AN ORDINANCE REZONING AND GRANTING
A MAP AMENDMENT AND A SPECIAL USE FOR THE OAK BROOK CLUB
IN THE VILLAGE OF OAK BROOK
(PIN: 06 -23- 109 -004)
WHEREAS, the Oak Brook Club Subdivision, a condominium development (the Subject
Property), which is legally described herein, was voluntarily annexed by the Village in 1986; and
WHEREAS, at the time of the annexation the Village's Zoning Ordinance did not contain a
classification for multi - family developments; and
WHEREAS, on November 10, 2009, the President and Board of Trustees adopted Ordinance
G -903 creating an R -5 multi - family zoning classification; and
WHEREAS, as part of the discussion of Ordinance G -903 the President and Board of Trustees
directed that the Village of Oak Brook and the Oak Brook Club residents jointly file an application to
rezone the Oak Brook Club Subdivision property to the R -5 classification; and
WHEREAS, at its meeting on March 15, 2010, the Plan Commission completed its review and
deliberations on a application for a map amendment and special use filed by the Village of Oak Brook and
the Oak Brook Club residents; and
WHEREAS, on April 6, 2010, the Zoning Board of Appeals conducted a public hearing on the
request for the map amendment and special use, pursuant to due and appropriate legal notice and found
that the applicant had addressed and satisfied the requirements for the requested relief; and
WHEREAS, the Zoning Board of Appeals recommended approval of the requested relief; and
WHEREAS, the Subject Property is legally described as follows:
All of Lots 1, 2, 3, 4, and 5 in the Oak Brook Club Subdivision, being a subdivision in the Northwest
Quarter of Section 23, Township 39, North, Range 11, East of the Third Principal Meridian, according to
the plat thereof recorded February 7, 1973, as Document Number R73 -7036, in DuPage County, Illinois.
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and the Zoning Board of Appeals and deem the map amendment and special use,
as set forth below, to be in the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein.
Section 2: The Oak Brook Club is rezoned from R -1 to R -5 and the Village's zoning map is
amended accordingly.
Section 3: A special use is granted to the Oak Brook Club Subdivision, a condominium
development, as currently constructed to eliminate the nonconforming status in an R -1 single family
district.

RECOMMENDED MOTION: I move to concur with the recommendations from the Plan
Commission and Zoning Board of Appeals approving a map amendment from R-1 to R-5 and a
special use confirming the existing Oak Brook Club as an R-5 condominium development and
authorize the Village Attorney to prepare the necessary Ordinance for final consideration at
the May 25, 2010 Board of Trustees meeting.
Background/History:
On April 6, 2010, the Zoning Board of Appeals held the required public hearing and completed its
deliberations on a joint petition from the Village of Oak Brook and the Oak Brook Club seeking
approval of a map amendment to rezone the property to R-5 and a special use which would eliminate
the existing nonconforming status as a condominium development in an R-1 single family district.
On November 10, 2009, the Village of Oak Brook approved the ordinance creating the R-5 zoning
district as a text amendment to the Zoning Ordinance. As part of the deliberations on this issue,
residents of the Oak Brook Club were very strong in their views that the R-5 district designation
should be approved as it would eliminate the nonconforming status that now exists on the property.
The Plan Commission and Zoning Board of Appeals were also unanimous in their recommendations
to have the R-5 zoning designation apply to the Oak Brook Club.
The Oak Brook Club is a gated, upscale condominium development that was constructed between
1971 and 1975 in unincorporated DuPage County and was annexed by Oak Brook in 1986 under its
default zoning, which was R-1 single-family detached zoning. The Oak Brook Club has 316 units in
six, four-story buildings. There is underground parking and an extensive open space system as
amenities to the residents of the community. Please see the attachments depicting the existing site

Recommendation
The Plan Commission, by separate votes of 7 to 0, and the Zoning Board of Appeals by separate
votes of 7-0, recommended approval of the map amendment to rezone the property from R-1 to R-5

plan.

