AN ORDINANCE AMENDING SECTION XI
OF THE ZONING ORDINANCE
OF THE VILLAGE OF OAK BROOK, ORDINANCE G-60, AS AMENDED
WHEREAS, an application has heretofore been filed with the Village of
Oak Brook requesting a text amendment to the Zoning Ordinance of the Village
of Oak Brook relative to permitting a driveway configuration to allow for
three lanes of traffic; and
WHEREAS, the Plan Commission of the Village of Oak Brook has submitted
its report on the subject petition to the Zoning Board of Appeals and the
President and Board of Trustees and has recommended the approval of the
proposed zoning amendment regarding driveway design; and
WHEREAS, a public hearing on the application was conducted on August 2,
1994 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to
due and appropriate legal notice; and
WHEREAS, a recommendation has been made by the said Zoning Board of
Appeals that the proposed zoning amendment be approved; and
WHEREAS, the President and Board of Trustees have reviewed these
�- recommendations and concur with the recommendations and deem the passage of
this ordinance to be in the best interest and in furtherance of the general
welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth
are hereby adopted as though fully set forth herein.
Section 2: That Section XI(E) (4) (a) (2) (iii) of the Oak Brook Zoning
Ordinance, Ordinance G-60, as amended, be and is hereby amended to read as
follows:
11(a) (2) (iii) Not less than:
1. 24 feet wide or more than 38 feet wide for a two-way
driveway (two lanes out and one lane in) without a
median; or
2. 24 feet wide or more than 44 feet wide for a
two-way driveway (two lanes out and one lane in)
with a median,
serving more than 20 parking spaces or two or more loading
berths."

AN ORDINANCE APPROVING THIRD AMENDMENT TO ORDINANCE S-301
AND GRANTING AN AMENDED SPECIAL USE PERMIT
(OAK BROOK CHRISTIAN CENTER, 3100 MIDWEST ROAD)
WHEREAS, on April 23, 1974, the corporate authorities of the Village of
Oak Brook passed Ordinance S-301, which approved a special use for the
construction and operation of a "church and school of Oak Brook Centre Church"
known as Lot 1 of the Oak Brook Christian Church Subdivision hereinafter
described; and
WHEREAS, on October 26, 1976, the corporate authorities, upon the
recommendation of the Plan Commission, approved the final site plan subject to
the conditions that the existing frame building on the property be razed not
later than 24 months from the issuance of an occupancy permit and that the
site plan contain a note prohibiting overnight parking of buses; and
WHEREAS, upon the recommendation of the Plan Commission, on May 8, 1984,
the corporate authorities of the Village of Oak Brook passed Ordinance S-527
(First Amendment) which amended Ordinance S-301 by requiring construction
pursuant to a modified site plan and extending the deadline for demolition of
the existing frame house at the northeast corner of the subject property to
June 1, 1986; and
WHEREAS, pursuant to Ordinance S-606 passed on May 12, 1987 (Second
Amendment) , the corporate authorities, again extended the time period for
razing of the existing house on the subject property to no later than January
1, 1988 and reconfirmed compliance with the 1984 site plan;
WHEREAS, in its application dated April 15, 1994, the Oak Brook
Christian Center, has asked for approval of a revised site plan with a
different building configuration than the previously approved plan and
extension of the parking area into the south area of the property; and
WHEREAS, the Plan Commission on July 18, 1994 recommended approval of
the Special Use Amendment to revise the approved site plan subject to certain
conditions; and
WHEREAS, a public hearing thereon was conducted by the Zoning Board of
Appeals of the Village of Oak Brook on August 2, 1994, pursuant to due and
appropriate legal notice; and
WHEREAS, a recommendation has been made by both the said Zoning Board of
Appeals and Plan Commission that the amendment to special use be granted; and
WHEREAS, the President and Board of Trustees concur with the
recommendations of the Zoning Board of Appeals and Plan Commission and deem
the passage of this ordinance to be in the best interest and in furtherance of
the general welfare of the Village of Oak Brook, subject to the conditions and
restrictions set forth below;

Text Amendment
The Plan Commission and Zoning Board of Appeals have held the required hearings regarding
the above petition and have recommended approval subject to certain conditions.
Please review my previous memo for a brief history of the site and a more detailed description
of the petitioners request, including a site analysis (pages 10-10d of this file)
Several of the neighboring property owners immediately to the west of the site have expressed
concerns regarding the following:
1. Light spillage.
. 2. Noise and loss of privacy.
3. Security.
4. Drainage.
Also, Midwest Club's attorney was present at the first Plan Commission meeting and indicated
his concern with the same issues. The thrust of the neighbors concerns as stated by Attorney

Grossman is for the Village to require adequate berming and landscaping, control of the parking
lot lighting, and restricting the amount of parking to that which is needed.
There has been no public testimony with regard to the Text Amendment for the three-lane
driveway.
An ordinance approving the Special Use Ordinance Amendment should include the following
conditions as recommend by the Plan Commission and Zoning Board of Appeals.
1. The Phase II parking surrounding the existing residence at the southwest corner
of the site is not approved. The plans have been modified to delineate the Phase
II area. If, upon completion of the balance of the site the parking in this area is
still needed, the petitioner will request approval of a further amendment to their
Special Use.
2. The landscape plans have been modified to include a berm along the west lot lines
where the adjacent grades are approximately level.
3. All landscaping and berms are to be installed with the initial parking lot
expansion. This includes the perimeter of the Phase H area.
4. The landscaping will be maintained indefinitely. Any plantings which are not
successful or which subsequently do not survive shall be replaced.
I would suggest an additional condition as follows:
5. The existing parking lot lighting shall be adjusted to prevent light spillage off site
and to reduce as much as possible the visibility of the sources of illumination
from off-site. The existing and future lights are to be turned off when the parking
areas are not in use.
If it is your wish to approve these requests, it would be appropriate to authorize Attorney Martens
to draft the necessary ordinances for your action at your September 13, 1994 meeting.

