Recommendation Text Amendment — The Plan Commission, by a vote of 4 to 0 and the Zoning Board of Appeals, by a vote of 6 to 0 agreed that the applicant addressed the required standards to recommend approval of a text amendment to amend Section 13-11-8A of the Zoning Ordinance. Approval was subject to revising the language to reduce the allowed total square footage from 200 feet to 126 square feet; each sign face not to exceed 63 square feet; and reduce the requested sign height from 15 feet to 10'6". The proposed text to be added would read as follows: 2. The Plan Commission recommended that the overall dimensions proposed in the text amendment reflect the actual sign being proposed. He noted that the standards for a text amendment were addressed in the testimony presented and in writing on page C of the case file. Scott Day, Day and Robert, P.C. Attorney for the applicant reviewed the request for the text amendment. In the B-2 District, a very large sign would be allowed to identify the building and services, but would not allow the names of the tenants on the sign. The parcel is about 3 acres of a former 19-acre development located on the northeast corner of Route 83 and 16th Street and was originally developed as the Oak Brook Bank. The overall site includes J. Alexander's to the north and a shopping center including the Container store to the west. There is a common entrance from 16th Street to the site with stormwater detention facility in the center. There is also a stormwater detention facility located north of 16th street and south of the bank property. It is a large green dish-shaped space that provides stormwater detention., There are large contours in the grassy area, where the proposed sign would be located. With the exception of this property, the other parcels totaling about 16 acres were rezoned to B-1, which permits signs listing the tenants in the stores. The remaining parcel, which is the subject property, is limited to the signage in the B-2 district. This is the only B-2 zoned property in the village that is not located in the Oakbrook Center and the only other property that the sign restriction would apply. The original property was for a single user, Oak Brook Bank and used as its corporate headquarters. MB Bank then bought the property and used it as a branch bank with its corporate headquarters located elsewhere and they had thousands of square feet that they were not utilizing. InSite purchased the property from MB Bank. The current regulations specify that `there cannot be more than 2 freestanding ground signs on each of the boundary streets surrounding any shopping center in the B-2 District, located not less than 40 feet from any street line, provided that each sign shall not exceed a total area of 1000 square feet and 30 feet in height." He asked that the board envision a sign 30 feet tall by 33 feet wide, located 40 feet from the street; and on the sign, it would say: "We sell real estate, We sell industrial buildings, We lease industrial buildings, and We lease office space." However, simply listing the names of the tenants would be considered illegal. They reviewed different ways to do address the issue and solve the problem. They considered rezoning, however, the B-1 District would allow favorable sign regulations, but would not allow a 3-story office building, so they would be a nonconforming use. Reviewing the office classifications there were some favorable sign provisions available, but they would then have setback problems for the property. They became aware that the village was in the process of reviewing its sign ordinances and might be doing so for some time. Considering that, they drafted a very restrictive text amendment in the B- 2 District. They believe they are the only parcel of property that would be less than 5 acres in size. They reduced the total square footage down to a maximum 15 foot height and a total of 200 square feet. The Plan Commission recommendation was the actual dimensions of the proposed sign. The proposed text is as follows: "2. In a retail/commercial development containing less than five (5) acres, a maximum of one (1) ground sign, which identifies the name and address of the development and may also identify the names and services or merchandise of each of the tenants located in the center, may be erected in addition to signs affixed to the building wall; provided that the sign shall not exceed a total area of one hundred twenty-six (126) square feet and no more than sixty-three (63) square feet on either side and shall not exceed ten feet six inches (10'6") feet in height." Their client concurred that they could accept the conditions of the recommendation revising the proposed text amendment. The variation being sought is relief to the 40-foot requirement to have a ground sign set back from the street line. If the sign is erected facing east and west the request would be for a reduction to a 31-foot setback, if the sign is set as shown in the original application (facing 16th Street), the request would be for a reduction to a 26 foot setback from the street line, because of the shape and size of the stormwater detention facility. Placing the sign to comply with the 40 foot setback, places the sign over the top of the rim and down into the stormwater detention facility, which would then take up some of the space currently used for storage. Greg VanLandingham, InSite Real Estate Development, said that they have been a resident in Oak Brook since 1996, originally at 1603 16th Street. They purchased the site located at 1400 16th Street in June of 2007. They moved to this site in February of 2008 and are located with their corporate offices that are on the third floor. They are retail, industrial and office developer and have been VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 3 of 12 August 5, 2008 in business for approximately 30 years. In that time, they have developed approximately 400 locations across the country and are in approximately 39 states. They own approximately 52 retail locations across the country. They have 21 industrial facilities with approximately 14.5 million square feet of industrial space and two office buildings. They have a Class A office building in Burr Ridge and the building located at 1400 16th Street. They have redeveloped this building into a multi-tenant building. Originally the building was intended to be for a single tenant, owner-occupied building as the Oak Brook Bank corporate headquarters and branch location. When they purchased the building, they leased back a portion of the building to MB Bank, who currently occupies a portion of the