Chairman Davis swore in those that would be providing testimony.
Director of Community Development Kallien said that as part of the discussion
during the recent adoption of the R-5 zoning district, the Oak Brook Club fit
within the parameters set for the R-5 zoning district uses, etc. In the Plan
Commission and Zoning Board of Appeals recommendations to the Village
Board, it was indicated that the zoning designation for the Oak Brook Club
should be changed to the R-5 district when the text amendment was approved.
After consultation with the Village Attorney it was determined that due to legal
and proper noticing requirements, a public hearing would be required to request
the map amendment and special use approval.
The property is currently zoned R-1 and has been nonconforming since 1986
when it was annexed into the village. The R-5 district would make it
conforming and the special use would confirm the existing development. If the
Oak Brook Club would ever want to do an expansion or modification on the
site, they would need to amend the special use.
Jeff Kennedy, 4 Oak Brook Club Drive, Oak Brook, Illinois, president of the
Oak Brook Club Condominium Association spoke on behalf of all five of the
individual buildings associations along with the master association. As
president of the master association, he stated that each,of the associations
unanimously approved and recommended the rezoning of the Oak Brook Club
from R-1 to R-5. The primary reason that they want it is because it is a
nonconforming use and if one of the buildings would be 50 percent or more
damaged or destroyed by fire, tornado or earthquake, it could not be rebuilt.
They understand that if any changes to the existing development were desired in
the future, they would be required to come back to the village to request any
change.

Chairman Davis questioned whether there was a legal benefit to the approval of
the zoning request.
Mr. Kennedy responded there is a legal benefit for the village, because in a
legal case, Judge Zagel had ruled that the village's zoning ordinance was
discriminatory because it did not make provisions for multi-family,
condominiums, townhomes, etc. The village then explored the concept of the
R-5 zoning. By having the R-5 zoning district in the Zoning Ordinance and by
having a community also zoned R-5, puts the village in a better legal posture in
the future should there be any future dealings with Judge or any future lawsuits
that would challenge Oak Brook's zoning. It would be a win/win for the Oak
Brook Club and for the Village of Oak Brook.
Mr. Kennedy addressed the standards for an amendment as follows:
Changes in zoning look at the impact on the neighborhood. Oak Brook Club is
bounded on the east by Spring Road, Salt Creek and undeveloped woodlands.
They are bounded on the west and south and by commercial properties, office
buildings and the Oakbrook Center. They are bounded on the north by a
condominium complex in Oakbrook Terrace. The property is bounded by
commercial properties and multi-family. They have been a condominium
complex at this location for almost forty years. By recognizing the Oak Brook
Club for what it is will not have any adverse effect on the neighbors. No on has
objected to the zoning change. They feel it will be a benefit to the Oak Brook
residents that reside in the Oak Brook Club as well as for the Village of Oak
Brook.
Member Cappetta questioned that if the Oak Brook Club development existed
at the time that the Comprehensive Plan was approved, why didn't the plan take
the property into consideration at that time.
Mr. Kennedy responded that when the Comprehensive Plan was adopted by the
Village, it said that it would not rezone the Oak Brook Club because they did
not want to establish multi-family housing in Oak Brook. That particular
statement in the Comprehensive Plan was a major source of the ire of the
federal court when the case went to trial.
No one in the audience spoke in favor of or in opposition to the request.
Chairman Davis noted that the factors for a map amendment were set forth in
writing on page D of the case file and that the applicant had satisfied the
requirements to recommend approval of a map amendment.

