CHAPTER 10 OF THE CODE OF ORDINANCES OF THE VILIAGE OF OAK BROOK
REGARDING LAND MODIFICATIONS
WHEREAS, the corporate authorities have previously adopted regulations
for the control of soil erosion, sedimentation and land modifications; and
WHEREAS, said provisions are codified in Article III of Chapter 10 of the
Code of Ordinances of the Village of Oak Brook; and
WHEREAS, the corporate authorities deem the amendment of said provisions
to be appropriate in order to set forth standards for particular types of land
modifications known as berms;
NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That Section 10-54 of the Code of Ordinances of the Village
of Oak Brook be and is hereby amended to add thereto the following definition:
Berm: An artificially created earthen mound with or without decorative
rock features with a height of 36 inches or more.
Section 2: That Sections 10-58 through 10-61 be and are hereby
renumbered as Sections 10-59 through 10-62 and the following provisions are
substituted therein as a new Section 10-58 entitled "Standards For Berms."
Section 10-58. Standards for Berms
Berms may be constructed in accordance with the provisions of this
Article III and the following standards:
(a) Berms may not be constructed on public or private right-of-way but
may only be constructed in the buildable area of a lot or in the zoning
yard adjacent to toll highways, Butterfield Road, Roosevelt Road, 22nd
Street, Route 83, Oak Brook Road, Midwest Road, Meyers Road and York
Road. In all other locations, berms may be permitted pursuant to the
variance procedures set forth in Section 10-59 of this Code of
Ordinances. Notwithstanding these restrictions, berms may be constructed
in areas necessary to comply with the provisions of the Zoning Ordinance
regarding parking lot screening.
(b) Side slopes of berms may not exceed a maximum of 3 to 1 on the
street side of the berm and at either end of the berm.
(c) Berms may not exceed six feet in height as measured from the closest
edge of adjacent right-of-way pavement or ten feet in height above
natural ground level, whichever is less.
(d) No berms may be permitted that have an adverse impact upon drainage
or traffic sight lines.
Section 3: That this ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form in the manner
provided by law.
Section 4: The Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner as required by law.
