AN ORDINANCE APPROVING AN AMENDMENT TO A SPECIAL USE AND AMENDING
ORDINANCE S -237 WITH RESPECT THERETO

WHEREAS, on August 10, 1971, the Village Board of the Village of Oak Brook passed Ordinance
S -237, which approved a special use for the property hereinafter described for construction of a church
sanctuary and steeple, and
WHEREAS, in subsequent years, several amendments to such special use have been approved
to permit additional parking, the operation of a not - for - profit preschool, the construction of additions to the
church, various roadway and grading modifications, and the construction of a choir rehearsal room and
additional classrooms, and
WHEREAS, an application has been filed by Christ Church of Oak Brook requesting an
amendment to such special use and site plan for a building addition of approximately four thousand
(4,000) square feet, with both internal and external improvements, as follows- (i) construction of four (4)
safety exits in the church sanctuary, two (2) in the rear and two (2) in the chancel, to replace existing
exits, (ii) building of a new Oak Tree Discovery Center for children, including construction of upgraded
restrooms and more appropriate and suitable space for the infant/toddler age group programs, (iii)
construction of a new outdoor playground featuring safety upgrades; and (iv) construction of other internal
modifications to the building that are consistent with the approved special use for a church, and
WHEREAS, on February 19, 2007, the Plan Commission reviewed the request for an amendment
to such special use and site plan and recommended its approval subject to certain conditions, and
WHEREAS, on March 6, 2007, the Zoning Board of Appeals conducted a public hearing on the
request for an amendment to such special use and site plan pursuant to due and appropriate legal notice,
and recommended approval of the special use subject to certain conditions; and
WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the petitioner
satisfactorily addressed the factors required for approval of the requested amendment to such special use
and site plan, and made specific findings, including that the amendment to such special use and site plan
would be so designed, located and proposed so that the public health, safety and welfare will be
protected and there will be no substantial injury to other property in the neighborhood in which it is
located, and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and Zoning Board of Appeals and deem the amendment to such special use and
site plan, as set forth below, to be in the best interest of the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows
Section 1 The recitals above are hereby incorporated into and made a part of this ordinance
Section 2 Christ Church of Oak Brook is hereby granted an amendment to the special use
previously granted for a church sanctuary and steeple, and a new site plan is hereby approved, to allow
for a building addition of approximately four thousand (4,000) square feet, with both internal and external
improvements, as follows (i) construction of four (4) safety exits in the church sanctuary, two (2) in the
rear and two (2) in the chancel, to replace existing exits, (ii) building of a new Oak Tree Discovery Center
for children, including construction of upgraded restrooms and more appropriate and suitable space for

RECOMMENDED MOTION: I move to concur with the recommendations from the Plan
Commission and Zoning Board of Appeals and approve the requested special use
amendment for the Christ Church of Oak Brook located at 501 Oak Brook Road to permit
the construction of a 4000 square foot building addition as well as amend their site plan and
authorize the Village Attorney to draft the necessary ordinance for final consideration at the
March 27, 2007 Village Board of Trustees meeting.
Back2round/History:
The Plan Commission, at its meeting on February 19, 2007 and the Zoning Board of Appeals, at its
meeting on March 6, 2007 completed their review and deliberations on a petition from Christ Church
of Oak Brook, the owner of the property at 501 Oak Brook Road seeking approval of an amendment to
their existing special use to permit the construction of a building addition.
Specific features of this 4,000 square foot building addition are summarized by the petitioner in the
case file and are both external and internal improvements. Building modifications/improvements
outside of the current building foot-print include:
1. Construct four safety exits in the sanctuary;
2. Build the Oak Tree Discovery Center for children; and
3. Construct new outdoor playground equipment.
The other improvements relate to internal modifications to the building which are all consistent with
the approved special use for the Church.

Recommendation
The Plan Commission, by a vote of 6 to 0, and the Zoning Board of Appeals, by a vote of 4 to 0,
recommended approval of the special use amendment for Christ Church of Oak Brook to
accommodate a 4000 square foot addition to the existing church building and amends the existing site
plan, subject to the following conditions:
1. Development is to be in substantial conformance with the plans as submitted.
2. All other provisions of the existing special uses for the Christ Church property shall continue.
3. The applicant shall meet all Village ordinance requirements at the time of building permit
application except as specifically varied or waived.

