ORDINANCE 2008- ZO -V -S -1225 AN ORDINANCE GRANTING A VARIATION TO THE FRONT YARD AND SIDE YARD SETBACK REQUIREMENTS FOR THE PROPERTY COMMONLY KNOWN AS THE DANA PARK SUBDIVISION IN THE VILLAGE OF OAK BROOK (Cara Lane ) (PIN 06 -33- 103 -039, 06 -33- 103 -040, 06 -33- 103 -041 and 06 -33- 103 -042) WHEREAS, an application has been filed by the property owner, Frank Paul Development Corporation (the "Petitioner'), requesting a variation to Section 13 -6C -3 F.1 of the Zoning Ordinance to permit 30 -foot front yards and 30 -foot side yards abutting a street for the property commonly known as Dana Park Subdivision, and WHEREAS, on December 4, 2007, the Zoning Board of Appeals conducted a public hearing on the request for variation, pursuant to due and appropriate legal notice, and recommended approval of the variation subject to certain conditions, and WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the factors required for approval of the requested variation and made specific findings, including that the variation will not endanger the public health, safety and welfare, and that there will be no substantial injury to other property in the neighborhood, and WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of the Zoning Board of Appeals and deem the variation, as set forth below, to be in the best interests of the Village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein Section 2 The Petitioner is hereby granted a variation to Section 13 -6C -3 F 1 of the Zoning Ordinance to permit 30 -foot front yards and 30 -foot side yards abutting a street for the property commonly known as the Dana Park Subdivision Section 3 The variation and the scope of this ordinance are limited and restricted to the property commonly known as the Dana Park Subdivision, which is legally described as follows LOT 1 IN DANA PARK SUBDIVISION, BEING A SUBDIVISION OF PART OF THE EAST HALF OF THE NORTHWEST QUARTER OF SECTION 33, TOWNSHIP 39 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN ACCORDING TO THE PLAT THEREOF RECORDED FEBRUARY 8, 2006, AS DOCUMENT NUMBER R2006- 024939, IN DUPAGE COUNTY, ILLINOIS Permanent Index Number 06 -33- 103 -039 LOT 2 IN DANA PARK SUBDIVISION, BEING A SUBDIVISION OF PART OF THE EAST HALF OF THE NORTHWEST QUARTER OF SECTION 33, TOWNSHIP 39 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN ACCORDING TO THE PLAT THEREOF RECORDED FEBRUARY 8, 2006, AS DOCUMENT NUMBER R2006- 024939, IN DUPAGE COUNTY, ILLINOIS ORDINANCE 2008-ZO-MA-R-S-1224 AN ORDINANCE REZONING AND GRANTING A MAP AMENDMENT FOR THE PROPERTY COMMONLY KNOWN AS THE DANA PARK SUBDIVISION IN THE VILLAGE OF OAK BROOK (PIN:06-33-103-039,06-33-103-040,06-33-103-041,and 06-33-103-042) WHEREAS, Frank Paul Development Corporation (the "Petitioner") is the owner of certain Property known as the Dana Park Subdivision (the "Property') which is legally described in Exhibit A attached hereto and incorporated herein by reference; and WHEREAS, the Petitioner has filed a petition requesting the Village to rezone the Property from R-2 to R-3 and to amend the Village's zoning map accordingly; and WHEREAS, at its meeting on November 20, 2007, the Plan Commission reviewed the request and found that the applicant had addressed and satisfied the requirements for a map amendment. The Plan Commission unanimously recommended approval of the request to rezone the subject Property. WHEREAS, on December 4, 2007, the Zoning Board of Appeals conducted a public hearing on the request for the rezoning and map amendment, pursuant to due and appropriate legal notice, and did not recommend approval of the rezoning and map amendment;and WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of the Plan Commission as well as the minutes of the December 4,2007 public hearing of the Zoning Board of Appeals and deem the rezoning and map amendment, as set forth below, to be in the best interests of the Village. Section 3: if any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not effect any of the other provisions of this ordinance. Section 4: All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. DANA PARK RESUBDIVISION— 3111-3115 CARA LANE — FINAL PLAT DANA PARK RESUB-FINAL —FIVE-LOT SUBDIVISION PLAT -5-LOT SUBDIVISION Frank Drukas, owner and developer of the property, provided an overview of the request. The property is 3.5 acres and .5 acres of that is dedicated to a private gated cul-de-sac. The original plan was 3 one-acre R-2 zoned home sites, which replaced 3 older homes. Due to the commercial viability, an application was submitted to rezone the property to R-3 with variations. The Village Board approved the request. The property is fully improved with water, sewer, utilities, landscaping, and flood plan management, with the exception of seeding and some retaining walls that were deferred until the actual construction of homes are developed. The approved plat included variances for a private street, a reduced right of way width to 45 feet and a waiver from installing sidewalks. The new subdivision plan is for 5 new home sites with a reduced front yard setback to 30 feet. Lot 1 also has a side yard setback reduced to 30 feet. The new plan will also need some additional regarding of the site. The two additional lots will require two new sewer and water lines. They will be eliminating two retaining walls on Lots 1 and 2 and retaining walls will be added to lots 3, 4 and 5. The retaining walls are approximately 3 feet high and are decorative walls that will create additional yard space. They will provide a vacation of the easements from the original