Fairview-Meyers S-CLSYVe (C.H. 25)
WHEREAS, an Agreement, attached hereto and made a part.thereof, has
been prepared between the County of DuPage and the Village of Oak Brook
concerning the improvement of the Fairview-Meyers S-Curve; and
WHEREAS, it is in the best interests of the motorists of DuPage
County to accomplish this improvement.; and
WHEREAS, said Agreement must be accomplished before the improvement
may be initiated;
NOW, THEREFORE, BE IT RESOLVED, by the County Board of DuPage County
that the Clerk and Chairman of said Board be, and they are hereby directed
and authorized to execute the above mentioned Agreement with the Village
of Oak Brook; and
BE IT FURTHER RESOLVED, that certified copies of this Resolution and
Agreement be sent to the Village of Oak Brook thru the DuPage County Highway
Department.

Fairview-Meyers S-Curve (C.H. 25)
This AGIFENENT, made and entered into this 13th day of March ,
1979, by and between the COUNTY OF DU PAGE, ILLINOIS, a municipal corporation
(hereinafter referred to as the "County") ; and the VILLAGE OF OAK BROOK, a
municipal corporation (hereinafter referred to as the "Village") .
WIiNESSETH:
WHEREAS, the County and the Village, in order to facilitate the free
flow of traffic and insure safety to the motoring public, are desirous of im-
proving County Highway 25, Federal Aid Secondary 1151 (Fairview/Meyers Rd.)
from-State Route 34 (Ogden Ave.) to 35th St.; and
WHEREAS, Fairview/Me-yers Rd. is currently-designated as a County
Highway and the existing road right-of-way is owned and maintained by the
County; and
WHEREAS, the Village has obtained title to property from 35th St. to
38th St. through the Saddle Brook Development which could be used to realign
the existing Roadways of Meyers and Fairview to improve the free flow of traf-
fic and insure safety to the motoring public.
NOW, THEREFORE, in consideration of the mutual promises and co-,Tenants
of the Village and County and upon further .consideration of the- recitals herein-
above set forth, it is hereby agreed between the County and Village as follows:
1. Responsibility
The parties hereto agree that the Agreements herein contained shall
be binding upon the Village and the County.
2. Improvement
The County hereby agrees to construct an Improved Roadway from Ogden Ave.
(Route 34) to 35th St. The improvement will be constructed within the
existing right-of-way from Ogden Ave. to 38th. St. and on property dedi-
cated by the Village, as shown on Exhibit A, from 38th St. to 35th St.
- The Improvement will consist of the following:

a) Ogden Ave. to 39th St. : 4-lane roadway with necessary turn
lanes and signal modifications and installations at Ogden Ave.
and 39th St.
b) 39th St. to 38th St.-: Variable roadway width from 4-lane
facility at 39th St. to 2-lane divided roadway at 38th St.
c) 38th St. to 35th St. : 2-lane roadway divided by an 18 foot
grassed med i an wi th necessary turning lanes i n median at 38th St.
and 35th St. Paved shoulders will be provided throughout this
section with necessary drainage improvements. Fairview Ave.
north of 38th St., will be Cul-de-sac substantially in con-
formance with Exhibit A, attached.
Plans are to be submitted to the Villages of Oak Brook and Downers Grove
for review and comment prior to advertising for bids. Improvements
are to be implemented 'in the 1979/1980 budget period providing that
funds are available.
3. Village Property
The Village will dedicate to the County for use, the Village property
from 38th St. to 35th St. as shown on Exhibit A.
4. Future Improvement -
The Village and the County agree to permit the improved roadway to
function for a period of 3 years after completion of and final payment
for the improvements listed in Section 2 of this Agreement. If the adjusted
`daily volume, determined by 24-hour counts which have been adjusted
by seasonal or monthly factors as per the Illinois Department of
Transportation prescribed procedure, of 14,000 vehicles per day has
been reached, then the County may expand the improvement of the
roadway from 39th St. to 35th St. to a 4-lane roadway divided by an
18 foot grassed median and urban cross-section. -
5. Maintenance
The Village will maintain the grassed median from 38th St. to 35th St.
The County will maintain the remaining roadway improvements throughout
this section of improvement.

6 Dedication and Vacation
The Village agrees to dedicate to the County new right-of-way for
the improvement as shown in Exhibit A from 38th St. to 35th St.,
allowing it to be placed on the County Highway System for jurisdiction.
The County agrees to vacate existing County Highway 25 designation on
Fairview from 38th St. to 35th St. and 35th St. from Fairview to
Meyers Rd. The vacated sections revert to the Township or Munici-
pal's road system as boundaries dictate for full jurisdictional
responsibility.
7. Effect of this Agreement
In the event that any present or future resolutions, motions, ordi-
nances, or interpretations thereof by the Village or the County, be
in anyway inconsistent or in conflict with any provisions hereof,
then the provisions of this Agreement shall constitute lawful and
binding amendments to, and shall supersede, the terms of said incon-
sistent resolutions, motions, ordinances, or interpretations thereof
as they may relate to the road right-of-way described herein.
8. Enforceability
This Agreement shall be enforceable in any Court of competent juris-
diction by either of the parties hereto by any appropriate action at
law or in -equity to secure '-the performance of the covenants herein
contained.

seals on the day and year first above written.