Chairman Davis swore in all parties that would testify.
Walter Morrissey, Attorney for Christ Church of Oak Brook, described the

request as an amendment to the Church's existing special use to allow the
construction of an approximate 4000 square foot addition. Renditions of the
proposed addition were provided for the Zoning Boards review. The portion of
the building for the addition is located in the northeast exposure. The request
includes a replacement of the existing playground area; provide 4 new
emergency exits from the sanctuary; build an Oak Tree Discovery Center for
the children; and provide new outdoor playground equipment. There will also
be a few interior modifications including new restrooms and a toddler area.
David Melvin, Executive Director for Ministry Services said that they have
gone through a long process with their congregation to see what they should be
doing in their next capital development. The things outlined by Mr. Morrissey
are simple yet they will enhance their ministry, service to the community and
the public. The most significant change will be the Oak Tree Discovery Center
for the children, including some of the sanctuary improvements, which are
really not part of the special use. The special use permit application is touching
on the pieces, which are on the outside. There are some new exits and
relocation of some doors, which will allow for egress in case of emergency.
They have talked with the neighbors and letters of support have been provided
in the case file.
Special Use Standards
Mr. Morrissey noted that the factors had been provided in writing and had been
made part of the case file. He reviewed the special use factors as follows:
1. Is of the type described in subsection Al of this Section, is deemed
necessary for the public convenience at that location.
RESPONSE: The proposed improvements would be for the public convenience
at this location. The improvements to the existing structure will provide
additional emergency egress from the sanctuary; they are improving the area
used by the preschool and young adult education programs. They will be
providing ramps and a new playground, which will also provide a benefit for
the public convenience. The building material will be consistent with what
exists and there will be no unsightly site lines or other projections from the
building.
2. Is so designed, located and proposed to be operated that the public
health, safety and welfare will be protected;
RESPONSE: They believe the public health safety and welfare is served by the
addition of the doors and some of the interior corridors and restrooms inside
will also be a benefit. They are improving the traffic flow from a life safety
standpoint inside the structure; in particular in the infant/toddler corridor, which

is a clear benefit.
3. Would not cause substantial injury to the value of other property in
the neighborhood in which it is located.
RESPONSE: There is no detriment to the property in the neighborhood.
There are letters from neighbors and at the Plan Commission meeting,
Richard Allison, President of the Robin Hood Ranch Homeowner Association
spoke in favor of the application. Michael Macken, a neighbor from Robin
Hood Ranch, also spoke in favor of the project and appreciated the
communication from the church. The church will invest a$6 million budget for
the project, which will be available not just for the congregation, but for others
who wish to enroll in one of the programs offered.
They believe the special use standards have been met.
Chairman Davis noted that at the Plan Commission hearing the application was
unanimously supported by a vote of 6 to 0.
Mr. Morrissey noted that the Plan Commission recommendation included the
condition of final engineering approval and further recommended that they
meet all conditions of the building code.
No one in the audience spoke in support of or in opposition to the request.
Chairman Davis questioned whether the proposal changes the traffic pattern.
Mr. Morrissey responded that it would not.
Director of Community Development Kallien said that a condition that was not
stated was that all other provisions of the existing special use will continue.
Chairman Davis clarified with the applicant that this special use request will
add to the existing special use and nothing else will change. Mr. Morrissey
agreed that everything else would remain the same.
Member Bulin said that on page 17.a of the case file has specific wording that
should be included in any approved ordinance.
Mr. Morrissey responded that in their testimony they agreed that the addition
would be subject to engineering approval and comply with any conditions
required in the permit process.

Motion by Member Bulin, seconded by Member Krietsch that the applicant has
addressed and satisfied the applicable standards required to recommend
approval of the requested special use for the Christ Church of Oak Brook. This
approval will amend its existing special use to accommodate a 4000 square foot
addition to the existing church building, which will amend the existing site plan
and is subject to the following conditions:
1. Development is to be in substantial conformance with the plans as
submitted.
2. All other provisions of the existing special uses for the Christ Church of
Oak Brook property shall continue.
3. Notwithstanding the attached exhibits, the applicant shall meet all
village ordinance requirements at the time of building permit application
except as specifically varied or waived.

