G-814 - 10/10/2006 - ZONING - OrdinancesORDINANCE 2006- ZO -TA -G -814 AN ORDINANCE AMENDING TITLE 13, SECTION 13- 11 -11A.2 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, an application has been filed requesting certain amendments to Section 13- 11 -11A 2 of the Zoning Ordinance of the Village of Oak Brook to permit additional signage for hotels located in an ORA2 Office- Research - Assembly District, and WHEREAS, on August 16, 2006, the Plan Commission reviewed the proposed text amendment and recommended that it be approved, and WHEREAS, on September 5, 2006, a public hearing on such application was conducted by the Zoning Board of Appeals, pursuant to due and appropriate legal notice, and WHEREAS, the Zoning Board of Appeals found that the applicable factors for a text amendment had been satisfied and recommended that the requested text amendment be approved, and WHEREAS, the Village President and Board of Trustees have reviewed said recommendations and concur with the same NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the provisions of the preambles hereinabove set forth are hereby adopted as though fully set forth herein Section 2 That Section 13 -11 -11 A2 of the Zoning Ordinance of the Village of Oak Brook be and is hereby amended to read as follows 2 For a building containing less than one hundred thousand (100,000) square feet, the gross surface area in square feet of all signs for each building on a lot shall not exceed one hundred (100) square feet, provided that the maximum gross surface area in square feet of all nondirectory signs for each restaurant on a lot located in an ORA -2 zoning district shall not exceed four hundred (400) square feet subject to the condition that wall signs shall not exceed one hundred ten (110) square feet, ground signs shall not exceed one hundred forty (140) square feet and signs accessory to drive- through establishment for restaurants approved as special use shall not exceed one hundred fifty (150) square feet For buildings in excess of one hundred thousand (100,000) square feet, the allowable sign area permitted shall be computed on a basis of one square foot of sign area for each one thousand (1,000) square feet of gross floor area of each principal building on a zoning lot with a maximum sign for all signs not to exceed two hundred forty (240) square feet Gross sign area shall be applied to each building and shall not be cumulative No sign shall be erected above the height of the principal structure, excluding any penthouse or roof structure as described in section 13 -3 -8 of this title, or thirty five feet (35') above grade, whichever is less, except for hotels in the ORA2 zoning district, which are exempt from the 35 foot height limitation, but which must comply with all other aspects of the provisions herein Section 3 All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict Section 4 This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law Ayes Nays Absent APPROVED THIS 10th day of October, 2006.
