AN ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF SECTION VII(E)(8)(b)(1)
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO SIDE YARD REQUIREMENTS
(344 Forest Trail, Oak Brook, IL 60523)
WHEREAS, an application has been filed requesting a variation from the provisions of Section
VII(E)(8)(b)(1) of the Zoning Ordinance of the Village of Oak Brook to reduce the required side yard from
12 feet to approximately 8 feet 10 inches for the property commonly known as 344 Forest Trail Drive; and
WHEREAS, a public hearing on such application has been conducted by the Zoning Board of
Appeals on March 7, 2000 pursuant to due and appropriate legal notice, and
WHEREAS, the said Zoning Board of Appeals made explicit findings of fact that the variation
requested conforms to the standards set forth in Section XII(G)(4) of the Oak Brook Zoning Ordinance,
subject to certain conditions, and
WHEREAS, the corporate authorities have reviewed the recommendation and findings made by the
Zoning Board of Appeals and, subject to the conditions set forth below, deem the granting of the variation
requested to be appropriate and in the best interest and in furtherance of the public health, safety and
welfare,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1. That the provisions of the preamble hereinabove set forth are hereby adopted as though
fully set forth herein
Section 2 That a variation is hereby granted from the provisions of Section VII(E)(8)(b)(1) of the
Zoning Ordinance of the Village of Oak Brook so as to permit an 8 foot, 10 inch side yard instead of the 12
foot required, subject to the condition that the addition be constructed in substantial accordance with the
building plans drawn by N Batistich Architects dated January 21, 2000
Section 3 That this Ordinance is limited and restricted to the property located at 344 Forest Trail
Drive, Oak Brook, IL, which property is legally described as follows
Lot 18 in Timber Trail Estates Annex, being a subdivision of part of the East Half of Section
23, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat
thereof recorded August 17, 1950 as Document No 601607 in DuPage County, IL
Permanent Parcel No 06 -23- 200 -021
Section 4 That this ordinance shall be in full force and effect from and after passage and approval
pursuant to law
