WHEREAS, an application has been filed by Karyn Grane and Paul Grane ('Petitioner")
requesting a variation to allow the 60 -inch high fence, as constructed, to remain on the property located at
610 Lakewood Court, Oak Brook, Illinois ( "Subject Property "); and
WHEREAS, on June 7, 2011 the Zoning Board of Appeals conducted a public hearing on the
request for a variation, pursuant to due and appropriate legal notice; and
WHEREAS, the Petitioner, along with specific conditions stipulated below, has offered and
agreed to reduce the size of the fence to conform with the zoning regulations at the time of the sale of the
property, or upon moving from the property and has agreed to a deed restriction if the Petitioner sells the
property; and
WHEREAS, the Zoning Board of Appeals found that the Petitioners satisfactorily addressed the
factors required for approval of the requested variation and made specific findings, including that the
variation will not endanger the public health, safety and welfare, and that there will be no substantial injury
to other property in the neighborhood and recommended approval of the variation subject to certain
conditions; and
WHEREAS, the President and Board of Trustees have reviewed the recommendation of the
Zoning Board of Appeals and deem the variation as set forth below to be in the best interests of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein.
Section 2: The Petitioner is hereby granted a variation to allow the 60 -inch high fence as
constructed to remain on the Subject Property, subject to the following conditions:
A. If the property is sold, or if the child no longer has special needs, or if the child moves from
the home, the fence would be brought into compliance with the zoning regulations of the
Village in effect at that time and at the expense of the Petitioner; and
B. That the Petitioners execute an agreement, within thirty (30) days of the date that this
ordinance is passed, restricting the Subject Property by requesting that the fence be brought
into compliance with the zoning regulations of the Village in effect at that time if Petitioner
sells the property or no longer resides at the property, and
C. Should an event occur that would require the fence to be reduced in height in order to be in
compliance with the zoning regulations of the Village in effect at that time, the current style
and structural integrity of the fence are to be maintained when the size is reduced.

D. Comply with all other applicable rules and ordinances of the Village of Oak Brook.
Section 3: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance.
Section 4: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
Section 5: The effect of this ordinance is limited to the following property:

the Village of Oak Brook, Illinois, an Illinois municipal corpo ation (the "Village"), and Karyn Grane
and Paul Grane (the "Petitioners"), individuals and property owners in the Village,
WITNESSETH:
WHEREAS, on April 25, 2011, Karyn Grane and Paul Grane, the owners of the property at
610 Lakewood Court, Oak Brook, Illinois (the "Subject Property"), petitioned the Village for a
zoning variation to allow a 60-inch high fence as constructed to remain on the Subject Property;
and
WHEREAS, on August 9, 2011, the Village approved Ordinance 2011-ZO-V-S-1316, "AN
ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF SECTION 13-3-6B OF
TITLE 13 ("ZONING REGULATIONS") OF THE VILLAGE CODE OF THE VILLAGE OF OAK
BROOK RELATIVE TO FENCE HEIGHT FOR THE PROPERTY AT 610 LAKEWOOD COURT IN
THE VILLAGE OF OAK BROOK" (the "Variation Ordinance"), by which the Village granted a
variation from its zoning regulations allowing the 60-inch high fence as constructed to remain on
the Subject Property, subject to the condition that Karyn Grane and Paul Grane execute an
agreement, within thirty (30) days of August 9, 2011, restricting the Subject Property by requiring
that the fence be brought into compliance with the Zoning Regulations of the Village in effect at
that time if Petitioner sells the property or no longer resides at the Subject Property; and
WHEREAS, the Variation Ordinance was recorded with the DuPage County Recorder of
Deeds on August 17, 2011 as Document No. R2011-096649;
NOW THEREFORE, in consideration of the approval of the requested variation, Karyn
Grane and Paul Grane hereby agree as follows:
1. To bring the 60-inch high fence into compliance with the Zoning Regulations of the
Village in effect at that time, if Petitioner sells the property or no longer resides at the
Subject Property; and;
2. To execute the "Declaration of Restrictive Covenant" attached hereto as Exhibit "A" (the
Declaration"), which shall be recorded by the Village as a restriction on the title of the
Subject Property.

