S-1300 - 11/09/2010 - ZONING - OrdinancesORDINANCE 2010- ZO -SU -S -1300 AN ORDINANCE AMENDING AN ORDINANCE GRANTING A SPECIAL USE FOR A VILLAGE OWNED COMMUNICATION TOWER FOR THE PROPERTY AT 1200 OAK BROOK ROAD IN THE VILLAGE OF OAK BROOK (PIN: 06 -26- 400 -012) WHEREAS, on September 12, 2000 the President and Board of Trustees approved Ordinance 2000- ZO -SU -S -972 granting a special use permit in connection with the expansion of an existing municipal complex located at 1200 Oak Brook Road, subject to certain conditions; and WHEREAS, the Village of Oak Brook filed a petition requesting an amendment of special use Ordinance 2000- ZO -SU -S -972 in order to extend the height of the existing Village owned communication tower located on the subject property to 95 feet; and WHEREAS, at its meeting on October 18, 2010, the Plan Commission reviewed the proposed text amendment; and recommended approval of the proposed special use amendment; and WHEREAS, at its meeting on November 2, 2010 the Zoning Board of Appeals conducted the required public hearing pursuant to due and appropriate legal notice and found that the applicant had addressed and satisfied the requirements with respect to the proposed special use, and WHEREAS, the Zoning Board of Appeals recommended approval of the special use and found that the Petitioner satisfactorily addressed the factors required for approval of the requested special use amendment and made specific findings, including that the special use will not endanger the public health, safety and welfare, and that there will be no substantial injury to other property in the neighborhood; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of the Plan Commission and Zoning Board of Appeals and deem the special use, as set forth below, to be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein. All construction shall be in substantial conformance with the plans as submitted. 2. Prior to construction, written confirmation shall be obtained that the FAA has given its preliminary approval for the Village owned communication tower to be extended to 95 feet in height, if required. 3. Comply with all other applicable rules and ordinances of the Village of Oak Brook. Backaround/History: At its meeting on November 2, 2010, the Zoning Board of Appeals held the required public hearing on a petition from the Village of Oak Brook seeking approval of two text amendments in order to accommodate the Village owned communication tower that currently exists on the Butler Government Center property located at 1200 Oak Brook Road. In addition, a second petition has been submitted seeking approval of an amendment to special use Ordinance S-972 that was approved on September 12, 2000 for the expansion of the Butler Government Center, which recognized the presence of a Village owned communication tower on the property. With this amendment, the height of the existing tower would be increased to 95 feet. Public Works Department Sprint/Nextel built the existing tower in 2007 and ownership of the tower was turned over 630.368.5270 FAX 630.368.5295 to the Village of Oak Brook when construction was completed. Sprint/Nextel utilize the top 10 feet of the existing 80-foot tower. All of the safety antennas for the Village, police, fire, Oak Brook public works, etc., exist below the 70-foot level. The new tower replaced an 80-foot lattice Public Library tower that had existed for about 20 years. At that time, the Village ran into problems with some of its radio equipment that had been added, which was out of an effective range. 600 Oak Brook Road About 18 months ago, the Village added a wireless monitoring system for its water system Oak Brook,IL 60523-2200 and needed to get the tower taller in order to have the water system (SCADA- Supervisory 630.368.7700 Control and Data Acquisition) work with the existing structure. The proposed request is to FAX 630.368.7704 add a 15-foot section to the tower, bringing it to the 95-foot range. The plan calls for Oak Brook Sports Core adding another crown of antennas to be added by AT&T Mobility and the top 5 feet of the tower would be for Village use. Lew Caliento, identified himself as the Project Manager with SAC Wireless representing AT&T Mobility who would be installing the extension to the Village's communication tower at their expense. Jim Fox, Information Technology Manager for the Village, reviewed the background of the request. Sprint/Nextel built the existing tower in 2007 and ownership of the tower was turned over to the Village of Oak Brook when construction was completed. Sprint/Nextel utilized the top 10 feet of the existing 80-foot tower. All of the safety antennas for the Village, police, fire, public works, etc., exist below the 70-foot level. The new tower replaced an 80-foot lattice tower that had existed for about 20 years. At that time, the Village ran into problems with some of its radio equipment that was added, which was out of effective range, part of which was due to the height of the trees that interfered with communications between the water towers. Member Bulin questioned the revenue stream. Mr. Fox responded that amount was still be negotiated with AT&T. The Village has three other cellular companies two located on the west water tower on Tower Road with T-Mobile and Sprint with leases in the $2,000-3,000 per month range. Sprint/Nextel is on the communication tower and is within the same range. Member Young said that he would