first floor and a portion of the basement, totaling approximately 7 percent of the building. InSite currently occupies a portion of the third floor and the second floor is empty right now as well as the remaining portion of the first floor. They have added $4.5 million in improvements on their floor alone. Permits have been issued by the Village to do a lobby modification and an exterior modification to the rear of the building to provide for a better aesthetic that faces toward Oak Brook Club in the amount of$1.2 million. They are making a huge investment in this building and are trying to attract additional high-end tenants on the office side. It has gone from a single tenant owner/occupied building to a multi-tenant building, which has caused the necessity to have a ground sign and actually be able to identify the tenants that are located in the building. They are proposing one ground sign approximately 10 feet high by 6 feet wide with four tenant panels. Mr. Day said that they have submitted documentation and testimony showing compliance with the text amendment and variation standards. They requested those documents be submitted for the record as testimony at this hearing. Chairman Davis noted that the standards for each are located in the case file under pages C and F. 1. Character of the neighborhood RESPONSE: It is a very commercial area and most of it is B-1 with multi- tenant panel type signage. It is an intensely automotive driven area. The patrons of this commercial center are arriving by automobile and need to locate the identity of the buildings. They need visual identification for the location of individual companies at an appropriate distance from an automobile. RESPONSE: Multi-tenant office buildings do not do well in this type of atmosphere without the ability to be able to identify the individual tenants. They know from the business inside, that the tenants they are attempting to negotiate with are seeking outside identification of their commercial enterprises as part of their leasehold estate. InSite would like to be in a position in Oak Brook to provide that for them. 3. The extent to which the removal of the Existing Limitations Would Depreciate the Value of Other Property in the Area. RESPONSE: To the contrary, they believe the relief would make their property consistent with the surrounding parcels. 4. The suitability of the Property for Zoned Purposes RESPONSE: It is an outstanding office building with extensive remodeling done on the interior. It has always been an attractive building from the exterior and very suitable for commercial enterprises, for the corporate headquarters of InSite and for the tenants that are seeking Class A office space in the community. 5. Existing Uses and Zoning of Nearby Properties. RESPONSE: Discussed and described in testimony. 6. The Length of Time Under the Existing Zoning that the property has remained unimproved considered in the context of land development. RESPONSE: Not Applicable. 7. The Relative Gain to the Public as Compared to the Hardship Imposed on the Individual Property Owner. RESPONSE: As testified, under the current text in the B-2 District signage regulations a 30 x 33 foot sign could be constructed describing the goods and services for unnamed tenants. The gain to the public is much more with a smaller sign identifying the tenants. 8. The Extent to Which the Proposal Promotes the Health, Safety, Morals or General Welfare of the Public. RESPONSE: The proposal aids the safe travel for motorists to locate VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 5 of 12 August 5, 2008 ��C__ businesses that will be in the building. 9. The Relationship of the Proposed Use to the Comprehensive Plan. RESPONSE: They are consistent with the Comprehensive Plan. 10. Community Need for the Use Proposed by the Property Owners. RESPONSE: Oak Brook has always had the reputation for being a strong center for corporate businesses and corporate headquarter locations. They believe they are continuing that tradition. Variation Standards: Mr. Day reviewed the variation standards for the record as follows: 1. a. The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. RESPONSE: If they are required to comply with the 40-foot requirement, the sign will be over the rim and located within the stormwater detention facility, which would interfere with the stormwater detention function and be invisible to the general public. 1. b. The plight of the owner is due to unique circumstances. RESPONSE: The issue was addressed in their testimony. 1. c. The variation, if granted, will not alter the essential character of the locality. RESPONSE: If granted, it would be consistent with adjacent properties. The additional supplemental standards would be addressed as requested by the Board. William Lindeman, 19 Pembroke Lane spoke in opposition to the request stating that it was his belief that MB Bank used up the signage on the building. He did not believe the request was appropriate for an office building. He reviewed signage from several office buildings throughout the village. The sign proposed is larger and more aggressive than other signs. He questioned the direction the sign would be facing. VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 6 of 12 August 5, 2008 Mr. Day responded that the proposed signage was displayed at a meeting with the neighborhood. They received a written objection by one of the neighbors requesting that the face of the sign be turned with one panel facing east and the other facing west. By doing that, it eliminates a conflict with a Village easement and the sign could be moved back from 26 to 31 feet. The applicant believed that the objector was correct and would revise their original request. Member Rush suggested that if possible, the sign could be moved back further form the road. Member Bulin noted that the change would bring the sign into the downward slope and could interfere with the detention facility. Member Young questioned whether a suggestion should be made regarding a limitation for signage on the side of the building. Director of Community Development Kallien responded that the property is zoned B-2 and the way that signage is calculated in the B-2 District is very different from other districts. The B-2 District allows wall signage to be 2% of the gross floor area of the building, which is a lot of signage. What exists on this building is nowhere near the maximum allowed. Member Nimry noted that some of the residents of the Oakbrook Club do not believe that some of the wall signage is needed and should be taken down. He noted that the letter from the village