Member Nimry questioned the procedure for replacement of Member Shah and
whether it could be done before the election.
Director of Community Development Kallien said that appointment is made by
the Village President and accepted by the Board of Trustees. It would be
appropriate for Chairman Davis to make contact because when a member is
missing it can become difficult to have meetings.

1. The Village of Oak Brook has granted a special use and several amendments to Christ
Church of Oak Brook to develop and improve the property generally located at 501 Oak
Brook Road.
2. The Church has over the years requested modifications to their original special use to
accommodate various building and site improvements including new accesses on Oak
Brook Road and York Road, and construction of a building addition and parking lot along
the east side of the building.
3. With respect to the proposed improvement, the location and use of the new building area is
consistent with the previously approved special use as amended for the Church.
4. The proposed special use was properly noticed and no negative comments have been
received from neighboring property owners.
5. The applicant addressed all of the applicable factors required for a special use.

David Melvin, Executive Director for Ministry Services said that they are seeking an
amendment to its existing special use. The proposal includes 4 new emergency
exits, an Oak Tree Discovery Center for the children, outdoor playground
equipment, and some open space between the sanctuary and the first floor for
meeting rooms. The project is in the northeast exposure toward the intersection of
31" Street and York Road. It is currently improved with a garden and walkway; and
neighbors or passersby might see the proposed exterior improvements. They wanted
to be sure that they had good emergency exits and handicapped support. They are
providing handicapped accessibility on the doors coming into the building. They are
also planning on providing 2 more emergency doors on the front. They shared and
reviewed the proposal with the neighbors. He first called Richard Allison, President
of the Robin Hood Ranch Homeowner Association and they spent some time
together on December 1, 2006 and reviewed the project. He then advised the
neighbors in a letter of the action that the church was going to be taking with the
village and invited them to come to the church on December 10, 2006. Four
neighbors, William Misek, Arlene Birkhahn, (son, Kurt), and John Romanelli did
come to the church and they all indicated their support for the project. Copies of all
the letters that were sent to the residents have been submitted for the case file. Just
prior to this Plan Commission meeting, which was due to the extreme weather, he
stopped by and visited the neighbors that could be impacted the most; Stephanie
Loera (3109 York) and Margaret Nessel (424 Canterbury) and they also indicated
their support for the project.
Mr. Morrissey noted that the factors had been provided in writing and had been
made part of the case file. He reviewed the special use factors as follows:
1. Is of the type described in subsection Al of this Section, is deemed

RESPONSE: The improvements to the existing structure will provide additional
emergency egress from the sanctuary, which is a benefit for the public convenience.
The upgraded restrooms and the infant/toddler area is important to the project and
will also provide a public convenience and necessity.
2. Is so designed, located and proposed to be operated that the public
health, safety and welfare will be protected;
RESPONSE: The material will be compatible with the church and will be done so
that it is properly landscaped and will be operated to protect the public health, safety
and welfare.
3. Would not cause substantial injury to the value of other property in the
neighborhood in which it is located.
RESPONSE: The project will not impact the value of other property in the
neighborhood and would suggest that the $6 million budget for the project ensuring

the architectural design and compatible with the existing church structure.
Mr. Morrissey said that the church has made an effort to communicate with the
neighbors and there are no other projects currently planned for the church.
Richard Allison, 31 Robin Hood Ranch, President of the Robin Hood Ranch
Homeowners Association reminded the Plan Commission of a previous application
of the church to include 4 residential lots. In regards to this application, he met with
Reverend Melvin, toured the facility, and paid particular attention to security and
some of the decorative windows. The size of the footprint would only be marginally
enlarged. Their association acquiesces in what the church is attempting to do and
they do not have any objections.
Mike Macken, 4 Robin Hood Ranch, commented that he owns one of two properties
that adjoin the church's property. The area of the proposed project is far from their
home and he is not worried about that area being developed. He would encourage
them to develop their facility, and at that distance is fine with them.
Motion by Member Adrian, seconded by Member Saiyed to recommend approval of
the applicant's request for a special use approval for Christ Church of Oak Brook,
located at 501 Oak Brook Road. It will amend their existing special use to
accommodate a 4000 square foot addition to the existing church building and
amends the existing site plan. In making this recommendation, the Plan Commissio4
finds that:
1. The Village of Oak Brook has granted a special use and several amendments
to Christ Church of Oak Brook to develop and improve the property
generally located at 501 Oak Brook Road.
2. The Church has over the years requested modifications to their original
special use to accommodate various building and site improvements
including new accesses on Oak Brook Road and York Road, and
construction of a building addition and parking lot along the east side of the
building.
3. With respect to the proposed improvement, the location and use of the new
building area is consistent with the previously approved special use as
amended for the Church.
4. The proposed special use was properly noticed and no negative comments
have been received from neighboring property owners.
5. The applicant has addressed all of the applicable factors required for a
special use.
The approval is subject to the following conditions:

