G-812 - 10/10/2006 - LICENSES - OrdinancesORDINANCE 2006- 1-C -AL -G -812 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, SECTIONS 8A AND 8B OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, Title 4, Chapter 1, Sections 8A and 8B (4 -1 -8A and 8B) of the Village Code of the Village of Oak Brook establishes the application and license fees and number of liquor licenses available for issuance for each liquor license classification in the Village of Oak Brook, and WHEREAS, the President and Board of Trustees of the Village deem it advisable and in the best interest and in furtherance of the general welfare of the citizens of the Village that Title 4, Chapter 1, Sections 8A and 8B (4 -1 -8A and 8B) of the Village Code of the Village of Oak Brook be amended to clarify the required application and license fees for a license of any additional classification issued to a licensee currently holding a valid license of another classification, and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 That Paragraph A (Fees and Number of Licenses Authorized) of Section 8 (License Fees and Number) of Chapter 1 (Liquor Control) of Title 4 (Business and License Regulations) of the Village Code of the Village of Oak Brook, Illinois, be amended by deleting footnote 1 and all reference thereto, without replacement Section 2 That Paragraph B (Fee Regulations) of Section 8 (License Fees and Number) of Chapter 1 (Liquor Control) of Title 4 (Business and License Regulations) of the Village Code of the Village of Oak Brook, Illinois, be amended by deleting Subparagraph 2 and replacing it with the following 2 If an applicant conducts, or proposes to conduct, the retail sale of alcoholic liquor within a single building in ways which would require the issuance of more than one license to authorize all of the subject activities, the fee for the second or any additional licenses shall be $500 00, and no application fee shall be required for the second or any additional licenses. Each license issued shall be publicly posted at the appropriate location where alcoholic liquor is being offered for retail sale All of the subject activities must be conducted within a single building, and must be under the same ownership and control Nothing herein contained shall be so construed as to prevent any hotel operator licensed under the provisions of this chapter from serving alcoholic liquor to his registered guests in any room or part of his hotel, if such liquor so served shall be kept in and served from a licensed location, place, or premises in the hotel Section 3 This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law Section 4 All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict APPROVED THIS 10th day of October, 2006 it Kevin inlan Villag President ORDINANCE 2006- LC -AL -G -812 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, SECTIONS 8A AND 8B OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS PAGE 2OF2 PASSED THIS 10th day of October, 2006 Ayes Trustees Aktipis, Craig, Kennedy Manofsky, Sanford and Yusuf Nays None Absent None Y. �R ATTEST c?/'.