Dear Madam.President and Board of Trustees:
On August 2, 1994, the Zoning Board of Appeals held the required public hearing for the above
petition request. By a margin of 4 to 0, a motion was passed to recommend approval of the
revised text amendment regarding driveway design (see page 26 of the petition file).
Subsequently, by a margin of 4 to 0 a motion was passed to recommend approval of the Special
Use Amendment pertaining to the approved site plan subject to the conditions listed below.
1. The site shall be developed in substantial conformance with the following plans:
a. Preliminary Site Plan drawn by Roake and Associates, Naperville, II. and
dated July 21, 1994.
b. The landscaping plan as submitted on July 28, 1994 and identified as page
27 of the petition file.
C. The Parking Lot Lighting Plan as prepared by Rudd Lighting and
identified as page 23 of this petition.
2. The parking area identified as Phase H on the above site plan is not included in
this approval. The parking provided in Phase II is.not necessary to meet the
ordinance parking requirements. If, upon completion of the balance of the site,
the actual parking needs warrant the construction of these additional spaces, the
petitioner will apply for an amendment to their site plan approval.

3. All berms and landscaping, including those adjacent to the.Phase II area, will be
constructed at the same time as the initial parking area expansion.
4. All required landscaping shall be maintained indefinitely. Any plantings which
are not successful or which subsequently do not survive, shall be replaced.
5. All parking area lighting will only be in use when the specific parking area is in
use. Lighting fixtures will be aimed to avoid spillage off site and shielded to
minimize visibility of illumination sources by adjacent property owners.
Public testimony received indicated concerns in the following areas:
1. Construction of unnecessary parking areas.
2. Property screening of parking areas through the effective use of berms and
landscaping.
3. Control of parking area lighting to eliminate spillage,minimize the visible lighting
sources, and the avoidance of unnecessary usage.
The issue of including a sunset provision requiring completion of the site plan within a specified
number of years was discussed. However, it was a consensus of the members that such a
provision was unnecessary in light of the conditions pertaining to the Phase II parking area.

Kral thanked and complimented Hawk and Durfey for helping and educating him through this
procedure.
No one in the audience spoke for or against the petitioner's request. It was noted that several
neighbors were present at this meeting.
Hawk said that he has reviewed the plans with Durfey. He does not have any problems other
than a few minor details that will be straightened out prior to recording the documents. He also
advised the Board as to the conditions set forth by the Plan Commission.
Chairman Davis advised the Board that he felt the petitioner has met the necessary standards
required to allow this variation. The variation will not in any way alter the character of the
neighborhood. The requested relief is due to the unique circumstances of this property. The
conditions are unique and are not generally applicable to other property.
Member Shah moved, seconded by Member Dosedlo to allow the square footage contained in
easement to be included in parcel resubdivision lot area calculation and thereby allow the
establishment two conforming R-3 lots. The Petitioner has satisfied the standards and findings
as required by the Zoning Ordinance.
ROLL CALL VOTE: Ayes: 4 - Dosedlo, Shah, Vescovi, and Davis.
Nays: 0 - None.
Absent: 3 - Aldini, Hasen, and Goeken Martis. Motion carried.

AMENDMENT - DRIVEWAY VARIATION OR TEXT AMENDMENT
Bill Nelson was sworn in and then gave a brief review of the petition request, the lighting plans,
and the revised landscape plan to the Board members and audience. He advised the Board that
in addressing the concerns of the neighbors, all landscaping will be planted when Phase One of
the project begins. Nelson stated they are also seeking a variation or text amendment on the
egress/ingress to allow the three-lane entrance/exit. The variation is necessary because the Village
Ordinance does not allow driveway widths to exceed 30 feet.
Hawk said that the text amendment alternative was based on a suggestion from the Village
Engineer Durfey. The parking lot area of our Ordinance needs to be looked at in this area. We
do not have three-lane driveways addressed in our Ordinance. The Plan Commission requested
that the staff review and modify the text amendment. Page 26 of the file is the revised wording
prepared with Durfey. If approved, this will allow the petitioner to redesign the driveway to
meet this requirement. The Village will also receive the added benefit of it being an available
standard for the rest of the community where similar conditions may exist. Chairman Davis
reviewed the Phase 1 parking lot and Phase 2 plan that will require additional parking. Nelson
anticipated that Phase 2 will have to take place within five years. The text amendment is for a
change of the text of Section II, E (4)(a)(2)(iii) of the Ordinance.
ZONING BOARD OF APPEALS Minutes I 304 August 2, 1994

