AN ORDINANCE AMENDING SECTION X(B)(2)(a)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAR BROOK
RELATING TO STANDARDS FOR HELIPORTS
WHEREAS, the corporate authorities of the Village of Oak Brook have
conducted a heliport study and received recommendations from its Plan
Commission and Zoning Board of Appeals; and
WHEREAS, based upon said recommendations, the corporate authorities
prepared proposed amendments to the Zoning Ordinance relating to heliport
standards; and
WHEREAS, the Plan Commission considered such proposed ordinance
amendments on June 17, 1991 and recommended approval of the same with certain
amendments; and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on the
proposed amendments on July 2, 1991 pursuant to due and appropriate legal
-� notice and has recommended approval of the proposed amendments;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section X(B)(2)(a) of the Zoning Ordinance of the
Village of Oak Brook be and is hereby amended to read as follows:
"Special Uses:
(a) Heliports (not for freight): In accordance with the following
minimum standards:
(i) If the Federal Aviation Administration has conducted an
aeronautical study to determine the effect of the proposed
heliport on the safe and efficient use of the navigable air
space by aircraft and find no objection to the proposed
heliport.
(ii) The layout and design of the heliport, including approach and
departure paths, shall conform to the most current rules and
regulations of the Division of Aeronautics, State of
Illinois, Department of Transportation. Any approval for a
heliport granted by the Village shall be subject to evidence

heliport in accordance with plans approved by it; provided
however that any waiver of such rules and regulations granted
by said division shall be subject to approval by the Village.
No permit for the construction of a heliport will be given
until such an order has been issued by said division.
(iii) Hours of operation shall be from 7:00 a.m. to 10:00 p.m.
Monday through Saturday. The heliport may also be used on
Sunday, provided the Village is advised 72 hours in advance,
and said use does not exceed one such use per month.
(iv) Approach and departure patterns from said heliport shall be
limited to avoid operation over residential areas.
(v) Refueling, routine maintenance and storage of helicopter,
except for emergency purposes only, shall not be permitted at
the heliport.
(vi) There will be no receiving or shipping of freight from said
heliport, and there will be no on-site storage of fuel.
(vii) Use of the heliport shall at all times comply with any
specific requirements of the Federal Aviation Administration
or Illinois Department of Transportation in the Certificate
of Approval or Operation issued to the user of the heliport
by such agencies.
(viii) Special use shall only be applicable to the applicant
therefor and for only so long as the applicant is occupying
the subject property.
(ix) The applicant shall maintain at all times appropriate and
sufficient insurance coverage relative to the installation
and use of the heliport insuring against any property damage
or personal injury arising therefrom with policy limits of
not less than $20 million.
(x) All such special uses shall be reviewed by the Village every
five years for conformance with the conditions set forth
herein, character of safety and extent of operations and any
further relevant factors.
(xi) Helicopters utilizing a heliport shall fly at the maximum
safe level prior to entering the approach pattern to the
heliport.

(xii) Use of the heliport shall be made available to the Village of
Oak Brook or its designees for emergencies.
(xiii) A log of usage shall be submitted to the Village on an annual
basis, or as otherwise required by the Village.
Section 3: That this ordinance shall be in full force and effect from
and after passage, approval and publication as required by law.
Section 4: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.
