Dear Ms. Bushy:
This letter will serve as a Letter of Intent between the Village of Oak Brook and
the Illinois Department of Transportation for the maintenance and jurisdictional
transfer of 22° Street and York Road.
The elements of this proposal are as follows:
• The Illinois Department of Transportation will assume maintenance and
jurisdiction of 22°d Street between Illinois Route 83 and Clearwater Drive.
• The Village of Oak Brook will assume maintenance and jurisdiction of York
Road from the northern Village limits, approximately 162 feet north of
Harger Road,to the south abutment of the first bridge over the Tollway north
of 22nd Street, including current`IDOT responsibilities for the two structures
carrying York Road over the Tollways. Those responsibilities are the
maintenance and jurisdiction of the bridge decks. The portion of York Road
from the south abutment of that structure to 2,278 feet south of the centerline
of 22nd Street will be transferred to the Village upon completion of the York
Road at 22nd Street intersection improvement.
• The Village of Oak Brook would be responsible for routine maintenance of
22nd Street east of Illinois Route 83 within the Village limits,under the terms
of a Municipal Maintenance Agreement, for the months of April through
October. The compensation to the Village would be 35% of the normal
compensation called for in a twelve (12) month agreement. Attached is a
sample of such an agreement.
• IDOT will be responsible for routine maintenance of 22nd Street east of
Illinois Route 83 within the Village limits for the months of November
through March.

• IDOT will maintain the traffic signals along 22nd Street within the limits of
the jurisdictional transfer. Maintenance and energy costs associated with
these traffic signals will be divided per current IDOT policy. The Village of
Oak Brook will either gain the approval of the private sector for its financial
responsibilities or will be responsible for the private sector's portion of the
costs.

• By assuming maintenance and jurisdiction of 22nd Street between Illinois
Route 83 and Clearwater Drive, IDOT becomes partially responsible for
future capacity improvements including the widening/reconstruction of the
22nd Street @ I-88 structure, which has been estimated by Bollinger Lach
and Associates to cost $12 million. The Village of Oak Brook agrees to
participate to the extent of 1/3 of the future construction costs associated
with the improvement of this structure to provide additional capacity on 22nd
Street. The Village may transfer its 1/3 share to another agency upon
agreement with that agency and notification to our Department.
Please review this proposal, sign on the appropriate line below and return this
original to our office. Upon receipt of your concurrence, we will begin
preparation of the required agreement to effect these transfers.

ORDINANCE 1999-ST-JT-S-945
AN ORDINANCE DELETING A PORTION OF 22ND STREET
FROM THE MUNICIPAL STREET SYSTEM -
OF THE VILLAGE OF OAK BROOK, ILLINOIS
WHEREAS, the Village of Oak Brook, a municipal corporation ("Village") in the State of Illinois
("State"), approved a"Local Agency State Agreement For Jurisdictional Transfer("Agreement")on June 8,
1999,for transfer of jurisdiction of a portion of 22nd Street to the State highway system;and
WHEREAS,the Village and the State have agreed that the jurisdictional transfer should occur no
sooner than July 1, 1999;
WHEREAS,as part of the agreement between the parties,the Village has agreed to maintain the
portion of 22nd Street described below for the period April 1 through October 31;
NOW,THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1• That that portion of 22nd Street from the east edge of pavement of Illinois Route 83 to
the west edge of pavement at Clearwater Drive is deleted from the municipal street system effective
twenty-one (21)calendar days after execution of the Agreement by the State but not before the State
accepts the 22nd Street/York Road improvements;

for the period April 1 through October 31 per the agreement.
motion 33: That the Village Clerk is authorized and directed to forward a certified copy of this
ordinance to the State of Illinois through its District Engineer's office at 201 West Center Court,
Schaumburg, Illinois.
