AN INTERGOVERNMENTAL AGREEMENT ESTABLISHING
THE DUPAGE METROPOLITAN ENFORCEMENT GROUP (DUMEG)
I. PURPOSE:
In order to combat the multijurisdictional illegal
trafficking of narcotics, controlled substances and
dangerous drugs, the undersigned law enforcement agencies
hereby agree to pool and integrate law enforcement
resources and personnel the DuPage County Metropolitan
Enforcement Group (hereafter referred to as DUMEG) to
coordinate the enforcement of drug laws without regard to
Jurisdictional boundaries and to cooperate with State and
Federal enforcement groups.
II . AUTHORITY:
This agreement is entered into by the undersigned pursuant
to the provisions of Article VII, Section 10, of the 1970
Constitution -of the State of Illinois; the "Intergovern-
mental Cooperation Act" , Illinois Revised Statutes,
Chapter 127, Section 743 (1975) ; and the "Intergovern-
mental Drug Law Enforcement Act" , Illinois Revised
Statutes, Chapter 56 1/2, Section 1701 ( 1983 ) .
III. ORGANIZATION: j
A. Policy Board
i
The undersigned agree that effective use of its personnel,
in the enforcement of drug laws, requires that a Policy
Board shall be established. The DUMEG Policy Board shall
be composed of an elected public official, or his
designee, and chief law enforcement officer, or his
designee, from each participating law enforcement agency.
A local unit. of government may authorize the transfer of
municipal funds to DUMEG in lieu of providing personnel to
participate in the program. The Policy Bard shall
supervise and oversee the operations of DUMEG, and make
such reports to the Director of the Department of State
. Police as that Department may require. In accordance with
the expressed legislative intent in the "Intergovernmental
Drug Law Enforcement Act" , the Policy Board shall
determine that DUMEG operations are limited exclusively to
enforcement of drug laws of this State, sister States or
of the United States.

B. Executive Committee
The Executive Committee of the Policy Board shall be
comprised of the Chairman, Vice-Chairman, Executive
Secretary, designee of the Fiscal Officer and
participating law enforcement agencies contributing
personnel to DUMEG. The Executive Committee shall be
vested with the authority to act on behalf of the Policy
Board when an emergency or other situation makes it
impossible or impractical for the Policy Board to act.
The Executive Committee shall also make any decisions
required of the Policy Board during the interim period
between Policy Board meetings.
C. Fiscal Officer
An elected official of a participating unit of local
government shall be designated Fiscal Officer for DUMEG
upon appointment of the Policy Board. The Fiscal Officer
shall function as the sole Fiscal Officer for all
participating agencies in DUMEG. The Fiscal Officer shall
receive and disburse grant funds for the operation of
DUMEG, but at no time shall he consider the contribution
of manpower or personnel from the Department of State
Police as a basis for the 50 percent matching grant from
the State for the total operating budget from DUMEG. The
Director of the Department of Law Enforcement shall
monitor DUMEG and determine its eligibility to receive
State funding. Personnel salaries, the cost of leased
vehicles and equipment contributed by participating units
shall be considered in determining the amount of State
contribution under the grant.
D. Operating Director
The Policy Board shall designate by majority vote an
Operating Director who shall be responsible for the daily
operations of DUMEG. He shall report and be accountable
to the DUMEG Policy Board.
IV. OPERATIONS:
A. Each participating unit of local government may
contribute to DUMEG, personnel, equipment, or cash as
directed by the Policy Board.
B. It is expressly understood by and between the parties
that the police power of each member of DUMEG is
extended to all officers of DUMEG operating pursuant
to the terms of this agreement as provided for in
Illinois Revised Statutes, Chapter 127, Section 743
(1983 ) .

