G-428 - 05/09/1989 - PERSONNEL RULES & REGS - Ordinances ORDINANCE G- 428 AN ORDINANCE AMENDING ARTICLE VI OF THE PERSONNEL RULES & REGULATIONS OF THE VILLAGE OF OAK BROOK RF.r.ATING TO SICK.LEAVE WHEREAS, the corporate authorities have heretofore approved the policies for sick leave as embodied in the Personnel Rules and Regulations of the Village of Oak Brook; and WHEREAS, the corporate authorities deem the revision of the sick leave policies of the Village of Oak Brook to be appropriate and consistent with its goal of fair and equitable personnel practices and policies. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Article VI, Section 6(a) be and is hereby amended to read as follows: (a) Policy Sick leave shall not be considered as a privilege which an employee may use at his discretion, but shall be allowed only in case of: (1) Actual sickness. (2) Disability of the employee. (3) Because of childbirth by employee or wife. (4) Medical or dental appointment. (5) Other sickness prevention measures. (6) Serious illness of members of immediate family defined as follows: (a) Spouse. (b) Son or daughter. (c) Mother or father. (d) Sister or brother. (e) Mother-in-law or father-in-law. (f) Sister-in-law or brother-in-law. (g) Grandparents or grandparents-in-law. Firefighters/Paramedics and Fire Lieutenants may utilize up to one (1) duty day sick leave and other full-time employees may utilize up to three days sick leave for a serious illness of a member of the immediate family which shall be charged against any accrued sick leave as set forth in sub-section (b) hereof. All full-time employees are eligible for sick leave to be earned on the basis of one (1) day of sick leave for each full month of service up to a maximum of 120 days; Firefighters/Paramedics and Fire Lieutenants will earn 11 hours of sick leave for each full month of service, not to exceea 1,344 hours which is equivalent to 120 days for other Village employees. Section 3: That Article VI, Section 6(b) be and is hereby amended to read as follows: i (b) Approval and Accrual (1) All sick leave must be approved by the department head or Village Manager. Unused sick leave may be accrued from year to year, except that maximum accrual shah noc exceed 120 days or 1,344 hours for r'irei lighters jParamedics and Fire Lieutenants. Full-time Village Ordinance G- 428 An Ordinance Amending Article VI Relating to Sick Leave Page 2 employees employed on April 30, 1989 will be credited with one (1) day of sick leave for each full month of prior service not to exceed 120 days or if appropriate 1,344 hours. The Village shall deduct from said sick leave amount the actual sick days or, if appropriate, sick hours used by each full-time employee during the last three (3) years. In no case will a full-time employee who is employed on or before April 30, 1989 have a net beginning balance of less than twenty (20) days of sick leave or for Firefighters/Paramedics and Fire Lieutenants 224 hours. AW (2) Upon initial hiring of a full-time employee and after the end of the first month thereafter, such employee shall receive one (1) day sick leave or eleven (11) hours of sick leave for Firefighters/Paramedics and Fire Lieutenants regardless of the date of hire. Thereafter, full-time employees earn one (1) day of sick leave for each calendar month of service and Firefighters/Paramedics and Fire Lieutenants earn eleven (11) hours of sick leave for each calendar month of service. (3) Any full-time employee using more than three (3) sick days or one (1) duty day in a month will not be credited with any accrued or earned sick leave for that month. Section 4: That Article VI, Section 6 be and is hereby amended by adding thereto sub-section (i): (i) Unused Sick Leave Upon Retirement: Upon retirement for every 20 days of unused and unpaid sick leave, employees can elect to receive either: (1) 15% of accrued sick leave not to exceed 120 days, or the equivalent of 1,344 hours for Firefighters/Paramedics and Fire Lieutenants at the employees' then rate of pay, or (2) the statutory service credit authorized pursuant to the provisions of Chapter 1082 of the Illinois Revised Statutes. For purposes of this section, retirement shall mean the attainment of the requisite age and length of service as required by the employee's applicable pension statute to vest the employee with retirement pension rights. Section 5: That Article VI, Section 11 be and is hereby amended by adding thereto sub-section (c): (c) Death of Immediate Family Member Days away from work due to death of an immediate family member as defined in sub-section 6(a) of this Article VI shall not be chargeable as sick leave. Firefighters/Paramedics and Fire Lieutenants may receive up to one (1) duty day and full-time employees may receive up to three days leave with pay upon the death of a member of his or her immediate family. Section 6: That this Ordinance shall be in full force and effect from and after passage and approval as provided by law as of May 1, 1989. PASSED TAIS 9th day of May , 1989.
