AN ORDINANCE GRANTING A VARIATION TO ALLOW
WALL SIGNS ABOVE THE ROOFLINE OF THE
BUILDINGS AT 2001, 2015 AND 2021 SPRING ROAD
IN THE VILLAGE OF OAK BROOK
(PINS: 06 -23 -04 -029, 06 -23- 444 -030 and 06 -23 -04 -031)
WHEREAS, an application has been filed by TreeHouse Foods and Arden Realty, Inc. on behalf
of Long Ridge Office Portfolio, L.P. (the "Petitioner "), requesting a variation to allow the placement of wall
signs above the roofline of the buildings at 2001, 2015 and 2021 Spring Road, Oak Brook, Illinois; and
WHEREAS, on November 2, 2010 the Zoning Board of Appeals conducted a public hearing on
the requested variation, pursuant to due and appropriate legal notice, and recommended approval of the
variations subject to certain conditions, and
WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the
factors required for approval of the requested variation and made specific findings, including that the
variation will not endanger the public health, safety and welfare, and that there will be no substantial injury
to other property in the neighborhood; and
WHEREAS, the President and Board of Trustees have reviewed the recommendation of the
Zoning Board of Appeals and deem the variation, as set forth below, to be in the best interests of the
Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, OU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein.
Section 2: The Petitioner is hereby granted a variation to Section 13- 11 -10E.4 of the Zoning
Ordinance to allow the placement of wall signs onto the permanent precast penthouse structure above
the rooflines of the buildings located at 2001, 2015 and 2021 Spring Road.
Section 3: The variation granted by this ordinance is subject to the following conditions:
a. With the exception of locating signage above the roofline, all signage must meet all other
conditions and standards of the Village's sign regulations.
b. The Petitioner and Owner shall meet all Village Code requirements existing as of the time
that the building permit application is submitted to the Village except as specifically varied
or waived by this ordinance.
Section 4: The variation and the scope of this ordinance are limited and restricted to the buildings
located at 2001, 2015 and 2021 Spring Road, which are legally described on Exhibit "A" attached hereto
and incorporated herein by reference.
Section 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance.

RECOMMENDED MOTION: I move to concur with the recommendation from the Zoning
Board of Appeals and approve the requested variation in order to place wall signage above the
roofline of the buildings located at 2001, 2015 and 2021 Spring Road and approve attached
Ordinance S-1299.
Back2round/History:
At its meeting on November 2, 2010, the Zoning Board of Appeals completed its review and held the
required public hearing on a joint petition from TreeHouse Foods, Inc (tenant) and Arden Realty, Inc.
(property manager) seeking approval of a variation to Section 13-11-10E.4 of the Zoning Ordinance in
order to locate a wall sign above the roofline on the permanent precast penthouse structure for the
buildings located at 2001, 2015 and 2021 Spring Road.
TreeHouse Foods, has decided to move their headquarters from Westchester to Oak Brook, and has
signed a long-term lease to occupy two full floors at the building located at 2021 Spring Road. An
important component of the TreeHouse attraction to Oak Brook was the ability to get wall signage at
the top of the eight-story building they plan to occupy. After considering a number of alternatives,
due to the vertical triangular architectural columns on the building, a sign could not be visible from
the road. The applicants determined that a variation was their best option. Because the architecture
of the three buildings that make up Commerce Plaza involves both horizontal and vertical triangular
elements, the signable areas are quite small and results in wall signs of less than 25 square feet, which
is significantly less than the 140 square foot maximum permitted in our sign regulations.

Recommendation
By a vote of 7 to 0, the Zoning Board of Appeals recommended approval of the requested variation to
Section 13-11-10E.4 of the Zoning Ordinance in order to allow the wall signs to be placed above the
roofline onto the permanent precast penthouse structure for the buildings located at 2001, 2015 and
2021 Spring Road, subject to the following conditions:
a. With the exception of locating signage above the roofline, all signage must meet all other
conditions and standards of the Village's sign regulations.
b. The Petitioner and Owner shall meet all Village Code requirements existing as of the time that
the building permit application is submitted to the Village except as specifically varied or
waived by this ordinance.
In making these recommendations, the Zoning Board of Appeals found that the required standards for
approval of the variations was met by the applicants and would not injure the public health, safety
and welfare of the area.

