AN ORDINANCE GRANTING CERTAIN VARIATIONS FROM THE
PROVISIONS OF SECTIONS 13- 12 -4A, 13- 12 -4G, 13 -12 -4H
AND 13 -12 -5 OF CHAPTER 12 (OFF- STREET PARKING AND
LOADING) OF TITLE 13 (ZONING REGULATIONS) OF THE
VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATIVE
TO REQUIREMENTS FOR OFF - STREET PARKING SPACES
(Oak Brook Park District, 115 Canterberry Lane, Oak Brook, Illinois

WHEREAS, an application has been filed by Oak Brook Park District (the "Petitioner "), requesting
certain variations from the provisions of Sections 13 -12 -4A (Design and Maintenance Surfacing), 13-12 -
4G (Design and Maintenance Permanent Curbing), 13 -12 -4H (Design and Maintenance Striping and
Traffic Circulation) of Chapter 12 (Off- Street Parking and Loading) of Title 13 (Zoning Regulations) of the
Village Code, as follows (i) a variation from the hard surface requirement to gravel, except for the two (2)
required ADA parking spaces, (ii) a variation from the required permanent curbing to eliminate curbing,
(iii) a variation from the required single white or yellow line striping to eliminate striping, due to the gravel
lot, and (iv) a variation from the required 150 parking spaces to allow 22 parking spaces, and
WHEREAS, a public hearing on such application has been conducted by the Zoning Board of
Appeals of the Village of Oak Brook on August 22, 2007, pursuant to due and appropriate legal notice,
and explicit findings of fact were made that the variations requested conform to the standards set forth in
Sections 13 -14 -6D of the Village Code, and
WHEREAS, the Village President and Board of Trustees concur with the recommendations and
findings made by the Zoning Board of Appeals
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows
Section 1 • That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein
Section 2 That the Oak Brook Park District is hereby granted
1 a variation from the required hard surface parking lot, as provided in Section 13 -124A to
allow a gravel parking lot, except that the two (2) required ADA parking spaces shall be
hard surface,
2 a variation from the required permanent curbing, as provided in 13- 12 -4G, to eliminate
curbing,
3 a variation from the required single white or yellow line striping, as provided in Section
13- 12 -4H, to eliminate striping, due to the gravel lot, and
4 a variation from the required 150 parking spaces, as provided in Section 13 -12 -5, to allow
for 22 parking spaces
Section 3 That the variations granted in Section 2 of this Ordinance shall be subject to the
following conditions
1 Development in accordance with the plans as submitted.

2 Buses shall not be allowed to park on the parking lot
3 Notwithstanding the exhibits contained in the case file, the Applicant shall meet all Village
ordinance requirements at the time of building permit application, except as varied or
waived
Section 3 That this Ordinance is limited and restricted to the property known as 115 Canterberry
Lane, Oak Brook, Illinois, which property is legally described as follows*
THE SOUTHEAST Y4 OF THE NORTHEAST Y4 OF SECTION 36, TOWNSHIP 39 NORTH,
RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN DUPAGE COUNTY, ILLINOIS
ALSO KNOWN AS LOTS 1 AND 2 IN DEAN'S ASSESSMENT PLAT OF THE SOUTHEAST
QUARTER OF THE NORTHEAST QUARTER OF SECTION 36, TOWNSHIP 39 NORTH,
RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT
THEREOF RECORDED NOVEMBER 20, 1989 AS DOCUMENT R89- 145768 AND
RERECORDED FEBRUARY 23, 1990 AS DOCUMENT R90- 023141, IN DUPAGE COUNTY,
ILLINOIS
PERMANENT PARCEL NUMBERS 06 -36- 202 -017 AND 06 -36- 202 -018
Section 4 All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of the conflict
Section 5 This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law