RECOMMENDED MOTION: I move to concur with the recommendation from the Zoning
Board of Appeals and approve the requested variation to permit a 58-60 inch high fence at 610
Lakewood Court subject to the following conditions: If the property is sold, or if the child no
longer has special needs, or if the child moves from the home, the fence would be brought into
compliance with the zoning regulations of the Village at that time and at the expense of the properiy
owner; and authorize the Village Attorney to prepare the necessary ordinance for �nal
consideration at the August 9,2011 Board of Trustees meeting.
Background/Historv:
At its meeting on June 27, 2011, the Zoning Board of Appeals held the required public hearing on the petition
from Karyn Grane, the owner of the property located at 610 Lakewood Court seeking approval of a variation to
Section 13-3-6B of the Zoning Ordinance in order to allow an existing 60-inch high fence to remain as
constructed on the property. The fence is located around the perimeter of the properiy which is located around
the side and to the rear of the home.
According to information provided by the petitioner, a permit was issued by the Village of Oak Brook for the
construction of a 42-inch high fence on October 5, 2009. The final inspection for this fence failed because its
height of 58-60 inches was not consistent with the approved permit and exceeded th'e 42-inch maximum
permitted by Village Code. The applicant was advised to either, reduce the height of the fence,remove the fence
or seek the approval of a variation.
The petitioner testified that they needed a fence that exceeded the Village's 42-inch height limitation in order to
keep their special needs child safe. A letter from the Elmhurst School District 205 provides further
documentation relative to the child's condition.

Chairman Davis reviewed the requested variation and swore in those that would
provide testimony. He noted that the 60" fence had been installed and was in
use. He noted that the applicant had received approval from the Forest Glen
Homeowner Association.
Paul Grane, 610 Lakewood Court said that they were seeking approval to
maintain a fence that it is higher than the m�imum allowable height for fences.
He apologized for having already erected the fence. At the time the fence was
being installed they had a few 911 calls for their 7 year old son with autism
who had gone missing from their home. They were not thinking clearly at the
time and just wanted to get a fence in place.
When they realized that they were in violation of the height restriction they had �
every intention of applying for a variation, but that unfortunately became a back
seat to all of the other needs of their son who is mostly nonverbal and does not
speak very much. Childxen with autism are prone to wandering, which is the
case with their son. They have implemented many security measures with
locks and a security system, but he still finds ways to escape. There is a pond
directly behind their house and he is drawn to the water. He does not swim and
has already gone into the pond. A 42-inch high fence does not contain him and
he has figured out how to climb the 60-inch fence. They are already taking
additional measures to add shrubbery to hide the hinges so that he cannot climb
over it.
They have spoken to their neighbors and the homeowner association and have
been given approval by everyone. There is also a letter from the child's
principal stating his condition and the special school that he attends. They are
trying to keep their son safe and protected in their neighborhood.
The standards were submitted in writing as part of their application, and are in
the case file. In addressing some of the standards, he stated that these are
unique circumstances since the child has autism. Children with autism are
prone to wandering and there is a pond located directly behind their home, he is
attracted to water and cannot swim.

If granted, the variation will not alter the essential character of the locality and
they have received written approval from the homeowners association. Prior to
installation, they had provided samples of the fence to the board and it was also
shown to both neighbors.
Chairman Davis confirmed that as part of the approval of the variation the
applicants stated that they were willing to remove the fence should they move
or if they child was no longer living at the home.

received approval of a 42-inch high fence and added that the condition could
include approval to reduce the height of the fence to that of being in compliance
with the zoning regulations at the time of property is sold, etc.
Chairman Davis stated that the standards had been addressed to recommend
approval of the requested variation.
Motion by Member Bulin, seconded by Member Ziemer to recommend
approval of the requested variation to allow the existing 60-inch fence to
remain on the property subject to the following conditions:
If the property is sold or if the child leaves the home, the fence would be
brought into compliance with the zoning regulations at that time or be
removed all at the expense of the property owner.