of a map amendment to rezone the property known as the Oak Brook Club from

follows: standards were provided in writing on page E of the case file and

1. Is of the type described in subsection Al of this Section, is deemed
necessary for the public convenience at that location.
The Oak Brook Club is an existing multi-family project that has been in
existence for almost 40 years and approval of the map amendment and special
use will remove the nonconforming status.
2. Is so designed, located and proposed to be operated that the public
health, safety and welfare will be protected;
Approval of the special use will remove the nonconforming status, which has
created a cloud around the existing development and addresses a public need
that was spelled out in the Friary lawsuit.
3. Would not cause substantial injury to the value of other property in
the neighborhood in which it is located.
The Oak Brook Club has existed for almost 40 years and is an important
element in the Oak Brook community.
No one in the audience spoke in favor of or in opposition to the request.
Chairman Davis noted that the standards for a special use map amendment were
set forth in writing on page E of the case file and that the applicant had satisfied
the requirements to recommend approval of the special use as requested.

He noted that several months ago, the Village Board, Plan Commission and Zoning
Board of Appeals reviewed and approved the R-5 zoning district. During the
process it was determined that the Oak Brook Club met the requirements of the new
R-5 District. Due to certain legalities, the Village and the Oak Brook Club property

owners were required to formally petition for rezoning to the R-5 District and for
special use approval of the condominium development.

Brook Club Condominium Association spoke on behalf of all five of the individual
buildings associations along with the master association. As president of the master
association, he stated that each of the associations unanimously approved and
recommended the rezoning of the Oak Brook Club from R-1 to R-5.
He noted that the Oak Brook Club was built in the early 1970's in unincorporated
DuPage County and was built to the higher setbacks and standards that are known in
the Village of Oak Brook. In 1986,by their own agreement, they were annexed into
the Village of Oak Brook and at that time the village did not have zoning for
condominiums, so the property was given the default zoning of R-1, which was for
single-family two-acre lots. When the new zoning classification was adopted, the
Plan Commission, Zoning Board of Appeals and Village Board unanimously
recommended that the Oak Brook Club should be given the R-5 designation as a
condominium complex. They meet all of the standards for the rezoning and special
use approval, with the exception of some modest encroachments, in terms of side
yard requirements along the east side of the property along Spring Road. They
would like to be zoned as a condominium complex. There is a practical reason why
they would like to be rezoned, because if one the buildings were more than 50
percent damaged by fire, tornado, earthquake or any other event, under the existing
zoning it could not be rebuilt. They would like to remove that cloud and be zoned
legitimately for what they are as a condominium complex. Documentation has been
presented from all five of their building associations as well as the master
association to unanimously approve the request for rezoning. To his knowledge
there was no opposition from anyone in the Oak Brook Club.
Director of Community Development Kallien said that the application is a joint
application between the village and the Oak Brook Club. Approval of the requests
would make the Oak Brook Club legal and conforming, which will eliminate the
nonconformity. It will also address some of the criticism received as the result of
the Friary lawsuit. Judge Zagel's ruling basically said that the zoning ordinance was
significantly lacking because it did not have any opportunity for multi-family
condominiums, townhomes, assisted living, senior housing, etc. A significant step
was taken by creating and adopting the district. By having it applied to a property
with over 400 hundred residents, goes a long way to minimize a future criticism and
is not only needed,but it is deserved.

Director of Community Development Kallien noted that this request came out of the
review of the newly adopted sign regulations. One of the items that the consultant
had recommended was way finding signs and he provided a map of potential
locations, which was included in the case file. There is really a deficiency on way
finding for some of the commercial streets, including, Commerce Drive, Windsor,
Enterprise and Kensington. All of these streets have significant levels of
commercial or office type development, but are located on nothing more than cul de
sacs; so when someone is on a major thoroughfare. Unless you specifically know
where you are going, you may actually miss what business is located where on a
particular street. A resident questioned why take the next step for way finding when
people today rely upon GPS, MapQuest, etc., but the reality is that many of the
corporate entities really need identity, which is a key piece to functioning in their
business. McDonald's, which is a very successful commercial resident can be seen
when you drive down Jorie Blvd. However, unless you look really hard or have
visited the site, you would not know that there is a very large hotel located on the
complex. There are also facilities on the site that people rent out for weddings,
receptions, and training events, yet there is no signage for that anywhere. They
would benefit from some way finding signage. Complaints have been received from
Ace Hardware located on Kensington to try to get people to get to their facility.
When people drive down Kensington often they drive to the end and cannot find it
because of the lack of direction.
The goal is to investigate and work up a scenario where a proposal could be made to
allow limited way finding signage that would be located in the village right of way.
The village would have the ability to set parameters on what could be advertised,
when it could be advertised, what the signage would look like, where it would be

