AN ORDINANCE AMENDING THE
SUBDIVISION RF_GULATIONS OF THE VILLAGE OF OAK BROOK
WHEREAS, the Village of Oak Brook has heretofore filed an application for
text amendments to the Zoning Ordinance relating to various amendments to the
subdivision regulations; and
WHEREAS, the Plan Commission has submitted its report on the proposed
amendments to the Zoning Board of Appeals and to the President and Board of
Trustees; and
WHEREAS, a public hearing on such application has been conducted by the
Plan Commission of the Village of Oak Brook on December 19, 1988, pursuant to
due and appropriate legal notice; and
WHEREAS, a recommendation has been made by the said Plan Commission that
the requested amendments be made; and
WHEREAS, the President and Board of Trustees deem the passage of this
Ordinance to be in the best interest and in furtherance of the general welfare
of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section l: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That Article VI(2)(D) be and is hereby amended to read as
follows:
(D) Certificates. The following certificates shall be on the final plat
when submitted:
(1) Owner's
(2) Owner's Notary
(3) Surveyor
(4) County Clerk's Certificate on unpaid taxes.
(5) Plat certification by county board of supervisors if outside the
Village.
(6) Sanitary district certificate on unpaid assessments (where
applicable) .
(7) Village engineer
(8) Village treasurer
(9) Plan Commission
(10) Village Board
(11) Recorder
(12) Drainage (where applicable)
(13) Highway Department (where applicable)
(14) Health Department (where applicable)

Section 3: That Article VII(2)(D)(3) be amended to read as follows:
Land that is subject to periodic flooding cannot be developed unless it
complies with the standards set forth in Article V, Section 3(C)(9) .
Section 4: That Article VII(3)(I)(1) be and is hereby amended to read as
follows:
A grading and landscaping plan shall be submitted for all property within
the subdivision. Except for the traveled portions of areas designated as
right of way or as bicycle and pedestrian pathways, all areas shall be
graded, seeded and planted in accordance with the grading and landscaping
plan approved. Such grading and landscaping plan shall conform to the
standards set forth in Article III, Chapter 10 of the Code of Ordinances
of the Village of Oak Brook.
Section 5: Article VII(3)(B) be and is hereby amended by adding thereto
subsection 4 which shall read as follows:
Upon satisfactory construction and adjustment of all proposed fire
hydrants, the developer shall have a registered land surveyor ascertain
and list the elevation of either the arrow on the hydrant bonnet or the
letters "MUE" on the bonnet flange of each fire hydrant. These
elevations shall be based on USGS datum as currently used within the
Village of Oak Brook as determined by the Village Engineer. Said list
shall be certified as correct by the registered land surveyor and
submitted to the Village Engineer prior to the acceptance of the land
improvements by the Village.
Section 6: That the required Surveyor's Certificate set forth in
Appendix A be and is hereby amended to read as follows:

survey and subdivision. All distances are shown in feet and decimals
thereof. I further certify that all regulations enacted by the President
and Board of Trustees of the Village of Oak Brook relative to plats and
subdivisions have been complied with in preparation of this plat. I
further certify that the land is within the Village of Oak Brook* (or
within 11 miles of the corporate limits of the Village of Oak Brook*)
which has adopted a Village Comprehensive Plan and Map and is exercising
the special powers authorized by Division 12 of Article 11 of the
Illinois Municipal Code as amended. I further certify that a part of*
(all of*) (none of*) the lands shown on this plat are located within a
special flood hazard area as identified by the Federal Emergency
Management Agency.

Section 7: Appendix A is amended by adding thereto the following:

To the best of our knowledge and belief the drainage of surface waters
will not be changed by the construction of such subdivision or any part
thereof, or, that it such surface water drainage will be changed,
reasonable provision has been made for collection and diversion of such
surface waters into public areas, or drains which the subdivider has a
right to use, and that such surface waters will be planned for in
accordance with generally accepted engineering practices so as to reduce
the likelihood of damage to the adjoining property because of the
construction of the subdivision.