Dear ZBA Members and Chairman Davis,
This is a letter to offer testimony that the Forest Glen Homeowners Association fully
supports the Grane's having the fence they have installed—which I believe is 60"high.
Paul and Kary Grane came to the Forest Glen board and requested that we allow a fence
so their young son Adam,who is autistic and DOES NOT respond to verbal commands,
has a higher level of protection to keep him from the two nearby ponds which he has a
very strong attraction to. We approved the request, which was made in accordance with
our covenants in advance of the fence being installed. I understand that the decision to
increase the height to 60"was a decision made when they were ready to do the install and
realized a 42"fence would not protect Adam and keep him confined.
A couple of our boaxd members and I have personally witnessed Adam wandering down
the middle of the streets in Forest Glen—unconcerned and aware the danger cars and
trucks pose, after a sibling left the front door unlocked. It truly is a scary and sobering
thing to witness this.
I have also seen Adam trying to climb the fence and fortunately it is high enough that he
has not been able to get over it. Adam's family is very much in tune to the need to watch
Adam and he has a wonderful older sister and brother who help Kary and Paul watch and
protect him.
I am asking other members from the Forest Glen Board to attend your meeting and share
our board's support for this critical variance request.
I am confident once reviewed, you will vote YES to the variance, for the safety of young
Adam.
I would also like to point out that the Grane's, without hesitation, agreed to removing the
fence at their expense when they move or Adam is no longer living at the home. They
are good neighbors,that follow Oak Brook's laws (getting a permit) and who feel that
Forest Glen's covenants apply to ALL Forest Glen residents,they sought prior approval
as mandated.

DISCUSSION:
Ms. Karyn Grane, the owner of the home located at 610 Lakewood Court has submitted a
petition seeking approval of a variation to Section 13-3-6B of the Zoning Ordinance in order to
allow an existing 60-inch high fence to remain as constructed on the property. The fence is
located around the perimeter of the property which is located around the side and to the rear of
the home. According to information provided by the petitioner, a permit was issued by the
Village of Oak Brook for the construction of a 42-inch high fence on October 5, 2009. The final
inspection for this fence failed because its height of 58-60 inches was not consistent with the
approved permit and exceeded the 42-inch maximum permitted by Village Code. The applicant
was advised to either, reduce the height of the fence, remove the fence or seek the approval of a
variation.

Staff Comments:
1. At the March 1, 2011 Zoning Board of Appeals meeting, comments were made as part of
the discussion on another (fence height) case that the Forest Glen Homeowner

Association had previously approved plans for a fence. Staff found that a fence permit
was issued for a 42-inch high fence at 610 Lakewood Court. However, none of the
required inspections had ever been request from the Community Development
Department.
2. The Building Inspector inspected the fence on March 2, 2011 and it was discovered that
the fence installed was 58-60 inches high and exceeded the 42-inch height maximum
allowed.
3. As such, the petitioner was told of the following options; remove the fence, reduce the
height of the fence to 42-inches or request a variation.
4. Staff has received written comments from the homeowners association on the requested
variation(see case file).
RESPONSIBILITIES OF HEARING BODIES:
The Zoning Board of Appeals has the responsibility to make a recommendation on a request
for a variation. Please include in your consideration, your findings with respect to the
standards specified in the Zoning Ordinance for a variation. Those standards are:
"Section 13-14-6 D. Standards:
1. The Zoning Board of Appeals shall not recommend a variation of the provisions of this
Title as authorized in this Section unless it shall have made findings of fact based upon the
evidence presented to it on the following specific issues that:
a. The property in question cannot yield a reasonable return if permitted to be used only
under the conditions allowed by the regulations governing the district in which it is
located.
b. The plight of the owner is due to unique circumstances.
c. The variation, if granted, will not alter the essential character of the locality.
2. For the purpose of supplementing the above standards,the Zoning Board of Appeals, in
making the determination whether there are practical difficulties or particular hardships,
shall also take into consideration the extent to which the following facts, favorable to the
applicant, have been established by the evidence that:
a. The particular physical surroundings, shape,.or topographical conditions of the specific
property involved would bring a particular hardship upon the owner as distinguished
from a mere inconvenience if the strict letter of the regulation were to be carried out.
b. The condition upon which the petition for variation is based would not be applicable
generally to the other property within the same zoning classification.
c. The granting of the variation will not be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is located.

d. The proposed variation will not impair an adequate supply of light and air to adjacent
property, or substantially increase the danger of fire, or otherwise endanger the public
safety or substantially diminish or impair property values within the neighborhood.
e. That the purpose of the variation is not based exclusively upon a desire to make more
money out of the property.
f. That the alleged difficulty or hardship has not been created by any person presently
having an interest in the property."
The materials submitted by the applicant specifically address these standards.
CONCLUSION:
If the Zoning Board of Appeals is of the opinion that the applicant has satisfied the requirements
for a variation to Section 13-3-6B of the Zoning Ordinance for the property located at 610
Lakewood Court, a recommendation would be in order to approve the request subject to
reasonable conditions. One of those conditions could relate to the length of time that the existing
fence could remain on the property. Such a condition was made by the Forest Glen Homeowners
Association May 19, 2009 approval letter (see case file).
However, if you determine that the petitioner has not satisfied the required standards for a
variation,the request should be denied.
Findings of fact, which are the basis of the Zoning Board of Appeals determination, should be
stated as part of either motion. The recommendation may state any conditions reasonably related
to the petition, which the Zoning Board deems necessary to protect the public interest.

