AN ORDINANCE AMENDING TEE CODE OF ORDINANCES
OF THE VILLAGE OF OAR BROOK
REGARDING FEES FOR FALSE ALARMS AND ESTABLISHING FEES
FOR PUBLIC SAFETY MONITORING DEVICES
WHEREAS, the Village President and Board of Trustees of the Village of
Oak Brook have heretofore passed and approved Ordinance G-176 on September 28,
1982, revising the regulations for the installation, operation and maintenance
of alarm systems and fire protection systems; and
WHEREAS, said ordinance provided for a service charge to be imposed upon
any alarm user for false alarms; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook
have reviewed such fees and deemed that an increase in such fees is necessary
to more closely reimburse the Village for the costs of providing such
services; and
WHEREAS, paragraph 11-8-1 of the Illinois Municipal Code authorizes the
establishment and maintenance, for reasonable charges, of electrical
appliances in public or private buildings for fire and police protection upon
application of the custodian of public buildings, or of the owner of private
buildings; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook
find that, upon review, four dollars ($4) is a reasonable monthly charge for
security services monitored by the Oak Brook Fire Department or the Oak Brook
Police Department;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That Article II of Chapter 9, Section 9-28, of the Code of
Ordinances be amended to read as follows:,
"Sec. 9-28. False alarm service charge.
An alarm user shall be charged a service charge of fifty dollars
($50) for each false alarm in excess of one in any three-month
period transmitted by any alarm system. Such service charge shall
be remitted to the village by the alarm user upon receipt of a
statement for such service charge."

Section 3: That Article 11 of Chapter 9, Section 9-29 be and is hereby
amended by redesignating Sections 9-29 through 9-46 hereof as Sections 9 730
through 9-47 and by adding the following:
"Sec. 9-29. Security .service monitoring charge.
Each person subscribing to a security service which is monitored
by the Oak Brook Police Department shall pay a monthly charge of
four dollars ($4) to the Village. Said charge may be paid to the
agency supplying the monitoring board, provided that said agency
promptly remits the monthly fee to the Village."
Section 4: That Article III, Division 2 of Chapter 6, Section 6-54, of
the Code of ordinances be amended to read as follows:
"Section 6-54. False fire alarm service charge.
A fire alarm user shall be charged a service charge of two hundred
dollars ($200) for each false fire alarm if such false fire alarm
is: (a) due to or caused by a lack of required maintenance as
specified in the oak Brook Fire Prevention Code; or (b) resulting
from any test, repair, alteration or addition to the fire
protection system without prior notification thereof to the fire
department. For all other false fire alarms, an alarm user shall
be charged a service 'charge of two hundred dollars ($200) for each
such false fire alarm in excess of one in any three-month period.
All false fire alarm service charges shall be remitted to the
village by the alarm user upon receipt of the statement for such
service charge."
Section 5: That Article III, Division 2 of Chapter 6, Section 6-55 be
and is hereby amended by redesignating Sections 6-55 through 6-61 hereof as
Sections 6-56 through 6-62 and by adding the following:
"Section 6-55. Security service monitoring charge.
Each person subscribing to a security service which is monitored
by the Oak Brook Fire Department shall pay a monthly charge of
four dollars ($4) to the Village. Said charge may be paid to the
agency supplying the monitoring board, provided that said agency
promptly remits the monthly fee to the Village-"
Section 6: That all ordinances or parts thereof in conflict with the
provisions of this ordinance are hereby repealed to the extent of such
conflict.
Section 7: That this ordinance shall be in full force and effect from
and after its passage, approval and publication as required by law.

Section. 8: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.