plan and new easements will be provided to accommodate the new plan. New landscaping will not be required and the integrity of the compensation area and flood plain management will be maintained per the original plan. The Flagg Creek Reclamation District is currently reviewing the sanitary plan and they do not anticipate any issues. They are seeking a recommendation of the resubdivision plat. No one in the audience spoke in support of or in opposition to the request. Chairwoman Payovich asked the Village Engineer if there were any outstanding issues that should hold up the proposal. Village Engineer Durfey responded that all the issues were little details and there was nothing of a conceptual nature. Member Knitter questioned the vacation of the existing easements and whether a fire truck can make the turn in the cul-de-sac. Mr. Drukas responded that the easements are related primarily to the utilities. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 2 of 4 January 21, 2008 Jiun-Guang Lin, Ridgeline Consultants said that the 6 foot public utility easement is being vacated because there are no utilities located there now. Village Engineer Durfey responded that the cul-de-sac met Village standards and could accommodate a fire truck. Member Singhal asked if the Midwest Club residents had been contacted. Mr. Drukas responded that all the neighbors were notified and in some cases, they did not receive any feedback and in other cases, they received positive feedback. They were pleased to hear that the project was moving forward. One Heritage Oaks resident questioned the number of lots when they were seeking the map amendment. Motion by Member Tropinski, seconded by Member Iyer that in making the recommendation, the Plan Commission found that the applicant had met the requirements of the Subdivision Regulations and recommended approval of the request to approve the Dana Park Resubdivision as requested, which includes the following: 1. Section 14-6-3E to waive the requirement to construct sidewalks (previously approved in the Dana Park Subdivision) 2. Section 14-6-3 a variation to the requirement to allow private streets and the reduction of the right of way width to forty-five feet (45'). (previously approved in the Dana Park Subdivision) 3. Background/History: At its meeting on January 21, 2008 the Plan Commission reviewed an application from Mr. Frank Drukas, the owner of 3.54 acres at 3111, 3113 and 3115 Cara Lane seeking approval of a six-lot subdivision for the property currently known as the Dana Park Subdivision, which contains three lots for new homes and one lot for the private street Cara Lane. DANA PARK RESUBDIVISION— 3111-3115 CARA LANE — FINAL PLAT DANAPARK RESUB-FINAL —FIVE-LOT SUBDIVISION PLAT -5-LOT SUBDIVISION Frank Drukas, owner and developer of the property, provided an overview of the request. The property is 3.5 acres and .5 acres of that is dedicated to a private gated cul-de-sac. The original plan was 3 one-acre R-2 zoned home sites, which replaced 3 older homes. Due to the commercial viability, an application was submitted to rezone the property to R-3 with variations. The Village Board approved the request. The property is fully improved with water, sewer, utilities, landscaping, and flood plan management, with the exception of seeding and some retaining walls that were deferred until the actual construction of homes are developed. The approved plat included variances for a private street, a reduced right of way width to 45 feet and a waiver from installing sidewalks. The new subdivision plan is for 5 new home sites with a reduced front yard setback to 30 feet. Lot 1 also has a side yard setback reduced to 30 feet. The new plan will also need some additional regarding of the site. The two additional lots will require two new sewer and water lines. They will be eliminating two retaining walls on Lots 1 and 2 and retaining walls will be added to lots 3, 4 and 5. The retaining walls are approximately 3 feet high and are decorative walls that will create additional yard space. They will provide a vacation of the easements from the original plan and new easements will be provided to accommodate the new plan. New landscaping will not be required and the integrity of the compensation area and flood plain management will be maintained per the original plan. The Flagg Creek Reclamation District is currently reviewing the sanitary plan and they do not anticipate any issues. They are seeking a recommendation of the resubdivision plat. No one in the audience spoke in support of or in opposition to the request. Chairwoman Payovich asked the Village Engineer if there were any outstanding issues that should hold up the proposal. Village Engineer Durfey responded that all the issues were little details and there was nothing of a conceptual nature. Member Knitter questioned the vacation of the existing easements and whether a fire truck can make the turn in the cul-de-sac. Mr. Drukas responded that the easements are related primarily to the utilities. Village Engineer Durfey responded that the cul-de-sac met Village standards and could accommodate a fire truck. Member Singhal asked if the Midwest Club residents had been contacted. Mr. Drukas responded that all the neighbors were notified and in some cases, they did not receive any feedback and in other cases, they received positive feedback. They were pleased to hear that the project was moving forward. One Heritage Oaks resident questioned the number of lots when they were seeking the map amendment. Motion by Member Tropinski, seconded by Member Iyer that in making the recommendation, the Plan Commission found that the applicant had met the requirements of the Subdivision Regulations and recommended approval of the request to approve the Dana Park Resubdivision as requested, which includes the following. 