DISCUSSION:
On November 10, 2009, the Village of Oak Brook approved the ordinance creating the R-5
zoning District as a text amendment to the Zoning Ordinance. As part of the deliberations
on this issue, residents of the Oak Brook Club were very strong in their views that the R-5
District designation should be approved as it eliminates the nonconforming status that now
exists on the property. The Plan Commission and Zoning Board of Appeals were also
unanimous in their recommendations to have the R-5 zoning designation apply to the Oak
Brook Club.
The Village of Oak Brook Board of Trustees referred the matter of changing the zoning of
the Oak Brook Club on November 10, 2009 to the Plan Commission and Zoning Board of
Appeals for processing.
The Oak Brook Club is a gated, condominium development that was constructed between
1971 and 1975 in unincorporated DuPage County and was annexed by Oak Brook in 1986
under the R-1 (single-family) Zoning. It has 316 units in six, four-story buildings.
Underground parking and an extensive open space system exist as amenities to the

residents of the community. Please see the attachments depicting the existing site plan for
the property. The case file contains a letter from each of the Oak Brook Club residential
buildings associations indicating unanimous support of the requested rezoning to R-5 and
special use approval.
Staff Comments:
• The proposed map amendment to R-5 and accompanying special use will make the
Oak Brook Club a conforming use. Since the development has been fully built-out
for over 30 years, the requested actions are viewed as "house-keeping" items.
• The only potential inconsistency that exists with the application of the R-5 zoning for
the Oak Brook Club is that the setback along Spring Road appears to be less than the
required 40-ft. Since this condition has existed for over 30 years, it is an existing
condition that will be maintained. Any changes (new construction) to the
development that lessen the existing setback along Spring Road would require
approval of a variation.
• The special use will reference the existing site plan.
• Please see the attached narratives which address the factors for approval of a map
amendment and special use.
RESPONSIBILITIES OF HEARING BODIES:
Both the Plan Commission and Zoning Board of Appeals have the responsibility to make
recommendations on requests for a map amendment and special use. Please include in
your consideration, your findings with respect to the standards specified in the Zoning
Ordinance for each of these types of requests. The materials submitted by the applicant
specifically address each of the required standards.
CONCLUSION:
If the Plan Commission and Zoning Board of Appeals are of the opinion that the applicant
has satisfied the requirements for a map amendment and special use to designate the
existing Oak Brook Club as R-5 with a special use for multi-family use, a recommendation
would be in order to approve each of these requests subject to meeting the following
conditions:
1. The Oak Brook Club shall continue in substantial conformance with the site plan as
submitted.
2. Comply with all other applicable rules and ordinances of the Village of Oak Brook.

