POLICE PATROL
INTERGOVERNMENTAL AGREEMENT
This Agreement entered into by and between the City of
Elmhurst and Village of Oak Brook, municipalities situated in
DuPage County, Illinois.
W I T N E S S E T H
WHEREAS, the 1970 Illinois Constitution, (Art. VII, Sec.
10) and the Intergovernmental Cooperation Act (Ill. Rev. Stat.
1985, Ch. 127, Sec. 741 et. seq. ) provide authority for
interaovernmental cooperation; and
WHEREAS, the City of Elmhurst and Village of Oak Brook lie
adjacent to one another having a common boundary of Roosevelt
Road (Ill. Route 38) ; and
WHEREAS, the police patrol of the roadway which serves as a
common boundary of the City of Elmhurst and Village of Oak Brook
can be more effectively performed through the joint and
coordinated efforts of the parties hereto.
NOW THEREFORE, in consideration of the mutual covenants
contained in this Agreement, and pursuant to the Art. VII,- Sec.
10 of the 1970 Illinois Constitution and the Intergovernmental
Cooperation Act, the City of Elmhurst ("Elmhurst") and the
Village of Oak Brook ("Oak Brook") , (known collectively as the
"Parties" and individually as "Party") hereby agree as follows:
Section l: Purpose of Agreement. The Parties recognize
that in certain situations, the use of police personnel and
equipment to perform police duties outside the territorial
limits of the municipality where such officers are employed is
desirable and necessary in order to preserve and protect the
public health,- safety and welfare. I;: furtherance of this
purpose, the Parties hereinafter set forth the respective police

roadways known as Roosevelt Road and Illinois Route 83, which
roadways consti_ute the common boundaries- of the Parties.
Section 2 : Power and Authority. Elmhurst and Oak Brook
agree that each shall have the responsibility to establish and
maintain police patrols in the following described areas:
a) Elmhurst shall patrol the westbound lanes of Roosevelt
Road from Elmhurst' s eastern corporate limits to Oak
Brook's western corporate limits.
b) Oak Brook shall patrol the eastbound lanes of Roosevelt
Road from Elmhurst ' s eastern corporate limits to Oak
Brook's western corporate limits.
c) Each Party hereto authorizes the other Party to
establish and maintain the aforementioned police patrols
within the corporate limits of the other Party to the
extent necessary to carry out this Agreement.
d) Police patrol responsibilities shall include the
enforcement of all law$ of the State of Illinois and the
response to and processing of traffic accidents.
e) Neither Party shall be liable to the other Party for a
failure to maintain the aforementioned police patrols once
furnished pursuant to this Agreement.
f) Each party hereto further authorizes the other party to
enforce all laws of the State of Illinois within the
corporate limits of the other party regardless of the
jurisdictional boundary established hereinabove, in the
event suspected criminal or other unlawful activity is
observed by the parties ' police personnel.
Section 3 : Compensation. Police patrols under this
Agreement shall be established and maintained without charge to
the other Party during the normal conduct of police business.
Section 4 : Liability. All employee benefits, wages and
disability payments, pension and workers ' compensation claims,
damage to or destruction of equipment and clothing and medical
expense shall be borne by the Party regularly employing such
person performing services pursuant to this Agreement.
Section 5 : Rules and Regulations. Each Party may
establish rules and regulations concerning the establishment and
maintenance of police patrols contemplated hereunder consistent
with this Agreement.
Section 5: Effective Date of Agreement. This Agreement
shall be in full effect at such time as the corporate
authorities of each party have passed and approved
this agreement. This Agreement may be executed in
duplicate counterparts containing the authorized signatures of
each or the Parties .
Section 7 : Notices. All notices in connection with this
Agreement shall be in writing, and shall be deemed delivered to
the addresses thereof two (2) days after deposit of any main or
branch of the United States Postal Service, certified or
registered mail, postage prepaid, or on the date of delivery, if
personally delivered addressed to the Parties respectively as
follows:

or to such other person or address, provided notice of such
change is given in accordance with this Section.
Section 8: Termination of Agreement. Either party hereto
may withdraw from this Agreement at any time, at its option, by
ordinance of its corporate authorities, provided that such 60
days notice of the intent to withdraw is served upon the other
party.

Agreement on the date first above written.

To award the contract for a Golf Course Maintenance Facility to be
built on Site 1 to the lowest responsible bidder, Chapple Corporation,
Elmhurst, Illinois, in the amount of $311,261.00 and $25,100.00 for
contingencies and miscellaneous fees.

VI. NEW BUSINESS:
A. Discussion of Adjustments to Oak Brook's Lake Michigan Water
Allocation:
Consensus to proceed with process of reviewing the information from the
Illinois Department of Transportation (IDOT) Division of Water
Resources relative to Lake Michigan Water Allocations.
OB. Police Patrol Intergovernmental Agreement with City of Elmhurst:
Proposed agreement allows for the responsibility of Oak Brook police to
patrol the east bound lanes of Roosevelt Road from the Oak Brook west
boundary (approximately Salt Creek), to Elmhurst's east boundary
(approximately the east lot line of Cellozzi Ettleson Chevrolet).
Elmhurst police would patrol the west bound lanes of Roosevelt Road
from Elmhurst's east boundary to Oak Brook's west boundary.

To approve the Police Patrol Intergovernmental Agreement with the City
of Elmhurst and authorize the Village President and Clerk to affix
their signatures thereon.

C. Discussion ReEarding Pedestrian Path at Brook Forest School (60 Regent
Drive):
Mrs. Marguerite Bloch, Superintendent of School District #53, requested
the Village to accept the pedestrian path that goes onto the Brook
Forest School property from Hamilton Lane.
