AN ORDINANCE PROPOSING APPROVAL OF A REDEVELOPMENT
PLAN AND PROJECT FOR AND DESIGNATING THE OAK BROOK
PROMENADE REDEVELOPMENT PROJECT AREA, ADOPTING TAX
INCREMENT ALLOCATION FINANCING THEREFORE, CREATING
AN INTERESTED PARTIES REGISTRY, CONVENING A JOINT
REVIEW BOARD AND CALLING A 'PUBLIC HEARING IN
CONNECTION THEREWITH
Whereas, pursuant to the Tax Increment Allocation Redevelopment Act, as supplemented and
amended (the "TIF Act "), the President and Board of Trustees (the "Corporate Authorities ") of the Village
of Oak Brook, DuPage County, Illinois (the "Village "), have heretofore caused an eligibility study (the
"Report ") to be conducted to determine whether an area within the Village legally described as set forth
on Exhibit A attached hereto (the "Redevelopment Project Area ") qualifies as a "redevelopment project
area" under the TIF Act; and
Whereas, the Corporate Authorities have heretofore and it hereby expressly is determined that it
is desirable and necessary that the Village approve a redevelopment plan (the "Redevelopment Plan ")
and project (the "Project ") for and designate the Oak Brook Promenade Redevelopment Project Area and
adopt tax increment allocation financing for the Redevelopment Project Area; and
Whereas, pursuant to Section 11- 74.4 -4.2 of the TIF Act the Village is required to create an
interested parties registry for activities related to the Redevelopment Project Area, to adopt reasonable
registration rules, and to prescribe requisite registration forms for residents and organizations active
within the Village that seek to be placed on said interested parties registry, and the Corporate Authorities
have heretofore, and it hereby expressly is, determined that it is desirable and necessary that the Village
create such registry, adopt such registration rules and prescribe such requisite registration forms and give
public notice thereof; and
Whereas, the Corporate Authorities have heretofore, and it hereby expressly is, found and
determined that the Redevelopment Plan and Project will not result in the displacement of residents from
10 or more inhabited residential units; and
Whereas, the TIF Act requires the Village also to convene a joint review board and conduct a
public hearing prior to the adoption of an ordinance approving the Redevelopment Plan and Project,
designating the Redevelopment Project Area and adopting tax increment allocation financing therefor at
which hearing any interested person or affected taxing district may file with the Village Clerk written
objections to and may be heard orally with respect to the proposed Redevelopment Plan and Project,
Redevelopment Project Area and use of tax increment allocation financing; and
Whereas, the TIF Act further requires that such joint review board consist of a representative
selected by each community college district, local elementary school district and high school district or
each local community unit school district, park district, library district, township, fire protection district and
county that will have authority to directly levy taxes on the property within the Redevelopment Project
Area at the time that the proposed Redevelopment Plan and Project is approved, a representative
selected by the Village and a public member to consider the subject matter of the public hearing; and
Whereas, the TIF Act further requires that the time and place of such public hearing be fixed by
ordinance or resolution adopted by the Corporate Authorities; and

Whereas, the TIF Act further requires that not less than 10 days prior to adopting such ordinance
or resolution fixing the time and place of a public hearing, the Village must make available for public
inspection the proposed Redevelopment Plan; and
Whereas, the firm of Camiros, Inc., has prepared the Report and the Redevelopment Plan, which
have been presented to the Corporate Authorities and are now and have been for not less than 10 days
on file in the official files and records of the Village and available for public inspection; and
Whereas, the TIF Act further requires that the Village make a good faith effort to determine all
residential addresses that are outside the boundaries of the Redevelopment Project Area as proposed
but within 750 feet of said boundaries (being, collectively, the "Residential Addresses "); and
Whereas, the TIF Act requires that notice of the availability of the Report and the Redevelopment
Plan, including how to obtain the Report and the Redevelopment Plan, be mailed to the Residential
Addresses within a reasonable time after the adoption of this Ordinance; and
Whereas, the TIF Act requires that notice of the public hearing be given by publication and
mailing; and
Whereas, the Corporate Authorities have heretofore and it hereby is determined that it is
advisable to convene a joint review board and hold a public hearing to consider the proposed
Redevelopment Plan and Project, the designation of the Redevelopment Project Area and the adoption of
tax increment allocation financing therefor; and
Whereas, the Village expects to incur certain planning and other costs (the "Preliminary
Expenditures ") that will constitute "redevelopment project costs" as defined in the TIF Act, all of which
costs are consistent with the program for accomplishing the objectives of the Redevelopment Plan as
proposed and as included therein; and
Whereas, the Preliminary Expenditures will be included in the Redevelopment Plan and Project;
and
Whereas, the Corporate Authorities have heretofore, and it hereby is, determined that it is
necessary and desirable to approve the Preliminary Expenditures by ordinance or resolution.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1. Approval of Redevelopment Plan and Project, Designation of Redevelopment
Project Area and Adoption of Tax Increment Allocation Financing Proposed. The approval of the
Redevelopment Plan and Project as set forth in the Report, the designation of the Redevelopment Project
Area, and the adoption of tax increment allocation financing therefor are hereby proposed.
