ORDINANCE NO. G- 391
AN ORDINANCE ZONING CERTAIN PREVIOUSLY UNZONED PROPERTY
AND AMENDING THE TEXT OF THE ZONING ORDINANCE OF
THE VILLAGE OF OAR BROOK, ORDINANCE G-60, AS AMENDED
WHEREAS, on or about June 9, 1986, the Village of Oak Brook, a
municipal corporation, filed an application with the Village Clerk of the Village
of Oak Brook requesting that certain Illinois State Toll Highway Authority and
State of Illinois properties be zoned within the zoning classifications set forth
in the attached map and further that the text of Section VI(B) (2) (a) be amended;
and
WHEREAS, on June 24, 1986, the corporate authorities referred
application to the Plan Commission and the Zoning Board of Appeals for public
hearings; and
WHEREAS, at its meeting of July 21, 1986, the Plan Commission
recamnended to the Village Board that the application be approved; and
WHEREAS, a public hearing was held by the Zoning Board of Appeals on
October 7, 1986 pursuant to due and appropriate legal notice; and
WHEREAS, at the public hearing on October 7, 1986, the Zoning Board of
Appeals recamnended to the Village Board that the application be approved; and
WHEREAS, the President and Board of Trustees concur with the Plan
Commission and zoning Board of Appeals and find that it is in the best interests
of the Village that all lands within the corporate boundaries of the Village be
zoned;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAR BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preanble hereinabove set forth
.are hereby adopted as though fully set forth herein.
Section 2: That the properties within the Village of Oak Brook which
were previously not zoned are hereby zoned in accordance with the attached Zoning
Map, which Map is labelled Exhibit A and is incorporated herein.
Section 3: That the corporate authorities adopt and approve the
attached Zoning Map, which map is labelled Exhibit A and is incorporated herein.
Section 4: That Section VI(B) (2) (a) of the Zoning Ordinance of the
Village of Oak Brook, Ordinance G-60, as amended, is amended to read as follows:
(a) A zoning district boundary line following a street, state
highways or tollways or extension thereof shall be
construed to be the center line of such street, state
highways and tollways or extension.
Section 5: That the Village Clerk is hereby directed to amend the
"Official Map of Zoning Districts of the Village of Oak Brook" in accordance with
the provisions of Sections 2 and 3 of this Ordinance.
Section 6: All ordinances, rules and regulations of the Village of Oak
Brook which are in conflict with the provisions of this Ordinance are hereby
repealed to the extent of the conflict and only as they apply to the specific
properties hereinbefore described.
Section 7: That this Ordinance shall be in full force and effect from
and after its pass'passage and approval as provided by law.