C. Sworn law enforcement officer recommended by the
Policy Board and appointed as Inspectors shall
continue to be employees of the participating units
and shall be compensated by the units in accordance
with their regular procedures and subject to the
rules and regulations of the parent agencies, as well
as those established by the Policy Board of DUMEG.
D. Personnel contributed by participating units who are
not sworn law enforcement officers shall continue to
be regular employees of the participating units and
shall be compensated in accordance with the
participating units ' regular procedures.
E. Personnel employed by DUMEG who are not sworn law
enforcement officers shall be subject to the rules
and regulations promulgated pursuant to the terms of
this agreement and such other regulations which may
be promulgated by DUMEG or the Illinois Department of
State Police.
F. Each unit of government providing personnel to DUMEG
shall provide gasoline and oil for one vehicle per
officer assigned to DUMEG.
G. Each participating law enforcement group shall retain
disciplinary authority and jurisdiction over their
sworn and not sworn personnel.
V. FISCAL YEAR:
The Fiscal year of DUMEG shall commence on July 1 and
terminate on June 30 of each year.
VI. EQUAL EMPLOYMENT OPPORTUNITY:
The undersigned participating units of local government
are Equal Opportunity Employers and agree to subscribe to
and comply with any and all laws, rules and regulations
pertaining to Equal Opportunity, and further agree to
abide by the rules and regulations of the Equal Employment
Opportunity Commission (EEOC) and the Illinois Fair
Employment Practices Commission (FEPC) .
VII. AMENDMENT:
This agreement may be amended at any time by written
approval of all participants named herein.
Any subsequent changes or amendments to this agreement are
binding upon all participants named herein.

VIII CANCELLATION:
This agreement may be cancelled at anytime by written
agreement of a majority of all participating governmental
units herein named. In the event of such cancellation of
this agreement, all equipment or materials purchased with
State funds shall revert to the Department of State
Police. Any personal property contributed by an
individual member shall remain the property of that
member. Individual members may withdraw from this Agree-
ment sixty (60) days subsequent to presenting the Policy
Board with a written declaration of its intention to with-
draw from this agreement. The initial participants to
this agreement are required to supply their agreed
contributions for a period of time not to exceed the
statutory fiscal year of the unit's authority to budget or
appropriate funds.
IX. RADIO-MAINTENANCE:
The Department of State Police agrees to maintain all
automobile radios assigned to DUMEG cars.
X. VEHICLESc
The Operating Director shall at the earliest feasible
time, lease vehicles as needed and release to a
participating member any vehicle contributed by that
member.
XI. INSURANCE:
The Operating Director shall obtain liability insurance
for the benefit of DUMEG, participating local governments,
representatives thereof serving in any capacity in DUMEG,
and sworn personnel to DUMEG. Such insurance and
indemnification coverage shall be in such an amount as
decided by the DUMEG Policy Board but not less than
$1 ,000,000. DUMEG shall acquire and maintain insurance in
excess of $1,000,000 for combined single limit liability
for personal injury, bodily injury, property damage,
punitive damage, and any violation of rights guaranteed by
the Constitution of the United States, any award of
attorney' s fees, costs, and a specific civil rights
endorsement covering claims arising under 42 U.S.C. ,
§ 1981, § 1983 , §1985, and §1988; and

XIII EFFECTIVE DATE:
This agreement shall become effective when subscribed by
two or more participating units of government. This
agreement shall be in full force and effective upon its
passage and approval in accordance with law.

DUPAGE COUNTY METROPOLITAN NARCOTICS AND DANGEROUS
DRUGS ENFORCEMENT GROUP POLICY BOARD
As Adopted October, 1985
PREAMBLE
The DuPage Metropolitan Enforcement Group Policy
Board is hereby formed pursuant to the
Intergovernmental Drug Law Enforcement Act, Illinois
Illinois Revised Statutes, Chapter 56h,
Section 1701 (1977) (Public Act 80-617, effective July
11 1977) , to collectively support the maintenance and
development of effective drug law enforcement practices
which will enhance the support and respect of the people
in the communities in which we serve.
ARTICLE I
THE NAME OF THE ORGANIZATION SHALL BE:
The DuPage Metropolitan Enforcement Group
(hereafter referred to as DUMEG) Policy Board.
ARTICLE II
MISSION STATEMENT:
To the end that the health, safety and welfare of
the People of the State of Illinois should be protected
from those who would violate the laws regulating the
productions, sale, prescribing, manufacturing,
administering, transporting, having in possession,
dispensing, delivering, distribution or use of a
controlled substance, as defined in the Illinois
Controlled Substance Act, and cannabis, as defined in
the Cannabis Control Act, by combining the Local, County
and .State resources, so as to achieve maximum

effectiveness.
ARTICLE III
DUMEG POLICY BOARD:
Section 1 - POLICY BOARD FUNCTION
A. The purpose of the Policy Board shall be to
support the maintenance and development of local drug
enforcement practices in our respective jurisdictions
and to promote interagency cooperation, communications
and training of personnel from the contributing
agencies.
B. To supervise, oversee and promulgate policy for t
the operations of the DUMEG and make such reports to the
Director of the Department of State Police as that
Department may require, and to ensure that DUMEG
operations are limited exclusively to enforcement of the
drug laws of the State and of the United States,
pursuant to the Intergovernmental Drug Law Enforcement
Act.

