AN ORDINANCE AMENDING SECTIONS VIII(E)(2) AND XIV(B)
OF THE ZONING ORDINANCE OF THE VIIa AGE OF OAK BROOK
WHEREAS, an application has been filed requesting an amendment to Section
VIII(E) of the Zoning Ordinance of the Village of Oak Brook to create an
additional authorized Accessory Use for an automobile mini-market; and
WHEREAS, the Plan Commission of the Village of Oak Brook recommended
approval of the requested text amendment; and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on the
request on February 6, 1990, pursuant to due and appropriate legal notice and
has recommended approval of the requested text amendment; and
WHEREAS, the Village President and Board of Trustees have reviewed the
recommendations of its Plan Commission and Zoning Board of Appeals and deems
the requested text amendment be made to authorize an automobile mini-mart not
as an accessory use, but as a Special Use; and
WHEREAS, the applicant seeking the requested text amendment has amended
its application accordingly seeking a text amendment in the nature of a
Special Use;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That Section VIII(E)(2) be and is hereby amended by
redesignating subsections (a) through (j) thereof as subsections (b) through
(k) and by adding the following:
"(a) Automobile Mini-Market"
Section 3: That Section XIV(B) of the Zoning Ordinance of the Village of
Oak Brook be and is hereby amended by adding thereto the definition of
Automobile Mini-Market as follows:
11(9.1) Automobile Mini-Market - An automobile service station
which includes the retail sale of merchandise or services not
related to the maintenance, service or repair of motor vehicles in
addition to the sale of fuel, oil and accessories for motor
vehicles. Such use shall be located entirely within the buildable
area and the building floor area, including all storage for such
use, which may not exceed 1,000 square feet.

Section 4: That this Ordinance shall be in full force and effect from
and after passage and approval as provided by law.