welcome it, because in his neighborhood, the reception is lousy and it would be good to have coverage that is needed for their neighborhoods. Mr. Fox said that the higher the tower goes, the better the service the village can get. The biggest problem in Oak Brook is trying to get signals above the tree line. Member Young asked if a lighting plan should be considered. Director of Community Development Kallien responded that staff made an effort to reach out to surrounding residents in the Forest Gate, Hunter Trails, and Old Oak Brook. Some commented that they would not like to see lights on the tower. The new height would be 95 feet and the FAA requires lighting at 118 feet. Director of Community Development Kallien reviewed the Amendment and the Special Use Factors as follows: TEXT AMENDMENT FACTORS (a) The character of the neighborhood. Mr. Fox responded that there would be no cost to the Village. Lew Caliento, Sac Wireless and is a representative of AT&T Wireless added that there would be income paid in the amount of$2500 monthly to the Village for rent. Chairwoman Tropinski said that the added antennas would improve wireless communications. Mr. Caliento responded that a propagation plot located on pages 11-1 La of the case file shows the area of no coverage, especially those residents with I-phones and the expanded coverage with the added antennas. Chairwoman Tropinski said that it is important to have good communications for the residents and the Village communication devices. Mr. Caliento said that AT&T would pay for the entire construction of the extension. In addition, AT&T's ground equipment will be located inside the existing compound so there will be no change to the landscape. Chairwoman Tropinski questioned the length of the process. Mr. Caliento said that AT&T would like to complete the project in this calendar year. Due to the type of engineering and construction of the existing tower, it is strong enough to support this extension, plus more. The kit will in essence snap on to the top of the tower. Member Lindgren asked if Sprint/Nextel also paid rent. Mr. Fox responded that Sprint/Nextel pay a little less than what AT&T will pay. However, they paid for the original tower and constructed the existing 1000 foot climate-controlled shelter that exists at the base of the tower where a dedicated area was provided for the Village to locate its transmitters and equipment that had previously been stored in the Public Works building. Member Lindgren asked if any other vendor had an interest in the tower. Mr. Fox responded that T-Mobile was the only other carrier that had also shown an interest, but in 2007 the Village was reluctant to add any additional height to the tower rather than just replacing the lattice tower at that time. T-Mobile eventually placed equipment on the McDonald's building located just north of this tower. Member Dunn questioned how many other towers were located in the Village. Mr. Fox responded that this was the only monopole communication tower. Sprint/Nextel and T-Mobile are also located on the west water tower on Tower Road. The east water tower does not have any communication equipment on it at this time, although they have been approached by T-Mobile to add equipment. Mr. Dunn questioned the range for the tower and whether there could be fewer towers, if they were taller.. Mr. Caliento responded that it is about a 2-3 mile radius; it is all line of sight communication. There are many roof top antennas located in Oak Brook, which is why there is such good coverage in the office section of Oak Brook. Most communities do not want the height and prefer dispersion to height. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 3 of 6 October 18, 2010 Director of Community Development Kallien said that these types of communication towers in most communities have multiple carriers located on them and are privately owned and maintained. The key consideration here is that it is a Village-owned communication tower. It is a communication tower first, and it was originally designed to provide for modest equipment. Member Dunn questioned whether this tower was used to notify resides of various warnings. Mr. Fox responded that the antennas located below the 70-foot level are for public safety and broadcast signals for police, fire and public works bands. The lower antennas are for emergency communications with DuPage County. For emergency communications, some of the antennas activate the emergency siren system, should there be a tornado or severe weather approaching the Village. The special use request for the additional height would give the Village even more flexibility. The water telemetry system (SCADA) is working right on the borderline. The vendors that installed the system advised the Village that an additional 5-10 feet would provide better service. Currently they are at the 70-foot level and with the extension would be located at the 90-foot level. Member Sharma questioned whether it could be anticipated that the tower could go above the 95 feet proposed in order to accommodate additional carriers. Mr. Fox responded that the tower was engineered to allow for that capability in the future. An additional 15 feet could be added to the tower (110 feet), which would stay below compliance with FAA regulations. The FAA would require lighting added to the tower, if the tower went up to 118 feet. William Lindeman, 11 Pembroke Lane, commented that such towers