INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF OAK BROOK AND
THE COUNTY OF DU PAGE AND THE DU PAGE COUNTY EMERGENCY TELEPHONE
SYSTEM BOARD FOR THE MASTER STREET ADDRESS GUIDE AND THE
GEOGRAPHIC INFORMATION SYSTEMS MAPS
WHEREAS, the Constitution of the State of Illinois, 1970,
Article VII, Section 10, authorizes units of local government to
contract or otherwise associate among themselves in any manner
not prohibited by law or ordinance; and
WHEREAS, 5 ILCS 220/1 et seq. entitled the
"Intergovernmental Cooperation Act, " provides that any power or
powers, privileges or authority exercised or which may be
exercised by a unit of local government may be exercised and
enjoyed jointly with any other unit of local government; and
WHEREAS, 5 ILCS 220/2 defines a public agency as follows :
' any unit of local government as defined in the Illinois
Constitution of 1970, any school district, any public
community college district, the State of Illinois, any
agency of the State government or the United States, or of
any other State, any political subdivision of another State,
and any combination of the above pursuant to an
intergovernmental agreement which includes provisions for a
governing body of the agency created by the agreement . '
WHEREAS, the Village of Oak Brook is a unit of government
within the definition of the Intergovernmental Cooperation Act
and is a member of the DuPage County Emergency Telephone System
Board; and
WHEREAS, the Village of Oak Brook and the County of DuPage
have determined that there presently exists a need for
maintaining a master street address guide and creating a
geographic information system map for purposes of 9-1-1 which
will serve the residents of the Village of Oak Brook and the
County of DuPage; and
WHEREAS, the Village of Oak Brook and the County of DuPage
and the DuPage County Emergency Telephone System Board have
specified the procedures by which the Village of Oak Brook, the
DuPage County Emergency Telephone System Board and the DuPage
County Data Processing Department of DuPage County government
shall provide annexation information, addresses and map
information to each party to the Intergovernmental Agreement and
to Ameritech and SCC for purposes of 9-1-1 .
NOW, THEREFORE BE IT RESOLVED by the County Board of DuPage
County that the County Board Chairman is hereby authorized to
execute the Intergovernmental Agreement (attached hereto and made
a part hereof) on behalf of the County of DuPage, the DuPage
County Data Processing Department and the DuPage County Emergency
Telephone System Board; and
BE IT FURTHER RESOLVED that copies of the foregoing be sent
to the Auditor, Treasurer, Finance Department, County Board -
Nancy Hauptman; State ' s Attorney' s Office - Nancy Wolfe; Data
Processing - Don Zeilenga; GIS - Bill Faedtke; and the Village of
Oak Brook, DuPage County Emergency Telephone System Board.

A RESOLUTION AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT
WITH THE COUNTY OF DU PAGE
AND THE DU PAGE COUNTY EMERGENCY TELEPHONE SYSTEM BOARD
BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS that the Village President and
the Village Clerk are authorized and directed to execute an "Intergovernmental
Agreement Between The Village Of Oak Brook And The County Of DuPage And The
DuPage County Emergency Telephone System Board For The Master Street Address
Guide And The Geographic Information Systems Maps", a copy of which is
attached hereto as Exhibit A.
That this resolution shall be in full force and effect from and after
passage and approval pursuant to law.
PASSED AND APPROVED this 23rd day of May, 1995 by the President and
Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties,
Illinois, according to a roll call vote as follows:

THIS AGREEMENT is made and entered into this 24th
day October , 1995, between the Village of Oak
Brook, a unit of local government, the County of DuPage, a
unit of local government, and the DuPage County Emergency
Telephone System Board, a board appointed by the DuPage
County Board as authorized by state statute.
WHEREAS, the Constitution of the State of Illinois,

Board have specified the procedures by which the Village of
Oak Brook, the DuPage County Emergency Telephone System