2. Build the Oak Tree Discovery Center for children; and
3. Construct new outdoor playground equipment.
The other improvements relate to internal modifications to the building
which are all consistent with the approved special use for the Church.

RESPONSIBILITIES OF HEARING BODIES:
Both the Plan Commission and the Zoning Board of Appeals have the
responsibility to make a recommendation on a request for a special use
or any amendment to an existing special use. Please include in your
consideration, your findings with respect to the standards specified in the
Zoning Ordinance for special uses. The materials submitted by the
applicant specifically address each of these standards.
CONCLUSION: If the Plan Commission and Zoning Board of Appeals are of the opinion
that the applicant has satisfied the requirements for an amendment to
their existing special use, a recommendation would be in order to

As per your request of December 19, 2006, and the Planning & Zoning policy, Phil and I have
reviewed the file you forwarded since site plan drawings and sketches were included with the
application. As we understand it, the applicant is seeking to amend the existing special use for
the Church in order to approve an approximate 4,000 square foot addition to the existing
building.
We can answer your questions as follows:
1. Is there floodplain on the subject property? Yes, some of the property near Salt
Creek is floodplain, but not within the proposed addition areas.
2. If so, would the scope of this application require any relief to the Village
Stormwater Regulations? No floodplain relief is required other than a normal permit
application.
3. Are there any Engineering Department issues that would require any conditions if
approved? Yes — restoration of all disturbed areas with permanent erosion control,
placement of temporary erosion control during construction, site plan with topography
and benchmarks, cash erosion bond, etc. —typical permit issues.
4. If approved, will an engineering review be required at time of application for
building permit? Yes, a stormwater permit is needed due to a disturbed area greater
than 2,500 square feet.
Since complete site plan drawings were not submitted, there may be other issues that will surface
when a building permit is applied for and a full and complete review is accomplished.

If any submitted drawings are used as exhibits to ordinances, a note should be added within the
ordinance to the affect that:
Notwithstanding the attached exhibits, the applicant shall meet all
Village ordinance requirements at the time of building permit application
except as specifically varied or waived.
This would prevent an applicant from forcing the Village to issue a permit based on sub-standard
items that may be depicted on the drawings (these types of drawings are usually conceptual in
nature and do not contain the detail necessary for a full review regarding building permit items).

RECOMMENDED MOTION: I move to approve waiver of the required fees for the special use
application and public hearing signs in the amount of$850.
Background/History:
I have received a request from Mr. Walter Morrissey, Attorney for Christ Church to consider waiver of
fees associated with the proposed special use amendment.
In the past, the Village has received and approved requests for waiver of fees from entities such as the
Christ Church of Oak Brook and the DuPage County Forest Preserve District.
Section 1-14-2 of the Village Code permits waiver of such fees for other governmental entities.
1-14-2: Waiver of Fees:
Any governmental unit or any charitable organization as defined in the act to regulate solicitation
and collection of funds for charitable purposes may request waiver of any fees established to this
chapter. Upon such request the Village President and Board of Trustees may, in its discretion,
waive any such fees imposed pursuant to the terms of this chapter.
The fee for the application and public hearing signs is $850. All other expenses incurred by the
Village will be billed to the applicant.