C. To designate by majority vote of a quorum of
the .members, a Director, who shall be
responsible for the daily operations of DUMEG,
including the discretionary power to approve,
reject,- and/or cause the subsequent removal of
personnel to be assigned to DUMEG by member
agencies. The Director shall report and be
accountable to the DUMEG Policy Board.
D. To designate an elected official from a
participating unit of local government as
Fiscal Officer, pursuant to the .
Intergovernmental . Drug Law Enforcement Act.
The Fiscal Officer Shall function as the sole
Fiscal Officer for all participating agencies
in DUMEG, and shall receive and disburse funds
for the operation of DUMEG and complete fiscal
reports as required by the Director of the
Department of State Police.
DUMEG POLICY BOARD MEMBERSHIP:
Section 2 - MEMBERSHIP
Membership of the DUMEG Policy Board shall be
composed of an elected public official or his designee,
and the chief law enforcement officer, or his designee,
from each participating law enforcement agency (those
contributing personnel and/or financially) , pursuant to
the Intergovernmental Drug Law Enforcement Act.
Section 3 - RIGHT TO VOTE
Each participating law enforcement agency shall
have one vote.
Section 4 - POLICY BOARD OFFICERS:
A. OFFICERS:

Officers of the DUMEG Policy Board shall
consist of the Chairman, Vice-Chairman, and
Executive Secretary.
B. ELECTION:
The election of Chairman and Vice Chairman shall
take place during the last Policy Board meeting of
each calendar year, with the newly elected officers
taking office on the lst of January of each
calendar year.

I;. DUTIES OF OFFICERS:
1. CHAIRMAN:
The Chairman shall preside at all regular
business and Executive Committee meetings
of the DUMEG Policy Board. In conducting
the meetings, it is the Chairman' s
responsibility to call the members to
order; to announce the business which is to
be conducted; to recognize members entitled
to the floor; to state and to put to vote
all questions which are regularly moved, or
necessarily arise in the course of -the
proceedings.
During the interim between Policy Board
and/or Executive Committee meetings, any
necessary business relative to the DUMEG will
be conducted via the Chairman, who will
convey same to the membership at the next
Board/Committee meeting.
2. VICE-CHAIRMAN:
The Vice-Chairman shall assume the duties of the
Chairman, during his absence, and any other duties
for the good of the Policy Board as requested by the
Chairman.
3. EXECUTIVE SECRETARY:
The duties of the Executive Secretary shall be
performed by the Director of DUMEG, unless otherwise
moved and voted on by the Policy Board, and shall
include, but not limited to; recording and
maintaining minutes of the Policy Board and/or
Executive Committee meetings, preparing and
providing materials to the membership for the
meetings, initiating correspondence as required by
the Policy Board/Executive Committee, and conducting
any other business as directed by the Chairman,
and/or the Policy Board/Executive Committee.
ARTICLE IV
COMMITTEES:
Section 1 - EXECUTIVE COMMITTEE:
A. The Executive Committee shall be a standing committee
comprised of the Chairman, Vice-Chairman, Executive
Secretary, designee-of the Fiscal Officer and
participating Law Enforcement agencies contributing
personnel to DUMEG.

B. The Executive Committee shall be vested with the authority
to act on behalf of the Policy Board when an emergency or
other situation makes it impossible or impractical for
the Policy Board to act.
C. The Executive Committee shall keep records and
minutes of all its meetings and present them to the
membership at regular Policy Board meetings.
Section 2 - OTHER COMMITTEES:
The Chairman may appoint other committees as deemed
necessary for the benefit and advancement of the DUMEG Policy
Board.
ARTICLE V
PROFESSIONAL STANDARDS:
Section 1
All DUMEG personnel and operations shall be conducted in ,such '
a way as to bring credit and not discredit upon the Unit, the
department the individual represents, and the Department of
State Police.
Section 2
Rules of Conduct for H.E.G. agents as prescribed by the
Director of the Department of State Police and their respective
parent agency shall be adhered to by assigned personnel to the
DUMEG.
Section 3
Agents assigned to DUMEG will uphold the' Constitution of the
United States, and the State of Illinois, and will obey all
Federal, State and local laws, court decisions, and orders of
courts having jurisdiction, and rules of conduct as set forth by
DUMEG their respective parent agency and Department of State
Police.