Section 2. Interested Persons Registry Created. There is hereby created an interested
persons registry (the "Registry ") for the Redevelopment Project Area. The Village Clerk is hereby
expressly authorized and directed to maintain the Registry for the Redevelopment Project Area.
Section 3. Registration Rules and Forms. The registration rules for the Registry attached
hereto as Exhibit B are hereby incorporated herein by this reference and are hereby expressly approved.
Section 4 Publication of Notice of Availability of Registry Authorized. Notice of the availability
of the Registry, substantially in the form attached hereto as Exhibit C (the "Registry Notice "), shall be
published not more than 45 nor less than 30 days prior to the Hearing, in the Daily Herald, being a
newspaper of general circulation within the Village.

Section 5. Joint Review Board Convened. A joint review board as set forth in the TIF Act (the
"Joint Review Board ") is hereby convened and the Joint Review Board shall meet, review such
documents and issue such report as set forth in the TIF Act. The first meeting of the Joint Review Board
shall be held, at 10:00 A.M. on the 4th day of April, 2005, at the Village Hall, 1200 Oak Brook Road, Oak
Brook, Illinois. The Village hereby expressly finds and determines that said date is at least 14 days and
not more than 28 days after the notice to affected taxing districts hereinafter authorized in Section 8 of
this Ordinance will be mailed.
Section 6. Time and Place of Public Hearing Fixed. A public hearing (the "Hearing ") shall be
held by the President and Board of Trustees of the Village at 7.30 o'clock P.M. on the 26thth day of April,
2005, at the Village Hall, 1200 Oak Brook Road, Oak Brook, Illinois, for the purpose of hearing from any
interested persons or affected taxing districts regarding the proposed Redevelopment Plan and Project,
the designation of the Redevelopment Project Area, and the adoption of tax increment allocation
financing therefor.
Section 7 Publication of Notice of Hearing and Convening of Joint Review Board Authorized.
Notice of the Hearing and the convening of the Joint Review Board, substantially in the form attached
hereto as Exhibit D (the "Notice "), shall be published at least twice, the first publication to be not more
than 30 nor less than 10 days prior to the Hearing, in the Daily Herald, being a newspaper of general
circulation. within the taxing districts having property in the Redevelopment Project Area.
Section 8. Mailing of Notice of Hearing and of Convening of Joint Review Board Authorized.
(a) The Notice shall be mailed by certified mail not less than 10 days prior to the date set for the Hearing,
addressed to the person or persons in whose name the general taxes for the last preceding year were
paid on each lot, block, tract or parcel of land lying within the Redevelopment Project Area. In the event
taxes for the last preceding year were not paid, the Notice shall also be sent to the persons last listed on
the tax rolls within the preceding three years as the owners of such property.
(b) The Notice shall also be mailed within a reasonable time after the adoption of this
Ordinance by first class mail to all residents within the postal zip code area or areas contained in whole or
in part within the Redevelopment Project Area or organizations that operate in the Village that have
registered with the Village for that information in accordance with the registration guidelines herein
established by the Village.
(c) The Notice shall also be mailed by certified mail to all taxing districts of which taxable
property is included in the Redevelopment Project Area and to the Illinois Department of Commerce and
Community Affairs not less than 45 days prior to the Hearing, and such Notice (i) shall advise the taxing
bodies represented on the Joint Review Board of the time and place of the first meeting of the Joint
Review Board and (ii) shall also include an invitation to each taxing district and the Illinois Department of
Commerce and Community Affairs to submit written comments prior to the date of the Hearing to the
Village, to the attention of the Village Clerk, Village Hall, 1200 Oak Brook Road, Oak Brook, Illinois,
concerning the subject matter of the Hearing. Each such mailed Notice shall include the name of an
appropriate person to contact for additional information and a copy of the proposed Redevelopment Plan
and Project.