are inherently ugly and was surprised that no one was present from Hunter Trails or Forest Gate complaining. Member Dunn responded that he is from Hunter Trails and that he did not feel at all negative about the tower and realized that it has to be functional. He appreciates that the tower is there, along with the warning system that alerts residents of bad weather so that they can seek shelter. Mr. Lindeman said that there are towers that have a nicer appearance. He asked if AT&T had the ability to improve the appearance of the tower without diminishing the effectiveness of serving as a communication tower. Director of Community Development Kallien said that at a meeting with the President of the Forest Gate Homeowners Association, a point had been made that they specifically contacted all of the neighbors that front Jorie Blvd., and he was not aware of any complaints. A letter was also sent to Dr Forutan, President of the Old Oak Brook Subdivision and no complaints had been received. He respected the comments made by Mr. Lindeman, but the Village did reach out to all the surrounding neighbors. Chairwoman Tropinski commented that it was more of an engineering issue. If more masts were added to the top of the pole, there would be more resistance to the wind, which may affect the foundation, etc. to keep it from swaying; and, by the way it was designed, adding shielding and skirting may create more resistance to wind than may be possible. Mr. Fox said that AT&T was taking that into account, if there would be an addition of additional crowns made to the pole in the future, In response to Mr. Lindeman's comments, prior to 2007 there was an 80-foot lattice tower and some would say that appearance did not look good. The new tower is more pleasing, which was painted white; and at that time, an analysis had determined that it blended in with the sky and was less obtrusive. Director of Community Development Kallien said that the lattice tower had been there for a very long time. It had been hit by lightning a number of times, and when it was being dismantled, they found that many of the supports were not structurally sound because of the lightning strikes and time. From a safety point of view and the efficiency of providing service, the current tower is much better. It is under the control of the Village and cannot be expanded without going through the special use process again. In addition, an 80-foot communication tower is located on the property and contains a variety of Village owned and operated public safety communications equipment. A portion of the tower has been leased to Sprint/Nextel Communications to accommodate equipment which is used by a number of the Village Departments for field communication as well as private entities. The proposed amendments will also allow the Village to expand the tower in the future to accommodate additional communication equipment if needed. This case was previously on the Plan Commission agenda last year, but was continued at that time to allow for revisions to the proposed special use request. As a result, the Village has modified its original request and has reduced the height of the proposed addition to the existing tower, which will still provide a reasonable upgrade for AT&T services to the Village residents. Is of the type described in subsection Al of this Section, is deemed necessary for the public convenience at that location; RESPONSE: The proposed use of the added antennas will benefit the public by providing affected residents expanded wireless coverage. It will help to provide better, faster, 4G service to the area covered by this tower; and it will allow the village to locate some of its equipment to the 90-foot range for improved Village communication as well as additional revenue to the Village. 2. Is so designed, located and proposed to be operated that the public health, safety and welfare will be protected; RESPONSE: When the tower was constructed in 2007, it was engineered to accommodate additional tower height and crowns such as the proposed 15-foot addition. All of the safety antennas for the Village, police, fire, public works, etc., exist below the 70-foot level and the Village ran into problems with some of its radio equipment that was added, which was out of effective range. About 18 months ago, the Village added a wireless monitoring system for its water system and needed to get the tower taller in order to have the water system work with the existing structure. By adding another crown of antennas (which will be added at the expense of AT&T Wireless, the top 5 feet of the tower would be for Village use and the tower will be operated so that the public health, safety and welfare will be protected. 3. Would not cause substantial injury to the value of other property in the neighborhood in which it is located. RESPONSE: The three adjacent subdivisions have been contacted and there has been no opposition to the proposed 15-foot addition, which will not cause substantial injury to the value of other property in the neighborhood and will benefit Village communications as well as improve local wireless service to local area residents —4 Ordinance 2010- ZO -SU -S -1300 Village of Oak Brook — 1200 Oak Brook Road Special Use — Village Owned Communication Tower (S -972) PIN: 06 -26-400 -012 Page 2 of 2 Section 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance. Section 6: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