OF THE VILLAGE OF OAK BROOK RELATIVE TO WIDTH OF DRIVEWAYS
AND SPACING BETWEEN SEPARATE DRIVEWAY ENTRANCES

WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth the
Zoning Regulations for the Village of Oak Brook in Title 13 of the Village Code; and
WHEREAS, Section 13-14-6 of the Village Code sets forth the authority and standards of the
granting of variations to the Zoning Regulations; and
WHEREAS, Christ Church of Oak Brook ("Petitioner") is the owner of certain property legally
described in Exhibit A, attached hereto and made a part hereof.
WHEREAS, the Petitioner submitted a petition for a variation to allow construction of two (2) new
right in/right out driveways, one (1) on Oak Brook Road and one (1) on York Road; and
WHEREAS, on March 7, 2006 and April 4, 2006 the Zoning Board of Appeals of the Village of
Oak Brook conducted public hearings at the Oak Brook Village Hall, 1200 Oak Brook Road, Oak Brook,
Illinois in connection with the aforesaid petition, after due and appropriate legal notice was given; and
WHEREAS, the Zoning Board of Appeals specifically considered the standards set forth in
Section 13-14-6 (D)of the Village Code and found that the petitioner addressed the factors as required by
the Zoning Ordinance for approval of the variations and that the variations would be designed so that the
public health, safety and welfare will be protected and there will be no substantial injury to other property
in the neighborhood; and,
WHEREAS, the Zoning Board of Appeals recommended approval of the requested variation; and
WHEREAS, the Village Board recommended that the variations be approved; and
WHEREAS, the Village President and Board of Trustees concur with the findings and
recommendations made by the Zoning Board of Appeals as amended by their recommendation; and
WHEREAS, all applicable requirements of Section 13-14-6 of the Village Code relating to the
granting of variations to the Zoning Regulations have been met.
NOW THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of
Oak Brook, Du Page and Cook Counties, Illinois as follows:
Section 1. The recitals hereto are incorporated as part of this ordinance.
Section 2. A variation to Sections 13-12-3-E1(b) and 13-12-3-E4 of the Zoning Regulations of
Ordinance 2006-ZO-V-EX1-S-1155

Section 3. This Ordinance is limited and restricted to the property commonly known as 501 Oak
Brook Road, 3022 and 3222 York Road, Oak Brook, Illinois, P.I.N. # 06-36-100-004, 06-36-100-005; 06-
36-100-006, 06-36-107-001 and 06-36-107-002.
Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of the conflict.
Section 5. This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.

authorities of the Village of Oak Brook passed Ordinances S-346 and S-511,

AN ORDINANCE AMENDING ORDINANCE S-346 AND
GRANTING AN AMENDED SPECIAL USE PERMIT
(CHRIST CHURCH - 501 OAK BROOK ROAD)
WHEREAS, on October 28, 1975 the Corporate Authorities of the Village of
Oak Brook passed Ordinance No. S-346, which in part approved a special-use for
property hereinafter described to be utilized for vehicular parking in
conjunction with use of adjoining property for church purposes; and
WHEREAS, the owners of said property have applied to the Village for an
amendment to said special use to increase the allowable number of parking spaces
thereon due to the inadequate number of existing parking spaces; and
WHEREAS, the Plan Commission on August 15, 1983 recommended approval of the
requested amendment to special use regarding parking; and
WHEREAS, a public hearing thereon was conducted by the Zoning Board of
Appeals of the Village of Oak Brook on September 6 and September 20, 1983; and
WHEREAS, a recommendation has been made by the said Zoning Board of Appeals
and Plan Commission that the amendment to special use be granted; and
WHEREAS, the President and Board of Trustees concur with the recommendation
of the Zoning Board of Appeals and deem the passage of this ordinance to be in
the best interest and in furtherance of the general welfare of the Village of Oak
Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set_forth are
hereby opt as though fully set forth herein.
Section 2: That the special use granted pursuant to Ordinance No. S-346
be a is hereby amended to permit the construction of an additional 146 parking
spaces on property hereinafter described.
Section 3: That the amendment to the special use permit herein granted
pursuant to Section 2 of this Ordinance is expressly subject to compliance with
the following conditions.
A. That the construction of the additional parking
( spaces be in accordance with the site plan therefore
entitled, "Parking Lot Paving Additions-Christ Church
of Oak Brook, 31st and York Road, Oak Brook, 'Illinois",
Job No. 83-152 dated September 27, 1983 and prepared
by Edmund M. Burke A Associates, Ltd., Consulting
Engineers, a copy of which is attached hereto, labelled
Exhibit 01 and hereby made a part hereof.
B. The the owner of the subject property in conjunction with
the construction of the additional parking herein authorized
additionally provide landscaping adjacent to 31st Street and
internal to the parking lot in accordance with the landscape plan
prepared therefore by C. Edward Ware, Architect, Sheet LPI, Job
7427, dated as last revised September 28, 1983, a copy of which
is attached labeled Exhibit 02 and hereby made a part hereof.
Section 4: That this Ordinance is limited to property located at 501 Oak
Brook RoM, Oak Brook, Illinois which property is legally described on Exhibit ?
which is attached hereto and hereby made a part hereof. Permanent Parcel No.