Section 9 Notice to Residential Addresses Authorized. Notice of the availability of the Report
and the proposed Redevelopment Plan, including how to obtain this information, shall be provided by mail
within a reasonable time after the adoption of this Ordinance to all residential addresses that, after a good
faith effort, the Village determines are located outside the boundaries of the Redevelopment Project Area
as proposed which are within 750 feet of the boundaries of the Redevelopment Project Area as proposed.
Section 10. Preliminary Expenditures Approved. The Preliminary Expenditures as set forth in
Exhibit E attached hereto and incorporated herein by this reference are hereby approved.

Section 11. Superseder; Effective Date. All ordinances, resolutions, motions or orders in
conflict with the provisions of the Ordinance are, to the extent of such conflict, hereby repealed. This
Ordinance shall become immediately effective upon its adoption and approval.

Interested Parties Registration Rules
A. Definitions: The following words and terms as used in these Registration Rules shall have
the following meanings:
"Act" means the Tax Increment Allocation Redevelopment Act, as amended (65 ILCS
§ 5/11- 74.4 -1 et seq.)
"Interested Party(s)" means (a) any organization(s) active within the Village (b) any
resident(s) of the Village, and (c) any other entity or person otherwise entitled under the Act to
register in a specific Registry who has registered in such Registry and whose registration has not
been terminated in accordance with these Registration Rules.
"Redevelopment Project Area" means a redevelopment project area that (a) is intended
to qualify (or has subsequently qualified) as a "redevelopment project area" under the Act and
(ii) is subject to the "interested parties" registry requirements of the Act.
"Registration Form" means the form appended to these Registration Rules or such
revised form as may be approved by the Village consistent with the requirements of the Act.
"Registry" or "Registries" means each interested parties registry established by the
Village pursuant to Section § 11- 74.4 -4.2 of the Act for a Redevelopment Project Area.
"Village" means the Village of DuPage County, Illinois.
B. Establishment of Registry: The Village shall establish a separate Registry for each
Redevelopment Project Area within the Village, whether existing as of the date of the adoption of these
Rules or hereafter designated The Village shall establish a new Registry whenever it has identified an
area for study and possible designation as a Redevelopment Project Area. In any event the process of
establishing each new Registry must be completed prior to the deadline for sending any of the notices
required by Section (J) of these rules or any other notices required by the Act with respect to a proposed
Redevelopment Project Area.
C. Maintenance of Registry: The Registries shall be maintained by the Village Clerk (the
Village Clerk, or his or her designee. In the event the Village determines that a designee other than the
Village Clerk should maintain the Registries, the Village Clerk may transfer the responsibility for
maintaining the Registries to such other designee provided that the Village (i) gives prior written notice by
first class mail to all Interested Parties not less than thirty (30) days prior to such transfer and
(ii) publishes notice of such transfer in a newspaper of general circulation within the taxing districts
affected by the respective Redevelopment Project Area.
D. Registration by Residents: An individual seeking to register as an Interested Person with
respect to a Redevelopment Project Area must complete and submit a Registration Form to the Village
Clerk. Such individual must also submit a copy of a current driver's license, lease, utility bill, voter's
registration card, financial statement or such other evidence as may be acceptable to the Village Clerk to
establish the individual's current permanent residency.
E. Registration by Organizations: An organization seeking to register as an Interested Person
with respect to a Redevelopment Project Area must complete and submit a Registration Form to the
Village Clerk. Such organization must also submit a copy of a one -page statement describing the
organization's current operations in the Village.
F. Determination of Eligibility: All individuals and organizations whose Registration Form
and supporting documentation complies with these Registration Rules shall be registered in the
applicable Registry within ten (10) business days of the Village Clerk's receipt of all such documents.
The Village Clerk shall provide written notice by first class mail to the registrant confirming such
registration. Upon registration Interested Parties shall be entitled to receive all notices and documents
required to be delivered under these Rules or as otherwise required under the Act with respect to the
applicable Redevelopment Project Area If the Village Clerk determines that a registrant's Registration
Form and /or supporting documentation is incomplete or does not comply with these Registration Rules,
the Village Clerk shall give written notice by first class mail to the registrant specifying the defect(s). The
registrant shall be entitled to correct any defects and resubmit a new Registration Form and supporting
documentation.