William Grossman, the attorney representing a resident of Midwest Club, was sworn in and
requested that the Board be careful to specify what is approved and what is not. He stated that
his concern is the construction of Phase Two. His belief is that the church will have sufficient
parking to meet the code after the sanctuary is built without expanding to Phase 2.
Hawk stated that Grossman's client lives immediately adjacent to Phase 2 of the church's plan.
The Plan Commission recommendation was for the approval of the site plan with the sanctuary,
but not with the inclusion of the Phase 2 parking in the corner. It was their recommendation that
if the petitioner can show the need for the additional parking, they can come back to the Village
to request a further amendment to the site plan. All landscaping is to be installed at the beginning
of the construction and is to be maintained indefinitely. The revised plans on pages 27 & 28
reflect the revisions as requested by the Plan Commission.
Shah questioned how light spillage will be controlled. Hawk said that the design illustrated in
the plans is for low foot candle parking lot lighting fixture. It is about half of what would be
found in a typical commercial light. On the shoebox type structures neighbors will probably not
be able to see the source of illumination, which is typically where the problem is. The church
has also indicated that they will work with the Village and,if necessary, shield the existing lights
as they are made aware of problems by the neighbors.
Dosedlo questioned the combined height of the berm and plantings. Nelson said the berm will
be four to five feet high and plantings will be six to eight feet high. Vescovi questioned when
the lights will be on. Nelson answered that all the lights may be on only twice a year. Timers
will be on the lights.
Davis asked when the construction would be proposed to begin. Nelson said if not by October
of 1994, then the following spring. They are anticipating starting the sanctuary in 1997.
Grossman said that the standards set by the other communities and the case law acknowledges
that the church can do whatever they want to with the property. The church should be required
to prove the need for the additional parking spaces.
Member Dosedlo moved, seconded by Member Shah to recommend approval of the text
amendment to allow 3-lane driveway with the revised language as stated on page 26 of the
petition file.

Hawk reviewed the recommendations of the Plan Commission in regards to the landscaping:

Hawk said that after a discussion with Plan Commission Chairman Savino, perhaps they should
consider implementing a sunset provision. Ten years from now the church's needs may change.
Attorney DelPreto objected to the implementation of a sunset provision. He reasoned that the
provision would be a good idea if they were building from the inside out, but they are not. They
are building from the outside in. They are taking care of the berming, the neighbors, and the
parking and are leaving a spot in the middle for the sanctuary that is green right now. They will
have to return to the Village to build Phase 2.
Member Dosedlo moved, seconded by Member Shah to recommend approval of the revised site
plan, date stamped July 28, 1994 and marked petition file number 28; the revised landscape plan,
date stamped July 28, 1994 and marked petition file number 27; and, the lighting plan marked
petition file number 23. This is conditioned on the following conditions:
1. The Phase II parking surrounding the existing residence at the southwest corner

OAK BROOK CHRISTIAN CENTER - 3100 MIDWEST ROAD - SPECIAL USE
AMENDMENT AND DRIVEWAY VARIATION OR TEXT AMENDMENT
Bill Nelson gave a brief review of the petition request to the members and audience. Tom
Houlihan of The Brickman Group reviewed the landscape plan explaining in detail the type of
trees and vegetation to be planted. He stated that the proposal which includes a variety of
evergreen trees, shade trees, and shrubs should provide close to 100% coverage. The berm will
continue around to the west side and will be three to four feet high all around.
Hawk said that the text amendment alternative was based on a suggestion from Durfey that our
Ordinance needs to be reviewed in this area. We do not have a three-lane driveway design
covered very adequately by our Ordinance. We should have one, especially in this day and age,
and considering the size of our parking lots.

Nelson advised the members that he has had the lighting plans reviewed by a lighting engineer.
Twenty foot poles will give adequate lighting for the parking lot. The westernmost poles will
only be on a few times a year. There will be eight foot pole entrance lights. In the summer they
are usually out of the building before dark and will not need the lighting. The lights will be used
on Friday and Sunday evenings and for special occasions such as the Christmas holidays.
They have maximized the use of the parking lot and timing has become critical. Cars are now
being parked on the grass.
Chairman Savino clarified the fact that Durfey did not draft the language of the proposed text
amendment. Durfey stated that the bare minimum width on the three-lane driveway (two out/one
in) should be 12'/12'/14'. Durfey said that for future applicants the text amendment language
should allow the latitude for a median strip. This would make it 12'/12'/6'/14' (two out/median
strip/one in). He also said that the three-lane plan was a good plan. Chairman Savino questioned
whether the berm would create a problem by causing a block to the sight-line view of the traffic.
Durfey answered no, and also said that the County plans to widen Midwest Road in 1996 to four
lanes. This plan will not be effected by the planned widening.
Savino asked if anyone in the audience would like to speak for or against the petition.
1. William Grossman, identified himself as the attorney representing a resident of
Midwest Club. He said that his client's concerns were as follows: to keep out the
noise, the lighting that may bleed onto Midwest Club, and possible drainage
problems that may occur. He is also concerned that the parking lot will negatively
effect the value of their homes. Grossman said he believed the Board has a
responsibility to make sure the petitioner proves the need for the constructing the
entire parking lot.
Response: Hawk said that the petitioner has committed to install shields to
eliminate light spillage if necessary to diffuse the light source. Aktipis said they
could install adjustable lights on the west side to direct the lights down. Durfey
stated that all drainage will go into the central detention basin.
2. Carol Rademacher of 1807 Midwest Club said that she was concerned that the
plantings in the berm will be maintained. She is worried that should the
vegetation die, the dead vegetation will not be removed or that it will be removed
and not replaced.
Response: Hawk said that the Special Use Ordinance can require that the
plantings are maintained.
3. Ann Loiterman of 1806 Midwest Club requested clarification of the height of the
vegetation installed in the berm. She said that an existing 30 foot parking lot
lights shines into her son's bedroom.