Dear Mr. Kallien,
I received a letter from Bill Hudson on March 10�`and I spoke with him today. 1VIy home
is currently in violation for having a fence 18"too high from the acquired permit from a
couple of years ago. After speaking with Bill, I have two options: lower it 18" or take it
down.
My son Adam has Autism. At the time of the permit a couple of years ago,my wife
applied for the perxnit after the 2"d and documented 911 call because Adam disappeared
and was nowhere to be found. He was found and at that time we put up a fence--
immediately. The only fence permit we could get was a 42"in height. Adam is a very
strong climber and would easily climb over a 42" fence. A 60" is just high enough to keep
him safe and protected.,Because we have a concrete stoop on the side of the house which
has a 12" step, at that point it only makes the 48"height but fortunately that hasn't clicked
with him yet. A 42"total height fence at that step would make it a mere 30"height, a
simple up and over for him.
After the installation, our intention was to go through the variance process,but our first
intention was to get Adam safe and immediately. We did not follow through on that
process and I am sorry. It was forgotten.
Being that our residency is in Forest Glen,we are in the Elmhurst School District. Adam
is in the Special Education program and currently attends Hawthorne School. Wlien I
approached Harry Peters and the FGHA Board,they requested a letter from the School,
stating that a fence is needed to keep him safe due to his impulsivity,which was provided
by the School Principal. Our home also backs up to a Pond as well. As I hope you can
see,this is necessary for our son's safety. Adam is now seven and is still unable to swim.
The FGHA also wanted to see the fence we erected and everyone in the community enjoys
it. It is very attractive and upholds our community. Our back yard also has a common
yard with a park and everyone sees our fence and comments how nice it is during our
FGHA parties and get togethers. We put bushes to the front and rear in order to minimize
the visualization of it as well. This was also asked of us and we complied with the FGHA

requests. Further, in case we ever move,the fence has to come down,which was also
agreed to by me with the FGHA.
After Bill and I spoke,his recommendation was to write you and see what can be done. I
would be happy to appeal to the Village Board or go through whatever process I need to in
order to protect Adam and to seek approval to keep our fence at 60". If I am in violation of
any rules, which it appears I am,then I need to correct them. Tearing down the fence or
lowering to a dangerous height will only expose Adam to further danger and risk. I hope
the Village will be sympathetic to my request. Please let me know what we can do to
remedy this situation.

On March O 1,2011, Mrs.Julis Marcionetti,a Forest Glen Homeowners Association (FGHA)
Board member,told Dr.Ann and Mr.James Degerstrom that the fence at 610 Lakewood Court(Lot#062)
was already approved at five(5)foot high and the Village had been informed of the FGHA Board
approval. This was shortly after an Appeals Board meeting ah a four(4}foot fence at 15 Glenable Court
(Lot#119). During the March O1 meeting Hany Peters,President of FGHA Board,said the four(4)foot
fence(his error}was something not liked because it"blocked the view".
The fence at 610 Lakewood Court Lot#062)was approved because it was needed for the
protection of a severe autistic child. Why it was erected at five(5)feet is unclear. Fences around pools are
to be no higher than four(4)feet. Of note,Forest Glen has twelve(12)in-ground outdoor fenced in
swimining pools. A liouse at 809 Wildwood Court�ias a five(5)foot fence aromid a sinall patio area at its
south side which the owner uses as a tool storage area It is an uncovered area and is attached to the garage.
It is in the same court as Mr.Peters home.
We,as twenty-four(24)plus years of residents in Forest Glen,strongly believe that all the fences
presently in place shouid be accepted by the Oak Brook Village at their current height. To change would
cause additional expenses in tough economic times. We already have two pools not being used for the last
three(3)years due to severe damage and the expense of repairs. The families at b 10 Lakewood Court and
15 Glenoble have suffered enotigh hardships and tmacceptable abuse by the Forest Glen Homeowners
Association Board.
We regret the fact that it is impossible for us to attend the Jane 07,2011 meeting.Tt appears all

