AN ORDINANCE AMENDING SECTIONS V, VII, XI AND %IV
OF ORDINANCE G-60, AS AMENDED,
THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
DU PAGE AND COOK COUNTIES, ILLINOIS
WHEREAS, the President and Board of Trustees of the Village of Oak Brook
adopted Ordinance G-60, the Zoning Ordinance of the Village of Oak Brook, in
order to regulate and limit the height and bulk of structures; to regulate and
limit the intensity of the use of lot areas, and to regulate and determine the
areas of open space within and surrounding such structures; to classify,
regulate and restrict the location of .trades and industries and the location
of structures designed for specified industrial, business, residential and
other uses; to divide the entire Village into districts for the purpose of the
ordinance; to fix standards to which structures shall conform; to prohibit
uses or structures incompatible with the character of such districts,
`�. respectively; and to prevent additions to and alterations or remodeling of
existing structures in such a way as to avoid the restrictions and limitations
lawfully imposed thereby, and to provide penalties for violations thereof; and
WHEREAS, certain amendments to the aforesaid Zoning Ordinance have been
proposed by the Plan Commission of the Village of Oak Brook to clarify and
amend certain provisions of the aforesaid Zoning Ordinance, and
WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has
held a public hearing, pursuant to statutory notice, on the proposed
amendments and has recommended approval of said amendments by the President
and Board of Trustees.
NOW, THEREFORE, BE IT ORDAINED By THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section V(G) (3) (e) of Appendix A (Ordinance G-60) of
the Code of Ordinances of the Village of Oak Brook is hereby amended to read
as follows:
"(e) Accessory structures which are only permitted in required rear
yards shall not be constructed within the buildable area between the
principal structure and adjacent streets along the front or side lot
lines unless a setback equal to double the required front or side yard
setback is maintained from the front or side yard lot line to such
accessory structure." -

Section 3: That Section V of Appendix A (Ordinance G-60) of the Code of
Ordinances of the Village of Oak Brook is hereby amended by adding thereto a
new subsection (S) to read as follows:
"(S) Permanent Entryway Canopies.
Permanent entryway canopies to provide weather protection for persons
being dropped off or picked up may be erected in required front and
corner lot side yards for hotel, restaurant and office use buildings in
the B-4 Hotel Office District; ORA-1, 2 & 3, Office Research Assembly
Districts; and 0-3 Office District, subject to these following
conditions:
1. Only applies where the required yard is 100 feet or more in depth.
2. The area of the encroachment is limited to a maximum of 600 square
feet.
3. The maximum depth of the encroachment into the required yard is 30
feet.
4. The minimum clearance for a canopy above a driveway or parking
area shall be not less than 14.5 feet.
5. The maximum height of the canopy is 18 feet."
Section 4: That Section VII(B) (2) (d) of Appendix A (Ordinance G-60) of
the Code of Ordinances of the Village of Oak Brook is hereby amended to read
as follows:
"(d) Unilluminated "For Sale" and "For Rent" ground signs shall be
permitted in accordance with the following:
(1) One sign on a lot, except on a corner or through lot, a sign
may be erected along each street frontage.
(2) Each sign shall be not more than six (6) square feet in area
and shall be located not closer than eight (8) feet from a
side or rear lot line and not closer than one-half the depth
of the required front yard from a front lot line.
(3) Professionally designed and lettered open house directional
"For Sale" signs not exceeding six (6) square feet in
surface area per face and not exceeding four (4) feet in
overall height may be placed within the public right-of-way
under the following conditions:
i. Signs may be erected on Saturdays and Sundays only
between the hours of 9:00 a.m. and 6:00 p.m. Signs
must be removed not later than 6:00 p.m. every
`-' Saturday and every Sunday.