CHRIST CHURCH OF OAK BROOK BY ORDINANCE NO. S-237 OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS
WHEREAS, the owner of the below described property has
petitioned the President and Board of Trustees of the Village of Oak Brook,
Du Page and Cook Counties, Illinois, for an amendment to the Special Use
Permit granted to the said property by Ordinance No. S-237; and
WHEREAS, the Zoning Board of Appeals of the Village of
Oak Brook has held a public hearing, pursuant to statutory notice, on the pro-
posed amendment to the Special Use Permit and has submitted its recommen-
dations to the President and Board of Trustees; and
WHEREAS, the Plan Commission of the Village of Oak Brook
has submitted its report on the proposed amendment to the President and
Board of Trustees; and
WHEREAS, the President and Board of Trustees deem the
• passage of this Ordinance to be in the best interest and in furtherance of the
general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Oak Brook, Du Page and Cook Counties,
Illinois, that:
SECTION 1: The provisions of the preamble hereinabove set forth are hereby
restated herein as though herein fully set forth.
SECTION'2: Section 1 of Ordinance No. S-237 of the Village of Oak Brook is
hereby amended by the addition of a second paragraph thereto which shall
read as follows:
"A Special Use Permit is hereby granted to Christ Church of Oak
Brook for the operation of a not-for-profit preschool for three
and four year old children subject to the following conditions:
1. Any play area to be provided for said preschool shall be lo-
cated in the triangular area east of the principal church
building and parallel to York Road; and
2. Any play equipment or other such items used in conjunction
.with said preschool shall be adequately sight screened with -
plant materials sufficient to conceal the image of such equipment
or items, .all to the reasonable satisfaction of the Village of Oak
Brook."
SECTION 5: All ordinances, rules, and regulations of the Village of Oak
Brook which are in conflict with the provisions of this Ordinance arc
hereby repealed to the extent of the conflict and only as they apply to the
property hereinbefore described.
SECTION 6: If any section, subsection, sentence, clause, or phrase of
this Ordinance is for any reason held to be invalid, such determination
shall not affect the'validity of any remaining portion of this Ordinance.

WHEREAS, the Butler Company, the owner of the hereinafter-
described property, has applied for a special use under Section VII D 2
and Section VII C 2 b and g and for variations of Sections V F and XI E 7
of Ordinance No. G-60, the Zoning Ordinance of the Village of Oak Brook,
DuPage County, Illinois, to permit utilization of said property for vehicular
parking, together with the adjoining property to the East owned by Christ
Church of Oak Brook; and
WHEREAS, all necessary public hearings, pursuant to proper.
legal notice, have been held; and
WHEREAS, both the Plan Commission and Zoning Board of Appeals
of the Village of Oak Brook have recommended that such special use and
variations be granted, subject to certain stated conditions; and.