Loretta Tierney, Manager of Corporate Administration from TreeHouse Foods
and David Lind, Real Estate Broker with CB Richard Ellis reviewed the
request
Director of Community Development Kallien noted that Arden Realty is the
property manager of the three buildings and the case file contained a letter from
them as representing the property owners seeking this relief jointly with
TreeHouse Foods.
Ms. Tierney provided background on the company stating that TreeHouse
Foods is a Fortune 1000 company as traded on the NYSE (THS). Their annual
sales have grown at a compound annual rate of over 23 percent % since their
founding in 2005. Today they have nearly $2,000 billion in annual sales. They
are one of the largest manufacturers of private label food products for the North
American Retail Grocery segment and manufacture their products at 19
facilities located throughout the United States and Canada. They also supply
food products to the food service channel and are currently the largest supplier
of pickles to McDonald's. They are moving their headquarters into 48,000
square feet on two floors at the Commerce Plaza and will employ
approximately 130 staff initially, but will have expansion space on hand for an
additional 45. When they started the company five years ago, their headquarters
in Chicago had a mere handful of about 10 people. They have enjoyed
tremendous growth in sales and people and their plan is to accelerate that
growth. One of the attractions in moving to the new Oak Brook location was
having the ability to put a sign on the building. Unfortunately due to the shape
of the building with the triangular jut outs, makes it difficult to put the sign on
the building due to the length of their name. They look forward to becoming a
community member in the Village of Oak Brook.
Mr. Lind said that he has worked in this market for 33 years and his office is
located in the 700 Commerce building, where they employ 100 people. He has
worked with TreeHouse Foods and Arden Realty in completing this transaction,
where TreeHouse has signed a long-term lease. One of the reasons that
TreeHouse selected this building in Oak Brook was to improve its corporate

identity by posting a sign on the building. The attraction to Oak Brook was due
to the recent change in the Sign Regulations that offered this option, which was
not available in Oak Brook before. They currently occupy space in
Westchester. They pursued several different signage alternatives on the
building but due to the vertical precast architectural columns on the building, a
sign that would be visible or readable from Spring Road and architecturally
consistent with the high quality of the surrounding building signs; it could not
be placed on the building. They could not come up with a way that the
windows would not be obstructed or the sign was too small and could not be
seen from the road. If the sign had increased, it would have been separated by
the precast panels on the building, which would have split the sign in half, does
not work. By putting the sign on the precast structures it would not be secure
and would interfere with window washing and cover up windows by another
tenant.
They are applying for a variance when they came to the conclusion of placing a
wall sign on the permanent precast concrete penthouse structure, which is
consistent with the design and materials of each building located in the
Commerce Plaza, located at 2001, 2015 and 2021 Spring Road.
The sign will not exceed the maximum allowable size of 140 square feet and
they will comply with all other provisions of the Sign Regulations and the sign
will include high quality LED illumination and will be architecturally consistent
with the other penthouse signs located on other buildings in Oak Brook. The
Renaissance Hotel and Citibank building both have signs on the permanent
penthouse structures.
Chairman Davis noted that the request was for 3 separate buildings and
questioned whether signs were contemplated for the other two buildings.
Mr. Lind responded that there was not, however, the recommendation was that
if another company comes along, it would be approved for all three buildings.
Director of Community Development Kallien said that when this matter was
originally proposed they were looking at the 2021 Spring Road building, but in
analyzing the three structures, all have the exact same limitations and hardship.
The Village Attorney advised that if they were going to go through this process,
it should be applied to all three buildings, instead of separately. They are not
seeking any other relief to the Sign Regulations other than the location of the
sign, which would be required of any sign being placed on the other two
buildings. If they wanted anything larger they would have to apply for
additional relief at that time.