consultant, Houseal Lavigne supported the request. He said that additional landscaping should be provided around the base of the sign. The Plan Commission noted that the applicant provide a more neutral color for the sign. Director of Community Development Kallien said that the sign code requires landscaping around all ground signs. Member Young asked if it has been difficult to attract clients to this area. Mr. VanLandingham responded that currently, other than InSite on the third floor, MB Bank is the only tenant in the building, they occupy about 7 percent of the total building, and the rest is vacant. They have had a lot of interest in the building, but one of the major concerns of potential tenants is identification. Without the ground sign, they are unable to provide that. It is a major concern that is keeping tenants from leasing the space. Mr. Day responded that the proposed sign has been modified based upon the comments made by the Plan Commission. The original application contained colored logo's that matched the individual tenants. There has been an overall reduction in the size of the size and an overall muting of the tone of the text. The resulting sign is in black, white and grey tones. In response to the comments relating to MB Bank, they have a long term lease with MB Bank and under those terms they have a full right to all of the signage on the building. MB Bank will not be listed on the tenant panel. As landlord they have requested that the signs located on the east side of the building be removed, but they do not have any contractual leverage to force them to comply with that request. The signs have been permitted by the Village, but they will encourage them the signage on that side of the building. Director of Community Development Kallien clarified that the Code requires that "the bases of all permanent ground signs to be effectively landscaped and maintained in good condition at least 3 feet beyond all sign faces." TEXT AMENDMENT Chairman Davis noted that the Zoning Board was in receipt of the Plan Commission recommendation to approve the request by a vote of 4 to 0. He noted that the standards for a text amendment were addressed in the testimony presented and in writing on page C of the case file. We submitted the text amendment portion of this application to the Plan Commission on July 21, 2008. While the Plan Commission voted in favor of the text amendment, it is our understanding that they did so under the condition that the overall size and height configuration be modified so that the proposed text amendment restrict signage size to sixty-three (63) square feet per side and restrict sign height to ten feet and six inches (10'6"). 1 have reviewed these proposed modifications with InSite, and they are willing to live with the limitations recommended by the Plan Commission. InSite has also received concerns in the form of a letter of objection from a Larry Niemark, an Oak Brook Club resident. Mr. Niemark specifically objected to the layout and orientation of the proposed sign. Mr. Niemark's e-mail and proposed sign elevations dated July 14, 2008 are attached to this letter. The original application from InSite proposed a one-sided sign laid out in an east/west configuration. Mr. Niemark's objection has put forward a suggestion that the overall sign would be better served using a double-faced sign laid out in a north/south configuration. After consideration of this objection from Mr.Niemark, InSite agrees that a revised layout might better suit its needs. We have also confirmed through your investigation that the original MB Bank signs are in strict conformity with the Village code, and that they did not require any variations at the time they were permitted. Despite the fact that all the MB Bank signs are lawful, InSite is sensitive to the concerns of nearby residents, especially those who have objected to the MB Bank signage on the east wall of the InSite building. InSite has, and will continue to request that MB Bank review its existing signage, and consider if the wall sign facing east could be removed. They have also requested MB Bank consider changing the color of their wall signage to a more muted tone than the current red configuration. While InSite does not have the lawful authority to force MB Bank to remove or change any existing signage, InSite has encouraged MB Bank to give consideration to the neighbors and the Village's requests. My comments are essentially as we had discussed by phone and I'll try to repeat them below. I am not in favor of the sign design that you presented on June 12. 1 believe the sign is too large and not in keeping with the boulevard character that 16th Street now has after the Oak Brook Village added a center divider and landscaping in 2005. It is more in character with the signs of the Oaks of Oak Brook and the mini-mall on the northwest corner of 16th Street and Rte. 83. Furthermore, I believe the sign would be of greater usefulness to the building's visitors if it were turned to be in the N-S direction with nameplates and illumination on both sides. The set-back from 16th St. could still be —25-26 ft.. It would thus be visible to visitors coming from both Rte. 83 and Spring Rd.. You should note that virtually all the signs in the area are perpendicular to the street. As you now have it E-W, it would likely require the visitor to stop at the intersection, at the stoplight, to read it and perhaps cause a traffic delay there and perhaps even a few rear-end collisions. If the bush/tree just to the east of the sign tends to obscure the view of it, I'd guess that the bush/tree could be trimmed back and down even though it does now hide a low fixture of something. The attached drawing is a rendering of a sign that I believe to be more advantageous to all concerned. It is somewhat smaller than your proposal, but the height of the nameplates is still reasonable but could be enlarged within essentially the same dimensions. The addition of"16th St." (or Street) next to 1400 eliminates any ambiguity as to the address, which is 1400 Sixteenth Street on your letterhead. And lastly, it's obviously a sign I would not have objections to. I hope you will give it due consideration. They are proposing to add the following text: "2. The reason they are requesting the amendment is because they are the only other property located in the B-2 District in the village. This parcel along with the Oak Brook Court and J. Alexander's restaurant located to the west and north of this parcel was originally developed by the John Buck Company and Urban Development and was intended to be a Galleria, which would have