RECOMMENDED MOTIONS: I move to refer the request for a map amendment and
special use for the property known as the Oak Brook Club Subdivision from R-1 to R-5 to
the Plan Commission for review and to the Zoning Board of Appeals for public hearing.
Background/History:
At the Village Board meeting on October 27, 2009, the Board of Trustees were unanimous in
their support for the approval of the proposed R-5 Residential District and for its suitability as
the correct zoning for the Oak Brook Club residential community. Residents of the Oak Brook
Club were very strong in their views that the R-5 District designation should be approved as it
eliminates the nonconforming status that now exists on the property. The Plan Commission and
Zoning Board were also unanimous in their recommendations to have the R-5 designation apply
to the Oak Brook Club.
To ensure that all statutory requirements are met including the provision of proper notice to all
residents of the Oak Brook Club and surrounding property owners, a formal request to change
the zoning on the Oak Brook Club to R-5 along with the special use must be filed and reviewed
by the Plan Commission and holding a public hearing before the Zoning Board of Appeals.
Per the recommendation of the Village Attorney, since the Board of Trustees have already
expressed their support for rezoning the Oak Brook club to R-5 and the fact that such a request
involves a large number of homeowners (over 300) that would be affected by such petition, the
Village should be the applicant for such request. The Oak Brook Club has offered to assist the
Village by providing mailing addresses for all Oak Brook Club property owners and by assisting
the Village staff in verifying that the Oak Brook Club meets all criteria for the R-5 designation.

Ladies and Gentlemen:
As background, the Oak Brook Club, a 316-unit condominium community, was voluntarily
annexed into the Village in 1986 by unanimous vote of the Village Board of Trustees. At
that time, the Village had no zoning classification for condominium or "multi-family"
developments. So, the Oak Brook Club received the default zoning of R-1 — single family
homes on lots of 2 or more acres — but was grandfathered as a non-conforming use.
Since then, the Oak Brook Club has fully complied with Village ordinances and permitting
requirements, including the installation of a state-of-the-art fire alarm system in full
compliance with Village and national code requirements. Oak Brook Club residents have
actively participated in Village affairs, including exceptional voter turnout, participation
in the Civic Association, and service on many Village boards and commissions.
In November, 2009, partially in response to a federal court ruling that the Village's zoning
unlawfully failed to provide for multi-family uses, the Village Board, on recommendation
from both the Plan Commission and the Board of Zoning Appeals, adopted an R-5 zoning
classification for multi-family developments in Oak Brook meeting high-quality standards.
At the end of 2009, the Plan Commission, Board of Zoning Appeals, and Village Board
each unanimously supported rezoning the Oak Brook Club as the Village's first R-5

Ladies and Gentlemen:
Each of the five residential buildings at the Oak Brook Club is organized as a self-
governing Condominium Association under the Illinois Condominium Act. Overall,
the Oak Brook Club is governed by the Oak Brook Club Community Area Trust, a
master association under that Act.
In noticed, public meetings, all five of the individual Association Boards have voted
unanimously to authorize the Community Area Trust Board, and Jeff Kennedy,
President of this Board, to act on their behalf to support the re-zoning of the entire
Oak Brook Club to R-5 zoning. The Community Area Trust Board has also
unanimously voted to support that re-zoning in a noticed, public meeting.
Our six associations have consulted our outside legal counsel. He advises that our
individual Condominium Associations' and master association's Declarations do not
require that any of those associations secure a vote of approval from their individual
unit owners to support this rezoning. However, to my knowledge, none of our
individual unit owners has expressed any opposition to this rezoning.
Thus, all six Oak Brook Club condominium associations unanimously join in
supporting the change of our zoning to R-5. Attached are the resolutions of
authorization and support from Clubs West, Three, Four, Five, and Six. This letter
is to serve as authorization from the master association, the Community Area
Trust, to-seek rezoning.

RESPONSE: Oak Brook Club is an existing multi-family residential project surrounded by
numerous office and commercial land uses.
b. The extent to which property values are diminished by the particular zoning restrictions;
RESPONSE: The Map Amendment will protect the property values by eliminating an
existing legal non-conforming use and correctly designating the property as a multi-family
development consistent to the recently adopted R-5 district.
C. The extent to which the removal of the existing limitations would depreciate the value of other
property in the area;
RESPONSE: The map amendment will not depreciate the value of any of the commercial
properties that surround the Oak Brook Club Subdivision, since the project has existed for
over 30 years.

Section 4: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance.
Section 5: All ordinances or parts thereof in conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict.
Section 6: This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.