Response: Houlihan said that the trees installed will be six to eight feet tall
and that the pines grow forty to fifty feet tall. Savino said that with the additional
height of the berm itself, the initial planting would be somewhere between nine
and twelve feet high to start. Nelson said that if she will contact him at the
church and point out the light, they will try to correct it.
4. Richard Rademacher said that he would like to see the use of the lights limited
to when the building is in use. He requested that the Board stipulates that all
landscaping be planted now. This will allow the vegetation to fill in and grow
before they start the phase two construction.
Response: Hawk stated that all landscaping and berming can be constructed
now if the Ordinance so stipulates.
Chairman Savino questioned Nelson on the possibility of having more services on Sunday.
Nelson said that they were at three services five years ago. In 1992 they added two services in
the new sanctuary. The new attendance has increased 50% in two years time. They will add
another service in the fall and before long will add yet another. They are currently running an
attendance of 1,000 people Sunday morning. Services last around an hour and a half,
sometimes up to two hours.
Tappin questioned the possibility of changing the existing light poles to 20 feet. Nelson said it
would have to be checked out. Aktipis said that perhaps adjustable mounts should be added to
the lights on the west side of the lot.
Chairman Savino said that if the second phase of the plan is not planned to begin for five years,
perhaps the petitioner should return when they are ready to begin. The Board will review the
plans for the second phase at that time. At that point, the Board can see how the vegetation is
coming along and maybe things will change by that time. The possibility could exist that the
church may not need more parking spaces then. Nelson said that he did not want to be placed
in a five-year time frame. Savino said they could come back whenever they were ready to
proceed with the second phase.
Member Aktipis moved, seconded by Member Mueller to recommend approval of the text
amendment for a three-lane driveway with the revised language to be developed by the Village
Attorney, the Village Engineer, and the Director of Code Enforcement.

1. The Phase II parking surrounding the existing residence at the southwest corner
of the site is not approved. The plans are to be modified to delineate the Phase
II area. If, upon completion of the balance of the site the parking in this area is
still needed, the petitioner will request approval of a further amendment to their
Special Use.
2. The plans are to be modified to include a berm along the west lot lines where the
adjacent grades are approximately level.
3. All landscaping and berming are to be installed with the initial parking lot
expansion. This includes the perimeter of the Phase H area.
4. The landscaping will be maintained indefinitely. Any plantings that are not
successful or which subsequently do not survive shall be replaced

IV. CELOZZI'S OAK BROOK SUBDMSION-LOTS 14 AND 15 ON HUNT CLUB LANE
TWO LOT RESUBDIVISION AT THE EAST END OF HUNT CLUB LANE
Christopher Edmonds introduced himself as the attorney for the petitioner. He is also the
contract purchaser of Lot #1 in this resubdivision request. The property is located on the
northwest corner of I-294 and 31st Street.
Edmonds described the existing two lots that lengthwise go east/west. The only way someone
could build on the southernmost lot would be to get an easement from the northern lot so that
they would have ingress/egress. Edmonds said that in July of 1988 the Board of Trustees
approved the subdivision under Ordinance S-764. However, the process for whatever reason was
never seen to completion. The lots are not two acre lots. Total acreage for the two lots is
3.8578. One lot can be two acres, but the other cannot. The new survey shows the Lot 1 to be
1.781 acres and Lot 2 is 2.0 acres.
Hawk stated that the variance was granted in 1988, but the owner never proceeded with it.
Edmonds said that the property was 140 square feet smaller in area than previously granted. This
is based on the development of state of the art equipment that enables the measurements taken
today to be an exact science. Hawk said that he reviewed this difference with the Village
Attorney. It was his recommendation that this 140-foot difference falls within the range of an
insignificant difference and is primarily due to more accurate survey information.

II. APPROVAL OF MINUTES
Member Mueller moved, seconded by Member Tappin, to waive the reading of the November
15, 1993 minutes, but to add reference to the Midwest Club residents objections regarding the
lighting problem and additional potential problems at the Oak Brook Christian Center parking
lot and to approve them as revised.
VOICE VOTE: All in favor. Motion passed.
Hawk reported that the Oak Brook Christian Center Special Use petition has been withdrawn.
III. OAK BROOK COURT RESUBDIVISION - 16th and Route 83 - FINAL PLAT
David Gooder introduced himself as the attorney for the petitioner, and Lee Winter, Project
Manager, Paul Hendricks, Chief Surveyor, and Chris Malloy, Civil Engineer. They are seeking
to subdivide lots 1 and 2, lot 3 is the Oak Brook Bank. The purpose for the resubdivision is to
allow for separate ownership of the land encompassing the building pad for the free standing
building to be located at the north end of the retention basin. There are no changes to the
zoning, use, layout, only minor changes to the stormwater management, new easements are
being created by the documentation submitted. The lot does not have direct connection with 16th
Street. The specifics of the lot indicated the need for increased stonmwater management which
has been incorporated into the plan submitted.

IV. OAK BROOK CHRISTIAN CENTER - SPECIAL USE

Hawk stated that John Hover brought in a petition for special use for the property that lies a

south end of the Oak Brook Christian Center property and was working under P
the property had still not been granted a special use. They were seeking a special use for it with
the addition of site plan approval for the parking expansion as the only improvement to be added
to the south end of their site. In researching this development which dates back to 1973-1974,
discovered some thing s that the members need to be aware of in dealing with this petition. `.

Formal approval for this current site plan cannot be found. All of the people involved in the
project in 1973-76, 1984 and 1987 are no longer the same people that are involved on either side
of the issue.