been an extension of the Oakbrook Center. However, the development never materialized and the development company sold off the property in three (3) lots. Oak Brook Bank purchased the lot now owned by InSite; the other two parcels were intended to be a high-end hotel, which also never materialized. The developer requested that the village rezone the property to B-1 in order to build the Oak Brook Court and J. Alexander's, which left Oak Brook Bank as the only remaining B-2 property in the development and the only other B-2 property in the Village beside the Oakbrook Center mall. Larissa Addison, General Counsel and Managing Director with InSite Real Estate Development as well as manager for the three entities that are the petitioner in the case; said that InSite Real Estate Development has been a resident in Oak Brook since 1996. They were originally located at 1603 16th Street and purchased the site located at 1400 16th Street in June of 2007. They moved to this site in February of 2008 and are located with their corporate offices that are on the third floor. They are retail, industrial and office developer and have been in business for approximately 30 years. In that time, they have developed approximately 400 locations across the country and are in approximately 39 states. They own approximately 52 retail locations across the country. They have 21 industrial facilities with approximately VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 2 of 26 July 21, 2008 14.5 million square feet of industrial space and two office buildings. They have a Class A office building in Burr Ridge and the building located at 1400 16th Street. They have redeveloped this building into a multi-tenant building. Originally the building was intended to be for a single tenant, owner-occupied building as the Oak Brook Bank corporate headquarters and branch location. When they purchased the building, they did a sale lease back. They did lease back a portion of the building to MB Bank, who currently occupies a portion of the first floor and a portion of the basement. They occupy a portion of the third floor and the second floor is empty right now as well as the remaining portion of the first floor. It has gone from a single tenant owner/occupied building to a multi-tenant building, which has caused the necessity to have a ground sign and actually be able to identify the tenants that are located in the building. They are proposing one ground sign approximately 10 feet high by 6 feet high consisting of about 60 square feet on each side. Ms. Morrison noted that the Village standards for a text amendment have addressed the as part of the application and are contained in the case file. Member Lalmalani questioned whether the MB Bank signs would be removed, if this request were approved. Ms. Morrison responded that MB Bank received variations for their wall signs before InSite purchased the property from MB Bank and all of the signage existed at that time. InSite leased a portion of the building back to MB Bank and as part of the sale and lease, MB got to keep all of its existing wall signage. InSite is contractually obligated to MB Bank for the wall signage.. Director of Community Development Kallien noted that MB Bank was never given a variation for the wall signage. He added that this is a two-step process. InSite is seeking a text amendment to allow them to have a ground sign and they are seeking a variation that would allow the proposed ground sign to be placed in another location. The text amendment alone does not give them the ground sign that they have proposed. Trustee Wolin noted that he sent a memo to the Plan Commission and that it behooves any Trustee or anyone in the Village to do whatever could be done to help the businesses in the village. These are tough economic times and we want to do whatever could be done to help people. He is not opposed to the sign, more or less, which, the Zoning Board of Appeals will address. His concern is the proliferation of five (5) red signs that are on the building. A personal observation with the way that it stands makes the building looks like a Christmas decoration and is not the type of aura that you necessarily want in Oak Brook. There is a very large red sign on the top of the building facing east toward the Oak Brook Club condominium and serves virtually no purpose because it can't be seen from 16th Street. A nice letter was received from the attorney in response to his memo that explains the agreement with MB Bank to keep the signs, but they would see what can be done. He would VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 3 of 26 July 21, 2008 encourage InSite to talk with MB Bank and beside the sign on top facing the Oak Brook Club; the other on the side of the building is overkill and just irritates some people. You would think that they would not want to irritate the neighbors and potential customers. He noticed an MB Bank in Hinsdale where the sign is black and although the standard for MB Bank is red, it is obvious that it is much more subdued and nicer looking. He would encourage InSite to work with MB Bank. He was not opposed to a ground sign at that location and one is appropriate, but the multi-colors should be reviewed. In terms of the text amendment, a ground sign would be appropriate language to include. He noted that the sign provisions for a shopping center are very different from those for an office. Director of Community Development Kallien said that one of the alternatives was to look at rezoning the property rather than a text amendment. B-1 may have been a more appropriate zoning. William Lindeman, 11 Pembroke Lane said that he agreed with Trustee Wolin. He drove by the property today and on both sides of the street, there is a lot of landscaping. He disputed the fact that MB Bank was able to negotiate a continuation of leaving signs in place. He also believes that the signs on the building are illegal because it is mounted above the top of the building on the mechanical enclosure. He asked Director of Community Development Kallien to confirm that. Director of Community Development Kallien responded that he had discussed this issue with Mr. Lindeman and noted that the B-2 District does not have the same height requirements as all of the other zoning districts, which is also a deficiency of the regulations in the B-2 District. Mr. Lindeman noted that the sign is shown parallel to 16th Street. He questioned the need for office buildings to have a list of individual tenants. It is an impossibility for an office building to list their tenants on a freestanding outdoor sign, which is the purpose