S-1150 - 03/14/2006 - ZONING - OrdinancesORDINANCE 2006- ZO- SU -EXI -S -1150 AN ORDINANCE FURTHER AMENDING ORDINANCE S -841 GRANTING AN AMENDED SPECIAL USE PERMIT (Forest Preserve District of DuPage County, 1717 Oak Brook Road, Oak Brook, IL 60523) (Part of 06 -34- 200 -015) WHEREAS, the Forest Preserve District of DuPage County (District) has applied to the Village for an amendment to a special use originally granted by Ordinance 5 -841, which approved a special use for the property commonly known as 1717 Oak Brook Road for use as a historic facility, and WHEREAS, Ordinance S -841 has been amended by Ordinances S -893, S -926, S -960, S -986, S- 1007 and S -1015, and WHEREAS, the District, in this amendment now under consideration, has requested that the area of the special use be expanded to allow for the inclusion of the entire Retreat Wing (now known as the Learning Institute), the formal garden and surrounding grounds Included in this request are the following site improvements • Construction of staff offices and artifact storage areas in the Learning Institute, • Construction of a gift shop, tea room and multi- purpose auditorium in the Learning Center, • Construction of a production kitchen for caterers to provide meals onsite, • Construction of the formal garden based upon the original landscape plans, and • Continued improvements to the quality of the historic garden, woodlands, wetlands and lake areas, and WHEREAS, the Plan Commission on December 19, 2005, recommended approval of the requested amendment to the special use as amended, and WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on February 7, 2006, pursuant to due and appropriate legal notice, and WHEREAS, a recommendation has been made by both the said Zoning Board of Appeals and Plan Commission that the amendment to special use as amended be granted, and WHEREAS, the President and Board of Trustees concur with the recommendations of the Zoning Board of Appeals and Plan Commission and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions set forth below 1 Development to be in accordance with the plans as submitted on pages M and N of the case file, provided that the Applicant shall meet all Village requirements at the time of building permit except that specifically varied or waived, 2 Subject to the development and approval of a landscape plan to plan additional conifers and natural screening along the west side of the parking lot with implementation to begin in 2006 as requested by the Trinity Lakes Homeowners Association to provide proper screening between the parking lots and the Peabody Mansion from homes in Trinity Lakes, and 3 All other provisions of Ordinances S -841 and S -1015 remain in full force and effect NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein Ordinance 2006- ZO- SU -EX1 -S -1150 Amending S -841, Granting an Amended Special Use Permit, Forest Preserve District, 1717 Oak Brook Rd ,06 -34- 200 -015 Page 2 of 3 Section 2 That the special use granted pursuant to Ordinance S -841 is hereby further amended to allow for the inclusion of the entire Retreat Wing (now known as the Learning Institute), the formal garden and surrounding grounds and the above -