Some of the existing screening is deciduous around the parking lot and should have been
evergreen. Landscaping requirements should be upgraded. Complaints have been received
regarding bus parking and lighting from one of the immediate neighbors. A previous petition
for overnight bus parking was denied.
Bill Nelson stated that the parking lot will be used one day a week, on Sunday mornings. The
lights will not be on at night. The lights currently in the back parking lot are off when the lot
is not in use, except for one light on the far north side of the parking lot which is on a timer and
is on only Sunday evenings until 10:00 p.m. The lights on the side parking lot are left on until
11:00 p.m. The parking lots will not be used except for Sunday or a special occasion. Will
build a berm and/or landscape to screen the parking lot areas. Services are held on Sunday at
8:30 and 11:00 a.m. and one at 6:00 p.m.
Hawk stated that the approved plan is out of date and does not reflect reality. Right now, the
plan as currently configured and completed, meets the Village requirements as far as bulks,
i setbacks, heights, stormwater, drainage, retention, etc. The additional parking requirements meet
the setback requirements of the ordinance. It will also have to meet the stormwater and
engineering requirements of the Village. One neighbor, Mr. Randemacher lives immediately
west to the new parking area at the south end called Hawk. He felt that the screening and
landscaping along the west and south perimeter should be built now, rather than when the phase
begins, to allow the vegetation time to mature. Would also suggest that some of the existing
vegetation should be replaced and upgraded to evergreens.
Nelson stated that the original 1974 plan has been changed due to the church's no longer planning
on building a school. Phase 1 - office wing; Phase 2 - sanctuary 1600 seat; and parking lot.
With the exception of the sanctuary, everything else has been built. Within 5-7 years the
sanctuary will be built at which time the existing house will be razed. At completion of Phase
1 there will be 760 parking spaces; and will expand to 918 parking spaces. School and
swimming pool have been eliminated. Plan now includes the original phase 1 building, the
gymnasium and the sanctuary.
Members discussed lighting, screening and providing privacy for the neighbors. Illuminate the
parking lot in a way that the lighting will be lowered or deflected away from surrounding
neighbors.
Surrounding residents objecting to the plan were as follows: Dr. Gilbert Tresley, Dr. David
Loiterman, John Samatis. The objections consisted of the following: not approving a long term
site plan; short notice of the meeting; do not want to look at a parking lot from their windows;
landscaping plan is not a substitute for acres of asphalt; bought homes with a reasonable
expectation that the area would remain residential; residents being impacted by church expansion;
lighting from parking lot shining into windows of homes; increase in parking lot size will result
in more lighting which already is a problem and would only get much worse; noise level has
increased; requested that issue be tabled so more residents can attend meeting; landscaping
inadequate; project will have strong negative impact on property values and will effect traffic of
the immediate area.

Chairman Savino stated that the issue has changed and as such the matter should be continued
to give residents the opportunity to review. Notice was required for the formal hearing in front
of Zoning Board of Appeals. A church is a permitted special use in residential areas and as such
are allowed to develop the property as would any other property owner. The development must
comply with the ordinance. The revised site plan does not contain anything that is contrary to
what the ordinance allows.
Hawk stated that the special use was approved in 1984. The zoning is in place for the entire
property. The Village is only dealing with the additional site plan work and changes that may
exist on the present site plan.
Member Dudek moved, seconded by Member Aktipis to continue the Oak Brook Christian Center
petition to the January 17, 1993 Plan Commission meeting and to notify surrounding homeowners
of the continuance.
VOICE VOTE: All in favor. Motion passed.
Member Dudek moved, seconded by Member Pequet to cancel the next regular Plan Commission
meeting of December 20, 1993 due to the Christmas holidays and to reschedule all agenda items
to the following regular Plan Commission meeting of January 17, 1993.

This letter is a follow up to our discussion of Nov. 15, 1993, regarding
the back parking lot of the Oak Brook Christian Center and their intent
of building additional parking spaces. Please make this letter available to the
the Oak Brook Plan Commission, Zoning Board Of Appeals, and the
Village Board when they will be deliberating Oak Brook Christian Center's
request for "Special Use for a church parking lot."
My property boarders the Oak Brook Christian Center and is in full view
of the lot that they build two years ago. With their new lot, the Oak Brook
Christian Center has destroyed the beautiful view and the privacy that existed
before. Although the use of the lot is limited to about a two hour period
Sunday morning, the Christian Center has a tendency to park a blue and
white school bus for days and nights at a time, without moving it. They also
installed two very tall light poles , each containing three strong flood lamps.
These lights come on every evening, although there are no cars parked,
and stay on till all odd hours of the morning. These floods are not shielded
and shine into every room of our house. Although at one time, the Christian
Center had promised to have these lights out by 9:00 PM, it is my personal
experience that no one monitors them, and numerous times they have stayed
on past 4:00 AM. The question that I have is what function those lights play?
With their present application for additional parking space, I fear that these
problems will become greater and the whole area will become more commercial.
If I understand their rationale for additional parking, it is based on their Sunday
worship attendance. This past Sunday, Nov. 21 st, their back lot was only
two-thirds full.
Is it possible for the Christian Center to lower and shield the two tall
light poles, restrict the height of any future light poles, and restrict the use
of these lights ? Also, if they were to plant some small evergreen trees
along the border fence, it would shield the commercial nature of their
enterprise.