1. Section 14-6-3E to waive the requirement to construct sidewalks (previously approved in the Dana Park Subdivision) 2. Final Plat 1. This is a proposed resubdivision to create five residential lots from the current three lot Dana Park Subdivision that was approved in 2006. The construction of the Dana Park Subdivision has not been completely finished (a small Punchlist remains) and, if approved, this resubdivision will take its place. 2. Several minor drafting revisions need to be to the plat. 3. The Plat of Resubdivision will not only be a resubdivision but also a Plat of Vacation that will vacate certain detention and drainage and flood plain easements that were granted under the Dana Park Subdivision. Due to the complexities of all of these items on one drawing,the scale should be changed from 1"=30' to 1"=20'. B. Waivers and/or Variations 1. Since this is a lot reconfiguration of a recently approved subdivision, the waivers and variations of the Dana Park Subdivision will automatically apply to this resubdivision; separate applications are not necessary. 2. In determining the shape and size of blocks, existing topographic features,basic street system and traffic plan, areas designated for public and other nonresidential land use, and the minimum lot areas and dimensions required by the village zoning ordinance for the applicable zoning area shall be considered. 2. In residential subdivisions, the maximum length of blocks shall be two thousand six hundred forty(2,640) linear feet. No blocks shall be less than nine hundred (900) linear feet in length unless approved by the plan commission. In nonresidential subdivisions, maximum length of blocks shall be as approved by the plan commission. Where a subdivision borders upon or is traversed by a thoroughfare and frontage access is necessary, frontage roads (on 1 or both sides of such thoroughfare) shall be provided as needed. CB. ,Lot Design Standards: 1. Lots shall abut on a street. Flag or interior lots shall not be permitted unless after review by the village engineer,plan commission, and board of trustees, a determination is made that the land in question cannot be reasonably developed in any other way. When a flag or interior lot is permitted, the area of any such lot which is used for access shall not be construed as the front yard of said lot nor shall the access area be used to satisfy any other yard, setback or minimum lot area requirement as set forth in the zoning ordinance, and said access area shall be a minimum of twenty feet(20') in width except when the plan commission may deem additional width to be necessary. 2. Side lines of lots should be approximately at right angles to straight streets and on radial lines on curved streets. Very irregular lots should be avoided. 3. Through lots should be avoided except that in residential districts along thoroughfares, lots shall face on the interior street with a no vehicular access area along such thoroughfares. Through lots in all ORA(including O) and all business districts shall meet such special access requirements as the village board on recommendation of the plan commission may require. D4inimurn lot areas, dimensions and setback lines shall conform to the provisions of the ~� zomng ordinance for the district in which the subdivision is located within the corporate limits of the village. Lot sizes in those areas outside the corporate limits shall be in conformance with the applicable ordinances regulating lot sizes outside the corporate boundaries. t ly- 6'3 E. Sidewalks: Paved sidewalks shall be installed on both sides of each street,provided that this requirement may be waived by the village board for good cause shown by the owner. The plan commission, when making its recommendations to the village board, shall state whether or not in its opinion such requirement should be waived. Sidewalks shall have a minimum width of five feet(5') and be constructed in accordance with standard requirements of the village. F. Street Lighting System: A street lighting system shall be installed on all streets within the subdivision, designed and constructed in accordance with the lighting standards as adopted by the village, unless waived by the village board for residential subdivisions. The plan commission,when making its recommendations to the village board, shall state whether or not in its opinion such requirements should be waived or modified. 14-7-4: VARIATIONS AND AMENDMENTS: A. Variations: The plan commission may recommend variations from the requirements of this title in specific cases which, in its opinion, are in harmony with the intent and purpose of the official plan of the village and in harmony with the spirit and intent of these regulations. Such recommendations shall be communicated to the corporate authorities and,where the land affected lies outside the corporate limits, to the appropriate governing authorities of DuPage County. The village president and board of trustees may approve variations from these requirements for subdivisions within the village limits or for those where the land affected lies within one and one-half(1 1/2)miles of the limits of the village, when, in its opinion, such variations will not be contrary to the purpose or intent of the official plan and the spirit and intent of this title.