Member Ziemer said that they would all be required to apply for a building
permit.
Director of Community Development Kallien agreed.
Member Nimry questioned if another tenant would come into the same building
as TreeHouse would they be allowed to place another sign on the roof.
Director of Community Development Kallien responded that the Sign
Regulations allow up to two signs on the roofline and are only allowed to be
placed opposite of one another.
Mr. Lind responded to the Variation Standards as follows:
1. a. The property in question cannot yield a reasonable return if permitted to
be used only under the conditions allowed by the regulations governing
the district in which it is located.
RESPONSE: Due to the configuration of the buildings, which do not have a
long enough flat surface, a visible sign cannot be placed between the triangular
vertical columns without blocking the windows. The only place a normal sign
fits on the buildings is on the permanent precast penthouse structure.
1. b. The plight of the owner is due to unique circumstances.
RESPONSE: The Commerce Plaza buildings have a unique design. The
buildings have vertical triangular precast architectural columns every 15 feet,
which does not allow adequate room for the TreeHouse name and logo, or any
other tenant name, to placed on the building and be visible from Spring Rd.
1. c. The variation, if granted, will not alter the essential character of the
locality.
RESPONSE: The essential character of the locality will not be altered
because the sign will be of high quality and neighboring buildings such as
Citibank, and the Renaissance Hotel have similar signs on the permanent
penthouse structure.
2. a. The particular physical surroundings, shape, or topographical conditions
of the specific property involved would bring a particular hardship upon
the owner as distinguished from a mere inconvenience if the strict letter
of the regulation were to be carried out.
RESPONSE: The shape of the building with its vertical precast architectural
columns prevents a visible sign from being placed on the side of the building
without covering windows.

2. b. The condition upon which the petition for variation is based would not
be applicable generally to the other. property within the same zoning
classification.
RESPONSE: Other properties in the same zoning classification do not have
the precast vertical features. A longer smooth surface would allow for a more
visible sign to be placed on the building for companies that have longer names.
2. c. The granting of the variation will not be detrimental to the public
welfare or injurious to other property or improvements in the
neighborhood in which the property is located.
RESPONSE: The variation will not be detrimental to the public welfare or
injurious to other properties in the neighborhood because many of them like the
Renaissance Hotel and the Citibank building have existing signs including
those placed on permanent penthouses.
2. d. The proposed variation will not impair an adequate supply of light and
air to adjacent property, or substantially increase the danger of fire, or
otherwise endanger the public safety or substantially diminish or impair
property values within the neighborhood.
RESPONSE: There will be no impact on light or air or increase the danger of
fire or endanger public safety or impair property values as there will be no
changes to the building.
2. e. That the purpose of the variation is not based exclusively upon a desire
to make more money out of the property
RESPONSE: TreeHouse wants to improve its identity so its business will be
successful in the village of Oak Brook and has no monetary interest in the
property. All three buildings have the same hardship due to the original design.
2. f. That the alleged difficulty or hardship has not been created by any
person presently having an interest in the property.
RESPONSE: The building was designed and constructed before the sign
regulations were changed allowing for rooftop signage and the buildings were
constructed around 1980. .
No one in the audience spoke in support of or in opposition to the request.
Chairman Davis noted that the standards have been sufficiently addressed to
recommend approval.

of the requested variation to allow the wall signs to be placed above the roofline

DISCUSSION:
TreeHouse Foods, Inc (tenant) and Arden Realty, Inc. (property manager) have submitted a joint
petition seeking approval of a variation to Section 13-11-IOEA of the Zoning Ordinance in order to
locate a wall sign above the roofline on the precast permanent penthouse structure for the buildings
located at 2001, 2015 and 2021 Spring Road.
TreeHouse Foods, has decided to move their corporate offices from Westchester to Oak Brook,
and has signed a lease to occupy two full floors at the building located at 2021 Spring Road. An
important component of the TreeHouse deal is the ability to get wall signage at the top of the
eight-story building they plan to occupy.
Staff was presented a number of different signage alternatives to accomplish wall signage (see
case file). The first alternative depicts a wall sign at the top of the southwest corner of the

