AN ORDINANCE AMENDING SECTION 3-29 OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK RELATIVE TO THE PROHIBITION OF CERTAIN
SALES OF ALCOHOLIC BEVERAGES
WHEREAS, Section 110 of Chapter 43 of the Illinois Revised Statutes
authorizes the President and Board of Trustees of the Village to establish
regulations and restrictions upon the issuance and operations under local
licenses not inconsistent with law as the public good and convenience may
require; and
WHEREAS, the corporate authorities of the Village of Oak Brook have
heretofore passed Ordinance S-7, codified as Section 3-29 of the Code of
Ordinances of the Village of Oak Brook; and
WHEREAS, the President and Board of Trustees deem it advisable and in
the best interest and in furtherance of the general welfare of the citizens of
the Village that said Section 3-29 be amended;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section 3-29 of the Code of Ordinances of the Village
of Oak Brook be and is hereby amended to read as follows:
Sec. 3-29. Certain sales prohibited.
(A) It shall be unlawful for a licensee to sell, give or
deliver alcoholic liquor to any minor or to any intoxicated
person or any person known by him to be a habitual drunkard,
spendthrift, feebleminded or distracted person.
(B) It shall be unlawful for any licensee selling alcoholic
beverages to be served and consumed on the licensed premises
to engage in any of the following enumerated practices:
(1) deliver more than two drinks to one person at one
time.
`- (2) sell, offer or deliver to any person an unlimited
number of drinks during any set period of time for
a fixed price, except at private functions not
open to the public.
(3) sell, offer to sell or deliver drinks to any person
or group of persons on any one day at prices less
than those charged the general public on that
entire day, except at private functions not open to
the public.
(4) increase the volume of alcoholic beverages
contained in a drink without increasing
proportionately the price charged for such
drink.
(5) encourage or permit on the licensed premises any
game or contest which involves drinking or the
awarding of drinks as prizes.
(6) advertise or pr ante in any way whether within or
without the licensed premises any of the above

The prohibited practices contained in Sub-Section B hereof
shall not prohibit licensees fran:
(1) Offering free food or entertairment at any time.
(2) Including a drink as part of a meal package.
(3) Free wine tastings.
(4) Offering roan services to registered guests in hotels licensed for
such service.
Section 3: That all ordinances or parts thereof in conflict with the
provisions of this Ordinance be and the sane are hereby repealed.
Section 4: This Ordinance shall be in full force and effect fran and
after its passage, approval and publication in pamphlet form as required by law.
Section 5: That the Village Clerk is hereby authorized and directed to
publish this Ordinance in pamphlet fo nn in the manner provided by law.

MEMO TO: Village President and Board of Trustees
FROM: John H. Brechin, Village Manager
RE: Ordinance Restricting Sale and Promotion of Alcoholic Beverages
RECOMMENDATION: That the Village Board pass the attached ordinance restricting
"Happy Hours" and similar promotional devices in licensed
liquor establishments.
Some time ago, the mayors of Downers Grove, Lombard and Oak Brook met and
agreed that to attempt to develop an ordinance to control "Happy Hours" and
similar types of liquor promotions that have in other communities produced a
myriad of problems. In response to this request, I have drafted the attached
ordinance which has been reviewed by the attorneys for the various communities
involved. It is anticipated that Downers Grove and Lombard will pass the ordinance
`- April 14, 1987 and that Oakbrook Terrace will pass the ordinance shortly.
It is hoped that the passage of the ordinance by multiple jurisdictions will have
a desired effect of minimizing the promotion of alcoholic consumption and further
the interests of public health and safety.

The Regular Meeting of the Board of Trustees was called to order by President
Cerne in the Samuel E. Dean Board Room of the Village Commons at 7:35 P.M.