of having an inside registry. Very few office buildings have outside I ignage. Although he was not sure how they allocate outside signage, he thought it would make the most sense to allow it to offices that deal the most prominently with the general public. He thought the sign was excessively large and the 12" height for lettering can be read from 600-700 feet; it did not have to be that large because the traffic is not fast moving through there so the sign can be reduced considerably in size. He did not see the need to reduce the setback because it could be maintained and the sign would still be legible. He commented that there seems to be a phobia with signage and it's turning Oak Brook into Pottersville (in the Jimmy Stewart movie where they lost control of the town and it turned into something that we would not want to live in; and that is what has happened). He gets irritated every time he goes down 22'd Street and sees the dinky little coffee shop; and shakes his head and wonders how it got there and does it really fit there. On 16th Street, there is the Citicorp Bank and the Oak Brook Club and he thinks the proposed sign would detract from the ambiance of that section. There are also three office buildings in the Oakbrook Center along Spring Road. He questioned Director of Community Development Kallien as to whether the Citicorp, Oakbrook East, Oakbrook North office buildings and the Renaissance Hotel would be entitled to freestanding signage. He questioned if that was fair in this competitive market to other office buildings in town, such as on Commerce and Harger. He suggested that the history of the zoning be looked at and the possibility that it should be addressed by a zoning change or keeping Oak Brook stay the way it has been; the way some pretty smart people designed and planned it before there was this mad rush to create artificial expansion. Director of Community Development Kallien responded that as a result of the Commercial Areas Revitalization Plan the Village has retained the firm of Houseal Lavigne who will be creating Planned Unit Development Regulations and upgrading the Sign Regulations. When requests like this are received, the current sign code provides certain impediments that need to be addressed. Member Tropinski commented that this is a relatively small office building that would be conducive to 3 or 4 tenants and can appreciate why they would want to have their names advertised on the buildings. On York Road in Elmhurst there is an office building there with a sign right on York Road and informs everyone what is in the building. As a consumer, she finds that information very useful. Trustee Wolin questioned the reference of "commercial retail development of less than 5 acres" in the proposed language. Director of Community Development Kallien responded that the Oakbrook Center is the only other property in the Village zoned B-2. There are several out lots within the Oakbrook Center, such as for Citibank, Sears and Macy's, but they are under signage control by mall management. He was not concerned that they would want to utilize or request additional signage should the amendment be approved. Member Wolin questioned the requested height for the sign. Mrs. Morrison responded that the original request reflected only a change in the size of the lot and tenant names but would still allow 1000 square feet of signage. After meeting with Village staff, they reduced the amount to round numbers. They are only proposing to construct the sign as depicted in the application. Chairwoman Payovich queried the Commission and the Commissioners agreed that the language should be modified to reflect the size of the proposed sign. Member Lalmalani questioned where Houseal Lavigne was at in terms of providing signage guidelines. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 5 of 26 July 21, 2008 Director of Community Development Kallien responded that it has been under review for about a month and it may be an approximate 4-5 month project. Upon completion, the recommendation would then be presented to the public and then ultimately back to the Plan Commission, Zoning Board and Village Board to approve actual amendments to the existing sign code. Trustee Wolin said that he thought it would be helpful to have the request reviewed by Houseal Lavigne and have their comments provided for the Zoning Board of Appeals. Mrs. Morrison responded that they did send the proposed text amendment and proposed signage specifications to Houseal Lavigne on June 3, 2008. They received a call from their office stating that they were giving them a tentative okay, but had not had a chance to discuss the proposal with zoning staff. Member Iyer questioned what the impact would be should the request be approved and was in conflict with the recommendation from Houseal Lavigne and did not want to see a problem occur later. Director of Community Development Kallien said that he wanted to hear the comments from the Commissioners regarding their thoughts and ideas prior to seeking out comments from the consultant. The consultant has yet to formulate any final opinions as to what is the appropriate level of signage in Oak Brook, which is what they are trying to ascertain as part of their research. Director of Community Development Kallien said that if this were in an office district, especially a building of this size the requested 10 x 6 sign is not too large. Member Lalmalani visited the site and the sign proposed is nice, yet there are five bright red signs on the existing building. He questioned how one tenant has five signs and then the other tenants would only have one sign. Larissa Addison, Manager of InSite, responded that when they purchased the building from MB Bank the signage was already in place. When the sale was negotiated the sale they ended up on the lease back that they had to leave the existing signage in place. The lease required that they obtain permits and required approvals for the signage. Additional signage has not been added since they acquired the building in June of 2007. She understands the situation and they have spoken with MB Bank. After hearing the concerns from the Commissioners, they will continue to see if there is something, they could do to modify the signs, although they are contractually obligated within the lease agreement to allow MB to have the signs that were in place. InSite has made a multi-million dollar investment in the building and they have added $4.5 million in improvements on their floor alone. Permits have been issued by the Village to do a lobby modification and an VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 