building. Because of the building architecture that involves both horizontal and vertical elements,
the signable area is quite small and results in a wall sign of less than 25 square feet, which is
significantly less than the 140 square foot maximum permitted in our sign code.
The second alternative depicts a wall sign in the same location but breaks up the TreeHouse
name onto two adjacent wall panels. Even though this sign is larger and still meets the sign
code, TreeHouse was unhappy with the overall look of that "split" signage arrangement.
The third and final alternative that has been suggested is to locate the TreeHouse name on the
rooftop mechanical/penthouse. The rooftop mechanical/penthouse appears to be approximately
15-feet in height and is finished with the same materials as the rest of the building.
However, based on our current sign code, a sign located on the rooftop mechanical/penthouse is
in conflict with Section 13-11-10; which states that Signs shall be permitted in the B4, 03, 04,
ORA1 and ORA2 districts as follows:
"E. Maximum Height Of Signs Permitted:
4. Wall Signs: No wall sign shall extend beyond the roofline or parapet of the building to
which it is affixed. No wall sign shall cover any architectural features (architectural
features shall include, but not be limited to: pediment, cornice, belt course, pier,
windows, pilaster, roof, decorative stone or tile inlay, kick plateibulkhead, raised or
colored brick pattern, and corbel) of the building to which it is affixed. No wall sign shall
be affixed to HVAC screening, elevator overrun, or other features protruding from the
roof of the structure, with the exception of building parapets which have been designed
and integrated into the building's architecture and which are in line with and not set back
from the perimeter facade of the building. For ground floor restaurants requiring a special
permit, wall signs shall be no higher than thirty feet (30') in height and located only on
the first floor of the building."
As such, the applicants are seeking a variation to permit the placement of wall signage above the
roofline and on the penthouse area. Since each of the three buildings in Commerce Plaza is
impacted similarly, the variation has been requested for all three buildings.

Staff Comments:
Considering the signage needs of TreeHouse against the Village's sign code, it would appear that
there are four(4) options available to TreeHouse Foods regarding wall signage:
1. Live within the limit of the code, which would result in a wall sign of approximately 30-
square feet in size.
Staff Analysis—Based on the size and height of the building, a 25 square foot wall sign
appears to be too small.

2. Construct a parapet wall above the existing roofline.
Staff Analysis — This may be an expensive solution that would also need to be done on
the two adjacent buildings that make up the Commerce Plaza complex. Also, the
overall building architecture may make this a difficult option to accomplish.
3. Request a text amendment to change the code to permit signage on rooftop mechanical
rooms.
Staff Analysis — This amendment may result in some undesirable consequences if
permitted by right on all buildings. Some rooftop mechanical rooms are poorly located
and designed. As such, signage that would be attached may be unsightly.
4. Request a variation to the above referenced section to permit a wall sign on the rooftop
mechanical/penthouse for the building(s) located in Commerce Plaza.
Staff Analysis — Based on the building design there is a hardship present that limits
this building from placing adequate wall signage at the top of the building. Because
the rooftop mechanical/penthouse for this building is of the same finish as the building
and appears to "architecturally fit" within the overall building design, signage placed
at this location does not appear to negatively impact the adjacent uses. It should be
noted that wall signage already exists on the rooftop units of two buildings in
Oakbrook Center, the Citibank building located at 1900 Spring Road and the
Renaissance Hotel located at 2020 Spring Road. Those two signs were permitted under
our previous sign code.
On September, 14, 2010, Staff presented this analysis to the Village Board to get their input
and direction on how to proceed. Based on the challenges presented by the building
architecture, the Board was very supportive of a variation request. Also, I have reviewed
this matter with Village Attorney Sterk who concurs with the Staff analysis of the current
sign code and recommended course of action to seek a variation as discussed in option 4.
RESPONSIBILITIES OF HEARING BODIES:
The Zoning Board of Appeals has the responsibility to make a recommendation on a request for
a variation. Please include in your consideration, your findings with respect to the standards
specified in the Zoning Ordinance for a variation. The materials submitted by the applicant
specifically address these standards.
CONCLUSION:
If the Zoning Board of Appeals is of the opinion that the applicant has satisfied the requirements
for a variation to Section 13-11-10E.4 of the Zoning Ordinance for the properties located at
2001, 2015 and 2021 Spring Road, a recommendation would be in order to approve the request
subject to the following conditions:

SUBJECT: Tree House Foods Wall Signage—Commerce Plaza—2021 Spring Road

RECOMMENDED MOTION: Concur with the Staff recommendation for Tree House to
Proceed with an Application for a Variation to Accommodate Wall Signage on the Building
located at 2021 Spring Road.
Backeround/History:
Staff has been in discussions with Mr. David Lind, CBRE who is the broker and representative
for Tree House Foods, which has signed a lease to occupy two full floors at the building located
at 2021 Spring Road. An important component of the Tree House deal is the ability to get wall
signage at the top of the eight story building they plan to occupy.
Mr. Lind has presented Staff with several signage alternatives (see attached). The first
alternative depicts a wall sign at the top of the southwest corner of the building. Because of the
building architecture, the signable area is quite small and results in a wall sign of less than.25
i
sq.ft.,which is significantly less than the 140 sq.ft. maximum that is permitted by our sign code.
The second alternative depicts a wall sign in the same location but breaks up the Tree House
name onto two adjacent wall panels. Even though this sign is larger and still meets the sign
code, Mr. Lind has indicated that Tree House is unhappy with the overall look of that "split'
signage arrangement.
The third and final alternative that has been suggested is to locate the Tree.House name on the
roof-top mechanical/penthouse. The roof-top mechanical/penthouse appears to be approximately
15-feet in height and is finished with the same materials as the rest of the building.

A sign located on the roof-top mechanical/penthouse is in conflict with the Village's sign code.
Section 13-11-10: Signs shall be permitted in the B4, 03, 04, ORA1 and ORA2 districts as
follows states that:
"E. Maximum Height Of Signs Permitted:
4. Wall Signs:No wall sign shall extend beyond the roofline or parapet of the building to
which it is affixed.No wall sign shall cover any architectural features (architectural
features shall include, but not be limited to: pediment,cornice,belt course, pier,
windows,pilaster,roof, decorative stone or tile inlay,kick plate/bulkhead,raised or
colored brick pattern, and corbel)of the building to which it is affixed.No wall sign shall
be affixed to HVAC screening, elevator overrun, or other features protruding from the
roof of the structure,with the exception of building parapets which have been designed
and integrated into the building's architecture and which are in line with and not set back
from the perimeter facade of the building. For ground floor restaurants requiring a special
permit,wall signs shall be no higher than thirty feet(30') in height and located only on
the first floor of the building."
Considering the needs of Tree House against the Village's sign code, it would appear that there
are four(4)options available to Tree House Foods regarding wall signage:
1. Live within the limit of the code which would result in a wall sign of approximately 30-
sq.ft. in size.
Staff Comment—Based on the size and height of the building, a 25 sq.ft. wall sign
appears to be too small.

2. Construct a parapet wall above the existing roof-line.
Staff Comment—This may be an expensive solution that would also need to be done on
the two adjacent buildings that make up the Commerce Plaza complex. Also, the
overall building architecture may make this a difficult option to accomplish.
3. Request a text amendment to change the code to permit signage on roof-top mechanical
rooms.
Staff Comment— This amendment may result in some undesirable consequences if
permitted by right on all buildings. Some roof-top mechanical rooms are poorly
located and designed. As such,signage that would be attached may be unsightly.
4. Request a variation to the above referenced section to permit a wall sign on the roof-top
mechanical/penthouse for the building located at 2021 Spring Road.
Staff Comment—Based on the building design, there is some hardship present that
limits this building from placing adequate wall signage at the top of the building.
Because the roof-top mechanicallpenthouse for this building is of the same finish as

