ORDINANCE 2010- ZO- V -EX1 -S -1296
AN ORDINANCE AMENDING AN ORDINANCE GRANTING A VARIATION
ALLOWING BALL FIELD LIGHTS FOR THE PROPERTY AT
1450 FOREST GATE ROAD IN THE VILLAGE OF OAK BROOK
(PIN: 06 -26- 303 -002)
WHEREAS, on September 28, 2004 the President and Board of Trustees adopted Ordinance
2004- ZO -V -S -1084 granting a variation in connection with the installation of ball field lights by the Oak
Brook Park District ( "Park District') subject to certain conditions; and
WHEREAS, the Park District filed a petition requesting amendments to the conditions of
Ordinance 2004- ZO -V -S -1084 in order to extend the use of the ball field lights and to allow adult athletic
teams on Field 1; and
WHEREAS, on September 7, 2010 the Zoning Board of Appeals conducted a public hearing on
the requested amendments, pursuant to due and appropriate legal notice, and recommended approval of
the amendments; and
WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the
factors required for approval of the requested amendments and made specific findings, including that the
variation as amended will not endanger the public health, safety and welfare, and that there will be no
substantial injury to other property in the neighborhood; and
WHEREAS, the President and Board of Trustees have reviewed the recommendation of the
Zoning Board of Appeals and deem the amendments to the variation, as set forth below, to be in the best
interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein.
Section 2: Section 2 of Ordinance 2004- ZO -V -S -1084 is amended by amending the text covering
the hours of operation to read as follows: "the Park District will ensure that all lights on all fields will have
secure activation by coaches only and automatically shut off by 10:00 p.m. on Fields 2, 3 and 4 and by
9:00 p.m. on Field 1 between April 1st and November 151" for use by youth athletic teams, and until
October 31 for adult athletic teams."
Section 3: Section 2 of Ordinance 2004- ZO -V -S -1084 is amended by deleting the following: "the
use of lights on Field #1 will be limited to youth sports (high school age and younger)."
Section 4: All other provisions of Ordinance 2004- ZO -V -S -1084 shall remain in full force and
effect
Section 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance.
Section 6: All ordinances or parts thereof in conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict.

Section 7: This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.
