IGA DuPage Water Comission, County, & VOB 01-22-1985 INTERGOVERMENTAL AGREEMENT BET19EEN THE DU PAGE WATER COMMISSION, DU PAGE COUNTY, AND THE VILLAGE OF OAK BROOK This agreement made and entered into this 22nd day of January , 1985 , between the DuPage Water Commission ("Commission") DuPage County, Illinois, Illinois. and the Village of Oak Brook, Cook and DuPage Counties, WHEREAS the DuPage Water Commission is rapidly exhausting all operating 8' or fu nds and a nticipates no revenues from the 1984 Tax Levy until dune 1, 1985, from any other source. easure, the "Commission' has adopted a WHEREAS, as an extraordinary m 1984-85 Operating Budget in the amount of $458,000 providing for emergency operating funds and has requested funding for 50% of same. ve agreed that it is in their best interests WHEREAS the parties hereto ha to maintain the Commission during this transition period by providing funds for necessary operating expenses and certain engineering costs associtate with the construction of a water main in Route 83. The Village of Oak Brook, Illinois hereby agrees to loan to the Commission the sum of $2,545.00, ($.35 per person x 7263 persons) . 2. The Commission agrees to reimburse the Village of Oak Brook, Illinois from the first funds available to the Commission for taxes or any other source after July 1, 1985. Interest shall be paid from July 1, 1985 at the rate of 70% of prime as of July 1, 1985 or 9% per annum, whichever rate is greater. In that regard I enclose duplicate original copies of the Intergovernmental Agreement authorizing this transaction executed on behalf of the Village by our Village President and Village Clerk. I would ap- preciate if you could arrange for the execution and return of one of these dupli- cate originals for our records. I sincerely hope that Oak Brook's confidence in the Water Commission in achieving our goal of delivery of Lake Michigan water is shared by all of the other com- munities in DuPage County and that your efforts are successful. To approve and ratify the following investment from the Corporate Fund: One (1) federally secured Certificate of Deposit in the amount of $438,000.00 to mature at Standard Federal Savings and Loan on May 15, 1985 at a rate of 8.50% (120 days). ROLL CALL VOTE: Ayes: Trustees Imrie, Listecki, Maher, Philip, Rush, Watson and President Cerne. Nays: None So ordered. Trustee Rush moved, seconded by Trustee Imrie. .. To approve and ratify the following investment from the Corporate Fund: One (1) federally secured Certificate of Deposit in the amount of $600,000.00 to mature at Great American Savings and Loan on January 17, 1986 at a rate of 9.50% (360 days) . INTERGOVERNMENTAL AGREEMENT - DU PAGE WATER COMMISSION LOAN: As directed at the Regular Meeting of November 13, 1984. Trustee Philip moved, seconded by Trustee Rush. . . To approve the Intergovernmental Agreement as presented and authorize the Village President and Clerk to affix their signatures thereon. To approve the Subdivision Sign as depicted on Plan prepared by Oak Brook Landscape Company, dated December 14, 1984, subject to removal of the existing letters, "Brook Forest", from the common wall of Briarwood Lakes, prior to issuance of the permit. ROLL CALL VOTE: Ayes: Trustees Imrie, Listecki, Maher, Philip, Rush, Watson and President Cerne. Nays: None So ordered. B. AGREEMENT -ILLINOIS DEPARTMENT OF TRANSPORTATION (IDOT (South Frontage-Road of Roosevelt Road Trustee Imrie moved, seconded by Trustee Listecki. . . To conceptually approve the jurisdictional transfer from TDOT to the Village of Oak Brook for the South Frontage Read of Roosevelt Road between the Village's west corporate limits and York Road; and that Staff be directed to work with IDOT in preparing the necessary documentation to accomplish same.