LETTER OF EXPLANATION
TreeHouse Foods, Inc. a NYSE listed company that manufactures food products
for the North American Retail Grocery and foodservice channels. TreeHouse is
one of the fastest growing food companies in North America, having seen sales
increase from $700 million in 2005 to nearly$2 billion in annualized sales in
2010. Their significant growth has resulted in the need to expand their corporate
headquarters. They have recently entered into a long-term lease and will move
their corporate into two floors consisting of 48,000sf at 2021 Spring Rd
(Commerce Plaza).
One of the reasons TreeHouse selected Oak Brook and this building was to
improve its corporate identity by placing a sign on the building. TreeHouse was
attracted by the recent change in the Oak Brook signage ordinance which offered
them this option which was not available before.
TreeHouse pursued several signage alternatives but due to the vertical triangular
precast architectural columns on the building, a sign that would be
visible/readable from the ground and architecturally consistent with the high
quality of the surrounding building signs could not be placed on the building.
Many alternatives were explored but they resulted in windows being obstructed or
the sign being too small and not easily visible from Spring Rd. If the size of the
sign would have been increased it would have to be separated by the precast
triangular column window openings which appeared like two disjointed signs
which does not fit in with the surrounding Oak Brook signs and is not the identity
TreeHouse is seeking for it corporate identity. A sign attached to the triangular
columns would block the windows, create window washing problems and not be
consistent with other signs in Oak Brook. The same scenario would apply to any
other signs on the buildings.
TreeHouse and Arden Realty are applying for a variance to zoning ordinance
section 13-11-10.4 to allow wall signs to be placed on the permanent precast
concrete penthouse structure which is consistent with the design and materials of
each building located in Commerce Plaza(2001, 2015 and 2021 Spring Road).
The sign will not exceed the maximum allowable size of 140 square feet,will
comply with all other provisions of the Sign Regulations and be of high quality,
LED illuminated and architecturally consistent with other penthouse signs on
other buildings in Oak Brook including the neighboring Renaissance Hotel,
Doubletree Hotel, and Citibank building.

VARIATION STANDARDS
1. a. The property in question cannot yield a reasonable return if permitted to be used only under the
conditions allowed by the regulations governing the district in which it is located.
RESPONSE: Due to the configuration of the buildings, which do not have a long enough flat
surface, a visible sign cannot be placed between the triangular vertical columns without blocking the
windows. The only place a normal sign fits on the buildings is on the permanent precast penthouse
structure.
1. b. The plight of the owner is due to unique circumstances.
RESPONSE: The Commerce Plaza buildings have a unique design.The buildings have vertical
triangular precast architectural columns every 15 feet which does not allow adequate room for the
TreeHouse name and logo, or any other tenant name, to placed on the building and be visible from
Spring Rd.
1. c. The variation, if granted, will not alter the essential character of the locality.
RESPONSE: The essential character of the locality will not be altered because the sign will be of
high quality and neighboring buildings such as Citibank, and the Renaissance Hotel have similar
signs on the permanent penthouse structure.
2. a. The particular physical surroundings, shape, or topographical conditions of the specific property
involved would bring a particular hardship upon the owner as distinguished from a mere
inconvenience if the strict letter of the regulation were to be carried out.
RESPONSE: The shape of the building with its vertical precast architectural columns prevents a
visible sign from being placed on the side of the building without covering windows.
2. b. The condition upon which the petition for variation is based would not be applicable generally to the
other property within the same zoning classification.
RESPONSE: Other properties in the same zoning classification do not have the precast vertical
features. A longer smooth surface would allow for a more visible sign to be placed on the building
for companies that have longer names.
2. c. The granting of the variation will not be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located.
RESPONSE: The variation will not be detrimental to the public welfare or injurious to other
properties in the neighborhood because many of them like the Renaissance Hotel and the Citibank
building have existing signs including those placed on permanent penthouses.
2. d. The proposed variation will not impair an adequate supply of light and air to adjacent property, or
substantially increase the danger of fire, or otherwise endanger the public safety or substantially
diminish or impair property values within the neighborhood.
RESPONSE: There will be no impact on light or air or increase the danger of fire or endanger
public safety or impair property values as there will be no changes to the building.
2. e. That the purpose of the variation is not based exclusively upon a desire to make more money out of
the property
RESPONSE: TreeHouse wants to improve its identity so its business will be successful in the
village of Oak Brook and has no monetary interest in the property. All three buildings have the same
hardship due to the original design.
2. f. That the alleged difficulty or hardship has not been created by any person presently having an interest
in the property.
RESPONSE: The building was designed and constructed before the sign regulations were changed
allowing for rooftop signage.