6 of 26 July 21, 2008 exterior modification to the rear of the building in the amount of $1.2 million to provide for a better aesthetic that faces toward Oak Brook Club. They are making a huge investment in this building and are trying to attract additional high-end tenants on the office side. They have had tenants come through the building and one of the comments made, is that they do not want to come to the building because they would not have any identity at the building. This national tenant would have been great for the building. Signage has been a problem, which has led them to seek the text amendment to move forward for their own sign. Chairwoman Payovich questioned when they.would actually be able to make some changes with MB Bank. Ms. Addison responded that they could not commit to any changes. They would continue to approach them, but could not force them into a position of removing the signage as long as they secured the proper required permits through the village. It is difficult because MB Bank has had the signs in place for several years. Member Iyer asked whether there would be a problem in proposing only two colors on the ground sign rather than multiple colors in order to tone it down. Director of Community Development Kallien commented that in his discussion with representatives of the sign company it was stated that any inclusion of color might be problematic and discussed the desire of the removal of color. Ms. Addison commented that they would be amenable to changing that. They realize it is an office building not a retail strip. Motion by Member Tropinski, seconded by Member Lalmalani to recommend approval a text amendment to allow a ground sign on properties less than five acres in the B-2 District to be added to the Zoning Ordinance. They recommended that the proposed text to be amended to allow a total of 63 square feet of signage on either side, totally no more than 126 square feet and the sign height is not to exceed 10 feet 6 inches. a. Recommend to the Zoning Board of Appeals that the applicant present more neutral color on the sign. b. Recommend that comments be obtained from Houseal Lavigne on the proposed signage and provided to the Zoning Board of Appeals. c. Recommend that the proposed sign would not appear to look like a building directory. As we understand it, the applicant is seeking approval of a Variation to install a ground sign that would be 26 feet from the pavement of 16th Street. There is no flood plain on this property, nor would any stormwater regulations require relief. Since this request only regards a sign on private property, an engineering permit is not required. The proposed sign will be located in a Detention Basin Easement (R93-236878 and R94- 105054). This easement has distinct language concerning signage in the easement: the owners of the entire development must approve any signage in this easement as well as the Village. Attached please find a copy of pages 16-17 of R93-236878 for your reference. Also attached is a copy of this part of the Oakbrook Court Resubdivision Amended Plat(R94-152760). Since topography was not attached and it is unclear exactly where the sign will be placed (on top of the berm or on which side, possible under the high water level), please have the applicant provide topography of the immediate area. In his correspondence, Trustee Wolin expressed concerns regarding the MB Bank signs currently existing on InSite's building located at 1400 16' Street, Oak Brook which is the subject of InSite's applications. InSite held an informal meeting regarding the Applications so that residents of Oak Brook Club and other neighbors could learn more about the proposed sign as well as express any concerns. The sign in sheet for that neighbor meeting is attached to this letter. At that meeting, InSite representatives did not receive any concerns regarding their proposed sign. Trustee Wolin is proposing that as a condition to InSite receiving approval for their proposed text amendment and variation, InSite would be required to remove some of the existing MB Bank wall signs. While InSite does recognize Oak Brook Club resident concerns, InSite is contractually obligated with MB Bank to allow the existing wall signs. MB Bank is the previous owner of the property located at 1400 16th Street, and during their ownership of the building, MB Bank applied for and received approval from the Village for their existing wall signage. When InSite purchased the property in 2007, MB Bank became a tenant of InSite. As a part of the sale of the property to InSite and Day 6 Robert.P.C. If you feel it would be appropriate to forward any or all comments to members of the Plan Commission and ZBA please do so. I recognize that our process calls for PC and ZBA review before Trustees get involved. In addition, many residents are already upset with the five MB Bank red signs that are already on the building and give it the appearance of a Christmas decoration. The large red sign on the top of the east side is a particular irritant since it stares directly in the face of many of our condos. The sign on the east side serves no purpose since no one can see it except for the Oak Brook Club residents that it irritates. Insite did hold a meeting yesterday for their neighbors to discuss the planned sign. I believe that several residents from the Oak Brook Club were in attendance. I spoke to one OB club resident who indicated that the sign was not as bad as he expected it might be. My comments are: ■ No Plan Commission or ZBA member should discuss the sign request unless they come out and view the existing red signs including the sign on the East side which is difficult to see unless one looks very carefully. These signs are a real irritant. ■ I was driving south on York Road just south of the Graue Mill. On the west side of York there is an MB Bank branch and the sign is black. My assumption is that either the Hinsdale sign code or the building owners did not want to have a glaring red sign like the ones on the Insite building in OB. ■ Since we have now hired Houseal Lavigne (sp?) to redo our sign ordinance, I think it would be helpful to get some preliminary guidelines from them on what they would consider acceptable. I believe that with their experience they should be able to readily provide that info. ■ I believe it is in Oak Brook' s interest to minimize the number and size of signs whenever practical. We should also control the colors as evidenced by the much better appearance of the MB Bank sign in Hinsdale vs. the existing red signs we have in OB. ■ While I believe in minimizing the number