SECTION 1: The provisions of the preamble hereinbefore set forth are re-
stated herein as though herein fully set forth.
SECTION 2: A special use is hereby granted to the Butler Company under the
provisions of Section VII D 2 and VII C 2 b and g and Section XIII J of Ordinance
No. G-60, the Zoning Ordinance of the Village of Oak Brook, to permit the
property hereinafter described to be utilized for vehicular parking by the
adjoining property owner to the East, Christ Church of Oak Brook, all in
accordance with that certain Site Plan prepared by C. Edward Ware, A.I.A..
Architect, Rockford, Illinois, under Job No. 7427, Sheet No. SU-5 dated
October 11, 1975, and revised October 16, 1975, a copy of which Site Plan
is annexed hereto, identified as Exhibit A, and by this reference incorporated
herein, and subject to the following conditions:
(1) The special use herein granted shall terminate upon cessation
of utilization of the subject property by the Christ Church of
Oak Brook for vehicular parking in conjunction with the use
of the adjoining property to the East owned by said Christ
Church of Oak Brook, upon which occurrence the said Christ
Church of Oak Brook shall, with reasonable promptness,
restore the subject property to its original condition as
unimproved property; provided, however, that said special
use shall terminate on January 1. 1981, unless prior thereto
the Christ Church of Oak Brook shall acquire title to the
subject property.

(2) The special use herein granted shall permit the subject
property to be utilized for vehicular parking on a limited
basis when needed for various sporting events held at the
International Sports Core, provided that advance notice of
such use shall be given to the Village of Oak Brook and
its Police Department and provided further that such use
shall be subject to such parking and traffic control regulation
as may be imposed by the Village of Oak Brook and its
Police Department.
SECTION 3: The provisions of Section M E 7 of Ordinance No. G-60, the
Zoning Ordinance of the Village of Oak Brook, are hereby varied to reduce
from 40 feet to 5 feet the required parking space setback from the west and
south boundaries of the subject property lines and the provisions of Section
V F of said Ordinance No. G-60 are hereby varied to reduce the setback as
applied to the subject property from 110 feet from the north line of Section
36 (approximately the Center Line of Oak Brook Road)to 60 feet for parking
area access and service drives, to 85 feet for parking area concrete or .
landscaping "islands", and to 95 feet for parking spaces, all to permit the
subject property to be used for vehicular parking by the Christ Church of
Oak Brook as permitted and subject to the conditions stated in Section 2 of .
this Ordinance.
SECTION 4: The subject property encompassed by the provisions of this
Ordinance is legally described as follows, to-wit:
That part of Lot 2 in Old Oak Brook Assessment Plat No. 2,
of Parts of the Northeast 1/4 of Section 35 and the Northwest
1/4 of Section 36, Township 39 North, Range 11, East of the
Third Principal Meridian, as per Plat thereof recorded
November 10, 1964, as Document No. R64-42440 described
as follows:
Commencing at the Southwest corner of Salt Creek Highlands,

Christ Church of Oak Brook is seeking to modify further its Special Use as amended for
its property at the southwest corner of 31S` Street and York Road to construct building
addition to its existing structure at the so-called triangle area of the northeast exposure
thereof.
The features of the proposed building addition would consist of:
■ Construct four safety exits in the sanctuary, two in the rear and two in the chancel
(in the front); the new safety exits in the chancel will replace existing exits;
■ Build the Oak Tree Discovery Center for children;
■ The infant/toddler corridor would receive upgraded restrooms and more
appropriate and suitable space for the infant/toddler age group programs;
■ A new outdoor playground be installed featuring safety upgrades like rubber
paving to reduce the risk of any accidents;
■ Remodel existing early childhood and nursery facilities;
■ Classroom/seminar space on the second floor; and
■ General meeting space and mechanical space on the lower level.
Christ Church by its constituents have met its objective of the "Through All Generations"
campaign to raise $6,000,000 for(a) the building improvements described above and (b),
to the extent of approximately 25% of such sum, routine capital replacements and major
maintenance throughout the overall facilities over the next three years. The proposed
building addition will have a positive impact aesthetically and visually for the benefit of
the neighbors. Neighbors have written letters of endorsement in support of the special

