S-1004 - 09/11/2001 - VARIATION - OrdinancesORDINANCE 2001- ZO -V -S- 1004 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF SECTION 13- 6B -3F2 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATIVE TO SIDE YARD REQUIREMENTS (10 Lochinvar Lane, Oak Brook, IL 60523) WHEREAS, an application has been filed requesting a variation from the provisions of Section 13- 613-3F2 of Title 13 ( "Zoning Regulations ") of the Village Code of the Village of Oak Brook to permit the construction of a second -floor addition to the existing non - conforming home which currently encroaches 11 feet into the required 18 -foot side yard at the property commonly known as 10 Lochinvar Lane;' and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals on August 7, 2001 pursuant to due and appropriate legal notice; and WHEREAS, the said Zoning Board of Appeals made explicit findings of fact that the variation requested conforms to the standards set forth in Section 13 -14 -6 of the Oak Brook Village Code, subject to certain conditions; and WHEREAS, the corporate authorities have reviewed the recommendation and findings made by the Zoning Board of Appeals and, subject to the conditions set forth below, deem the granting of the variation requested to be appropriate and in the best interest and in furtherance of the public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section 13 -613-3F2 of the Zoning Ordinance of the Village of Oak Brook to permit construction of a second -story addition to the existing non - conforming home which encroaches 11 feet into the required 18 -foot side yard, provided that the addition is constructed in substantial accordance with the building plans drawn by Normandy Architects, Inc. dated June 12, 2001, which were submitted with the application. 3 � 1 Section 3: That this Ordinance is limited and restricted to the property located at 10 Lochinvar Lane,, Oak Brook, IL, which property is legally described as follows: Lot 93 in Ginger Creek Subdivision of parts of Section 27 and Section 28, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded December 30, 1960 as Document No. 992057 in DuPage County, IL. Permanent Parcel No 06 -28- 400 -006. Section 4 That this ordinance shall be in full force and effect from and after passage and approval pursuant to law.