A fence permit application was issued on October 6, 2009. The final inspection failed because
the fence height of 58-60 inches exceeded the maximum 42 inches allowed. The applicant was

Dear Village Board,
I am seeking approval to maintain a fence that is higher than the maximum allowable
height for fences in Oak Brook. I apologize for already erecting the fence. At the time of
the fence installation,we had already had a few calls to 911 after Adam had gone missing
from our home. I was not thinking clearly at the time and was just focused on getting a
fence in place. When my husband realized that we were in violation of the height
restriction,we had every intention of applying for the variance,but it unfortunately took a
back seat to a11 of our son's other needs. Again,we apologize for the delay of this
petition and any inconvenience it may have caused the village.
Our 7 year old son has autism. This is a disorder that affects his ability to speak and
understand things. He is mostly non-verbal. Children with autism are prone to
wandering. This is definitely the case with our son. We have taken many security
measures with locks and a security system,but he still manages to find ways to escape.
He loves the water and we have one pond behind our house and one that is behind the
homes at the end of our cul-de-sac. He cannot swim. This poses a major security risk.
He has already gone in the pond. We have also had to ca11911 on a few occasions
because he got out without anyone's knowledge. A four foot fence would not contain
him because he is already that tall. He has already figured out how to climb our five foot
fence and we are talking with our landscaper to decide what shrubbery to put in front of
the fence to deter him.
As you can see in the documentation,we have spoken to our neighbors and our
homeowners association has given approval for the reason for and style of fence. We
have a letter from Adam's principal sta.ting his condition and the police deparhnent has
records of the 911 calls that have been made from our home.
I am sure you can understand my desire, as a parent,to keep my son safe and protected.
My husband and I are doing everything we can think of and just need your help with this
safety measure.

Forest Glen Homeowners Association:
I have been asked by Mr. Grane to write#his letter regarding the special education needs of their son,
. Adam Grane. Adam has the educational special education eligibility of Autism and is participating in our
special education programs at Madison Early Childhood Center in District 205. This program is specifically
designed to meet the needs of ASD students and is staffed with one adult per every two students to meet
their educational needs. Adam requires consistent supervision paired with specialized supports to keep
him safe at school. This includes restricting the environment (clear physical boundaries)to keep him within
a defined physical space. Adam will require this same support at home in terms of a fence to define safe
physical space. He typically will flee although he does not always have a specific goal in mind as to where
he is running to. My understanding is that there is also a pond in close proximity to the Grane's home.
This is an obvious danger and needs to be addressed with a fence to keep Adam safe.

VARIATION STANDARDS
1. a. The property in question cannot yield a reasonable return if permitted to be
used only under the conditions allowed by the regulations governing the district
in which it is located.

RESPONSE:
Our son, Adam, has autism. Children with autism are prone to wandering. We have a
pond behind our home and he is very attracted to water but cannot swim. Therefore,
his safety is at risk.
1. c. The variation, if granted, will not alter the essential character of the locality.
RESPONSE:
We have approval from the homeowners association regarding the need for and look
of the fence.
2. a. The particular physical surroundings, shape, or topographical conditions of
the specific property involved would bring a particular hardship upon the owner
as distinguished from a mere inconvenience if the strict letter of the regulation
were to be carried out.
RESPONSE:
Our son is attracted to water but cannot swim. There is one pond behind our house
and another behind the homes at the end of our cul-de-sac. Just as pools require a
fence to prevent people from getting in, we are trying to prevent our son from getting
out to the ponds.
2. b. The condition upon which the petition for variation is based would not be
applicable generally to the other property within the same zoning classification.

RESPONSE:
The reason for our petition is the safety of our son who has special needs. If he
didn't have autism, we would not be requesting a fence.
2. c. The granting of the variation will not be detrimental to the public welfare or
injurious to other property or improvements in the neighborhood in which the
properly is located.
RESPONSE:
The fence would be on our personal property. Therefore, it would not pose a
detriment to others or their property.
2. d. The proposed variation will not impair an adequate supply of light and air to
adjacent property, or substantially increase the danger of fire, or otherwise
endanger the public safety or substantially diminish or impair property values
within the neighborhood.
RESPONSE:

Our agreement with the homeowners association requires us to remove the fence if
