ORDINANCE 2001- ZO -SU -S -985
AN ORDINANCE GRANTING A SPECIAL USE FOR
CONSTRUCTION OF A HOTEL
(800 -810 Jorie Boulevard, Oak Brook, IL 60523)
WHEREAS, the owners of the property at 800 -810 Jone Boulevard have applied to the Village for
a special use to permit construction of a five -story, 155 -room hotel; and
WHEREAS, the Plan Commission on November 20; 2000 recommended approval of the
requested special use subject to certain conditions; and
WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the
Village of Oak Brook on December 5, 2000 pursuant to due and appropriate legal notice; and
WHEREAS, the Zoning Board of Appeals recommended approval of the requested Special Use
subject to certain conditions, and
WHEREAS, the President and Board of Trustees have reviewed the recommendations of,the
Zoning Board of Appeals and Plan Commission and deem the passage of this Ordinance to be in the best
interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions set
forth below:
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows.
Section 1 - That the provisions of the preamble hereinabove set forth are hereby adopted a
though fully set forth herein.

Section 2: That a special use, pursuant to Section 13 -14 -9 of the Village Code of the Village of
Oak Brook, is granted to permit the construction of a five -story, 155 -room hotel at the property commonly
known as 800 -810 Jorie Boulevard, which property is legally described as follows:
Parcel 1: LOT 1 in Chicago Bridge & Iron Company Subdivision, being a resubdivison of Lot 1 of the
Chicago Bridge & Iron Company Assessment Plat and Lot 1 of the Armour Company Assessment Plat, in
the Northeast Quarter of Section 26, Township 39 North, Range 11, East of the Third Principal Meridian,
According to the Plat of said Chicago Bridge & Iron Company Subdivision recorded July 12, 1976 as
Document Number R76- 45791, in DuPage County, Illinois.
Parcel 2: Easement for the benefit of Parcel One as created in Grant of Easement made by Chicago Title
and Trust Company, as Trustee under Trust Number 46940 to Chicago Bridge & Iron Company an Illinois
corporation, dated April 16, 1971 as Document R71 -17638 and Assignment of Easement recorded as
R84 -68454 for roadway purposes over a strip of land being 24 feet in width extending from the, lands of
Parcel One to Jorie Boulevard, the center line of said 24 foot strip being described as follows:
Commencing at the Northwest corner of Lot 2 in Corporate Plaza Subdivision Unit One, ; being a
subdivision of parts of Sections 25 and 26, Township 39 North, Range 11, East of the Third Principal
Meridian , according to the plat thereof recorded October 14, 1970 as Document R70- 373111,, thence
easterly along the North line of said Lot 2 a distance of 38 feet to the point of beginning of said center line;

thence South 32 degrees 32 minutes 46 seconds East a distance of 255 feet, thence South 20 degrees 06
minutes 50 seconds East to a point of termination of said center line of the South line of Lot 2 in Corporate
Plaza Subdivision Unit One, aforesaid, all in DuPage County, Illinois.
Parcel 3 Easement for the benefit of Parcel 1 for ingress and egress as created by grant recorded as
document R61 -7011 and R61 -9993 and reservation contained in deed record as document R96- 190558
recorded in DuPage County, Illinois

Section 3- That the special use permit herein granted pursuant to Section 2 of this Ordinance is
expressly subject to compliance with the following conditions and allowances*
That the five -story, 155 -room hotel shall be constructed in substantial conformity with the
Site Plan labelled Sheet A -IS drawn by Linden Group, Inc. as last revised January 9,
2001, and Sheets A -1 (Floor Plans) as last revised October 1, 2000; A -2 (Elevations) as
last revised October 1, 2000, A -4 (Rear Elevation) as last revised October 1, 2000; and A-
4S (Landscape Plan) as last revised November 9, 2000, all drawn by Linden Group, Inc.
and incorporated herein by reference
2. That pursuant to the foregoing Site Plan (Sheet A -IS), the following allowances are
permitted:
a) allowance to permit the elimination of the required loading berth (a specific
loading area is designated on the Site Plan);
b) allowance from the required 10 -foot setback to permit parking at the common lot
line with the adjacent Nicor property;
C) allowance to permit parking spaces in the front yard (Jorie Boulevard side);
d) allowance to eliminate the required parking lot landscaping along the Nicor
common lot line;
e) allowance to permit a floor -area ratio of 456 instead of 450; and
f) allowance to permit required parking on an adjacent parcel not owned by the
owner of the property containing the principal building
3 That construction of the proposed project is subject to final approval by the Village
Engineer.
4 That construction of the proposed project is subject to the Village Attorney's review of a
recorded easement between the owner of the special use property and the adjacent Nicor
property permitting use of the Nicor property for hotel patrons and visitors
Section 4 That this ordinance shall be in full force and effect from and after passage and
approval pursuant to law.