in accordance with the building code and other ordinance requirements of Oak Brook.
The so-called triangle area on the northeast exposure of the existing structure is only
partially visible from either 31St Street or York Road.
The preschool program of Christ Church is opened to residents of the community
regardless of affiliation with the church. The infant and nursery facilities are available to
all parents attending worship services, social programs and study groups conducted at the
church. Christ Church upon request makes its facilities available to the police and fire
departments for training purposes, Butler School District 53 special programs and other
community organizations. Christ Church further makes its parking facilities available to
residents of the village to accommodate overflow parking associated with special events
at the Sports Core including the Fourth of July fireworks program.
The factors are addressed hereafter set forth in Ordinance Section 13-14-9E 1, 2, and 3
for the granting of a Special Use.
1. Is of the type described in subsection Al of this Section, is deemed necessary
for the public convenience at that location;
The improvements to the existing structure will provide additional emergency
egress from the sanctuary, upgraded restrooms and more appropriate and modern
meeting space for the preschool program, and enhancements to the infant/toddler
services program. The new meeting space also will facilitate group meetings on
social outreach programs. There is a growing demand among the Christ Church
families and the residents of Oak Brook to use these types of facilities.
Christ Church desires to satisfy this demand by its constituents and residents of
Oak Brook for access to the preschool program, the infant/toddler corridor space,
the upgraded restrooms in the preschool area, and the new meeting space for the
social outreach activities. The public benefits resulting from having such
amenities available to the residents of the community are apparent.

2. Is so designed, located and proposed to be operated that the public health,
safety and welfare will be protected; and
The proposed building improvements to the existing structure of Christ Church
will be made at the so-called triangle area at the northeast exposure of the
structure. This triangle area at the northeast exposure of the building is partially
visible from 31St Street and York Road. The new playground will be visible from
York Road as is the existing playground, but the new playground will be slightly
closer to the street. The design and location of the proposed improvement
situated in the triangle space are significantly removed from the boundaries of the
property. The three safety exits to be added to the sanctuary will improve
emergency access for congregants and responders as well. The upgraded
restrooms in the preschool program area are a necessity. The reconfiguration of
classroom space in the preschool area is desirable for their instruction and utility
purposes. The proposed Oak Tree Discovery Center will offer a significant
opportunity to residents of the community. The enhance space for the
infant/toddler corridor is available to any resident or member of the church
attending seminars, social outreach programs in addition to worship services.
The preschool programs are available to children of preschool age of congregants
and residents of Oak Brook. The current enrollment is 70, and the capacity
enrollment is 120. The social outreach programs conducted by the church include
bible study groups, choir and music sessions, counseling services and symposium
on topics of community interest.
The architecture will be compatible with the existing facade, materials and

The building program for the new addition demonstrates the long term
commitment of Christ Church of Oak Brook to its neighbors and the community.
The budget for the new addition is approximately$6,000,000. The new
investment of$6,000,000 in the Christ Church of Oak Brook facility will enhance
the utilization of the space for the infant/toddler corridor space, the preschool
program, social outreach, general meeting space to the benefit of the neighbors in
addition to the congregation.
Conclusion
Accordingly, Christ Church of Oak Brook is an Illinois not for profit corporation devoted
primarily to religious activities. Christ Church additionally offers a wide range and
variety of programs to benefit the congregants and residents at large of Oak Brook for
preschool, social outreach and symposium purposes. Christ Church of Oak Brook makes
its facilities available to Butler District 53 to conduct various programs at the request of
the superintendent. Christ Church of Oak Brook also benefits facilities available to the
benefit of the Oak Brook fire and police departments to conduct training and educational
programs.
Church of Oak Brook is an important member of the community as evidenced by its
support for special events in the community by making its parking facilities available to
attendees. The granting of the amendment to its Amended Special Use Permit will allow
Christ Church of Oak Brook to better administer traffic during community special events
and its involvement with and support of the Village and its residents.

upgrades, and (iv) construction of other internal modifications to the building that are consistent with the
approved special use for a church located at 501 Oak Brook Road, Oak Brook, Illinois, subject to the
following conditions:
1) Development shall be in substantial conformance with the Site Plan and Floor Plan
prepared by Saavedra Gehlhausen Architects, as submitted
2) All other provisions of the existing special uses for the Christ Church property, including
Ordinances S -237, S -346, S -382, S -511, S -583, S -729, S -919, and S -1040 shall continue
and are hereby ratified and confirmed in all respects, except as specifically in conflict with
the amendment to a special use and site plan granted herein
3) Notwithstanding the plans approved, Christ Church of Oak Brook shall meet all Village
ordinance requirements at the time of building permit application except as specifically
varied or waived
Section 3 The special use and the scope of this ordinance are limited and restricted to the