ii. Signs must be free-standing, not attached to any
utility pole or structure or any traffic control sign,
and placed at least three (3) feet from the curb or
edge of pavement.
iii. No attention or attracting devices such as pennants,
streamers, balloons, inflatable shapes, banners,
flashing lights or other illumination shall be
attached to an open house sign or placed in any public
right-of-way.
iv. Each sign must have attached an adhesive label or
other means to identify the name, business address and
business telephone number of the person responsible
for the placement and removal of each sign.
V. A maximum of four (4) signs for each Open House may be
placed in the public right-of-way.
vi. No sign greater than thirty (30) inches in height
shall be placed within any portion of a twenty-five
(25) foot sight triangle at the intersection of two
streets. The sight triangle. is determined by
extending the curb or edge of pavement lines to a
`— point of intersection; then measuring back along these
extended curb or edge of pavement lines for a distance
of twenty-five (25) feet to two points. A line drawn
connecting the above determined points completes a
triangle.
vii. No more than one (1) sign directing the public in any
one direction shall be placed by the same company at a
single corner of an intersection.
viii. If an owner of a lot adjacent to a right-of-way
objects to the posting of a sign in front of .his/her
property, the sign shall not be posted or shall be
immediately removed.
Section 5: That Section XI(E) of Appendix A (Ordinance G-60) of the
Code of Ordinances of the Village of Oak Brook is hereby amended by adding
thereto a new subsection (14) to read as follows:
"(14) Handicap Parking:
(a) When required, all facilities which provide parking shall
provide accessible parking. Accessible parking shall comply
with the provisions of the Illinois Accessibility Code of
the Capital Development Board, as amended, and of the
�.,. Federal Americans with Disabilities Act.

(b) Required Minimum Number of Off-Street Accessible Parking
Spaces. The required minimum number of accessible parking
spaces is set forth in Section 400.320 of the Illinois
Accessibility Code and in the Americans with Disabilities
Act (ADA) Accessibility Guidelines.
(c) Location of Parking and Passenger Loading Zones. Accessible
parking spaces for disabled and accessible passenger loading
zones that serve a particular building shall be the spaces
or zones located closest to the nearest accessible entrance
on an accessible route. In separate parking structures or
lots that do not serve a particular building, parking spaces
for disabled people shall be located on the shortest
possible circulation route to an accessible pedestrian
entrance of the parking facility.
(d) Dimensions, Marking and Signage of Accessible Parking
Spaces. Each parking space shall be at least sixteen (16)
feet wide including an eight (8) foot wide access aisle, and
adjacent parking spaces shall not -share a common access
aisle. All access aisles shall blend to a common level with
an accessible route and shall be diagonally striped.
Accessible parking spaces shall be sized, marked and signed
N-1 in accordance with Section XI(E) (3) and Exhibits A, B and C
which are set forth below.
Each parking space designated as reserved for
environmentally limited persons shall be equipped with a
sign which complies with Section 11-301 of the Illinois
Rules of the Road (Ill.Rev.Stat. 1989, Ch. 95, par. 11-301,
et seq, as amended, and meets the requirements of Sign R7-8
(U.S. Department of Transportation Standard) . The sign
shall be the Illinois standard R7-8 Reserved Parking sign
and R7-I101 $50 Fine sign (Illinois MUTCD) . (See below
Exhibits B and C for description of above referenced signs. )
Signs shall be vertically mounted on a post or a wall at
front center of the parking space, no more than five (5)
feet 0" horizontally from the front of the parking space,
and set a minimum of four (4) feet 0" from the finished
grade to the bottom of the sign.

WIDTH AND PAVEMENT MARKINGS
Effective October 1, 1992, all -parking spaces reserved for the
handicapped, except those reserving on-street parking areas,
shall be at least 16 feet wide, including an 8 foot wide access
aisle. Adjacent handicapped parking ,spaces shall not ,share a
common access aisle. All access aisles shall blend to_ a common
level with an accessible route and should be diagonally striped.

HANDICAPPED PARKING SIGN
Effective January 1. 1983. Public Act 83-1316 arhended sec. 11-301 of"The Illinois
Vehicle Code" to require Handicapped Parking Signs (for parking lots subject to"The
Illinois Vehicle Code') to compiy with the R 7-8 sign shown below (U.S.,Department
of Transportation standard). Existing signs may remain,but their useful lives shall not
be extended by other means than normal maintenance.

Section 6: That Section XIV(B) (77) of Appendix A (Ordinance G-60) of
the Code of Ordinances of the Village of Oak Brook is hereby amended to read
as follows:
11(77) Lot Area--the area of a horizontal plane bounded by lot lines.
For the purposes of meeting minimum lot area requirements, the
land area of a lot used for providing private access right-of-ways
shall not be included."
Section 7: That this ordinance shall be in full force and effect from
and after its passage, approval and publication as required by law.
Section 8: That the Village Clerk is hereby authorized and directed to
publish this ordinance in pamphlet form in the manner provided by law.
