately 16 additional parking spaces between the building and the Kensington Court right of way based on the following findings of fact: 1) The Post Office site is unique due to its small size and double frontage. 2) Approval of the Variation would not be detrimental to the area, since the Post Office is surrounded by other businesses, including a parking area directly North of the proposed construction.
