G-433 - 10/10/1989 - WATER CHARGES - Ordinances ORDINANCE NO. G- 433 AN ORDINANCE AMENDING SECTION 12-87 OF THE CODE OF ORDINANCES OF THE VILLAGE OF OAK BROOK RELATING TO WATER CONNECTION FEES AND RELATED FEES WHEREAS, the Village President and Board of Trustees of the Village of Oak Brook have heretofore by ordinance established rates, fees and charges for water usage; and ..r WHEREAS, the Village President and Board of Trustees deem the revision of certain rates relating to its water system to be in the best interests and in futherance of the general welfare of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 12-87(C)(3)(b) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (b) Water supplied by Oak Brook. This fee includes a connection fee and a fee for inspection of all lines. The meter charge includes the cost of the meter and installation to connections installed by the owner. There shall be a fee for a water meter based on the actual costs for time and materials incurred by the Village. It does not include the actual cost of the installation of the lines or fittings. RESIDENTIAL Meter Size Connection Charge 5/8................................$1,128.00 1 "...............................1,459.00 1 1/211...............................1,835.00 2 ................................. --- 3 compound...................... --- 4 " compound...................... --- 6 " compound...................... --- COMMERCIAL (i) A fee for each of the first twelve (12) months' usage commencing with the first full month of usage occurring after the issuance of occupancy permits determined in the manner provided in paragraph (ii) hereof: 10.34 x gallons used per meter reading Fee = __________ The number of days per month of usage.- Example: Date of Operation Per sleek Value 5.0 21.67 5.5 23.83 6.0 26.00 7.0 30.33 (ii) The fae determined pursuant to paragraph (i) above shall be reco:-.puted by the Village upon the expiration of a period of thirty-six (36) months after the first full inonth of usage as determined above, as follows: Ordinance No. G-_433___ Amending Section 12-87 of the Code of Ordinances Relating to Water Connection Fees and Related Fees Page two $4.08 x gallons used per meter reading for the last 12 months of stated 36-month period. Fee = Number of days of operation in the last 12 months of stated 36-month period., The fee so recomputed shall then be adjusted by the amount determined and paid pursuant to paragraph (i) above, and any additional amount resulting from said recomputation shall be paid when billed; and any reduction resulting therefrom shall " be reimbursed by the Village. (iii) In the event there is a substantial change in the use of the premises subject to the fee hereinabove provided at any time during the thirty-six month term described above, the fee provided in paragraph (i) hereof shall be recomputed in accord with paragraph (ii) hereof as though the month in which the change is use occurs were the last month of the thirty-six month term provided in paragraph (ii) hereof. Section 3: That Section 12-87(C)(3)(c) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (c) Fire protection lines: Four thousand four hundred seventy-five dollars ($4,475.00). Section 4: That Section 12-87(C)(7) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (7) Meter testing at the request of customer shall be charged at a rate equal to total out-of-pocket expenses of Village for such testing. Section 5: That Section 12-87(C)(8) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (8) Turning on water following interruption of service shall be subject to a minimum charge of twenty-five ($25.00) dollars during normal working hours and forty ($40.00) dollars after normal working hours, the total charge based upon the out-of-pocket expenses of the Village. Turning on water following discontinuance of service pursuant to provisions of Section 12-406 shall require the payment of a two hundred ($200.00) dollar service charge. Section 6: That Section 12-87(C)(11) of the Code of Ordinances of the Village of Oak Brook be and is hereby amended to read as follows: (11) Water Main Expansion and Extension Connection Fee: A water main expansion and extension connection fee is hereby authorized and established to partially reimburse the Village for the cost of extending water lines to serve new or additional users or to increase its capacity to produce or transport water. This fee shall be in addition to any and all other fees provided in this Article. The water main expansion and extension connection fee shall be as determined by ordinance of the Village for each individual project based upon the costs to the Village of such installation and the benefit to property owners abutting such improvements. Any such fees hereinafter established shall be applicable only to the projects and properties described therein and shall not affect any water main expansion and extension connection fees heretofore established. Section 7: That this Ordinance shall be in full force and effect from and after passage, approval and publication in pamphlet form in the manner as provided by law. Section 8: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form in the manner provided by law.