On Friday, I received a phone call from Richard and Carol Rademacher, 1807 Midwest Club
Court 18, Lot 185 in Midwest Club.
The Rademacher's are the owners of a lot that is immediately adjacent to the area subject to the
parking area expansion that is the subject of this hearing. I explained that a site plan is being
reviewed that will allow expansion of the parking area into the south area of the Oak Brook
Christian Center site and that the work will be done in phases.
The Rademacher's have requested that the parking area screening and landscaping which will be
required upon completion of all parking areas, be completed as part of the initial expansion
phase.

Following is a brief history of the Planning and Zoning activity of the Oak Brook
Christian Center.
April 1974 Ordinance S-301 approved granting a Special Use for a "church and
school" Site plan ap roval was required. This val did not me ude

October 1976 Site plan approval. As far as I can determine, this approval was based on
a "Master Site Plan" prepared by Smith and Stevens Architects, Inc.,
Oakbrook Terrace, Job Number 7667, dated September 30, 1976, sheet
number 1. This site plan approval included the conditions that the home
at the northeast corner of the site be razed no later than 24 months if-ter

removed and the prohibition of overnight bus parking remain effect.
January 1977 The Oak Brook Christian Cen_er Subdivision was approved. This
subdivision combined the property of the previous Special Use approval
(S-301) with lot 1 and 2 of th James K 'vision which lies to
the immediate south of the ori ginal pry ,(approximately acres). This
additional uron�rty is the subject of the present request. This new
subdivision identifies the entire property as Lot 1 in the Oak Brook
Christian Center Su division.
November 1983 A petition filed requesting the following:
1. lifting of the conditions requiring removal of the home at the
northeast corner and the prohibition of overnight bus parking.
2. rezoning of the entire property to the Institutional Zoning District
classification.
May 1984 Ordinance S-527 amending Ordinance S-301 approved. The r uested
rezoning to Institutional was denied.- The ordinance maintained the above

Present Petition
On October 11, 1993, a petition was filed requesting the approval of a Special Use for "church
40Eand school' for the south portion of their property (Lots 1 and 2 in-the James Korecky
ubdivision) to allow expansion o e parking lots into this area.
ased on the review of the previous activities and the above history, the Special Use request is
not necessary. The property already has Special Use for "church and school'. The scheduled
public hearing before the Zoning Board of Appeals on December 7, 1993 will not be required.
However, ordinance S-301 did require site plan approval by the Board of Trustees with review
by the Plan Commission and the Zoning Board of Appeals. No special restrictions were
stipulated, consequently the Zoning Ordinance bulk regulations regarding structures and parking
would apply.
Recommendation:
The proposed site plan meets the setback requirements. The currently proposed site plan provides
for the use of the southeast ortion of the pmperty for additional garking. The setbacks shown
are in compliance with the Zoning Ordinance. The required landscape screening and trees are
not shown, but John Hover of the Christian Center has assured me that the ordinance will be
complied with in a final plans submitted with the constriction r)erm1ts. creening o parking
areas with berms and/or evergreen plantings are required along with trees placed throughout the d
site. The ordinance contains specific details regarding both the screening and trees.

Providing required and necessary parldng is a requirement for all land uses within the Village.
This proposed parking expansion due to the location on the site will probably only be used when
overlapping services on Sunday mornings cause the parking needs to peak.
I recommend approval subject to compliance with the landscaping requirements of the Zoning
Ordinance and all other applicable Village ordinances.

AN ORDINANCE AMENDING AN ORDINANCE GRANTING A
SPECIAL USE PERMIT PURSUANT TO THE PROVISIONS OF THE ZONING ORDINANCE
OF THE VILLAGE OF OAK BROOK, ORDINANCE NO. G-60, AS AMENDED
(Oak Brook Christian Center)
WHEREAS, on April 23, 1974 the corporate authorities of the Village of Oak
Brook passed Ordinance No. S-301 which granted a special use permit for the
construction and operation of a "church and school of Oak Brook Centre Church" at
what is now known as Lot 1 of the Oak Brook Christian Church Subdivision,
commonly known as 3100 Midwest Road; subject to approval of final site and
construction plans by the appropriate Village Boards and Commissions; and
WHEREAS, on October 26, 1976, the corporate authorities upon the
recommendation of the Plan Commission, approved the final site plan subject to
certain conditions including the following:
1. The existing frame building on the property (at the Northeast
corner of the property at 31st Street and Midwest Road) be
razed not later than 24 months from the issuance of an
Occupancy Permit for Phase 1, and .
2. The site plan contain a note prohibiting overnight parking of
buses; and
WHEREAS, a No-Fault Certificate (Early Occupancy Permit) was issued to the
Church on June 2, 1978; and
WHEREAS, in its application dated November 11, 1983, the Oak Brook Christian
Center Church requested that the Village rescind the foregoing two conditions and
further that the Village rezone the subject property to the Institutional
District; and
WHEREAS, the Plan Commission at its March 19, 1984 meeting and the Zoning
Board Board of Appeals at its April 3, 1984 meeting, both recommended that the
Village Board grant a two year extension for razing the existing frame building
and further, that the Village Board deny both the request for rezoning and the
request for permission to park buses on the subject property overnight; and
WHEREAS, on April 24, 1984 the corporate authorities voted to deny the
requested rezoning and adopted by reference the Zoning Board's findings set forth
in the Zoning Board's April 3, 1984 Minutes; and
WHEREAS, the applicant has had an opportunity to present additional
testimony before the corporate authorities.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are
hereby adopted as though fully set forth herein.
Section 2: That Sections 1 and 2 of Ordinance No. 5-301 are amended to read
as follows:
Section 1: That a special use permit be and hereby is granted
for the construction and operation of a "church and school of
Oak Brook Centre Church" essentially as shown on the site plan
marked Exhibit A, and subject however, to the conditions 1)
that the existing house on the subject property (at the
Northeast corner of the subject property at 31st Street and
Midwest Road) be razed not later than June 1, 1986, 2) that
the applicant comply with all other conditions imposed at the
time the site plan was approved on October 26, 1976,
including, but not limited to the provisions against parking
buses on the subject property overnight, and 3) that the
applicant install a culvert under the driveway onto Midwest
Road, or present another alternative acceptable to the Villae
by its engineer, on or before October 1, 1984, in accordance
with the permit granted June 8, 1977.