and size of signs, I also recognize the importance of our commercial customers and would like to help them in any way that makes good sense. ■ I am not opposed to approving the sign request from Insite assuming that the size and colors are consistent with projecting a good image. However, I would like to make the approval conditional on removing the red sign on the east side of the building, eliminating two of the three MB bank signs on the west side of the building, and changing the remaining three MB signs to black. It is owed by InSite Goshen, L.L.C., InSite Freeport, L.L.C., and InSite Oak Brook, L.L.C., Illinois limited liability companies which are part of the InSite Real Estate family ("InSite"). To the north is an adjoining parking lot, also owned by InSite, which serves the subject property as well as J. Alexander's restaurant. West of the subject property is Oak Brook Court which houses The Container Store and Borders among other tenants; to the east is Oak Brook Club, a condominium development, and to the south, across 16th Street, is the Oak Brook Center, the only other B-2 parcel in the entire Village of Oak Brook("Village"). The subject property is improved with a three (3) story office building and surrounding parking lot and drive aisles. MB bank is a current tenant occupying part of the 1" floor and part of the lower level, the remaining part of the 1St floor and 2nd floor are advertised as available for tenants, and InSite offices occupy the 3rd floor. Property History 1400 16th Street was annexed into the Village of Oak Brook in 1959 and was developed as a single-family subdivision known as the Ernie Pyle Subdivision. As time went on the residents of this single-family subdivision began to feel the strain of being surrounded by commercial property on three sides of the subdivision. By 1987, the John Buck Company, in partnership with Urban Investment and Development Co., had purchased all of the single family residential lots in the desire to redevelop the property into a large commercial parcel. This parcel was originally planned to be the "Galleria," an extension of the Oak Brook Center. However, the "Galleria" never materialized and the property was sold as separate parcels; the subject property parcel was purchased by Oak Brook Bank. The subject property parcel, now known as Lot 3 of the Buck/Ernie Pyle Second Resubdivision, was developed by Oak Brook Bank as its corporate headquarters and a branch bank. Oak Brook Bank received permission from the Village to operate drive through banking lanes unless and until the property ceased to be used as a bank. The Oak Brook Bank Company was then purchased by MB Bank in December of 2006, who continued to solely use the parcel as a banking facility. InSite purchased the building from MB Bank in June of 2007. In 1987, the Village Board of Trustees, Zoning Board of Appeals and Village Plan Commission found that the Ernie Pyle subdivision (of which the subject property is a part) was no longer viable as a single family residential area due to the amount of commercial property surrounding it. The Village determined that the best use of the Ernie Pyle subdivision was as a commercial development with multiple buildings. Oak Brook bank successfully occupied the subject property as its corporate offices from 1990 until 2006 and the subject property is currently used as a branch for MB Bank and as InSite corporate offices with additional office space available. (e) The existing uses and zoning of nearby property. The balance of the 19 acre Buck/Ernie Pyle Commercial Subdivision is in the B-1 Zoning District which allows tenant identification as a matter of right for parcels more than 10 acres in size. Oak Brook Court, located on Lot 1 of the Buck/Ernie Pyle Subdivision has been improved with a large strip retail center and has two freestanding multi-tenant monument signs along Route 83. Multi-tenant panel signage is consistent and compatible with the surrounding land uses and in truth, absence of multi tenant panel signage would be more inconsistent than inclusion. To the north is an adjoining parking lot, also owned by InSite, which serves the subject property as well as J. Alexander's restaurant which is zoned B-1; to the east is Oak Brook Club, a condominium development zoned R-1, and to the south, across 16th Street, is the Oak Brook Center, the only other B-2 parcel in the entire Village of Oak Brook. (f) The length of time under the existing zoning that the property has remained unimproved, considered in the context of land development. N/A—InSite is not seeking to amend the current zoning of the subject property. (g) The relative gain to the public as compared to the hardship imposed on the individual property owner. InSite is proposing this ground sign with tenant panels in order to create a viable first class office building in Oak Brook. Due to the topography of the subject property and the amount of traffic along 16th Street, InSite requires tenant signage to compete in the commercial real estate market. Tenant identification would serve to make the subject property easier for people to know of the subject property and make the specific tenants more easily found by travelers along 16th Street. Easier visibility of the subject property increases the safety of vehicular traffic along 16th Street as travelers would no longer have to search for the tenants of the subject property by street address alone. 4/10/08 Day&Robert, P.C. 2 InSite has researched all potential options prior to requesting a text amendment to the B-2 sign ordinance. The Village Zoning Administrator has determined that InSite could not be granted a variation for tenant panels as that would be tantamount to a use variation which is unauthorized. It is also not practical for InSite to rezone the property into either the B-1 or ORA districts. A rezoning into the B-1 District would still require InSite to apply for a sign variation for tenant panels as well as variations from B-1 Is bulk regulations. A rezoning into an ORA district would still require InSite to apply for variations for their proposed sign. D S INSITE SIGN VARIATION APPLICATION EXHIBIT A Property Information The subject property is located at 1400 160' Street in Oak Brook, Illinois, is approximately 3 acres in size and is located in the B-2 Zoning District (the "subject property"). It is owed by InSite Goshen, L.L.C., InSite Freeport, L.L.C., and InSite Oak Brook, L.L.C., Illinois limited liability companies which are part of the InSite Real Estate family ("InSite"). To the north is an adjoining parking lot, also owned by InSite, which serves the subject