AN ORDINANCE AMENDING CAAPTER 5
OF THE CODE OF ORDINANCES
OF THE VILLAGE OF OAK BROOK REGARDING BUILDING PERMIT FEES
WHEREAS, the corporate authorities of the Village of Oak Brook have
heretofore established certain building permit fees as codified in Section 5-7
of the Code of Ordinances of said Village; and
WHEREAS, current review of said fees conclusively establishes a need to
increase said fees to compensate the said Village for its increasing costs in
providing building plan review and inspection services;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as
follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That Section 5-6 of the Code of Ordinances of the Village of
Oak Brook entitled "Account Codes for Fees" be and is hereby repealed.
Section 3: That Section 5-7 of the Code of Ordinances of the Village of
Oak Brook entitled "Fee Schedule" be and is hereby amended to read as follows:
Section 5-7. Fee schedule.
Before a permit required by this Chapter is issued, the building official
shall collect a fee calculated according to the following schedule.
Volume computation: Volume shall be commuted on the exterior dimensions of
the building and shall include all space above the lowest level of the
foundation wall and to the highest point of the main roof and to include all
projections.
Unit of volume cost: Figure a fraction larger than one-half as a full unit.

Certain entities permitted to request waiver: Any governmental unit or any
charitable organization as defined in "An Act to Regulate Solicitation and
Collection or Funds For Charitable Purposes, Providing for Violations Thereof
and Making An Appropriation Therefor," Chapter 23, Illinois Revised Statutes,
1977, Sections 5101 et sequitur, may request waiver of any fees imposed
pursuant to the terms of this section. Upon such requests the President and
Board of Trustees may by motion waive any such fees imposed pursuant to this
section.
Section 4: That Section 5-10 of the Code of Ordinances of the Village of
Oak Brook entitled "Fines; penalties" be and is hereby amended to read as
follows:
Section 5-10. Fines; penalties.
(a) Any person who violates, disobeys, omits, neglects, or refuses to
comply with, or who resists the enforcement of any of the provisions of this
Chapter, including provisions adopted by reference, or who refuses to remedy a
violation of any such provisions, shall be fined as prescribed in Section 1-8
of this Code for each otfense and each day upon which such violation continues
shall constitute a separate offense.
(b) Any person Licensed :,r registered by the state or a subdivision

arch--tecturai or enqineerinq service who violates the law or provisions of

this Chapter under which licensed or registered, shall be subject to
proceedings or action to revoke the certificate of license or registration.
(c) When a building or structure or part or appurtenance thereof is found
by competent authorities to be maintained in a condition not reasonably safe
from the hazards of fire, explosion, collapse, contagion or spread of
infectious disease, the owner thereof, upon order from the President and
Board, and after due notice, shall be liable for correction or removal of the
condition or the cost thereof upon failure to act.
(d) A penalty, as specified in Section 5-7 shall be added to all permits
upon issuance of said permit in cases where work has commenced prior to
issuance of said permit.
Section 5: That this Ordinance shall be in full force and effect from
and after its passage, approval and publication all as required by law.
Section 6: That the Village Clerk is hereby authorized and directed to
publish this Ordinance in pamphlet form as required by law.