further public hearing, may vote upon the adoption of
any proposed amendment in accordance with applica-
ble Illinois Statutes, or may refer it back to the Boards
for further consideration.
(5) Be-Applications: Any person, firm, or corporation
having been- denied an amendment to the Zoning
Ordinance respecting a specific parcel of property may
not re-apply for a like amendment on said real
property until the period of one (1) year has elapsed
since the denial of the application for amendment by
the President and Board of Trustees. (Ord. No. G137,

(J) Special Uses.
(1) Purpose: The development and execution of the zoning
ordinance is based upon the division of the Village
into districts, within any one of which the use of land
and buildings and the bulk and location of buildings
or structures, as related to the land, are essentially
uniform. It is recognized, however, that there are
special uses which, because of their unique character,
cannot be properly permitted in particular districts
without consideration, in each case, of the impact of
those uses upon neighboring lands and upon public _
need for the particular use or the particular location.
Such special uses fall into two categories:
(a) Uses operated by public agency or publicly-regu-
lated utilities, or uses traditionally affected with a
public interest.
(b) Uses entirely private in character, but of such a
nature that the operation may give rise to unique
problems with respect to their impact upon
neighboring property or public facilities such as,
but not limited to, single-family attached and
semi-detached dwellings, horizontal condomini-
ums and other residential developments. (Ord. No.
G-66, 12-19-66)

(2) Authority: Special uses shall be authorized or denied
by the Village Board in accordance with the Statutes
of the State of Illinois applicable to amendments of
this ordinance,and the regulations and conditions set
forth in this ordinance for special uses.

No application for a special use shall be acted upon by
the Village Board until after: ((
(a) A written report is prepared and forwarded to the lr
Board of Appeals and the Village Board by the
Plan Commission in a manner prescribed herein
for amendments to this ordinance, and
(b) A public hearing has been held by the Zoning
Board of Appeals, after due notice by publication �C
as provided by the applicable Statutes of the State
of Illinois for amendments and upon a report of
the Plan Commission to the Board of Trustees, if I L
such a report is made.
(3) Initiation: An application for a special use may be
made by any person, firm or corporation or by any I C
office, department, board, bureau or commission
requesting or intended to request a zoning certificate.
(4) Processing. An application for a special use, in such f

form and accompanied by such information as shall
be established from time to time by the Plan IL
Commission, shall be filed with the Village Clerk and
thereafter processed in the manner prescribed thereto-

fore for applications and amendments. Special use
applications may be processed simultaneously with
requests for amendment of this ordinance. (Ord. No.

(5) Decisions: The Village Board, upon report of the
Zoning Board of Appeals and the Plan Commission,
and without further hearing, may authorize or deny
an application for a special use in accordance with the
Statutes of the State of Illinois applicable to amend-
ments, or may refer it back to the Board of Appeals
and the Plan Commission for further consideration.

APPENDIX A—ZONING Sec.XIII
No special use shall be authorized by the Village
Board unless the special use:
(a) Is of the type described in Section XIII J-1 (a) is
deemed necessary for the public convenience at
that location. (Ord. No. G-66, 12-19-66);
(b) Is so designed, located and proposed to be
operated that the public health, safety and welfare
will be protected; and
(c) Would not cause substantial injury to the value of
other property in the neighborhood in which it is
located.
(6) Conditions. The Plan Commission and Zoning Board
of Appeals may recommend, and the Village Board
may provide, such conditions and restrictions upon
the construction, location and operation of a special
use, including, but not limited to, provisions for
off-street parldng and loading as may be deemed
necessary to promote the general objectives of this
ordinance and to minimize the injury to the value of
the property in the neighborhood.
(K) Fees.
Fees for any relief under this ordinance shall be as
otherwise established by separate ordinance. (Ord. No.
G-132, 5-25-71; Ord. No. G-289, § 2, 3-24-81)
(L) Violation, Penalty and Enforcement.
(1) Any person, firm or corporation who violates,
disobeys, omits, neglects, refuses to comply with or
who resists enforcement of any of the provisions of
this ordinance shall, upon conviction, be fined not less
than $25.00 nor more than $500.00 for each offense.
Each day that a violation is permitted to eidst shall
constitute a separate offense. `"�'
(2) The Building Inspector is hereby designated and
authorized to enforce this ordinance. However, it shall
also be the duty of all officers, citizens and employees
of the Village, particularly of all members of the police

as the principal uses and for a period of not to I
exceed the duration of such construction.
(6) Temporary construction and sales offices in
subdivisions containing 40 acres or more in
area—for a period not to exceed 90 days
following completion of such construction.
(2) Special Uses:
(a) Agricultural: Growing of farm and garden crops
and nursery stock as a principal use on a lot
provided:
(1) The lot area for commercial growing of farm
crops, truck garden produce, and nursery stock
shall be not less than 10 acres in area.
(2) The sale of such materials is not conducted
from a store, stand or other structure erected
or maintained for such purpose.
(b) Churches, chapels, temples and synagogues—on
lots not less than 300 feet in width and not less
than 2 acres in area and one additional acre for
each 240 seats in the sanctuary over 240 seats.

