S-1160 - 05/09/2006 - PERSONNEL RULES & REGS - OrdinancesORDINANCE 2006- PL -RR -S -1160 AN ORDINANCE AMENDING THE PERSONNEL MANUAL OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, the President and Board of Trustees of the Village of Oak Brook have heretofore adopted the Personnel Manual, and WHEREAS, it is the policy of the Village that applicants for full -time employment by the Village be reviewed and selected for employment exclusively on the basis of merit, qualifications and suitability based upon criteria established by the supervising Department Director and Village Manager, and WHEREAS, in furtherance of the aforesaid policy, the Village Board has determined that the Personnel Manual be amended to include the following rules regards employment of relatives by the Village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 The provisions of the aforesaid recitals are hereby adopted as a part of this Ordinance follows- Section 2 That Section 7 09B of the Personnel Manual is hereby deleted and replaced as B Employment of Relatives This paragraph shall apply to the hiring and employment of all full -time Village employees except for (a) firefighters, police officers and any other employee whose hiring is subject to the statutory authority of the Board of Fire and Police Commissioners, and (b) the Village Manager and Department Directors, whose appointments are subject to the approval of the Board of Trustees 2 For purposes of this Ordinance only, the terms "related to" and "related persons" shall mean natural persons legally related as spouses, parent - child, grandparent - grandchild, siblings, or siblings -in -law 3. The Village shall not hire full -time employees who are related to any elected Village official, the Village Manager, Assistant Village Manager, employee with access to personnel information or any current employee in the Department or office in which the fob opening exists, unless the Village Manager determines that the applicant is the most - qualified for the open position and that the employment of that person would not present an undue risk of (a) inappropriate supervision, evaluation, or other treatment of one related person by the other, or (b) allow inappropriate access to confidential personnel information by either of the related persons The Village Manager shall advise the Board in writing of any such determination and his justification therefore 4 If after becoming employed by the Village, an employee becomes related to another employee by marriage, the Village Manager shall make a determination whether that relationship presents an undue risk of (a) inappropriate supervision, evaluation, or other treatment of one by the other, or (b) inappropriate access to confidential personnel information by either of the related persons If the Village Manager makes such a determination, one or the other employee shall be Ordinance 2006- PL -RR -S -1160 Amending Article VII of Personnel Manual, Page 2 reassigned or safeguards shall be Instituted to eliminate such risks, if neither employee resigns The Village Manager shall advise the Board in writing of such determination and the justification therefore Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict.