Board and the DuPage County Data Processing Department shall
provide annexation information, addresses and map
information to each party to the Intergovernmental Agreement
and to Ameritech and SCC for purposes of 9-1-1.
NOW, THEREFORE, based upon the above premises, the
conditions set forth below, the parties hereto agree as
follows:
1. MAINTENANCE OF MASTER STREET ADDRESS GUIDE AND MAPS
The DuPage County Data Processing Department shall
maintain the master street address guide and the
geographic information system address maps on a
contractual service basis for the DuPage County
Emergency Telephone System Board. The DuPage County
Data Processing Department shall enter all addresses on
the geographic information system maps stored on the
DuPage County Data Processing Department main frame
computer located at 421 N. County Farm Road, Wheaton,
Illinois. In addition, the DuPage County Data
Processing Department shall enter all addresses on the
SCC Geo Graphic File Manager and make all corresponding
changes to the 9-1-1 Master Street Address Guide which
assigns an Emergency Service Number specifying the
correct police, fire and emergency service agencies to
the address. The DuPage County Data Processing
Department shall transmit the changes to the master
street address guide to Ameritech, 8426 West Grand
Avenue, Floor 2, River Grove, Illinois, 60171
(708-452-3342) via the U.S. mail or electronically via
the SCC GGM tool when such technology becomes available
and compatible with the County of DuPage and Ameritech.
2 . SUBMISSION OF MAP DATA BY THE MUNICIPALITIES
The Village of Oak Brook shall transmit to the DuPage
County Emergency Telephone System Board 9-1-1, ATTN:
MSAG, 421 N. County Farm Road, Wheaton, Illinois 60187,
within seven (7) working days after the official
government act whereby a change is made in map data,
including but not limited to, all addresses, street
names, plats of subdivisions, annexations,
deannexations, address modifications, police beats,
fire reporting districts, municipal boundaries, police
boundaries and fire boundaries.
All submissions of map data must contain the following
information:
1. A copy of the official document enacted by ' the
unit of government.
2 . A legible plat of survey or map showing cross
streets and adjacent streets of the affected
parcel.
3. All street names, including designations such as
street, lane, avenue, etc. , all addresses written
on the specific parcel.
4. A legal description of the parcel and the
permanent index number (PIN) for each parcel and
address.
5. Any old addresses which are discontinued or
replaced by new addresses.
6. List of the property owner, if known, and a copy
of the notice to the property owner from the
municipality advising the owner of his/her new
address.
7. Subsequent or additional modifications or
development of a previously annexed vacant parcel.
3. INDEMNIFICATION
The Village of Oak Brook, to the fullest extent
provided by law, shall defend, indemnify and hold
harmless the County of DuPage, its agents and
employees, the DuPage County Data Processing
Department, it agents and employees, and the DuPage
County Emergency Telephone System Board, its agents and
employees against any and all claims by third parties
(including legal fees and expenses) arising in whole or
in substantial part out of any negligent acts or
omissions committed by the Village of Oak Brook under
this Agreement for all matters involving the master
street address guide and/or map. The County of DuPage
County, the DuPage County Data Processing Department,
and the DuPage County Emergency Telephone System Board
shall promptly notify the Village of Oak Brook of any
claim and thereafter fully cooperate with the defense
of any and all claims. This obligation to indemnify
shall survive termination of this Agreement. This
indemnification shall survive failure of any exclusive
remedy.
4 . TERMINATION
The County of DuPage, DuPage County Data Processing
Department, and the DuPage County Emergency Telephone
System Board may terminate this Agreement for failure
of the Village of Oak Brook to provide said map data as
provided for in this agreement. The County of DuPage
shall notify the Village of Oak Brook in writing of the
noncompliance. The Village of Oak Brook shall have
thirty (30) calendar days thereafter to correct or
contest said noncompliance. Failure to correct said
noncompliance and to provide the correct map data shall
constitute a basis for the disconnection of the Village
of Oak Brook from the County's mapping system and the I
SCC CAD system. The Village may be reinstated on the
County mapping system and the SCC CAD system upon
furnishing the updated and corrected map data in
accordance with paragraph one herein.
5. EFFECTIVE DATE
This Agreement shall be effective when signed by the
County of DuPage, the DuPage County Data Processing
Department, the DuPage County Emergency Telephone
System Board and the Village of Oak Brook. This
Agreement may be modified upon the written request of
the County of DuPage, the DuPage County Data Processing
Department, System Department, the DuPage County
Emergency Telephone System Board and the Village of Oak
Brook.
IN WITNESS WHEREOF, the undersigned governmental units,
department of government and the DuPage County Emergency
Telephone System Board caused this Agreement to be duly
executed and attached herewith are copies of the respective
resolutions authorizing the signing official to execute this
Agreement and have set their signatures on the respective
dates set forth below. This document may be signed in
duplicate originals.

8. Two-year time period for Certificate of Occupancy for Special Use.
9. The burying of overhead utility lines when improvements are made on
the property.
10. Village of Oak Brook review of sub-leases concurrently with the
Forest Preserve District of DuPage County.

A lengthy discussion ensued of the uses for the property in a sub-lease
form from Atelier International.
Alexander Ertas, Executive Director of Atelier International, spoke to the
high level of institutions in mind for participation at the location.
The Board requested an opportunity to review a draft of the ordinance
before the next Regular Board meeting.
Robert Strukoff, Director of Operations, spoke to the integrity of the
programs.
D. REQUEST FOR APPROVAL - PLAT OF EASEMENT - TOWN & TOWN & COUNTRY
COUNTRY HOMES - ANVAN PHASE IV WATER SERVICE REQUEST: HOMES - ANVAN
PHASE IV WATER
At the Village Board meeting of May 25, 1993, the Board approved a SERVICE REQUES
Water Service Agreement with Anvan Development Corporation for
property bounded between Meyers Road, 18th Street, Luther Avenue, and
16th Street within the City of Oakbrook Terrace. Anvan has since sold
the project to Town & Country Homes and the project is now proceeding.
The granting of easements to the Village of Oak Brook over those
portions of the property on which a water system will be constructed is a
part of the documentation furnished by Town & Country Homes.
Motion by Trustee Payovich, seconded by Trustee McInerney, to approve
the Plat of Easement from Town & Country Homes. VOICE VOTE:

The E911 Emergency Telephone System Board (E.T.S.) is purchasing SYSTEM
VILLAGE OF OAK BROOK Minutes Page 12 of 13 May 23, 1995
and installing a computer aided dispatch center for the Oak Brook Police
Telecommunications Center. It is being done for all telecommunications
centers in DuPage County who are members of the county E911 System.
Prior to the installation of the equipment, the Board requests the
execution of an Intergovernmental Agreement. The agreement requires
the Village to periodically submit map data to the E.T.S. Board when
jurisdictional changes occur; such as annexations, de-annexations, street
name changes, etc.

Approve and sign the attached Intergovemment Agreement between the DuPage
County E911 Emergency Telephone System Board (E.T.S.) and the Village of Oak
Brook.
The E911 E.T.S. Board is purchasing and installing a computer aided dispatch center
for the Oak Brook Police Telecommunications Center. They are doing this for all
telecommunications centers in DuPage County who are members of the county E911
System.
Prior to the installation of the equipment they request the execution of the attached
agreement. The agreement requires the Village to periodically submit map data to the
E.T.S. Board when jurisdictional changes occur; such as, annexations, de-annexations,
street name changes, etc.
I have met with the Village Engineer Dale Durfey and the Director of Code Enforcement
Tom Hawk. They have indicated that they can meet the submission requirements as
listed in Section 2 of the agreement. The Village Attorney has approved the agreement
as to form.