(c) Rear: Not less than 40 feet in depth—except that por-
tion of a rear yard abutting a residence district shall
be not less than 100 feet in depth and except that a
rear yard abutting an alley or service drive may be
reduced by 20 feet in depth.

Assembly District.
(6) Off-Street Loading and Off-Street Parking:As in Section XI
of this ordinance.,

SECTION XI. OFF-STREET LOADING
AND OFF-STREET PARSING
(A) Scope of Regulations.
The off-street loading and off-street parking provisions of this
ordinance shall apply as follows; subject to the restrictions set
forth in XIII-C:
(1) Accessory off-street loading and off-street parking facilities
shall be provided as required by the regulations of this
section for all uses and structures established in each dis-
trict after the effective date of this ordinance. However,
where a building permit has been issued prior to the effec-
tive date of this ordinance,and construction is begun within
six(6) months after such effective date and diligently pros-
ecuted to completion, parking and loading facilities in the
amounts required for the issuance of said building permit
may-be provided in lieu of any different amounts required
by this ordinance.

gross floor area, seating capacity, or other units of mea-
surement in the amount specified herein requiring parking

(3) Whenever the existing use of a structure shall hereafter be
changed to a new use,parking or loading facilities shall be
provided as required for such new use.However,if the said
structure was erected prior to the effective date of this

datory only in the amount by which the requirements for
the new use would exceed those for the existing use, if the
latter were subject to the parking and loading provisions of
this ordinance.
(B) Permissive Paiking and Loading Facilities.
Nothing in this ordinance shall be deemed to prevent the vol-
untary establishment of off-street parking and loading facilities
to serve any existing uses or structures, provided that there is
adherence to all regulations herein governing the location, de-
sign, and operation of such facilities.
(C) Damage or Destruction.
When any conforming or nonconforming use or structure which
is in existence on the effective date of this ordinance,

NOTICE TO APPLICANTS
A Variation is a zoning adjustment which permits minor changes of district requirements where individual properties are both harshly
and uniquely burdened by the strict application of the law. The power to vary is restricted and the degree of Variation is limited to
the minimum change necessary to overcome the inequality inherent in the property.
1. A Variation recognizes that the some district requirements do not affect all properties equally. Variations permit minor
changes to allow hardship properties to enjoy equal opportunities with properties similarly zoned. You must prove that your land is
affected by special circumstances or unusual conditions. These must result in uncommon hardship and unequal treatment under the
strict application of the Zoning Ordinance. Where hardship conditions extend to other properties, in general, a variation cannot be
granted. The remedy for general hardship is a change of the map or the text of the Zoning Ordinance.
2. You must rove that the combination
of the Zonis Ordinance and

you from making reasonable use of your land as permitted by your zoning district. Since zoning regulates land and not people, the

Variations must be in harmony with the intent and purposes of the Zoning Ordinance.

Dear Mr. Hawks:
Please find attached a site plan outlining the proposed future building plans and
the parking lot requirements.
First, let me tell you about the growth experienced since we opened our new
sanctuary in May of 1992. Prior to the new facility our average attendance was 550.
Now,one year later we are enjoying weekly attendance in excess of 900 an increase of
350 plus people. This translates to a 63% growth in just one year.
Our current sanctuary has a seating capacity of 843. If you use the national
average of 1.8 person per car we would be required to have 468 parking spaces. We
currently have 329 spaces or a deficient of 139 spaces. Our problem is even worse
since we are experiencing a ratio of 1.5 person per car. That dictates a need for 562
spaces.

Now for the proposed immediate and long range planning:
Immediate Plan
In 1994 we propose to expand the parking lot to include part of
the five acres adjacent to the church property. This is
currently zoned R2. Upon receiving the special use zoning,
we propose expanding our parking lot an additional 331
spaces, bringing our total to 760 or provide space for 1140
people using the ratio of 1.5. The house on this property
would remain as pastoral housing for the next 5 years.
Long Range Plan 5 to 7 years)
Build a new 1600 sanctuary seat South of our current building
in the space indicated on the site plan. At the same time we
would eliminate the house and expand the parking by an
additional 158 spaces bringing the total to 918 resulting in a
1.74 person to space ratio.
Mr. Hawks, I hope this letter provides enough clarity to support our request for the
zoning change to special use.

Oak Brook Christian Center owner of the parcel requests a change frQm R244-Special
Use.
REASON: Convert to additional parking - two phases.
PHASE I: Parking to accommodate 431 more cars. Bringing the total to 760
spaces. The house on the property would remain a pastoral residence.
PHASE H: Construct 1600 seat sanctuary and add 158 more parking spaces.
Phase II is 5-7 years in the future. This would bring the total spaces
to 918. The residence would be removed, thus making the e n t i r e
parcel a parking lot.
Oak Brook Christian is experiencing a growth rate that exceeds our current facility and
parking capabilities. The Sunday morning worship services now exceed 900 in two
services. The 11 o'clock service is consistently over 600. That is testing our current
parking capacity of 329 spaces. We figure we are running a 1.5 person per car ratio
verses the national average of 1.8 per car. Using the 1.5 ratio times our expected 11
o'clock service attendance of 700 plus, this next year we would need to add 139 spaces
immediately. Thus we are required to expand our parking capacity in the Spring of
1994 or our growth will be limited.