property as well as J. Alexander's restaurant. West of the subject property is Oak Brook Court which houses The Container Store and Borders among other tenants; to the east is Oak Brook Club, a condominium development, and to the south, across 16th Street, is the Oak Brook Center, the only other B-2 parcel in the entire Village of Oak Brook("Village"). The subject property is improved with a three (3) story office building and surrounding parking lot and drive aisles. MB bank is a current tenant occupying part of the 1St floor and part of the lower level, the remaining part of the 1St floor and 2° floor are advertised as available for tenants, and InSite offices occupy the 3rd floor. Property History, 1400 16th Street was annexed into the Village of Oak Brook in 1959 and was developed as a single-family subdivision known as the Ernie Pyle Subdivision. As time went on the residents of this single-family subdivision began to feel the strain of being surrounded by commercial property on three sides of the subdivision. By 1987, the John Buck Company, in partnership with Urban Investment and Development Co., had purchased all of the single family residential lots in the desire to redevelop the property into a large commercial parcel. This parcel was originally planned to be the "Galleria," an extension of the Oak Brook Center. However, the "Galleria" never materialized and the property was sold as separate parcels; the subject property parcel was purchased by Oak Brook Bank. The subject property parcel, now known as Lot 3 of the Buck/Ernie Pyle Second Resubdivision, was developed by Oak Brook Bank as its corporate headquarters and a branch bank. Oak Brook Bank received permission from the Village to operate drive through banking lanes unless and until the property ceased to be used as a bank. The Oak Brook Bank Company was then purchased by MB Bank in December of 2006, who continued to solely use the parcel as a banking facility. InSite purchased the building from MB Bank in June of 2007. As MB Bank only desires to use part of the building as a banking facility, InSite now leases parts of the first floor and lower level to MB, is currently marketing the remaining first floor and entire second floor as office space, and is occupying the third floor as the corporate headquarters for InSite. InSite is converting the former owner-occupied building into a multi-tenant building and has received building permits from the Village to demise a portion of the 1St floor for MB 4/10/08 1 Day&Robert,P.C. -- IF Bank, and for InSite's rehabilitation of the third floor. InSite is now proposing a ground sign along 16th Street to identify current and future tenants of the subject property. Applicant request: InSite has recently moved its corporate offices to 1400 16th Street, Oak Brook, Illinois. As part of the relocation, InSite is in the process of converting the former Oak Brook Bank corporate headquarters into a multi-tenant building. As part of this conversion to a multi-tenant building, InSite is proposing a ground sign along 16th Street. InSite's desired ground sign would require a setback variation from the B2 district sign ordinance,Village Zoning Ordinance Title 13-11-8. To facilitate this desired free-standing ground sign, InSite requests the following variation: A setback variation from the B2 Zoning, District Sian Ordinance. Title 13-11- 8(A)(1) states that a freestanding ground sign may be located "not less than forty feet (40') from any street line." The green space of InSite's front yard includes a water detention basin. The topography of this basin is such that a ground sign must be placed less than 40 feet from the 16th Street line. Without the variation, the ground signage would be depressed and would serve no identification purpose due to a lack of visibility. In the alternative, placement of the proposed ground sign in the water detention basin would require the ground sign to be a pylon sign which could violate Title 13-11-5C of the Village zoning ordinance. (c) The variation, if granted, will not alter the essential character of the locality. The subject property is approximately three acres and the overall commercial complex of which InSite is a part (the former Ernie Pyle subdivision) is collectively 19 acres and is immediately north of the retail Oak Brook Center. The balance of the 19 acre Commercial Subdivision is in the B-1 Zoning District which allows tenant identification as a matter of right for parcels more than 10 acres in size. (2) For the purpose of supplementing the above standards, the Zoning Board of Appeals, in making the determination whether there are practical difficulties or particular hardships, shall also take into consideration the extent to which the following facts, favorable to the applicant, have been established by the evidence that: (a) The particular physical surroundings, shape, or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulations were to be carried out. The subject property is the only B-2 District parcel outside of the Oak Brook Center within the Village. Due to the location of the subject property and its proximity to detention facilities and rights of way, InSite needs to mount the ground sign near the rim of the detention basin thus bringing it twenty six (26) feet from the 16"' Street line. Without the variation, the ground signage would be depressed and would serve no identification purpose due to a lack of visibility. (d) The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the danger of fire, or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood. The proposed ground sign will be set back far enough (in excess of 25 feet from the pavement) from 16th Street so as to not impair the site lines of drivers along 16th Street. InSite will conform to all applicable building codes and all other Village ordinances in order to eliminate danger to the public safety. As the subject property is in a commercial neighborhood, the proposed ground sign will not impair neighboring property values and the first class office building will attract tenants that will have a positive impact on the neighborhood. (e) That the purpose of the variation is not based exclusively upon a desire to make more money out of the property. InSite is proposing this ground sign in order to create a viable first class office building in Oak Brook. Due to the topography of the subject property and the amount of traffic along 16th Street, InSite requires tenant signage and the proposed location of the ground sign to compete in the commercial real estate market. (f) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property.