G. Renewal and Termination: An Interested Person's registration shall remain effective for a
period of three years. At any time after such three year period the Village Clerk may provide written
notice by first class mail to the Interested Person stating that such registration shall terminate unless the
Interested Person renews such registration within thirty (30) days of the Village Clerk's mailing of written
notice. To renew such registration, the Interested Person shall, within such thirty (30) day period,
complete and submit the same Registration Form and supporting documentation then required of initial
registrants in order to permit the Village Clerk to confirm such person's residency or such organization's
operations in the Village. The registration of all individuals and organizations whose Registration Form
and supporting documentation is submitted in a timely manner and complies with these Regulation Rules
shall be renewed for an additional, consecutive three year period. If the Village Clerk determines that a
registrant's renewal Registration Form and /or supporting documentation is incomplete or does not comply
with these Registration Rules, the Village Clerk shall give written notice by first class mail to the registrant
at the address specified in the renewal Registration Form submitted by such registrant specifying the
defect(s). The registrant shall be entitled to correct any defects and resubmit a new Registration Form
and supporting documentation within thirty (30) days of receipt of the Village Clerk's notice. If all defects
are not corrected within thirty (30) days of the Interested Person's receipt of the Village Clerk's notice, the
Interested Person's registration shall be terminated. Any Interested Person whose registration is
terminated shall be entitled to register again as if a first -time registrant.
H. Amendment to Registration: An Interested Party may amend its registration by giving
written notice to the Village Clerk by certified mail of any of the following: (i) a change in address for
notice purposes; (ii) in the case of organizations, a change in the name of the contact person; and (iii) a
termination of registration. Upon receipt of such notice, the Village Clerk shall revise the applicable
Registry accordingly.
I. Registries Available for Public Inspection: Each Registry shall be available for public
inspection during normal Village business hours. The Registry shall include the name, address and
telephone number of each Interested Person and for organizations, the name and phone number of a
designated contact person.
J. Notices to be Sent to Interested Parties: Interested Parties shall be sent the following
notices and any other notices required under the Act with respect to the applicable Redevelopment
Project Area:
(i) pursuant to section §74- 4 -5(a) of the Act, notice of the availability of a proposed
redevelopment plan and any related eligibility report, including how to obtain such proposed
redevelopment plan and any related eligibility report, shall be sent by first class mail within a
reasonable period of time after the adoption of an ordinance fixing the public hearing for a
proposed redevelopment plan;
(ii) pursuant to section § 74- 4.5(a) of the Act, notice of changes to proposed
redevelopment plans that do not (1) add additional parcels of property to a proposed
Redevelopment Project Area, (2) substantially affect the general land uses proposed in the
redevelopment plan, (3) substantially change the nature of or extend the life of the redevelopment '
project, or (4) increase the number of low or very low income households to be displaced from a
Redevelopment Project Area, provided that measured from the time of creation of the
Redevelopment Project Area the total displacement of households will exceed 10, shall be sent
by first class mail not later than ten (10) days following the Village's adoption by ordinance of any
such changes.
(iii) pursuant to section § 74 -4 -5 (c) of the Act, notice of amendments to previously
approved redevelopment plans that do not: (1) add additional parcels of property to a
Redevelopment Project Area, (2) substantially affect the general land uses in the redevelopment
plan, (3) substantially change the nature of the redevelopment project, (4) increase the total
estimated redevelopment project costs set out in the redevelopment plan by more than 5% after
adjustment for inflation from the date the plan was adopted, (5) add additional redevelopment
project costs to the itemized list of redevelopment project costs set out in the redevelopment plan
or (6) increase the number of low or very low income households to be displaced from a
Redevelopment Project Area, provided that measured from the time of creation of a
Redevelopment Project Area the total displacement of households will exceed 10, shall be sent
by first class mail not later than 10 days following the Village's adoption by ordinance of any such
amendment.
(iv) pursuant to section § 74.4- 5(d)(9) of the Act for redevelopment plans or projects
that would result in the displacement of residents from 10 or more inhabited residential units or
that contain 75 or more inhabited residential units, notice of the availability of the annual report
described by sub - section § 74.4 -5(d), including how to obtain such annual report, shall be sent by
first class mail within a reasonable period of time after completion of the certified audit report.

(v) pursuant to section § 74.4 -6(e) of the Act, notice of any preliminary public
meeting required under the Act for a proposed Redevelopment Project Area that will result in the
displacement of 10 or more inhabited residential units or which will contain 75 or more inhabited
residential units shall be sent by certified mail not less than -15 days before the date of such
preliminary public meeting.
K. Non Interference: These Registration Rules shall not be used to prohibit or otherwise
interfere with the ability of eligible organizations and individuals to register for receipt of information to
which they are entitled under the Act.
L. Amendment of Registration Rules: These Registration Rules may be amended by the
Village subject to and consistent with the requirements of the Act.