ARTICLE VI
BUSINESS MEETINGS.: .
Section 1 - POLICY BOARD MEETINGS:
The Policy Board shall meet not less than twice a calendar
year.
Section 2 - EXECUTIVE COMMITTEE MEETINGS:
The Executive Committee shall meet not less than quarterly, at
least thirty days prior to the commencement of each fiscal quarter.
Section 3 - OTHER MEETINGS:
The Chairman has the authority to convene any other meetings
of the Policy Board and/or Executive Committee, as may be deemed
necessary.
Section 4 - QUO
A majority of those members present of either the Policy
Board or Executive Committee will constitute a quorum.
Section 5 - ORDER OF BUSINESS:
The order of business shall be as follows:.
1. Call to order.
2. Roll call of membership.
3. Reading of minutes of the previous meeting.
4. Fiscal Report.
5. Report of the committee.
6. Old Business.
7. New Business.
8. Adjournment.
ARTICLE VII
AMENDMENTS TO THE CONSTITUTION AND BYLAWS
Section 1:
Any amendments to the Constitution and Bylaws shall be made by
a two-thirds vote of the full Policy Board.
Section 2:
All members shall be given written notice at least thirty days
prior on any proposed amendment.

A RESOLUTION AUTHORIZING THE EXECUTION OF AN
AGREEMENT TO PARTICIPATE IN THE
METROPOLITAN ENFORCEMENT GROUP (DuMEG)
WHEREAS, the State of Illinois Department of State Police has
established a program of coordination for the enforcement of drug laws in an
effort to provide a better response to illegal trafficking of narcotics,
controlled substances and dangerous drugs in multiple communities; and
WHEREAS, the Department of State Police, through the Intergovernmental
Drug Law Enforcement Act, Illinois Revised Statutes, Chapter 56-1/2, Section 1701
(1983) ("Intergovernmental Drug Law Enforcement Act") , provides for financial
assistance for the establishment of Metropolitan Enforcement Groups which meet
the minimum criteria established in Section 1703; and
WHEREAS, certain units of local government in DuPage County have
entered into an Intergovernmental Agreement for the purpose of establishing such
a Metropolitan Enforcement Group and have requested the Village of Oak Brook to
enter said Intergovernmental Agreement pursuant to the "Intergovernmental Drug
Law Enforcement Act"; and
WHEREAS, pursuant to Section 10 of Article VII of the 1970 Illinois
Constitution a unit of local government may exercise its corporate powers to
authorize participation in an Intergovernmental Agreement for the establishment
and operation of a DuPage Metropolitan Enforcement Group (DuMEG); and
WHEREAS, the corporate authorities of the Village of Oak Brook deem it
in the best interest of the Village to participate in the DuPage Metropolitan
Enforcement Group by approving the Intergovernmental Agreement establishing the
DuPage Metropolitan Enforcement Group.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Oak Brook, DuPage and Cook Counties, Illinois as follows:
Section 1: That the Intergovernmental Agreement, a copy of which is
attached hereto as Exhibit A, is hereby approved.
Section 2: That the Village President and Tillage Clerk are hereby
authorized and directed to execute on behalf of the Village of Oak Brook the
Intergovernmental Agreement (Exhibit A) establishing the DuPage County
Metropolitan Group (DuMEG).
Section 3:^ That the Village ?resident, or his designee, is hereby
authorized to serve on the Policy 3oard .of the DuPage ;Metropolitan Enforcement
Group (DuMEG) and to participate otherwise as authorized pursuant to the
Intergovernmental Agreement.
Section 4: That the Village Clerk is hereby directed to forward a copy
of the executed Intergovernmental agreement together with a certified copy of
this Resolution to the Co—orainator of the DuPage Metropolitan Enforcement Group
as evidence of the Village's consent to, and authorization of, the
Intergovernmental Agreement.
Section 5: That this Resolution shall be in full force and effect from
and after its passage and approval as provided by law.
