G-608 - 03/10/1998 - ZONING - Ordinances ORDINANCE 98-ZO-TA-G-608 AN ORDINANCE AMENDING SECTIONS VI-A(2)AND SECTIONS VII(C),VII(D),VII(E)AND VII(F) OF ORDINANCE G-60,AS AMENDED, THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK DU PAGE AND COOK COUNTIES, ILLINOIS WHEREAS, the President and Board of Trustee of the Village of Oak Brook adopted Ordinance G- 60,the Zoning Ordinance of the Village of Oak Brook in order to regulate and limit the height and bulk of structures; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the areas of open space within and surrounding such structures; to classify, regulate and restrict the location of trades and industries, and the location of structures designed for specified industrial, business, residential and other uses; to divide the entire Village into districts for the purpose of the ordinance; to fix standards to which structures shall conform; to prohibit uses or structures incompatible with the character of such districts respectively; and to prevent additions to and alterations or remodeling of existing structures in such a way as to avoid the restrictions and limitations lawfully imposed thereby,and to provide penalties for violations thereof; and WHEREAS, certain amendment to the aforesaid Zoning Ordinance have been proposed by the Plan Commission of the Village of Oak Brook to clarify and amend certain provisions of the aforesaid Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Oak Brook has held a public hearing, pursuant to statutory notice, on the proposed amendments and has recommended approval of said amendments by the President and Board of Trustees. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section VI-A(2)of the Code of Ordinances of the Village of Oak Brook be hereby amended to include subsection Q)which subsection shall read as follows: Winter sports—ice skating rinks, ice hockey, curling, skiing or tobogganing—not less than twenty-five (25)acres." Section 3: That Section VII(C)(2) of the Code of Ordinances of the Village of Oak Brook be hereby amended to read as follows: "(2) Special Uses: (a) Agricultural--growing of farm and garden crops and nursery stock as a principal use on a lot provided: (1) The lot area for commercial growing of farm crops, truck garden produce, and nursery stock shall be not less than ten (10) acres in area. (2) The sale of such materials is not conducted from a store, stand or other structure erected or maintained for such purpose. (b) Churches, chapels, temples and synagogues—on lots not less than three hundred j I I Ordinance 98-ZO-TA-G-608 Amending Sections VI-A(2), VII(C),VII(D), VII(E)and VII(F) of the Zoning Ordinance Page 2 feet(300') in width and not less than two(2)acres in area and one additional acre for each two hundred forty (240)seats in the sanctuary over two hundred forty (240)seats. Where churches and parochial schools are on the same land—not less than eight(8)acres in area. (c) Outdoor and indoor cultural and recreational facilities including, but not limited to, swimming pools, tennis courts, meeting facilities and other similar facilities accessory to and owned in common by the owners of properties within a residential subdivision. (d) The following recreational and cultural uses, public or private, provided the site meets the minimum area requirements hereinafter stipulated: (1) Golf courses and clubs, standard or par 3--when operated only during daylight hours, but not including commercially operated miniature courses or golf driving ranges–not less than twenty five(25)acres. (e) Public utility, transportation, and governmental service facilities, including municipal offices and civic centers, public libraries, police and fire stations, public works facilities and similar uses. (f) Accessory Uses: Accessory uses, customarily incidental to the above special uses—including but not limited to the following: Agricultural, recreational and cultural uses; (1) Club houses and lodges–containing customary facilities incidental to the operation of the principal recreational use including but not limited to restaurants, cocktail lounges and shops primarily for the sale and service of equipment and other commodities related to participation in the recreational facilities on the premises on lots not less than two(2)acres in area, and provided further that the restriction relating to operation only during daylight hours does not apply to the accessory uses. (2) Horse stables, kennels and other similar structures—for keeping and shelter of livestock, other animals, poultry and game—and accessory structures, provided that such structures shall be located: a) not less than one hundred fifty feet(150')from a street; b) not less than one hundred feet(100')from a structure on the same lot intended for occupancy as a dwelling; c) not less than one hundred feet(100')from a residence district line; d) not less than seventy feet(70')from a non-residence district line; and e)on lots not less than ten (10)acres in area. Section 4: That Section VII(D)(2)of the Code of Ordinances of the Village of Oak Brook be hereby amended to read as follows: "(2) Special Uses: As in the R1 Single-Family Detached Residence District." i Section : That Section VII(E)(2)(a)of the Code of Ordinances of the Village of Oak Brook be hereby amended to read as follows: Ordinance 98-ZO-TA-G-608 Amending Sections VI-A(2), VII(C),VII(D),VII(E)and VII(F) of the Zoning Ordinance Page 3 "(a) As in the R-1 Single-family Detached Residence District; and" Section 6: That Section VII(F)(2)of the Code of Ordinances of the Village of Oak Brook be hereby amended as follows: Amend subsection (a)to read as follows: "(a) As in the R1 Single-family Detached Residence District; and" Delete Section VII(F)(2)(b). Reletter Section VII(F)(2)(c)as Section VII(F)(2)(b). Section 7: That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Section 8: That the Village Clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law. PASSED THIS 10th day of March, 1998.