TAX INCREMENT FINANCING REDEVELOPMENT PROJECT AREA
REGISTRATION FOR INTERESTED PARTIES REGISTRY
Pursuant to Section § 5/11- 74.4 -4.2 of the Tax Increment Allocation Redevelopment Act, 65 ILCS § 5/11-
74.4-1 et seq. (the "Act ") the Village of Oak Brook (the "Village ") is required to establish an interested
parties registry ( "Registry" or "Registries ") for each Tax Increment Financing ( "TIF ") redevelopment
project area created pursuant to the Act (a "Redevelopment Project Area ") whether existing as of the
date of this notice or hereafter established. On March 8th the Village adopted an ordinance authorizing
the establishment of Registries by the Village of Oak Brook Clerk ( "Clerk') and adopting registration rules
for such Registries. The purpose of this notice is to inform interested parties of the Registries and
registration rules for the Registries and to invite Interested Parties (as defined below) to register in the
Registry for any Redevelopment Project Area.
Any organization active within the Village and any resident of the Village (an "Interested Party ") is entitled
to register in the Registry for any Redevelopment Project Area. Organizations include, but are not limited
to, businesses, business organizations, civic groups, not - for - profit corporations and community
organizations.
An organization seeking to register as an Interested Party with respect to a Redevelopment Project Area
must also complete and submit a registration form to the Clerk. Such individual must also submit a copy

supporting documentation is incomplete or does not comply with the registration rules adopted by the
Village, the Clerk will give written notice to the registrant specifying the defects. The registrant will be
entitled to correct any defects and resubmit a new registration form and supporting documentation. An
Interested Party's registration will remain effective for a period of three years. Rules for the renewal or
amendment of an Interested Party's registration are included with the registration form that may be
obtained as described herein.
Each Registry will be available for public inspection at the office of the Clerk during normal Village
business hours. The Registry will include the name, address and telephone number of each Interested

The Project Area is located at the southwest corner of Meyer and Butterfield Roads,
bounded on the north by Butterfield Road, on the east by Meyer Road, on the south by
the 1 -88 Tollway, and the west by the ComEd substation,
There will be considered at the hearing approval of the Redevelopment Plan and Project and
designation of the Redevelopment Project Area and the adoption of tax increment allocation financing
therefore The proposed Redevelopment Plan is on file and available for public inspection at the office of
the Village Clerk at Village Hall, 1200 Oak Brook Road, Oak Brook, Illinois 60523. Pursuant to the
proposed Redevelopment Plan and Project the Village proposes to facilitate redevelopment of the
Redevelopment Project Area by incurring or reimbursing eligible redevelopment project costs, which may
include, but shall not be limited to, studies, surveys, professional fees, property assembly costs,
construction of public improvements and facilities, building and fixture rehabilitation, reconstruction,
renovation and repair, financing costs and interest costs, all as authorized under the Tax Increment
Allocation Redevelopment Act, as amended. The Redevelopment Plan and Project proposes to provide
assistance for residential and commercial facilities by paying or reimbursing costs related to site
assembly, analysis, professional services and administrative activities, public improvements and facilities,
including new streets, water and sewer improvements, street lighting, landscaping, storm water
management, and bridge improvements, the execution of one or more redevelopment agreements, and
the payment of financing and interest costs.
Prior to the date of the hearing, each taxing district having property in the proposed
Redevelopment Project Area and the Illinois Department of Commerce and Community Affairs may
submit written comments to the Village, to the attention of the Village Clerk, Village Hall, 1200 Oak Brook
Road, Oak Brook, Illinois 60523.
There is hereby convened a joint review board to consider the proposed approval of the
Redevelopment Plan and Project, designation of the Redevelopment Project Area and adoption of tax
increment allocation financing therefore. The point review board shall consist of a representative selected
by each community college district, local elementary school district and high school district or each local
community unit school district, park district, library district, township, fire protection district, and county
that will have authority to directly levy taxes on the property within the Redevelopment Project Area at the
time the proposed Redevelopment Plan and Project is approved, a representative selected by the Village,
and a public member The first meeting of said point review board shall be held at 10 A. M. on the 12th
day of April, 2005, at Village Hall, 1200 Oak Brook Road, Oak Brook, Illinois
At the hearing, all interested persons or affected taxing districts may file written objections with
the Village Clerk and may be heard orally with respect to any issues regarding the approval of the
proposed Redevelopment Plan and Project, designation of the Redevelopment Project Area, and
adoption of tax increment allocation financing therefore.
The hearing may be adjourned by the President and Board of Trustees of the Village without
further notice other than a motion to be entered upon the minutes of the hearing fixing the time and place
of the subsequent hearing.
